Hello, and welcome to episode 96 of the Financial Crime Weekly Podcast, I'm Chris Kirkbride. It is yet another busy week for financial crime, which is not unexpected in the week of the second anniversary of the invasion of Ukraine. So, there is a range of new and amended sanctions news. On money laundering new, the EU has churned out a new Delegated Regulation, and a major UK bank announces that the Financial Conduct Authority has its AML framework under investigation. In bribery and corruption, there has been an outcome in the trial of the former Chief of Staff to the President of Madagascar. The EU is responsible for the majority of this week's fraud news, having taken a good deal of action across of broad range of activity. On market abuse, the SEC in the US has charged a man with inside dealing who is alleged to have traded on inside information obtained from listening in on his wife's meetings. Brian Walshe, a 49-year-old Massachusetts man, has been sentenced to 37 months in prison for his involvement in a fraudulent art scheme selling counterfeit Andy Warhol paintings, announced the U.S. Attorney's Office in Boston. The sentencing comes amidst pending state charges against Walshe, including first-degree murder, related to the disappearance of his wife, Ana Walshe. In a federal case, Walshe pleaded guilty in 2021 to charges of wire fraud, interstate transportation for a scheme to defraud, and unlawful monetary transaction. These charges stem from what prosecutors described as "a years-long, multi-faceted art fraud scheme," wherein Walshe advertised and sold fake Andy Warhol "Shadows" paintings. Ana Walshe was last seen on New Year's Day 2023 at her home in Cohasset, according to police reports. While her body has never been found, Brian Walshe faces allegations of her murder, with a criminal complaint suggesting he killed her that day and disposed of her remains. The fraudulent art scheme centered around two abstract paintings that Walshe claimed to be authentic Warhol "Shadows," which he sold for $80,000 outside of eBay in 2016. Court documents reveal that the genuine Warhol paintings belonged to the family of a former classmate of Walshe's from Carnegie Mellon University in the 1990s. Prosecutors allege that Walshe never intended to return the authentic Warhol pieces to their rightful owners, as evidenced by excerpts from his diary at the time. Entries suggest a premeditated intent to defraud, with statements indicating a callous disregard for the victims. Despite the federal sentencing, Walshe's legal troubles are far from over. Karl Kadon, a lifelong resident of Cincinnati, is an alumnus of Walnut Hills High School, Miami University, and the Salmon P. Chase College of Law. Since 2006, he has served as a Criminal Chief, a federal prosecutor, stationed at the Cincinnati branch office of the United States Attorney's Office for the Southern District of Ohio.In his role, Kadon dedicated a significant portion of his federal career to the Organized Crime Drug Enforcement Task Force, focusing on pursuing major drug dealers and drug cartels. In 2019, he was appointed as the Deputy Criminal Chief overseeing the Task Force. Shortly thereafter, he assumed the position of Chief of the Criminal Division of the U.S. Attorney's Office, where he took charge of all investigations and criminal cases. Over the past two decades, Kadon has either personally litigated or supervised some of the most notable federal prosecutions in the Southern District of Ohio, earning several awards and recognitions for his contributions.Before becoming a federal prosecutor, Kadon served as the Chief Assistant Prosecuting Attorney for the Hamilton County Prosecutor's Office. Prior to that, he held the position of Deputy City Solicitor for the City of Cincinnati, where he was responsible for managing all civil litigation and criminal prosecution matters. In 1987, he was commissioned as an officer in the United States Army Reserve, serving as a Judge Advocate ("JAG") in the Judge Advocate Generals Corps until his retirement in 2015 as a Lieutenant Colonel. His military service included mobilization for Operation DESERT STORM, deployment as Deputy Staff Judge Advocate for the Special Operations Component of U.S. Central Command during Operations ENDURING FREEDOM and IRAQI FREEDOM, with assignments in the Gulf, Afghanistan, and other regions.Beyond his professional and military commitments, Kadon has actively participated in youth soccer and the Boy Scouts. He previously served on the Board of Directors for the Dan Beard Council of the BSA and currently holds positions on the Board of Directors of the FC Cincinnati Foundation and the Miami University Alumni Association Advisory Board.

