A atuação do Ministério Público no estabelecimento desses acordos, bem como seus limites e possibilidades de aplicação nos âmbitos judicial e extrajudicial são abordados no decorrer deste episódio. O entrevistado, Emerson Garcia, foi integrante de comissão de juristas na Câmara dos Deputados para revisão da Lei de Improbidade Administrativa (Lei nº 8429/92) e autor da proposta do instituto de acordo de não persecução cível (ANPC), presente na Lei 13964/19 (Pacote Anticrime). No decorrer do episódio conversamos sobre a criação do instituto do ANPC, as condições necessárias para elaboração do acordo e seus limites. Abordamos também as diferenças entre o Termo de Ajustamento de Conduta e o ANPC, a necessidade de homologação judicial do acordo ou a sua celebração em juízo. As hipóteses de uso das informações obtidas em acordos frustrados, a inserção de terceiros nos ANPCs e a criação de acordos provisórios ou parciais também são debatidos. Neste episódio conversamos com Samia Saad Gallotti Bonavides, Procuradora de Justiça do Ministério Público do Estado do Paraná (MPPR), sobre a Justiça Restaurativa e sua importância para o restabelecimento do vínculo comunitário. Em tese de doutoramento em Ciências Jurídicas defendida recentemente na UENP, nossa convidada aborda detalhadamente o assunto. Como opção à ênfase punitivista vigente em nosso sistema de justiça, debatemos as principais vertentes de atuação da prática restaurativa para a resolução de conflitos, apresentando resoluções (CNJ 225/2016 e 288/2019) e jurisprudências em que sua aplicação se efetiva. Abordamos questões como a aplicabilidade da Justiça Restaurativa em crimes de menor ou maior potencial ofensivo, as principais diferenças entre a justiça retributiva e a restaurativa e seus possíveis resultados. Também apresentamos as vantagens da Justiça Restaurativa como meio de recuperação do infrator, em especial nos casos de infância e juventude. O debate sobre a aplicação de acordos de não persecução penal ou acordos restaurativos são elucidados perante a legislação do Pacote Anticrime. Por fim, a necessidade de mudanças normativas e culturais para uma efetiva aplicação da Justiça Restaurativa encerram as reflexões deste episódio. Consultor jurídico internacional e conferencista, Mazzuoli é autor de diversos livros jurídicos publicados, com destaque para as áreas do Direito Internacional Público e dos Direitos Humanos, sendo referência constante na jurisprudência do Supremo Tribunal Federal. O caso Gelman vs. Uruguai, referente a uma brutal e trágica violação dos Direitos Humanos ocorrida na América Latina, é trazido ao debate. A construção histórica do controle de convencionalidade diante a atuação da Corte Interamericana e seu funcionamento frente às nações aderentes aos Tratados Internacionais de Direitos Humanos são abordados no decorrer deste episódio. A harmonização entre os tratados internacionais e as constituições nacionais, seus decorrentes conflitos (a Lei de Anistia no Brasil e a lei de caducidade do Uruguai, no caso Gelman) e o cumprimento ou não das decisões da Corte Interamericana de Direitos Humanos complementam o debate. Por fim, são avaliadas as possibilidades de atuação do Ministério Público em favor do exercício do controle de convencionalidade e os avanços e retrocessos recentes das nações parte nos Tratados Internacionais de Direitos Humanos ligados à OEA. Neste episódio conversamos com Antonio do Passo Cabral, Procurador da República do Ministério Público Federal no Rio de Janeiro, sobre as possibilidades de aplicação dos acordos processuais na atuação do Ministério Público. Professor de Direito Processual Civil da UERJ, Cabral é autor do livro “Convenções Processuais - Conforme novo CPC”, que serviu de referência para a elaboração da Resolução 118 do CNMP sobre a política de Autocomposição no âmbito ministerial. No decorrer do episódio abordamos a transposição do uso das convenções processuais do âmbito do Direito Privado para o Direito Público e o entendimento sobre essa mesma convencionalidade e os negócios jurídicos processuais no contexto do Direito Processual Civil. As orientações da Resolução 118 do CNMP, as inovações do novo CPC (2015) referentes ao tema e o Pacote Anticrime também são abordadas. Conversamos sobre os possíveis impactos destas normativas na celebração de acordos pelo Ministério Público, seus limites e possibilidades frente a garantia dos direitos fundamentais das partes envolvidas, a tutela coletiva e o princípio da indisponibilidade do interesse público. Por fim, abordamos também a possibilidade de aplicação dos acordos de não persecução penal e os parâmetros de negociação para sua realização. The proclamation of the forgiveness of sins is integral to the content of the gospel. After all, it was the forgiveness of sins that opened the path for gentiles to become children of the Bible. In the Gospel of Mark, the sharing of this news is the single priority of Jesus Christ--so much so, that Jesus is constantly on the move, teaching and preaching. With this in mind, it seems odd that Jesus would say, "whoever blasphemes against the Holy Spirit never has forgiveness." It seems odd, that is, until you realize that Jesus is frustrated with those who willfully oppose his Father's teaching.
