The Trump Administration and the Rule of Law Under Pressure

On March 6, President Trump issued the executive order “Addressing Risk from Perkins Coie LLP,” essentially preventing the firm from doing business with the federal government, stripping its staff of security clearances. It was the first of several presidential orders aimed at law firms that represented clients and/or employed attorneys at odds with Trump. At the same time, Trump and members of his administration have voiced loud opposition to judges who rule against him and, in what many see as a weaponization of justice, have fired members of the Department of Justice without cause. Even the new Attorney General Pam Bondi is breaking with long held protocol by openly defending the administration, taking a partisan position when defending her decision not to investigate the Signal scandal of top national security officers sharing war plans via the public ap, saying: “If you want to talk about classified information, talk about what was in Hillary Clinton's home. Talk about the classified documents in Joe Biden's garage that Hunter Biden had access to.”Are the norms and practices that have maintained the rule of law in the United States straining under the pressure of the Trump administration?Stanford Law Professor David Sklansky, a criminal law expert, joins Pam Karlan for a look at the first 100 days of the Trump administration—and the unprecedented number of executive orders targeting rule of law norms. Sklansky, co-director of the Stanford Criminal Justice Center who teaches and writes about policing, prosecution, criminal law, and the law of evidence, is the author, most recently of Criminal Justice in Divided America: Police, Punishment, and the Future of Our Democracy, was published earlier this year by Harvard University Press. Earlier he practiced labor law in Washington D.C. and served as a federal prosecutor in Los Angeles.Links:David Sklansky  >>> Stanford Law pageCriminal Justice in Divided America >>> Stanford Law pageConnect:Episode Transcripts >>> Stanford Legal Podcast WebsiteStanford Legal Podcast >>> LinkedIn PageRich Ford >>>  Twitter/XPam Karlan >>> Stanford Law School PageStanford Law School >>> Twitter/XStanford Lawyer Magazine >>> Twitter/X (00:00:00) The Rule of Law and Executive Orders(00:15:01) Legal Profession's Response to Political Pressure(00:27:01) Impact on Universities and Academic Freedom(00:37:01) Redefining Pro Bono Work(00:44:42) The Importance of the Rule of Law

Today on Mea Culpa, I welcome back Nick Akerman, former federal prosecutor, Assistant Special Watergate Prosecutor, and the Assistant United States Attorney in the SDNY, where he specialized in white-collar crime. We break down Trump's escalating attacks on the judiciary, including his push to impeach Judge James Boasberg and Chief Justice Roberts' rare public rebuke. Nick explains how Trump's efforts to undermine judicial independence mirror authoritarian regimes and what legal safeguards remain to check his power. We also discuss Trump's violations of court orders in deportation cases, the dangers of his expanded executive authority, and the legal battles ahead as he attempts to reshape the government in his image. How do we prevent or catch mismanagement, corruption, and waste of taxpayers' dollars in federal agencies? On January 24, 2025, days into his second administration, President Trump fired Inspectors General from 17 different federal agencies, including the Department of Labor. If no one is watching, does that mean there's nothing to see?In this episode Pam Karlan is joined by Glenn Fine, a former Inspector General of both the Department of Justice and the Department of Defense. Glenn highlights the extensive work involved in detecting and deterring waste, fraud, and abuse within these massive agencies. He discusses the differences between the DOJ and DOD, emphasizing the unique challenges and the importance of understanding each agency's culture and operations. Through detailed examples, including politicized hiring at the DOJ and a tragic incident at the Bureau of Prisons, he illustrates the breadth and impact of the investigations conducted by Inspectors General—and the essential function of these watchdogs in maintaining integrity and accountability within federal agencies. Earlier in his career, Glenn served as an Assistant United States Attorney in Washington D.C., where he handled criminal cases, including more than 35 jury trials. He also worked in private practice in two law firms.  He is the author of the book Watchdogs: Inspectors General and the Battle for Honest and Accountable Government, with a foreword by General Jim Mattis. He currently is a fellow at the Brookings Institution and serves as an Adjunct Professor of Law at Georgetown University—and as a visiting lecturer at Stanford Law School.Links:Glenn Fine >>> Stanford Law pageWatchdogs >>> UVA Press pageConnect:Episode Transcripts >>> Stanford Legal Podcast WebsiteStanford Legal Podcast >>> LinkedIn PageRich Ford >>>  Twitter/XPam Karlan >>> Stanford Law School PageStanford Law School >>> Twitter/XStanford Lawyer Magazine >>> Twitter/X(00:00:00)  Introduction and Overview of the Inspector General's Role(00:03:52) The Impact of Inspector General Reports(00:04:39) Notable Investigations at DOJ and DOD(00:15:56) The Role of the Defense Criminal Investigative Service(00:17:23) Coordinating COVID-19 Relief Oversight(00:27:59) Importance of the IG's role in maintaining government accountability