Highlights: Karen Read's Attorney, David Yannetti, says 6 letters moved to be suppressed by the prosecution that are between the US Attorney's Office and DA Michael Morrissey do not meet the standard for suppression and will be made public anyway when Yannetti moves to sanction the DA's office. Thought the Attorney's Office has no objection to the letters being made public, DA Lally argues that that isn't the reason his office wants them to be suppressed. They are under a grand jury and should not yet be made public. Discussion over the notes and interviews and recordings and other correspondence between a reporter for Boston Magazine and Karen Read. Boston Magazine attorney argues that the "off the record" notes should not be made available to the prosecution. That it will have a chilling effect on reporting and that reporters should never be used as witnesses. The judge wants Boston Magazine to present court soon rulings in Massachusetts that support his argument. DA Lally argues that no special protections in Massachusetts for reporters and that they only want the correspondence between the reporter and Read. The judge expresses concern for the reporters safety as she has been threatened. Karen Read's lawyer says federal office will release evidence on the Morrissey case and he wants to wait until after that release to argue for sanctions. Hearing is scheduled for February 15th. It's simple: inspire, educate and let's go change this world!On today's episode, Jeff welcomes guest Judge Echo Hutson, the elected judge of Montgomery County Court at Law #4, which oversees misdemeanor criminal cases, domestic violence court and mental health treatment court. She has dedicated her personal and professional career to protecting Montgomery County's citizens and victims of violent crime, first as a prosecuting attorney and now in her role as Judge. She was instrumental in starting the first domestic violence division in the county in 2011 and became the county's first domestic violence specialized prosecutor. She loves to speak and educate others on matters involving domestic violence and mental health treatment. She is also the founder and host of the annual Flowers on the Lake Domestic Violence Awareness event.To begin, Judge Echo Huston shares that she earned her undergraduate degree in Alaska with the intention of attending law school. When one of her fellow students, a young woman, went missing in their small town, Judge Hutson had the opportunity to work with the U.S. Attorney's Office on the missing case as an intern. Working on this case changed Judge Hutson's career trajectory. From that moment on, she saw the practice of law as an opportunity to be an advocate for victims and to never give up on someone who no longer has their voice. Right after she finished law school, Judge Hutson moved to El Paso, TX, where there was a special division for domestic violence and began prosecuting. Judge Hutson began and organically grew the domestic violence division at the DA's office. A study done between 2021-2022 concluded that Montgomery County's specialty court is one of the highest national performers. This is based on conviction rates, the time from cases being filed to disposed, their trauma informed treatment for victims and more.Then, Judge Hutson shares some of the key statistics regarding domestic violence based on U.S. studies. First, 1 in 3 women in their lifetime will experience domestic violence. Those who attempt to leave the relationship, there is a 75% increased likelihood that they will be killed during that time. The average victim makes 7-8 attempts to leave domestic violent relationships before they finally leave for good. Judge Hutson shares that the biggest mistake people often make is to push victims to leave a relationship before they are ready to do it themselves. We also know that victims of domestic violence who have help from resources tend to remain alive. Before wrapping up, Judge Hutson highlights success stories and highlights her goals for the future. A South Carolina man faces life in federal prison after his wife's burned body was discovered in a 'makeshift' grave in 2020," according to the U.S. Attorney's Office. Lawrence Joseph Florentine, 56, has "pleaded guilty to interstate domestic violence resulting in death, use of a firearm during a crime of violence to cause death, obstruction of justice, and use of fire during the commission of a felony" over three years after his wife Nicole Zahnd Florentine's body was found "charred" with a ".22 caliber bullet wound to the head" determined to be her cause of death, per a release. The U.S. Attorney's Office noted that the two had a "volatile" relationship after marrying in 2018, citing recordings and observations from family. Since December 2019, authorities in York County responded to multiple calls from Nicole, who accused Lawrence of physically abusing her and having "threatened to kill her, burn her, and bury her." Lawrence was previously arrested twice on domestic violence charges, one of which was at least partially dismissed at Nicole's request. Then, on May 23, 