Teil 1 behandelt die Feststellung des Verteidigungsfalls, die erweiterten Kompetenzen der Exekutive, mögliche Szenarien, Grundrechte, Mobilität sowie Arbeitsrecht und Dienstpflichten. In einer Zeit geopolitischer Unsicherheiten, in der Konflikte die Sicherheit Deutschlands bedrohen, gewinnt die Frage nach den Abläufen eines Verteidigungsfalls an Bedeutung.Stellen Sie sich vor, wie ein solcher Ausnahmezustand den Alltag verändert: Von zentralisierten Entscheidungen bis zu Rationierungen, die das Leben auf den Kopf stellen. Basierend auf dem Grundgesetz und dem Operationsplan Deutschland, der militärische und zivile Maßnahmen koordiniert, entsteht ein Bild von gesteigerter Staatsmacht, die Freiheiten einschränkt, um die Nation zu schützen. Rechtliche Grundlagen und praktische Auswirkungen verdeutlichen die Bedeutung von Resilienz und machen die Grauzonen sichtbar, in denen politische Entscheidungen getroffen werden.Was bei Ausrufung des Verteidigungsfalls (also bei einem Krieg bzw. einer existenziellen militärischen Bedrohung) in Deutschland passieren würde, ist im Grundgesetz (GG) durch sogenannte Notstands-Artikel bestimmt. Aber: Es gibt viele Unsicherheiten, und nicht alle Szenarien sind gesetzlich konkret bis ins kleinste Detail geregelt. Die bestehenden Bestimmungen erlauben nur eine theoretische Einschätzung der zulässigen Maßnahmen, möglicher Einschränkungen von Grundrechten und der Bereiche, in denen Rechtslücken oder Interpretationsspielräume politisches Handeln bestimmen.Rechtsgrundlagen: Was bedeutet „Verteidigungsfall“ rechtlich?Der Verteidigungsfall markiert den Übergang zu einem Zustand erhöhter Alarmbereitschaft, in dem der Staat seine Kompetenzen erweitert, um eine sogenannte Bedrohung abzuwehren. Definition und Feststellung des VerteidigungsfallsIm Grundgesetz ist der Verteidigungsfall geregelt in Abschnitt Xa, Art. 115a–115l GG. Definition Verteidigungsfall, dort heißt es [1]:„Die Feststellung, daß das Bundesgebiet mit Waffengewalt angegriffen wird oder ein solcher Angriff unmittelbar droht (Verteidigungsfall), trifft der Bundestag mit Zustimmung des Bundesrates. Die Feststellung erfolgt auf Antrag der Bundesregierung und bedarf einer Mehrheit von zwei Dritteln der abgegebenen Stimmen, mindestens der Mehrheit der Mitglieder des Bundestages.“Die Feststellung wird vom Bundespräsidenten im Bundesgesetzblatt verkündet; ist dies nicht sofort möglich, erfolgt die Bekanntgabe auf anderem Weg und wird später im Bundesgesetzblatt nachgetragen. Ist der Verteidigungsfall festgestellt und erfolgt ein Angriff, kann der Bundespräsident mit Zustimmung des Bundestages völkerrechtliche Erklärungen über das Bestehen des Verteidigungsfalles abgeben. Kann der Bundestag nicht tätig werden, übernimmt der Gemeinsame Ausschuss diese Aufgabe.Gestärkte Kompetenzen der ExekutiveIm Verteidigungsfall erhält die Exekutive deutlich gestärkte Kompetenzen: Gesetzgebungsbefugnisse werden zentralisiert, Befehls- und Kommandogewalt über die Streitkräfte liegt beim Bundeskanzler. Notstandsgesetze (d.h. Gesetze, die nur im Verteidigungsfall relevant sind) können entgegenstehendes Recht außer Kraft setzen, solange sie gelten. Diese Notstandsregelungen gelten nach Art 115k jedoch nicht unbegrenzt: Spätestens sechs Monate nach Beendigung des Verteidigungsfalls treten viele der beschlossenen Maßnahmen wieder außer Kraft. Ashish Ranjan is an ex-ISRO, ex- BARC Scientist. He has spent the past 5 years writing a book on his experience of getting selected and working in India's Nuclear program and how he worked his way up into India's space program despite his poor academic background. Ashish had scored 53/100 in Mathematics and 61/100 in Physics on his 12th boards. He had even failed Physics in his 11th Standard.
