Tonight, my special guest is Nicole Weisensee Egan who is an award-winning journalist, former senior writer for People Magazine and Bill Cosby's worst nightmare. Get her book Chasing Cosby to read what she uncovered about American's pudding pop hero.   Bill Cosby's decades-long career as a sweater-wearing, wholesome TV dad came to a swift and stunning end on April 26, 2018, when he was convicted of drugging and sexually assaulting Andrea Constand. The mounting allegations against Bill Cosby - more than 60 women have come forward to accuse him of similar crimes - and his ultimate conviction were a shock to Americans, who wanted to cleave to their image of Cosby as a pudding-pop hero.  Award-winning journalist and former People Magazine senior writer Nicki Weisensee Egan was the first reporter to dig into the story when Constand went to the police in 2005. The rapper Tory Lanez has been sentenced to 10 years for the shooting of fellow musician Megan Thee Stallion. She required surgery to remove bullet fragments from her foot after he shot her following a party in 2020. BBC entertainment correspondent Chi-Chi Izundu joins Clare McDonnell to discuss. New research by The Sutton Trust reveals that more than a third of A-level students in England are considering living at home if they get into their preferred university. And in some cases, choosing lower-ranking universities because they are closer to home. Rebecca Montacute, head of research for the Sutton Trust, explains the findings. Hayley Hassall also hears from future student, Lori Cobon, and her mother Rachel. A few months ago, Sarah de Lagarde came on Woman's Hour to share her incredible story of survival. She had fallen on to the Tube tracks at a north London station and was run over by two Tube trains. She lost her right arm and leg as a result. Today, Sarah returns with a newly fitted bionic arm, made possible with the support of a crowdfunding campaign. She speaks to Hayley about her recovery. More than 60 women have made allegations of rape, sexual assault and sexual harassment against the US comedian and actor Bill Cosby. But only one woman, Andrea Constand, was able to gain a criminal conviction. In 2018, he was sent to prison for three to 10 years on three counts of aggravated indecent assault. At the time, it was celebrated as a major win for the #MeToo movement. Less than three years later, he was freed when the Pennsylvania Supreme Court overturned his conviction on a legal technicality. In a new two-part documentary exclusively for ITVX from 10 August, The Case Against Cosby, Andrea tells her story. It's been two years since the Taliban retook power in Afghanistan and during that time women and girls have found many curtailments on their liberty. Dr Nadia Nadim is Afghanistan's most successful and most influential female footballer. She fled to Denmark following the death of her father and has gone on to play for the Danish national team over 100 times. A judge in Texas has ruled that women who experience pregnancy complications are temporarily exempt from the state's abortion bans. The ruling comes after a group of thirteen women and two doctors sued the state of Texas in March of this year, calling for a clarification of the law. However, the injunction is only temporary until the lawsuit is decided - and the state of Texas has appealed the ruling. Dr Emma Long, Associate Professor in American History and Politics at the University of East Anglia, joins Clare McDonnell to explain the significance of the ruling. Author and researcher Dr Julia Ebner has spent the last two years immersed in one of the darkest corners of the internet, the world of incels. She has been pretending to be an unhappily single, unemployed, male in his late 20s who is tired of feminism. This is part of her decade-long work going undercover investigating different extremist movements and how they pose a risk to democracy. Her new book, Going Mainstream, looks at the rapid spread of extremism into our mainstream social and political discourse. Chloe Matharu is an award-winning, singer songwriter and harpist. She has cultural roots in Scotland, Wales and the Punjab, and draws inspiration from her time in the Merchant Navy and the natural world as experienced at sea. Her debut album, Small Voyages, was selected for Celtic Music Radio's Album of the Year. At Celtic Connections she was awarded the revered Danny in February this year. Nicki wrote the book 'Chasing Cosby' and hosted the podcast of the same name.To be clear, in 2018 Bill Cosby was found guilty in a criminal court of law for drugging and sexually assaulting Andrea Constand at his home (three felony counts of aggravated indecent assault). He was sentenced to three to ten years. However, he was released after serving only two years in 2021. He was not exonerated. He was never acquitted. His release had everything to do with a bizarre pre-trial procedural interpretation that his lawyers were able to convince a Pennsylvania Supreme Court to agree with, something Jim weighs in on. Joyce has been an expert witness and the architect of several legislative bills that can radically change how consent is dealt with by our justice system. Nicki documented her investigation in the book Chasing Cosby, which was the basis for her award winning podcast of the same name. More than sixty women made allegations against Cosby across the years. In December 2015, the Montgomery County District Attorney's Office announced it had filed an aggravated incident assault charge in Andrea Constand's case. It took nearly three years and two trials to convict Cosby. He was sentenced to 3-10 years. When Cosby was convicted in 2018, many considered the jury's decision a landmark in the movement to hold alleged sexual predators accountable. In 2018 Bill Cosby was convicted of sexual assault for drugging and molesting Andrea Constand in 2004.  