Ein Kommentar von Paul Clemente.Wer von GEZ-Clowns die Schnauze voll hat, sich nach derber Polit-Satire sehnt, dem sei die Befragung von Professor Christian Drosten vor der Enquete-Kommission empfohlen. Herrlich! Köstlich! Und das Allerbeste: Der Auftritt war gar nicht als Satire geplant. Der sollte zur Aufarbeitung der Lockdown-Jahre beitragen. Okay, das hat er auch getan. Aber eben anders als geplant.Tatsächlich kann man dem Virologen nur gratulieren. Dafür, dass er während der Lockdowns öffentliche Debatten mit Kritikern gemieden hat. Denn vor einem Professor Sucharit Bhakdi oder einem Dr. Wolfgang Wodarg hätte er sich in Grund und Boden blamiert. Ein medialer Super-GAU für das Corona-Regime.Ein Drosten kann nur im Umfeld geistiger Unterbelichtung glänzen. Vor Personen von so pechschwarzer Dummheit, dass sie seine Wirrnis nicht bemerken: Dem Gros der Mainstream-Journalisten. Im Rahmen der Enquete-Kommission musste Drosten allerdings in die Arena. Endlich mal. Zum verbalen Kampf gegen kritische Fachleute. Die durften ihn mit Fragen löchern. Dreieinhalb Stunden lang. Dass diese Befragung unter Polizeischutz stattfand, zeigt: Der Schrecken ist noch lange nicht verarbeitet.Zu Drostens schärften Gegnern zählt Stefan Homburg, emeritierter Professor für Finanzwissenschaft an der Leibniz-Universität. Den kostete es kaum Mühe, den Virologen zu grillen. Er musste ihn nur mit eigenen Aussprüchen konfrontieren. Drostens Vorteil: Die Zeit für Frage und Antwort waren streng limitiert, auf wenige Minuten reduziert. Und genau das nutzte der Ex-Hofvirologe zu seinem Vorteil.Homburg zitierte ein Statement von Drosten, das der am 02. März 2020 auf einer Bundespressekonferenz zum Besten gab:„Diese Erkrankung ist eine milde Erkrankung. Das ist eine Erkältung in erster Linie. Die ist im Prinzip für den Einzelnen gar kein Problem.“Klingt gut. Eine Woche später habe Drosten erneut beteuert: Es gebe keine neuen Erkenntnisse, denn: „Das kann in der Wissenschaft auch gar nicht passieren.“ Stimmt. Das braucht nämlich Zeit. Aber dann! Neun Tage später habe der Virologe eine krasse Drehung vollzogen. Plötzlich spreadete er Panik-Narrative. O-Ton:„Auch Jüngere sterben an dieser Erkrankung. In Afrika werden wir Bilder sehen, in der Zeit zwischen Juni und August, im Sommer, die wir aus Kinofilmen kennen. Aus reinen Fantasy-Filmen. Da wird es Szenen geben, die wir uns heute noch gar nicht vorstellen können.“Jetzt die Frage von Professor Homburg: Auf welcher Daten-Grundlage habe er, Drosten, innerhalb einer Woche seine Einschätzung um 180 Grad gedreht? Eine klare Frage. Drosten sollte lediglich eine Quelle nennen. Konnte er aber nicht. Stattdessen warf er Homburg vor, er habe fast die gesamte Zeit für eigene Behauptungen beansprucht. Ihm, Drosten, bleibe keine Zeit mehr zur Beantwortung der „komplexen Fragen“. Dabei hatte Homburg gar keine Behauptung aufgestellt, sondern lediglich drei Drosten-Zitate verglichen. Plötzlich flüchtete der Hofvirologe durch Themenwechsel, knüpfte an eine frühere Frage an. Aber der Finanzwissenschaftler ließ nicht locker. Beharrte auf seine einfache Frage: Weshalb habe Drosten innerhalb von neun Tagen seine Einschätzung so radikal gewechselt? Diesmal gab der Charité-Virologe sich irritiert: Er kriege das alles gar nicht mehr zusammen. Das sei „so verwirrend“. Das seien so viele „unterschiedliche Dinge“, die „miteinander gar nichts zu tun haben“. August 2025 (Aktenzeichen 4 A 1555/23), die für tausende Unternehmen in Nordrhein-Westfalen und möglicherweise bundesweit erhebliche Konsequenzen haben könnte. Das Gericht hat die Rückforderung von November- und Dezemberhilfen bestätigt und dabei eine bemerkenswerte Begründung gewählt: Die Bewilligung war nicht nur wegen falscher Angaben rechtswidrig, sondern verstieß auch gegen EU-Beihilferecht.Der SachverhaltEin selbstständiger Gewerbetreibender hatte im Jahr 2013 ein Gewerbe mit der Bezeichnung „Eventorganisation" angemeldet. Seine Tätigkeit bestand darin, Eintrittskarten und Einlasstickets für Konzerte, Sportveranstaltungen und Kulturveranstaltungen zu vertreiben. Er kaufte diese Tickets im eigenen Namen und auf eigene Rechnung ein und verkaufte sie an Endkunden weiter.Als im Herbst 2020 die Infektionen mit dem Coronavirus erneut exponentiell anstiegen und Bund und Länder im Beschluss vom 28. Oktober 2020 weitreichende Schließungen beschlossen, beantragte der Kläger sowohl November- als auch Dezemberhilfen. Er gab dabei an, indirekt betroffen zu sein, also nachweislich und regelmäßig mindestens 80 Prozent seiner Umsätze mit direkt von Betriebsschließungen betroffenen Unternehmen zu erzielen. Später erklärte er im Verwaltungsverfahren, er sei sogar direkt betroffen, weil er seinen Betrieb aufgrund der Schließungsanordnungen habe einstellen müssen.Die Bezirksregierung bewilligte daraufhin Abschlagszahlungen in Höhe von 50.000 Euro für die Novemberhilfe und 3.415,38 Euro für die Dezemberhilfe. Allein für November 2020 war dem Kläger wegen außerordentlich hoher Umsätze im