Justice starts with the neutral to set a tone of safety and the party's abilities to exercise free will. Mediators are leaders - they must know where they are going and why. What's your "why" for justice? What values help you achieve that in your mediation practice?
Mediators can influence the environment for chronically conflicted individuals by disarming their angst with a few cool techniques at the start of the mediation. Try this on for yourself and see what happens!
Stopping the adversarial tones in mediation through this helpful technique. This will honor everyone's lens but ultimately safeguard the mediation environment to allow for parties to exercise their free will.
Mediation in its "purist" sense should be party-driven and the mediator should be safeguarding "party self-determination or free will". Did you know there are a few different types of mediation? Some models cause mediation to feel like an extension of the courtroom and it comes down to a mediator's understanding of neutrality. When mediators do not understand their role - they can quickly fall into the trap of veering towards their professional lens (legal, social work, therapist, etc) ultimately eroding party's free will. Take a listen!
