A national anti-marijuana group that is organizing the opposition to Measure 2, which, if passed by North Dakota voters, would legalize recreational marijuana, has been touting support from several law enforcement groups. These organizations say legalizing marijuana will hurt public safety. There will be more crime. More inebriated driving. But that's not so says Diane Goldstein. She's a 21-year veteran of the Redondo Beach Police Department, who retired as a lieutenant, and has spent her post-law enforcement career researching drug policy and advocating for reforms. She joined this episode of Plain Talk, along with pro-Measure 2 campaigner and Fargo-based defense attorney Mark Friese, to rebut the argument coming from some in North Dakota law enforcement. Goldstein says it's a mistake to compare North Dakota's measure to what happened in California, which decided to open the legal marijuana market up with little in the way of regulation. She said North Dakota's measure contains prudent protections that California didn't contemplate when that state first legalized marijuana more than two decades ago. Both Friese and Goldstein also pointed out that legalizing marijuana isn't some social experiment anymore. Many states have legalized marijuana now, and have lived with legalization for years, and the evidence shows little in the way of a crime surge. That's not to say that legalizing marijuana in North Dakota will be a panacea for public safety, Goldstein warned. "We'll never get rid of the black market," she said. But, legalization can mitigate the public safety threat that comes from the marijuana black market and the criminal gangs who serve it. Diane Goldstein, Executive Director of the Law Enforcement Action Project, explains why and how she's working to change hardened minds. An extensive 2020 survey of 3615 law enforcement officers revealed that a large chasm that still exists between changing our out of date drug laws and changing the minds of the people who enforce those laws. While 37 US states have some form of medical or adult use laws, the police are still being trained to associate the devil's lettuce with criminality, a designation that was created by drug laws themselves. Here 's a sampling of the study's findings: 75% of cops surveyed had never used cannabis or used it less than four times.Two thirds agree that “marijuana is less dangerous than other Schedule 1 drugs” but over 75% still believe it is a gateway drug and that legalization leads to use of harder drugs.Over half of the cops surveyed in illegal states still believe that enforcing misdemeanor possession charges is a worthwhile use of their time.These statistics explain why I invited Diane Goldstein on to the podcast. Diane was a cop for 20 years and today she heads LEAP, the Enforcement Action Partnership. She is a cop who saw the failures of the Drug War from a professional and personal point of view and now works to educate and change hardened minds within the law enforcement hierarchy. We've all heard cops say, “We don't make the law, we only enforce it,” but the truth is that cops have a vested interest in and receive massive amounts of state and federal funding to maintain the prohibition status quo. “Cops often repress reform because it doesn't support their agenda,” is how Diane expresses it in this interview.It's no secret that Diane's task is Herculean, but she is optimistic that change is afoot. “Yes,” she says, “we must change laws but we also have to show Law Enforcement that they'll still have plenty of tools they need to do their jobs effectively.” In other words, reward them with the same funds they would have used to investigate marijuana crimes. “Before talking about defunding the police [a misleading and dreadful phrase to explain reapportioning funds in my humble opinion], we should defund the drug war first. Diane Goldstein served 21 years with the Redondo Beach (CA) Police Department, retiring as the first female lieutenant in the agency. During her career she served in patrol and investigative assignments that included gangs and narcotics. She is a subject matter expert and recognized leader in the area of crisis negotiations and developed national training guidelines for use during critical incidents, including the development of POST guidelines for Basic Crisis Negotiator Course Recommended Topics, and Crisis Negotiations Core Competencies. In addition she served as an Academy Instructor at the South Bay Reserve Academy, is a nationally recognized guest lecturer, writer and political commentator on drug policy. She holds a Bachelor of Arts degree in Legal Studies from Brandman University and is a board member for Law Enforcement Against Prohibition.

On December, 18, 2013, Christina Tobin interviewed Diane Goldstein, board member and spokesperson for Law Enforcement Against Prohibition (LEAP). Goldstein is a retired lieutenant from Redondo Beach who believes we need to reform our criminal justice system and move our drug policy under a public health model. She talks about how critical resources for fighting crime are being diverted to the drug wars and how people struggling with substance abuse and/or mental health issues are not getting the help they really need. Goldstein notes that some may think that the idea of law enforcement against prohibition is something of an oxymoron, but over 5,000 current, retired, and former criminal justice professionals, from police officers and supreme court justices, are members of LEAP. Goldstein talks about how criminal justice system lobbyists tend to focus on self-serving agendas, growing the system, rather than serving the people. She also talks about how her own brother’s struggles with substance abuse helped her see that the way the drug problem is being addressed in American is not working. “If we ground our government in compassion we would be better off as a society in general.” For more information go to www.LEAP.cc