2020, the couple's home in Rock Hill was "destroyed by fire," the release from the U.S. Attorney's Office noted. "Text messages and photographs Florentine sent to Nicole during the fire show that he intentionally burned her belongings and intentionally set the property on fire," the release read. "Florentine is charged with arson in state court in connection with the fire." Between June 2 and June 11 of that year, the two then traveled together by car and were last known to be in Piedmont, South Carolina, according to an FBI investigation. Nicole's grandmother reportedly filed a missing person report when she stopped hearing from her during the trip. A body that was later identified as Nicole's was found by a groundskeeper for Hill Cemetery in Fredonia, Kentucky, on June 13, 2020. "A gas can was recovered from behind a tree near the burial site," the release notes. "No identification, cell phone, or other personal belongings were found." For this week's episode, Jacquelyn interviewed Josh Naftalis, partner at law firm Pallas Partners.He's a long time attorney who represents companies, boards and executives in cases for white collar criminal defense, regulatory enforcement matters, internal investigations, crisis management and more.Prior to Pallas Partners, Josh was a federal prosecutor and served over a decade as assistant U.S. attorney in the U.S. Attorney's Office for the Southern District of New York. Back in a moment Break: ELON - Drake - Dayco STORY 4: Holly Springs City Council approves rezoning for 20 townhomes The Holly Springs City Council has approved a request to rezone nearly two acres for the construction of a 20-unit townhome community along Edmondson Lane. The rezoning changes the designation from general commercial to traditional neighborhood development with a density of 10.05 units per acre. The proposed townhomes are expected to be priced at $400,000 or less. Additionally, the council voted to approve an intergovernmental agreement with Cherokee County, Woodstock, and the Cherokee Office of Economic Development for a transportation plan for the I-575 and Sixes Road area. Other approvals include declarations for covenants, conditions, restrictions, and easements for various residential projects and contracts for park improvements. Story 5: Cherokee Fire promotes 10 firefighters On September 26, Cherokee County Fire and Emergency Services held a promotion ceremony at the Cherokee County Fire Training Complex in Holly Springs. Ten firefighters were promoted, including eight Fire Apparatus Operators who were promoted to the rank of sergeant, one sergeant who was promoted to lieutenant, and Battalion Chief Daniel Carder, who was promoted to the rank of division chief. The property was rezoned to downtown-medium density residential, and a conditional use permit was granted. The project includes the extension of Brownlee Road. The council also approved a $20.6 million amendment to the contract with Winter Construction for phase two of the City Center Parking Deck project. They held three public hearings, including one about electric vehicle charging stations, which was tabled for further discussion. A chilling verdict has been delivered by the U.S. justice system. Lawrence Rudolph, a 68-year-old man who coldly orchestrated the murder of his wife during a hunting trip in Africa, was sentenced to life imprisonment by a federal judge. This decision serves as a stark reminder that no act, no matter how meticulously planned, can elude the long arm of the law. The U.S. Attorney's Office for the District of Colorado made the announcement on Monday, Aug. 21. Rudolph was not only found guilty of murder but also of defrauding life insurance companies. He will serve a concurrent 20-year sentence for the latter offense. The legal repercussions didn't end there. Judge William Martinez ordered Rudolph to pay a staggering $4.9 million in restitution, an additional fine of $2 million, and a $200 special assessment. On the final day of their hunting trip in Zambia, Rudolph coldly "shot his wife [Bianca Rudolph] through the heart with a 12-gauge shotgun that was enclosed in a soft-shell case." The intent? To cunningly disguise the cold-blooded murder as a mere hunting mishap. In defense, Rudolph recounted a version of events wherein his wife tragically died while trying to stow away the shotgun, which he claimed had accidentally discharged. The emotional toll this crime has taken on the victim's family was palpable during the sentencing hearing. As reported by The Associated Press, Bianca Rudolph's brother addressed the convicted murderer, asserting that Rudolph would "die alone and unmourned." He further added, "Even Judas would be afraid to be in your company." The motive behind this grisly act became clearer as the prosecution shed light on Milliron's role. Lori Milliron, who maintained a professional relationship with Rudolph as a dental hygienist and manager in his office, reportedly pressured Rudolph to end his marriage with Bianca. This revelation, as disclosed by The Associated Press, further establishes the premeditated nature of the crime.
