County executives dispute federal designation Officials from Dutchess and Putnam counties say they should not be listed with New York State and other localities, including Beacon, on a roster of jurisdictions the Department of Homeland Security accuses of "obstructing" the Trump administration's effort to deport millions of undocumented immigrants. The list, released on Thursday (May 29) to comply with a presidential order, includes more than 500 jurisdictions, including New York state, 15 of its counties and 12 of its cities, identifying them as "sanctuaries" for immigrants who live in the country without authorization. [Update: the list was removed by DHS as of June 1 but is archived here.] Those states and municipalities, including Orange and Westchester counties and Newburgh and Poughkeepsie, are accused by the DHS of "deliberately and shamefully obstructing" federal immigration enforcement and protecting "dangerous criminal aliens." The agency demands that they "immediately review and revise their policies to align with federal immigration laws," but also cautions that the list is subject to change and "no one should act on this information without conducting their own evaluation" of the municipalities. Many municipalities have disputed their inclusion on the list, including Putnam and Dutchess counties. On Friday (May 30), Kevin Byrne, the Putnam executive, said: "Let's set the record straight: Putnam County is not a sanctuary county and never will be on my watch as county executive. We have consistently worked with our partners in law enforcement and encourage the continued collaboration and sharing of information with all federal, state and local law enforcement." Despite Putnam being named by DHS as a sanctuary jurisdiction, Byrne also on Friday posted on Facebook a video in which he accuses "liberal journalists at the Wall Street Journal," which published a story about the agency's announcement, of "inaccurately" adding Putnam to the list "before gathering all the facts." He added that "the bias media is wrong and needs to get the facts straight." In Dutchess, County Executive Sue Serino said on Friday that the county has contacted its federal representatives - Sens. Kirsten Gillebrand and Chuck Schumer and U.S. Rep. Pat Ryan - "for further clarity" and help getting the county removed from the list. "It is unclear how this list was developed, as DHS has not contacted us with any concerns, and the Dutchess County Legislature has never adopted any resolution relating to sanctuary jurisdiction," said Serino. On Monday (June 2), Beacon Mayor Lee Kyriacou read a statement at the City Council meeting: "It is absolutely not the case that the city is deliberately obstructing the enforcement of federal immigration laws. While the city has yet to receive any formal communication from the federal government, we remain confident the city is abiding by all applicable state and federal laws and judicial orders. Our city and our Police Department remain committed to protecting public safety, and any statements to the contrary are misleading and inaccurate." Neither Dutchess or Putnam has approved policies limiting cooperation with federal immigration authorities, and Dutchess sued New York City in 2023 when it began contracting with hotels in the Hudson Valley to house immigrants. That same year, Byrne and the Putnam Legislature adopted a resolution declaring the county a "rule of law" jurisdiction and pledging cooperation with federal immigration officers to identify "arrested felons and gang-associated" individuals suspected of being in the country illegally. Beacon restricted its role in immigration enforcement during the first Trump administration, when the City Council in April 2017 unanimously passed a resolution declaring the city to be "welcoming, safe and inclusive." Its resolution deliberately avoided the word sanctuary (Trump had threatened to withhold funding from "sanctuary cities") but said that city employees and...