November 2019 von durchschnittlich täglich über 9.300 Euro eine Novemberhilfe in Höhe von über 200.000 Euro bewilligt worden. Seine tatsächlichen Gesamtkosten im November 2020 betrugen jedoch nur gut 2.700 Euro.Nach einer Überprüfung nahm die Bezirksregierung die Bewilligungsbescheide zurück und forderte die gezahlten Beträge zurück. Der Kläger klagte dagegen. Das Verwaltungsgericht Gelsenkirchen gab ihm mit Urteil vom 25. Juli 2023 (Aktenzeichen 19 K 1492/22) zunächst recht und hob die Rücknahmebescheide auf. Die Bezirksregierung legte Berufung ein.Die Entscheidung des OVG MünsterDas Oberverwaltungsgericht Münster hob das erstinstanzliche Urteil auf und wies die Klage ab. Die Rücknahmebescheide sind rechtmäßig.Das Gericht stützt seine Entscheidung auf zwei Säulen. Zum einen waren die Angaben des Klägers im Antragsverfahren in wesentlicher Beziehung unrichtig. Er war weder direkt noch indirekt im Sinne der Förderrichtlinien betroffen. Der Verkauf von Veranstaltungstickets über das Internet musste nicht wegen des Beschlusses vom 28. Oktober 2020 eingestellt werden. Tickets für langfristig geplante Veranstaltungen durften auch während des Lockdowns verkauft werden. Der Kläger hat auch tatsächlich im Dezember 2020 noch Umsätze durch Ticketverkäufe erzielt.Auch die Voraussetzung der indirekten Betroffenheit war nicht erfüllt. Der Kläger erzielte seine Umsätze gerade nicht mit direkt betroffenen Unternehmen, sondern mit Endkunden, die von den Schließungsanordnungen nicht unmittelbar betroffen waren.Zum anderen – und das ist die eigentlich brisante Begründung – verstieß die Bewilligung gegen EU-Beihilferecht, konkret gegen Artikel…

The overarching view of the British Covid inquiry is that lockdown did not need to happen. Their inquiry is different to our two For a start, the key players turned up. Boris Johnson and co got grilled. Ardern and Hipkins and co never did because they refused. It still seems to me an astonishing act of arrogance that the same people who made such profound decisions on our lives refused to participate in a public way at the official look into the way they acted. It's a version of moral bankruptcy. Also, it's different in Britain in that it was adversarial. It's a mistake, I think, that we didn't take their approach. Also, it appears our inquiry, part two at least, has issues with a number of resignations. So who knows how our's pans out. It's due first thing next year. But although the British report says much, it's inescapable that a major observation is if the British Government had got its act together faster, if it had been more coordinated - lock downs were not necessary. Just think about that for a moment and apply it here. Lockdowns here started pretty much the same day they did in britain; March of 2020. If the British hadn't got their act together and were locking down in March, then surely it can be argued the same applies to us. Obviously their lockdowns were nowhere near as hard as ours, and that's another mass failing on the control freaks like Ardern and Hipkins. But just think about how Covid would have been, and our view of that period, if a lockdown had not been a part of the experience. Masks, rules, contact tracing, vaccines and respiratory hygiene could have stopped the need for lockdowns. That's the British conclusion. That's a pretty profound finding. It's profound for mental health and the economy. Think of the ensuing years-long damage that came out of the lockdowns, especially the Auckland ones that lasted months on end. Jobs lost, lives lost, recession after recession for something that, quite possibly, we didn't need to do. I can't see how, if they can conclude it in Britain, you can't conclude it here? Today on America in the MorningManhunt For Charlie Kirk's Killer The FBI has released images of who they are calling a person of interest in the assassination of conservative activist Charlie Kirk as the manhunt intensifies. His murder has also had a chilling effect on members of Congress on both sides of the political aisle ratcheting up fears for their safety and that of their colleagues. Washington correspondent Sagar Meghani reports on calls for unity as some on the left are being blamed for political violence. College Lockdowns Thursday was also a disruptive day on college campuses around the nation. The US Naval Academy in Annapolis was on lockdown following a threat that was called in, and one midshipman was shot by police when he mistook a member of law enforcement as a shooter and hit the officer with a training weapon. A number of schools in the nation either had to cancel or delay classes due to threats. Several historically black colleges and universities in America were on lockdown yesterday because of potential threats. Correspondent Clayton Neville reports. Remembering 9/11 The nation commemorated the 24th anniversary of the terror attacks of September 11, 2001 on Thursday, with remembrance ceremonies in New York, the Pentagon and western Pennsylvania.
