The clock is ticking. If you are an existing director of a company appointed before 31 October 2021, you have until 30 November 2022 to apply for your Director Identification Number. Failure to do so could result in penalties for non-compliance. According to the ATO, over half of eligible SMSFs with a corporate trustee are yet to apply, despite the deadline being just weeks away. In June 2022 the High Court handed down its decision on the appeal from a judgement of the Court of Appeal of the Supreme Court of Western Australia in the matter of Hill v Zuda Pty Ltd [2022] HCA 21. This case ultimately impacts SMSF documentation by looking at whether an SMSF can have a binding death benefit nomination (BDBN) that differs from that prescribed in the superannuation legislation and regulations. It is going to be a big year for SMSFs with a number of legislative and budget measures still to be determined in Federal Parliament. Several decisions are set to be made in Federal Parliament early in 2021 after they were left hanging when Federal Parliament broke over the Christmas holiday period. These included the Bring-Forward Rule for Non-Concessional Contributions, extending the number of members from four to six, Shutting down eligible rollover schemes as well as items that are yet to be legislated including removal of the actuarial certificate requirements for SMSFs that are 100% in pension phase with disregarded small fund assets and allowances to use the unsegregated method where an SMSF has 100% segregated assets for part of a financial year.
