One of the most frequently asked and hotly debated topics when it comes to incidents of sexual harassment has to do with Intent. People often ask, "What if someone did not intend to harass? What if the action was accidental, unintentional, or the person meant well?" In this month's episode, we take a deep dive into the topic of Intent vs Impact - what is relevant and why? Talking to us in about this theme is advocate, trainer, PoSH expert and SASHA team member Shweta Luthra. About Shweta: Shweta Luthra is a lawyer enrolled with the Bar Council of Karnataka. She has a BA LLB (Hons.) from the West Bengal National University of Juridical Sciences, and an MSc in Criminology and Criminal Justice from the University of Oxford. She is also pursuing a PhD at the University of Leicester, researching on the socio-legal aspects of fitness to stand trial of mentally disordered defendants in English and Indian courts. In affiliation with SASHA, Shweta has worked with nearly 50 organisations pan India, and currently provides support to over 20 organisations. Shweta covers an employee base of over 50,000 personnel for clients based in Bangalore, Hyderabad, Delhi NCR, Chennai, Mumbai, Kolkata, Goa, Pune and Kochi, amongst others. Shweta has conducted over 350 sessions, to sensitise employees on the prevention of sexual harassment at the workplace; to train Internal Committees on how to conduct inquiries; and to assist leadership teams in conducting risk assessments and putting in place policies to prevent such occurrences. Shweta acts as an external member on Internal Committees across India, and has handled over 150 cases. One of the most discussed themes nowadays in the area of workplace sexual harassment prevention is the trauma-informed approach. What is it, why are we talking about it, and how can we adopt it in PoSH? We're excited to the discussing this topic in this month's episode with our guest Dr.Anagha Sarpotdar. About our Guest: Anagha Sarpotdar is a practitioner and researcher working on social and legal aspects of sexual harassment at workplace. She has PhD degree in Social Sciences from Tata Institute of Social Sciences (TISS). Her PhD research was focused on social and legal aspects of sexual harassment at workplace. Her article on Sexual Harassment at Workplace published by EPW in November 2016 has found place in documentation namely Parliamentary Documentation done by Parliament of India. She was appointed as Chairperson of the Local Committee constituted by the District Women and Child Development Department, Government of Maharashtra and District Collector Office, Mumbai City under Sexual Harassment of Women at Workplace (PPR) Act, 2013 in 2018 and again in 2021. Sreevidya is also a subject matter expert for Code of Business Ethics Violations and is the expert member for several Ombud's Committees and 35 Internal Committees for redressal of sexual arassment. She regularly conducts trainings on conducting workplace investigations and sexual harassment inquiries. She has helped organisations set up policies, SOPs and develop an internal investigations programme. In addition to her educational and professional background, she holds membership with ACFE (Association of Certified Fraud Examiners) and Association of Workplace Investigators. She is the first person from India to attend AWI's Training Institute for Workplace Investigators, and hold ANSI accredited Certificate in Workplace investigations. About Kanti: With masters in law and sociology, Kanti Joshi is qualified to handle the sensitive matter of sexual harassment from a socio-legal perspective. As an External Member on the Internal Committees she supports around 30 workplaces and provides hand-holding support in conducting Inquiry into complaints of sexual harassment. Kanti has conducted about 630 awareness sessions on prevention of sexual harassment (POSH) at the workplace in both English and Kannada at various levels. She has managed POSH Campaigns, organised workshops, designed trainings, developed online modules and is invited as a speaker on POSH (Prevention of Sexual Harassment) in seminars/conferences. Studies upon studies show the significant impact the experience of sexual harassment can have on mental health and well-being. Sexual harassment can put its victims under severe mental and physical stress, leading to grave mental health consequences including depression, anxiety, stress, post-traumatic stress disorder, suicidal ideations, adjustment disorders, phobic and somatoform disorders. On the other side of this perspective, when the process of inquiry isn't fair, transparent and confidential, it can also impact Respondents, Witnesses and other Stakeholders. On 12th March, SASHA launched Connecting Voices - A SASHA Circle, our first close circle event. The topic for discussion was mental health and POSH at the workplace. The event focused on listening, discussing and sharing experiences around the social and psychological impacts of sexual harassment on complainants, respondents, witnesses, colleagues and family members. We had three speakers who shared their valuable insights on the theme. Our speakers were Dr. Sunita Simon, Professor, Dept of Psychiatry and Head of the Dept of Medical Ethics, St Johns Hospital, Bangalore, Dr. Preeti Majgi, clinical psychologist and social counsellor at Robert Bosch Engineering and Business solutions, Bangalore and Ms. Pavitra Jayaraman, Editorial Head at White Swan foundation, a non-profit working on mental health awareness. This was followed by Q&A and one sharing around the experience of sexual harassment in the virtual sphere. In this episode, we'll be talking about the highlights of this event. About Shweta: Shweta Luthra is a lawyer enrolled with the Bar Council of Karnataka. She has a BA LLB (Hons.) from the West Bengal National University of Juridical Sciences, and an MSc in Criminology and Criminal Justice from the University of Oxford. She is also pursuing a PhD at the University of Leicester, researching on the socio-legal aspects of fitness to stand trial of mentally disordered defendants in English and Indian courts. In affiliation with SASHA, Shweta has worked with nearly 50 organisations pan India, and currently provides support to over 20 organisations. Shweta covers an employee base of over 50,000 personnel for clients based in Bangalore, Hyderabad, Delhi NCR, Chennai, Mumbai, Kolkata, Goa, Pune and Kochi, amongst others.