In the summer of 2021, the Pennsylvania Court of Appeals not only reversed the conviction, but instructed the trial court and the Montgomery County DA that they were barred from brining this case to trial again.Typically, when an appeal results in the reversal of a conviction, it means that something pretty significant was done inappropriately during the trial.   So what went wrong here?  Why did the court of appeals not simply remand for a new trial.  Barring any further prosecution is an extreme remedy, but one the highest Pennsylvania court felt was appropriate here.The reason that Cosby cannot be prosecuted ever again for his 2004 actions with Andrea Constand is that the Montgomery County District Attorney at the time promised that he wouldn't, but his successor broke that promise after Cosby relied on his word and suffered in a civil lawsuit as a result.This episode looks at whether a DA can, should or must be held to their word when they make affirmative promises.  We also discuss what a DA will consider when making a decision as to whether or not there is enough evidence to pursue a prosecution and how the statute of limitations works.Because this episode had a lot of complex issues, it runs a bit long because Paul did not want to cut any explanations too short.  If, as a listener, you're okay with extending these episodes a bit, please write Paul at insummationpodcast@gmail.com or contact him via his website insummation.com and let him know if you want the episodes to run 45-50 minutes or if you'd prefer they were kept to the 35 minutes or so they typically run now.Thanks for listening! The Pennsylvania Supreme Court reversed the conviction of Bill Cosby for the rape of Andrea Constand in a stinging rebuke of Commonwealth prosecutors. The Court ruled that prosecutors cannot retry Cosby, now 83. By the time you read this, he should be a free man. Cosby was tried twice for the rape of Ms. Constand.  When the first trial ended in a hung jury, with no unanimous verdict, Pennsylvania tried again, adding more witnesses. The second trial resulted in a conviction. But fatal to both trials, the Pennsylvania Supreme Court ruled, was the use of evidence the Commonwealth promised Cosby it would never use. In 2005, Ms. Constand claimed Cosby had raped her one year earlier. Prosecutors investigated the claim and found it wanting. Because they did not think they could get a conviction, they encouraged Ms. Constand to sue Cosby civilly. In order to eliminate any use of the fifth amendment privilege against self-incrimination, prosecutors agreed never to prosecute Cosby for a crime. Ms. Constand sued, Cosby testified at a deposition, and the case settled for north of $3 million. At his criminal trials a decade later, prosecutors used his deposition testimony against him. In other words, they induced him to waive his right to remain silent and then used his own words to help convict him. When challenged at the trial level, prosecutors claimed that the agreement they reached was informal. The Pennsylvania Supreme Court wasn't buying that sorry tune today. In a stinging rebuke, it reminded prosecutors of the obvious: they are ministers of justice. In this case, they behaved unjustly. Bill Cosby's sexual assault conviction was thrown out Wednesday by Pennsylvania's highest court in a ruling that swiftly freed the actor from prison more than three years after he was found guilty of drugging and molesting Temple University employee Andrea Constand at his suburban Philadelphia mansion.Cosby, 83, was the first celebrity tried and convicted in the #MeToo era, and his conviction was seen as a turning point in the movement to hold powerful men accountable for sexual misconduct.Here's a look at the case against Cosby and the court's decision:WHY DID THE COURT TOSS HIS CONVICTION?The split court found that Cosby was unfairly prosecuted because the previous district attorney had promised the comedian once known as "America's Dad" that he wouldn't be charged over Constand's accusations. Cosby was charged by another prosecutor who claimed he wasn't bound by that agreement.The court said that's not the case. The justices found that Cosby relied on that promise when he agreed to testify without invoking his Fifth Amendment right against self-incrimination in a lawsuit brought against him by Constand.The court concluded that prosecutor who later brought the charges was obligated to stick to the nonprosecution agreement, so the conviction cannot stand. The justices wrote that "denying the defendant the benefit of that decision is an affront to fundamental fairness, particularly when it results in a criminal prosecution that was foregone for more than