A tragic incident in Lower Pottsgrove Township, Pennsylvania, has left a community in shock as an 84-year-old man, Barton Seltmann, stands accused of fatally striking his wife, Margaret Seltmann, 85, during a heated argument over money allocated for their cat's veterinary care.    The Montgomery County District Attorney's Office issued a press release detailing the disturbing events that unfolded in the Seltmann household. On Tuesday at 2:26 p.m., police responded to a 911 call made by Barton Seltmann, leading them to the couple's residence.    Upon arrival, officers encountered a harrowing scene. Barton Seltmann was found on the back porch of their home, his hands, face, and clothing smeared with blood. Tragically, inside the residence, Margaret Seltmann was discovered, described by officials as "obviously deceased."    An investigation revealed the shocking turn of events that transpired during the argument. The couple, locked in a dispute over financial matters related to their cat's veterinary expenses, saw tensions escalate. During this heated exchange, Barton Seltmann allegedly struck his wife multiple times in the head while she lay on the kitchen floor.    The Montgomery County Coroner's Office determined the cause of Margaret Seltmann's death as blunt force injuries to the head, classifying it as a homicide.    Barton Seltmann now faces serious charges, including first-degree murder and third-degree murder. He is currently in custody without bail at the Montgomery County Correctional Facility.    The investigation uncovered a small kitchen knife and shards of glass from a candle jar beneath the victim's body, shedding light on the tragic and violent nature of the incident.    Remarkably, their beloved cat, a source of the initial disagreement, is now being cared for by a family member, as confirmed by the DA's Office in a Facebook comment.    The case has taken a deeply troubling turn as relatives of the accused reported concerns about Barton Seltmann's mental state in the weeks preceding the fatal confrontation. They revealed that Margaret had expressed worries that her husband was suffering from dementia.    "In the last five or six weeks, Margaret said he was suffering from dementia, he wasn't remembering things. Like if he went somewhere, he didn't remember where he was at and things, and she was concerned about it," shared Barton's sister-in-law, Sandy Seltmann.    Barton's brother, Ron Seltmann, described the couple as happy, with a marriage spanning over 30 years. However, the argument took a violent turn when Margaret allegedly brandished a knife and threatened to kill her husband. According to Barton's account to investigators, he reacted by pushing a chair towards his wife, causing her to fall and hit her head on the floor. Subsequently, he reportedly punched her and struck her head with a candleholder.    Tragically, during the altercation, Margaret allegedly uttered the chilling words, "You're killing me," before, as the probable cause affidavit states, she "went to sleep."    This heartbreaking incident serves as a stark reminder of the importance of conflict resolution and mental health awareness within families, as a simple argument escalated into a devastating tragedy that will forever impact the lives of those involved. Authorities have identified the woman who was shot and killed while she waited at a Dunkin' drive-thru Tuesday morning while her 11-year-old son was in the vehicle. The Montgomery County District Attorney's Office said 35-year-old Rachel King of Elkins Park was shot multiple times while behind the wheel of her SUV. It happened around 7:40 a.m. in Cheltenham Twp. According to investigators, King was driving westbound on Cheltenham Avenue when she turned into the Melrose Shopping Center, then pulled into a line of traffic in the Dunkin' drive-thru lane. The D.A.'s office said a light-colored sedan, possibly a Ford or Mercury, was seen driving directly behind King. District Attorney Kevin Steele said this appears to be a targeted murder. He said the suspect did not try to open the door or communicate with King before firing. King was a teacher at Grover Cleveland Elementary School in the Mastery charter school system in Tioga-Nicetown.. Nicki documented her investigation in the book Chasing Cosby, which was the basis for her award winning podcast of the same name. More than sixty women made allegations against Cosby across the years. In December 2015, the Montgomery County District Attorney's Office announced it had filed an aggravated incident assault charge in Andrea Constand's case. It took nearly three years and two trials to convict Cosby. He was sentenced to 3-10 years. When Cosby was convicted in 2018, many considered the jury's decision a landmark in the movement to hold alleged sexual predators accountable. In 2018 Bill Cosby was convicted of sexual assault for drugging and molesting Andrea Constand in 2004.  In the summer of 2021, the Pennsylvania Court of Appeals not only reversed the conviction, but instructed the trial court and the Montgomery County DA that they were barred from brining this case to trial again.Typically, when an appeal results in the reversal of a conviction, it means that something pretty significant was done inappropriately during the trial.   So what went wrong here?  Why did the court of appeals not simply remand for a new trial.  