A promessa de eficiência e celeridade trazida pela IA é inegável, contudo, essa automatização suscita debates sobre os riscos de uma replicação de vieses discriminatórios já existentes em nossa sociedade, como o de gênero. Vemos no mercado de trabalho sistemas de recrutamento que, treinados com dados históricos de uma força de trabalho predominantemente masculina, aprendem a preferir perfis de homens, erguendo novas e invisíveis barreiras para a ascensão profissional de mulheres. A tecnologia, que um dia foi vendida como exemplo de neutralidade, revela-se um espelho que não apenas reflete, mas amplifica e automatiza as distorções da nossa sociedade. E quando esse espelho é posicionado no coração do sistema de justiça, os riscos se tornam ainda mais sensíveis. A busca por celeridade e eficiência nos leva a uma construção que, embora otimize tarefas repetitivas, ameaça a dimensão humana e simbólica do ato de julgar. Como garantir que um algoritmo, incapaz de empatia, não perpetue a discriminação? Como assegurar que a chamada "verdade algorítmica" não silencie as particularidades de um caso concreto, especialmente quando envolve grupos historicamente marginalizados? Neste episódio conversamos com Luiz Octávio Saboia Ribeiro, desembargador do TJMT, sobre a produção probatória em meio digital. Cada interação, cada transação, cada passo que damos é, de alguma forma, registrado em um universo de dados digitais. Essa onipresença da tecnologia transformou irreversivelmente a atividade probatória no processo judicial. Se antes a cognição judicial se baseava majoritariamente na prova oral e em documentos físicos, hoje é raro um processo complexo que não envolva a análise de smartphones, computadores ou dados armazenados em nuvem. A prova digital, em sua essência, é fundamentalmente diferente de suas predecessoras analógicas. Suas características de imaterialidade e volatilidade exigem uma abordagem radicalmente nova e o nosso arcabouço jurídico, notadamente o CPP de 1941, foi concebido para um mundo de evidências tangíveis e, por isso, mostra-se insuficiente para disciplinar essa nova realidade. Neste episódio, vamos mergulhar fundo nessas questões. Debateremos a importância crítica da cadeia de custódia como pilar para a confiabilidade da prova digital. Analisaremos a validade de práticas cotidianas, como o uso de prints de WhatsApp e atas notariais, e discutiremos os rigorosos limites que devem ser impostos à apreensão e análise de dispositivos eletrônicos. Neste episódio conversamos com Tainá Aguiar Junquilho, professora de Direito do IDP, sobre as propostas de regulação no uso da Inteligência Artificial. A ascensão exponencial de tecnologias de IA generativa e sua rápida integração em praticamente todos os setores da sociedade demonstram a importância de estabelecermos diretrizes e responsabilidades para uso dessa tecnologia. No Brasil, o debate ganhou contornos concretos com o Projeto de Lei 2.338/2023, que tramita no Congresso Nacional. A proposta, inspirada em modelos internacionais, busca criar um marco legal para o desenvolvimento e uso da IA. Contudo, a elaboração deste projeto está longe de ser um consenso: de um lado, a urgência em mitigar riscos de discriminação, violação de privacidade e desinformação em massa; do outro, o temor de que uma regulação excessiva possa inibir a inovação e a competitividade. Como dialogar com as leis que já temos, como o Marco Civil da Internet e a Lei Geral de Proteção de Dados? O próprio Poder Judiciário já utiliza ferramentas de IA para otimizar seus serviços, o que levou o CNJ a editar a Resolução 615 para guiar essa implementação. Simultaneamente, o Ministério da Justiça avança com portarias que buscam regular o uso dessas tecnologias em investigações criminais. Neste episódio conversamos com Camila Bonafini Pereira, promotora de Justiça do MPSP, sobre a confissão como meio de prova no descumprimento do ANPP. A confissão representa no processo penal um momento de ruptura, um ato em que o indivíduo se coloca diante do Estado e admite a autoria de um ilícito. No universo da justiça penal negociada, consolidado pelo estabelecimento do Acordo de Não Persecução Penal, a confissão assume um papel ainda mais complexo e multifacetado. Ela é a chave que abre a porta para uma solução consensual, o preço pago pelo investigado para evitar as incertezas e os estigmas de uma ação penal. É o ato de disposição voluntária que legitima a negociação, condição para que o Estado abra mão de sua pretensão punitiva.Mas o que acontece quando este pacto é rompido? Quando o investigado, após admitir sua culpa e receber o benefício da não persecução, descumpre as condições acordadas? Nesse momento, a confissão, antes um pilar do acordo, transforma-se no epicentro de um intenso debate jurídico. De um lado, a visão pragmática de que essa admissão de culpa, feita na presença de um defensor, não pode simplesmente se dissipar no ar. De outro, a muralha das garantias fundamentais: o direito ao silêncio e à não autoincriminação. Para destrinchar este tema, nosso episódio de hoje mergulha na validade probatória da confissão no ANPP rescindido, analisando o papel do Ministério