a decade."WHAT'S THE DEAL WITH THE NONPROSECUTION AGREEMENT?The promise not to prosecute Cosby was made in 2005 by Bruce Castor, who was then the top prosecutor for Montgomery County. Castor was also on the legal team that defended former President Donald Trump during his historic second impeachment trial over the Jan. 6 insurrection at the U.S. Capitol by his supporters.During a court hearing weeks after Cosby's 2015 arrest, Castor testified that he promised Cosby he wouldn't be prosecuted in the hopes that it would persuade the actor to testify in a civil case brought by Constand and allow her to win damages. Castor acknowledged the only place the matter was put in writing was in the 2005 press release announcing his decision not to prosecute, but said his decision was meant to shield Cosby from prosecution "for all time."His successor noted, during the appeal arguments, that Castor went on to say in the press release that he could revisit the decision in the future.Castor had said that Constand's case would be difficult to prove in court because she waited a year to come forward and stayed in contact with Cosby.The first jurors who heard the case may have agreed with him, as they could not reach a verdict in 2017. But a second jury empaneled after the #MeToo movement exploded found him guilty at his 2018 retrial. Constand settled her civil case against Cosby for more than $3 million.Castor's successor, District Attorney Kevin Steele, charged Cosby in 2015 after a federal judge, acting on a request from The Associated Press, unsealed documents from her 2005 lawsuit against Cosby, revealing his damaging testimony about sexual encounters with Constand and others. Castor has said Cosby "would've had to have been nuts to say those things if there was any chance he could've been prosecuted."HOW RARE IS THIS?Extremely rare.Wesley Oliver, a Pennsylvania law professor who has followed Cosby's case closely over the years, said he has never heard of a high court in Pennsylvania or anywhere else grappling with a prosecutor's informal promise not to prosecute."It breaks new ground entirely," said Oliver, who teaches at Duquesne University School of Law in Pittsburgh. Bill Cosby has been freed from prison after Pennsylvania's highest court overturned his sexual assault conviction.In a stunning reversal of fortune for the comedian once known as "America's Dad," the state Supreme court ruled that the prosecutor who brought the case was bound by his predecessor's agreement not to charge Cosby.Cosby, 83, has served nearly three years of a three- to 10-year sentence after being found guilty of drugging and violating Temple University sports administrator Andrea Constand at his suburban Philadelphia home in 2004. He was the first celebrity tried and convicted in the #MeToo era.Bill Cosby's Twitter account released this photo of the comedian inside jail earlier in his sentence. Cosby has served more than two years of a three- to 10-year sentence at a state prison near Philadelphia. He had vowed to serve all 10 years rather than acknowledge any remorse over the 2004 encounter with accuser Andrea Constand.  Cosby was charged in late 2015, when a prosecutor armed with newly unsealed evidence -- Cosby's damaging deposition from her lawsuit -- arrested him days before the 12-year statute of limitations expired.  Justice David Wecht said that overturning the conviction, and barring any further prosecution, "is the only remedy that comports with society's reasonable expectations of its elected prosecutors and our criminal justice system."  The 83-year-old Cosby, who was once beloved as "America's Dad," was convicted of drugging and molesting the Temple University employee at his suburban estate.  Mark explains how this all unfolded.

Then, investigative reporter Leonard Levitt explores a high court's sensational ruling to vacate Kennedy family cousin Michael Skakel's murder conviction — leaving the family of victim Martha Moxley reeling, and still without justice after she was beaten to death in 1975. Twenty-three years after he murder, a grand jury was convened, and two years after that Skakel was finally indicted for the crime. He was sentenced to 20 years to life. Skakel was then granted a new trial in 2013, however, based on mistakes by his trial lawyer, and remained free since, after posting a $1.2 million bond. Sixteen months ago, the Connecticut Supreme Court reinstated the conviction, but then reversed itself and granted Skakel freedom. So if Skalel didn't do it, who did?

(CNN)Bill Cosby said he had sexual relationships with at least five women outside his marriage, gave prescription sedatives to women he wanted to have sex with and tried to hide the affairs from his wife, according to a court deposition obtained by CNN. The deposition, first reported by the New York Times,was taken 10 years ago and stems from a civil lawsuit filed by Andrea Constand -- one of two dozen women who have publicly accused the comedian of sexual assault over four decades, often alleging he gave them some sort of drug without their knowledge. CNN independently obtained a copy of the full deposition.Cosby, 78, has never been criminally charged and has vehemently denied wrongdoing. In the deposition he says the sex and drug-taking were always consensual.