While some law enforcement officers may have a go-to contact in their state or local prosecutor's office, more consistent collaboration and information-sharing practices can help bring violent crime offenders to justice. For example, many prosecutors work with law enforcement to better utilize the National Integrated Ballistic Information Network or NIBIN leads and other crime intelligence to supplement case evidence. Corinne Ramey and James Fanelli of The Wall Street Journal write, “If Trump wins the next presidential election, he could attempt to pardon himself in any federal case or steer the Justice Department to retreat from Smith's charges. In Georgia, he would lack the ability to wipe away a state conviction or prison term. Even if Trump were to seek a state pardon, he wouldn't be eligible to do so until after serving a sentence for any conviction. In Georgia, any such pardon would be determined by a state board, not the governor.” You can read their full article here: https://www.wsj.com/articles/georgia-case-presents-unique-challenges-for-trumpand-prosecutors-4dd6ee37 3:35pm- In a video posted to Truth Social, former president Donald Trump addressed the wildfires that have devastated Hawaii—tragically killing nearly one hundred people making it one of the deadliest wildfires in recent U.S. history. 3:45pm- Is the Georgia indictment Donald Trump's greatest legal concern yet?  4:05pm- While speaking in Milwaukee, Wisconsin on Tuesday, President Joe Biden promised that he would soon be visiting Hawaii to assess the damage caused by wildfires in Maui. Johnson's responsibilities as Secretary included counterterrorism, cybersecurity, aviation security, border security, port security, maritime security, protection of our national leaders, the detection of chemical, biological and nuclear threats to the homeland, and response to natural disasters.  In three years as Secretary of DHS, Johnson is credited with management reform of the Department, which brought about a more centralized approach to decision-making in the areas of budgets, acquisition and overall policy.  Johnson also raised employee morale across the Department, reflected in the September 2016 Federal Employee Viewpoint Survey.  As General Counsel of the Department of Defense, Johnson is credited with being the legal architect for the U.S. military's counterterrorism efforts in the Obama Administration.  In 2010, Johnson co-authored the report that paved the way for the repeal of the Don't Ask, Don't Tell by Congress later that year. In his book Duty, former Secretary of Defense Robert Gates wrote that Johnson "proved to be the finest lawyer I ever worked with in government - a straightforward, plain-speaking man of great integrity, with common sense to burn and a good sense of humor."  According to published reports, Johnson provided the opinion that was the legal basis for U.S. special forces to enter Pakistan to kill Osama bin Laden on May 1, 2011.    Johnson is a 2022 recipient of the Ellis Island Medal of Honor, a 2021 recipient of the American Lawyer's Lifetime Achievement Award, as “an American statesman [who] has devoted his career to the public interest,” and a 2018 recipient of the Ronald Reagan Peace Through Strength Award, presented at the Reagan Presidential Library, for “contribut[ing] greatly to the defense of our nation,” and “guiding us through turbulent times with courage and wisdom.”  In 2020 the Chief Judge of New York State asked Johnson to conduct a comprehensive review of equal justice in the New York State courts.  On October 1, 2020 Johnson issued a public report with his findings and recommendations, all of which the Chief Judge has committed to adopting.  Johnson has debated at both the Cambridge and Oxford Unions in England, and in November 2019 was conferred honorary life membership in the Cambridge Union.  Johnson is a graduate of Morehouse College (1979) and Columbia Law School (1982) and the recipient of 13 honorary degrees.   Johnson married “the girl next-door,” literally, Dr. Susan DiMarco, in 1994. Susan is a retired dentist, a volunteer at the southern border and in numerous other activities, and, at the request of the U.S. Navy, is the sponsor of the Virginia-class submarine USS NEW JERSEY (SSN-796).  In February 2023, Johnson and his family history were profiled on an episode of PBS' Finding Your Roots. For Jazz fans, tune into “All Things Soul with Jeh Johnson", once a month on Saturdays from 8 – 10 am on WBGO 88.3 FM.   On this episode, Secretary Johnson shares his one way ticket to Birmingham, Alabama on May 20, 1961, to resume the Freedom Rides, and highlights the role they had in the US Civil Rights Movement. During the course of our conversation, he also covers his family history as unearthed by Henry Louis Gates on Finding Your Roots, how he approached managing the Department of Homeland Security, concerns about cybersecurity and AI and his love for classic R&B which he features on his radio show.

No one is above the law, and everyone has the right to a trial to prove innocence. Hopefully, the former President will peacefully respect the system, which grants him that right.” In response to Pelosi's preposterous claims of a “trial to prove innocence”, Twitter quickly fact checked the statement, citing Cornell Law School: “Ms. Pelosi mistakenly says that Trump can prove his innocence at trial. Law in the US assumes the innocence of a defendant and the prosecution must prove guilt for a conviction.” 3:25pm Attorney Kate Shaw—Law Professor at Yeshica University & an expert on Constitutional Law—appeared on ABC News and seemingly questioned whether Manhattan District Attorney Alvin Bragg has jurisdiction to indict Donald Trump. Smith contends Manhattan District Attorney Alvin Bragg's office has several major hurdles he'll have to clear in order to prove guilt including the character flaws of his star witness, Michael Cohen, who is a disbarred attorney that has pled guilty to lying before Congress. 4:15pm- While appearing on CNN, New York Times journalist Maggie Haberman claimed that indictment and arrest scare Donald Trump. 4:25pm- How much time has network television dedicated towards Biden family corruption allegations? Not much. Including zero coverage from ABC, CBS, and NBC…shocking!
