In this special edition we look back at a giant of the American Justice System. Laurence Silberman is a man most people, including me, had probably never heard of unless you were knowledgeable about the law. I was introduced to him because he was on a panel examining the massive evidence of prosecutorial misconduct that the 2013 Freedom of Information Act lawsuit by Geoff Shepard had uncovered. It was a symposium on the papers of Watergate hosted by The Federalist Society. That Symposium will be featured on our podcast all next week. The legal experts that are participating in that symposium are impressive to say the least. we are honored that The Federalist Society has granted our show permission to share the event with you. Sadly, just over two weeks after the symposium Judge Silberman passed away at age 86. The suddenness of his passing had me curious to learn more about him, when I did , I realized that this man was an impressive one. In this episode, we will hear from Judge Laurence Silberman on a range of topics including, his role in protecting the second amendment in a ruling that struck down the Washington D.C. gun policy, his thoughts on free speech in this modern age, the Rowe v Wade decision, His thoughts on the court system, the number of lawyers in the United States, and his role as a co-chair on the special committee that looked into the second Gulf War and how we got involved in it. This is one fascinating episode about one of the most fascinating individuals in modern American History and a man that almost no one in the general public has even heard of, until now. Ketanji Brown Jackson is an American attorney and jurist who has served as a United States Circuit Judge of the United States Court of Appeals for the District of Columbia Circuit since 2021. She is an associate justice-designate of the Supreme Court of the United States. Prior to her confirmation to the Supreme Court, Jackson was a judge on the United States Court of Appeals for the District of Columbia Circuit. Jackson was nominated to the court by President Joe Biden on April 19, 2021, and confirmed by the United States Senate on June 14, 2021, by a vote of 53-44. She was previously a federal judge on the United States District Court for the District of Columbia. Despite the fact that Title VI of the Civil Rights Act of 1964 prohibits racial discrimination by schools that receive federal funding, racial preferences are being applied in admissions at many colleges and universities for the purpose of enhancing diversity. More recently, in light of this renewed emphasis on and interest in student diversity, the application of racial preferences in student admissions in higher education is having a trickle-down effect in admissions at prestigious magnet, charter and private secondary schools as well, many of which are discarding merit and test-based admissions policies in the name of diversity. Jon O. Newman is a United States Circuit Judge of the U.S. Court of Appeals for the Second Circuit. He assumed senior status in 1997. Currently Of Counsel to The Lanier Law Firm, Ken served as president and chancellor of Baylor University and dean of the Pepperdine School of Law. He continues to teach law, write articles of interest, and serves as a commentator for Fox and various radio programs. He serves on the boards of Advocates International and the Christian Legal Society as well as the Advisory Board of Alliance Defending Freedom. Throughout his professional career, he has championed the cause of religious liberty and freedom of conscience for all persons. Ken has argued 36 cases before the U.S. Supreme Court, including during his service as U.S. Solicitor General. He served as United States Circuit Judge for the District of Columbia Circuit, as Counselor and Chief of Staff to U.S. Attorney General William French Smith, and law clerk to both Chief Justice Warren E. Burger and to Fifth Circuit Judge David W. Dyer. He was appointed to serve as Independent Counsel for five investigations, including Whitewater, from 1994 to 1999. He is author of Religious Liberty in Crisis (published April 2021); plus First Among Equals:The Supreme Court in American Life; Bear Country:The Baylor Story; and Contempt:A Memoir of the Clinton Investigation (a NY Times best seller in 2018). He and his wife Alice have been married since 1970 and live in Waco, Texas. They are blessed with three children and eight grandchildren.

Mr. Kavanaugh is a United States Circuit Judge of the United States Court of Appeals for the District of Columbia Circuit. He previously served as White House Staff Secretary during the presidency of George W. Bush. Mr. Kavanaugh is a strong family man, married with two daughters. He is also a very active member of his faith community (Catholic) and takes time out of his busy schedule to serve the homeless. Let’s face it, when it comes to Supreme Court nominees, the pro-life community has had more than ample reasons for caution and concern. When a new nominee like Judge Kavanaugh is presented, it’s wise to take the time and consider if there are any concerns in their record or body of work. For all intents and purposes, there is nothing to report when it comes to Mr. Kavanaugh’s record, in fact, there is plenty to get excited about! Looking at his record on abortion, free speech, and religious liberty it seems like the pro-life community is getting quite the upgrade from Justice Kennedy! Rest assured, Judge Kavanaugh seems to be a perfect nominee that’ll go to work fulfilling President Trump’s promise to appoint pro-life justices to the highest court in the land. Good news, the pro-abortion crowd HATES Judge Kavanaugh. As nice as it would be to see a Supreme Court nominee of Judge Kavanaugh’s caliber warmly accepted by all of our nation's leaders, it’s helpful to remember that there is a reason why he’s facing early opposition. It doesn’t take much research to find that Mr. Kavanaugh is almost universally opposed by Democrats and anyone who calls themselves “Pro-choice.” Just because he’s facing opposition from the other side doesn’t mean he should automatically get a pass when it comes to criticism and critique from the pro-life community but it is a good sign! While it’s not a slam dunk, Judge Kavanaugh’s chances are good. As the initial excitement over Judge Kavanaugh winds down, it’s a good time to examine and consider his chances when it comes to confirmation. Just a quick reminder, when it comes to filling a Supreme Court vacancy, it’s the President’s responsibility to nominate a candidate and it’s the United States Senate’s job to approve or reject that nominee by a simple majority vote. While it’s no slam dunk, the way things look to be playing out in the U.S. Senate seems to indicate that Mr. Kavanaugh will make it through the confirmation process to be seated as the next Supreme Court Justice. Now is not the time to celebrate! If you live in a swing state, make sure to contact your representative in the U.S. Senate and press them to support Judge Kavanaugh!