But planned drive-thru may not be allowed The Beacon Planning Board on Tuesday (March 11) approved a developer's proposal to convert a building at 420 Fishkill Ave. to a Dunkin' coffeehouse with a drive-thru, although the City Council is considering a law that would ban drive-thrus. The project, which will include other retail and apartments, has for months intersected with an ongoing city study of Fishkill Avenue. In early 2024, Mayor Lee Kyriacou appointed a citizen committee to study a mile-long stretch of the corridor and make recommendations regarding zoning, streetscapes and accessibility, among other questions. In November, Jay Healey, a member of the committee, brought an application to the Planning Board to transform the site of his family's former Ford dealership to the Dunkin' building. Two weeks later, the council asked the Fishkill Avenue committee for its early zoning recommendations. To move away from auto-related uses, it suggested that the council ban any new self-storage facilities, drive-thrus, gas stations, car washes, auto lots and repair shops. J.C. Calderon, the committee chair, said that its members had not all agreed but that the recommendations were informed by public feedback, including a survey. On Jan. 27, City Attorney Nick Ward-Willis told the council that the Dunkin' project would be regulated by whatever zoning is in place when a foundation is poured and "something substantial has come out of the ground." After approving the application on Tuesday, Planning Board members discussed the council's draft law, which would only ban new self-storage and drive-thrus. They said that drive-thrus could work in the Fishkill Avenue corridor but they would need more time to thoroughly review the idea. They did not favor "categorical prohibition" of the two uses. 45 Beekman St. The Planning Board continued a public hearing Tuesday on an application to construct two 4-story buildings with 64 one- and two-bedroom apartments on Beekman Street at its intersection with Route 9D. The project, which has been reviewed for more than a year, would include 15,000 square feet of commercial space and 91 off-street parking spaces. The feedback provided by neighbors was critical, with several people asking the Planning Board to send the developer "back to the drawing board." A Cliff Street resident said she was committed to Beacon's continued growth but "strenuously opposed" to the Beekman proposal. "It is simply too much construction for too little space," she said, noting that many cities "would love to have the character and personality that we have," but "this project is out of keeping with the unique historic character and look and feel" of Beacon. The board will continue the public hearing next month. 291 Main St. The Planning Board also held a public hearing on plans to construct a three-story addition in the alley adjacent to the two-story Telephone Building at 291 Main St. The third story would be set back from the second-story facade, and the addition would feature commercial space on the ground floor with three apartments on the second and third floors. Planning Board members cited "self-imposed" issues with the design, with Kevin Byrne suggesting that the Main Street frontage on the addition be reduced to one story. He said he is "very skeptical about [the project] unless some major changes are made." Karen Quiana said the plans call for too much construction on the South Brett Street side of the building. "It feels like there's a little too much stuffing for the taco there," she said. Several residents made similar statements. A South Brett Street neighbor lamented former owner Deborah Bigelow's yearslong restoration of the historic building, saying, "I hope she doesn't know what's going on. That's my secret hope." The hearing will continue next month.

County executive lawsuit cost $52,300 An aborted lawsuit filed by the Putnam County executive against the Legislature cost more than $50,000 and accounted for one-third of a request by the Law Department for more money to pay outside law firms. After Amy Sayegh, who chairs the Legislature and its Audit Committee, criticized the spending as excessive, the committee voted Monday (Jan. 27) to delay until February the department's $150,000 request. Michael Lewis, the finance commissioner, said the Law Department already received $200,000 after exhausting its $300,000 budget in 2024 for outside counsel. He said a "good amount" of the billing was from Harris Beach, a firm defending the county in a lawsuit filed by the contractor hired to reconstruct the intersection of Oscawana Lake and Peekskill Hollow roads in Putnam Valley. Another firm, Murtagh, Cossu, Venditti & Castro-Blanco, based in White Plains, billed the county $52,300 for representing Kevin Byrne in his lawsuit against the Legislature. He sued over a law that amended the county charter so lawmakers can fire he county attorney at will and a resolution that allowed them to hire their own attorney without Law Department approval. Byrne dropped the lawsuit on Dec. 18, citing its projected cost. "That's where the money's being spent," said Legislator Paul Jonke (R-Southeast), on Monday. "That's where the money's being wasted." Sales tax extension The three legislators on the Audit Committee on Monday weighed Byrne's request to ask the state for authorization to renew a 1 percent sales tax increase that will otherwise expire on Nov. 30. Putnam residents pay 8.375 percent on purchases - 4 percent in state tax, 4 percent to the county and 0.375 percent to the Metropolitan Commuter Transportation District. The Putnam tax has been 4 percent since 2007, when the state renewed a previous 0.5 percent increase and allowed the county to raise the rate by another 0.5 percent. A series of extensions, most recently in 2023, have kept the rate at 4 percent. Legislator Dan Birmingham (R-Mahopac), who chaired the Legislature in 2007, said sales tax and other revenue were "tanking" at the time while expenses rose. Today, he noted, the county has $134 million in savings, including $78 million that has not been budgeted. Birmingham, who left the Legislature in 2012 but returned this month after winning a seat in November, suggested the Legislature ask the state for a 0.5 percent increase, which would lower the tax to 3.5 percent, to "return some of that fund balance directly back to the taxpayers." In a memo addressed to legislators, Lewis advocated for 1 percent, which equates to about $22 million annually, or 25 percent of the $88 million collected in 2024. Those revenues allowed the Legislature to exempt sales tax on clothing and footwear under $110 and reduce its property tax levy and cut tax rates, he said. "All these accomplishments would be jeopardized if Putnam County failed to extend its existing rate," Lewis said.