Barring any further prosecution is an extreme remedy, but one the highest Pennsylvania court felt was appropriate here.The reason that Cosby cannot be prosecuted ever again for his 2004 actions with Andrea Constand is that the Montgomery County District Attorney at the time promised that he wouldn't, but his successor broke that promise after Cosby relied on his word and suffered in a civil lawsuit as a result.This episode looks at whether a DA can, should or must be held to their word when they make affirmative promises.  We also discuss what a DA will consider when making a decision as to whether or not there is enough evidence to pursue a prosecution and how the statute of limitations works.Because this episode had a lot of complex issues, it runs a bit long because Paul did not want to cut any explanations too short.  If, as a listener, you're okay with extending these episodes a bit, please write Paul at insummationpodcast@gmail.com or contact him via his website insummation.com and let him know if you want the episodes to run 45-50 minutes or if you'd prefer they were kept to the 35 minutes or so they typically run now.Thanks for listening!   This is the second of our two-part series about the physical and sexual abuse reported by kids housed at Miracle Meadows School, a residential treatment center located in West Virginia. Shaunestte interviews attorneys Brian Kent and Guy D'Andrea, who along with their co-counsel, represented twenty-nine former students in civil litigation against school administrators and faculty. Brian and Guy talk about the complex nature of sexual abuse litigation and the important role their trauma-informed training played in helping them connect with these survivors while also respecting their mental health needs. Brian and Guy share how teamwork between co-counsel and the survivors led to an impressive $51.9 million settlement. Brian Kent is a founding partner at the law firm of Laffey, Bucci & Kent, LLP based in Philadelphia with offices in New Jersey, New York, and Delaware. Brian was a sex crimes unit prosecutor with the Montgomery County District Attorney's Office where he worked to ensure the safety of abused children. He handled 100's of sexual assault and child sex abuse cases from inception and investigation through trial. He also tried and convicted some of Montgomery County's most dangerous sex offenders. In his current practice, Brian represents sexual assault survivors in a variety of litigation that has garnered extensive local and national media attention. Specifically, he has represented numerous women who reported they were sexually assaulted at Massage Envy facilities. Guy D'Andrea is an experienced high-profile criminal and civil trial lawyer who has litigated more than 100 jury trials and hundreds of bench trials. He is a former Assistant District Attorney in Philadelphia. During his tenure as a prosecutor, he tried over 500 cases. On an Instagram Live broadcast Monday night, Alexandria Ocasio-Cortez told the world in detail about her harrowing experiences during the Capitol insurrection.  11 House Republicans join all House Democrats in stripping QAnon Representative Marjorie Taylor Green of committee roles.  Senate Democrats pass a budget bill in the wee hours this morning paving the way for passing Biden’s $1.9 trillion coronavirus relief package through reconciliation. The bill was passed only after Vice President Kamala Harris cast a tie-breaking vote.  Joe Biden fired all 10 members of the Federal Services Impasse Panel this week.  The FSIP is a labor panel that settles federal labor disputes between public unions and the different federal agencies, but under Trump, the Panel was stacked with Koch operatives and used to break federal sector unions.  Congressional Democrats are pushing Biden to cancel $50,000 in student loan debt. During the campaign Biden says he would support canceling $10,000 in student loan debt, but pressure led by Chuck Schumer, Elizabeth Warren, Ilhan Omar, Ayana Pressley, Alma Adams, and Mondaire Jones seems to be having an effect. White House Press Secretary Jen Psaki tweeted “Our team is reviewing whether there are any steps he can take through executive action and he would welcome the opportunity to sign a bill sent to him by Congress.” The good folks at the American Prospect have an “Executive Action Tracker” on their website as part of their #DayOneAgenda project.  Over 1,100 Columbia University students have pledged to go on a tuition strike, saying they refuse to pay full tuition for all on-line classes.  This Super Bowl Sunday General Motors will unveil their electrical vehicle line. GM has said they will eliminate all their combustion engine vehicles by 2035.  Governor Tom Wolf released his annual budget address on Wednesday.  The Governor called for an increase in the personal income tax and a tax credit program that will reduce taxes for 70% of working Pennsylvania families.  He also called for the legalization of recreational cannabis use and an increase in the $15 minimum wage. Nikil Saval released a response to Gov. Wolf’s budget proposal, saying that his budget “does much to move funding swiftly, and equitably, to those who need it most.” But, Saval wrote that the absence of vigorous environmental protection to respond to the climate crisis and the budget’s silence on dealing with the housing crisis, especially during the pandemic, represents “two missed opportunities.”  