Público entre a eficiência do sistema e a intransigência das garantias constitucionais. In its Greek root, Mentos means “intent, purpose, spirit and passion.” It was with intent, purpose and passion that this special episode came to life. It is a rare occasion when one can get together with their mentor, and their mentor's mentor for a conversation anchored in three generations of mentorship, leadership and friendship. This is one of those conversations. My special guest, the mentor of my mentor is Admiral Bob Inman. I flew to Austin to meet up with him in person and record this incredible testimony of history and leadership and lifelong service. Admiral Inman was born in April 1931 in East Texas and went on to become a highly decorated United States Navy Officer and Intelligence Leader. His career and service had a profound impact on America's national security architecture. During his 31-year military career that spanned the world and included some of the most sensitive national security posts in the Government, the Admiral earned a bipartisan reputation as one of the Nation's finest intelligence officers of a generation. Journalists used to refer to him as “simply one of the smartest people ever to come out of Washington or anywhere.” Regarded as a superstar in the intelligence community he grew his career in Naval Intelligence serving on carriers, cruisers and destroyers…not to mention the hallowed halls of the Pentagon. The Admiral went on to serve as the Director of Naval Intelligence, Vice Director of the Defense Intelligence Agency and Director of the National Security Agency. He was nominated to be Deputy Director of Central Intelligence and served in that role until his resignation in 1982. It was during that time Admiral Inman became the first naval intelligence specialist to earn the rank of 4 Star Admiral. Admiral Inman went on to serve on numerous boards including CalTech's Board of Trustees and held the LBJ Centennial Chart in National Policy at the University of Texas at Austin Lyndon B. Johnson School of Public Affairs. In every capacity the Admiral has always focused on mentorship and leadership and sharing wisdom for the next generation. When we sat down to speak with the Admiral he had recently celebrated 67 years of marriage with his dear wife. At 94 years of age he is still motivated by selfless service and paying it forward to the next generations of leaders. This conversation counts as one of those gifts. So, sit back and listen to this incredible story of change and mentorship and leadership from a nation's patriot, a renowned thinker and educator and all around incredible guy. Neste episódio conversamos com Everton Zanella, promotor de Justiça do MPSP, sobre a decisão do júri que absolve o réu em contrariedade às provas. A reforma do Tribunal do Júri, promovida pela Lei nº 11.689/2008, introduziu o chamado quesito genérico de absolvição, permitindo aos jurados absolver um acusado sem a exigência de fundamentação do voto. Essa inovação acentuou a discussão sobre a possibilidade de absolvição por clemência e o alcance do recurso de apelação previsto no artigo 593, inciso III, do Código de Processo Penal, que permite a impugnação de decisões dos jurados "manifestamente contrárias à prova dos autos". Trata-se do debate sobre os limites do controle recursal sobre as decisões absolutórias expondo uma tensão entre princípios constitucionais de vital importância, como a soberania dos veredictos e a vedação à proteção deficiente. O Supremo Tribunal Federal, ao julgar o Tema 1.087 de Repercussão Geral, fixou teses importantes que buscam conciliar esses princípios. O STF admitiu o recurso da acusação, mas com ressalvas, como a exigência de que a tese de clemência, se acolhida, esteja constante em ata e seja compatível com a Constituição e precedentes vinculantes. Neste episódio, realizamos uma análise aprofundada, com questões que visam explorar os múltiplos ângulos dessa controvérsia, desde a perspectiva doutrinária e jurisprudencial até as implicações práticas para a atuação do Ministério Público. No sistema de justiça brasileiro, uma força normativa emerge para além das cortes: os precedentes criados a partir da atuação extrajudicial e diária do Ministério Público. Desde o advento do Código de Processo Civil de 2015, muito se tem discutido sobre o sistema de precedentes judiciais obrigatórios, um pilar para a isonomia e a segurança jurídica. Contudo, o conceito de Justiça Multiportas, também consagrado pelo Código, nos convida a olhar para além do Poder Judiciário. Ele propõe um sistema integrado de solução de conflitos, onde diversas 'portas' – mediação, conciliação, arbitragem e, crucialmente, a atuação resolutiva de instituições como o Ministério Público – operam para realizar o direito. Nesse cenário, como se posiciona a atuação extrajudicial do Ministério Público? Seus Termos de Ajustamento de Conduta, suas Recomendações e suas resoluções internas, ao pacificarem conflitos coletivos e orientarem políticas públicas, geram apenas soluções pontuais ou criam verdadeiros precedentes institucionais com capacidade de vincular e orientar condutas futuras?