Former Montgomery County District Attorney Bruce Castor has gone from political irrelevance to defending Donald Trump during the upcoming impeachment trial.  Castor managed to burn every bridge possible while serving as the Montgomery County District Attorney and as the Acting Attorney General of Pennsylvania.  Congratulations, Bruce? Kathy Boockvar steps down after a major screw up that set back the fight for a Constitutional Amendment allow abuse survivors access to justice.  Scott Perry’s faculty instructor at the Army War College pens an op-ed to the York Daily Record saying that he finds Perry’s behavior “troubling” and calls on Perry to “remove his name from any website that infers, in any way, that the Army War College considers him to be of the same stature” of some of the celebrated graduates of the college.  White House Press Secretary Jen Psaki could not say what the future of the Space Force will be under the Biden Administration. She promised to get together with the point of contact with the Space Force for more information. The Space Force flag was waving during the inauguration we should say.  On Super Bowl Sunday, SpaceX is launching a commercial for what it’s billing as the “first ‘all-civilian’ spaceflight” as part of their Inspiration4 project with billionaire Jared Isaacman. The commercial tells viewers they’ll have a chance to climb aboard. According to Space.com,  there are three non-billionaire seats available: “One seat is up for grabs in a contest to anyone who makes a donation to St. Jude's Children Research Hospital. Another seat will go to a St. Jude's healthcare worker, and the third will go to the winner of an entrepreneur contest run by Isaacman's Shift4Shop.” And in a major shift away from the Trump organization, Biden created a new role at NASA to prioritize Earth sciences to combat the climate crisis. The new Senior Climate Advisor position will report directly to NASA’s administrator. The head of NASA’s Goddard Institute for Space Studies, Gavin Schmidt, will be the acting senior advisor until they fill the role permanently.  Sean got shipments of pots this week. This bonus episode of Clear & Convincing features an interview with Trial Bureau Chief Kelly Blackburn of the Montgomery County District Attorney’s office regarding the Larry Swearingen case.  Mr. Blackburn assumed responsibility for the case in 2017.  Lisa O’Brien discusses the issues related to Swearingen’s multiple requests for DNA testing, including post-conviction counsel’s objection in 2013 to pre-execution testing requested by the State.  They’ll also talk about the agreed testing in 2017 and the inconclusive results.  Mr. Blackburn grew up in Brownwood, Texas and attended Texas Tech University, from which he graduated with a Bachelor of Arts degree in Political Science.  He graduated from South Texas College of Law in 1999 and began his legal career at the Harris County District Attorney’s Office as a felony trial prosecutor.  He also served in the Public Integrity Division handling cases and investigations of public corruption.  In 2008, Mr. Blackburn served as an Assistant United States Attorney in the Western District of Texas, where he handled narcotics offenses, human smuggling, bulk-cash smuggling, fire arms, organized crime and criminal immigration offenses.  In 2010, Mr. Blackburn joined the Montgomery County District Attorney’s office, where he served as a Chief Prosecutor and Chief of the Public Integrity Division.  His now serves as Chief of the Trial Bureau and is Board Certified in Criminal Law by the Texas Board of Legal Specialization.

In April, Cosby was found guilty of three counts of aggravated indecent assault. With each count carrying a maximum sentence of 10 years, the 81-year-old actor could have been hit with a three-decade sentence behind bars. He is currently under house arrest and out on $1 million bail. But no matter what the Constand family wants, with the lawyers’ arguments on both sides and Cosby’s inevitable appeal looming, that 30-year lockup just isn’t going to happen. On Day 1 of the sentencing hearing for Cosby with a vital defense witness still to come tomorrow, O’Neill revealed that the often-clashing Montgomery County District Attorney’s office and the defendant’s lawyer had agreed to a deal of sorts. “Counts two and three have been merged into count one,” O’Neill said this afternoon in suburban Norristown, PA. Looking at the state guidelines and their wiggle room, he declared that once A-lister Cosby was looking at a total jail time of 22 to 34 months in final sentencing. A woman in California sued Facebook Friday for being “exposed to highly toxic, unsafe, and injurious content during her employment as a content moderator at Facebook.” Selena Scola was a content moderator at Facebook’s Menlo Park, California headquarters from June 2017 through March of this year, according to the lawsuit. She worked for a contractor called Pro Unlimited, Inc., which helps Facebook delete content that violates its Community Standards. Facebook has roughly 7,500 content moderators worldwide, who are tasked with deleting hate speech, graphic violence and self harm images and video, nudity and sexual content, bullying, and a host of other content that violates its policies.
