Today on the podcast, Robin and Lester interview former US Deputy Attorney General Larry Thompson   Larry D. Thompson is the former U.S. Deputy Attorney General (2001-2003), the second highest ranking position in the U.S. Department of Justice. In a distinguished public and private sector career over more than three decades, Mr. Thompson also has prosecuted complex cases as U.S. Attorney for the Northern District of Georgia, directed internal investigations and defended individuals and businesses in special matters as a partner in a major law firm, and served as General Counsel and Senior Vice President of PepsiCo, Inc. During his tenure as Deputy Attorney General, Mr. Thompson led the Department of Justice's National Security Coordination Council, as well as the government-wide Corporate Fraud Task Force. In 2000, Congress selected Mr. Thompson to chair the bi-partisan Judicial Review Commission on Foreign Asset Control. In 2004, he served as a Senior Fellow with the Brookings Institution in Washington, D.C. Prior to serving as U.S. Deputy Attorney General, Mr. Thompson was a partner with the Atlanta-based law firm of King & Spalding, LLP, and was co-founder of the firm's special matters and government investigations practice. He previously served as U.S. Attorney for the Northern District of Georgia from 1982 to 1986. From 1995 to 1998, he served as Independent Counsel for the Department of Housing and Urban Development Investigation. Most recently, Mr. Thompson served as Senior Vice President for Government Affairs and General Counsel for PepsiCo.  He joined Finch McCranie LLP as Counsel in July 2015 and continues to serve as the John A. Sibley Professor of Corporate and Business Law at the University of Georgia. In the early hours of January 14, 2024 the Department of Justice released its long-awaited election interference report against President-elect Donald Trump. It was a long and winding road to that moment—and one marked, ultimately, by justice delayed. In November 2022, Attorney General Merrick Garland appointed Jack Smith as special counsel to oversee criminal investigations by the Justice Department into former President Donald Trump's efforts to overturn the 2020 election and his retention of classified documents. The two cases were brought in different jurisdictions—with charges for the classified documents case filed in Florida and the elections case in Washington, D.C. After false starts, the blockbuster Supreme Court ruling on July 1, 2024 that former President Trump is entitled to some immunity from criminal prosecution for actions taken to overturn the results of the 2020 election, and the subsequent re-election of Trump in November, Smith and the DOJ dropped both cases. EPISODE 221: COUNTDOWN WITH KEITH OLBERMANN A-Block (1:40) SPECIAL COMMENT: The UK newspaper "The Independent" reports Trump may be indicted as early as tomorrow for violations of the Espionage Act, specifically 18 U-S Code 793, Gathering, Transmitting or Losing Defense Information, a part of the act that does NOT require the actual documents in question to be CLASSIFIED – a deliberate choice by prosecutors, a strategic one, which thus completely ERASES Trump's defense that whatever he stole, he had somehow DE-classified it by blinking three times in succession or throwing ketchup at a particular White House wall. Those guilty of violations of 18 U-S Code 793, quote, “shall be fined under this title or imprisoned not more than ten years or both” and the Independent Counsel's Grand Jury will be asked to vote an indictment against Trump for violating 793 as early as TOMORROW, with the caveat that “that vote could be delayed as much as a week until the next meeting of the grand jury to allow for a complete presentation of evidence, or to allow investigators to gather more evidence for presentation if necessary” unquote. “The Independent” reports emphasizes that an indictment on ONE charge from 18 U-S Code 793 is far from all of it – that Trump may also be indicted on OTHER counts within the Espionage Age umbrella, AND potentially for Obstruction of Justice, AND that Jack Smith's mysterious FLORIDA Grand Jury is still operating and further indictments could emanate from there. The Washington Post in fact reports that the BULK of indictments could come from the Miami Grand Jury, which could give us a scenario in which there is ONE indictment in Washington tomorrow or next week, and many more from Florida in the weeks to come. The Independent's White House correspondent Andrew Feinberg adds that Mark Meadows DID flip, so, told you so. Quote: “It is understood that the former North Carolina congressman testified as part of a deal for which he has already received limited immunity in exchange for his testimony. A source who was briefed on the agreement claimed that the alleged agreement will involve the ex-chief of staff entering pleas of guilty to unspecified federal crimes.” The Independent says Meadows attorney George Terwilliger said the guilty plea story is quote “complete bull(spit)”but would NOT answer questions about immunity or testimony. B-Block (8:47) POSTSCRIPTS TO THE NEWS: CNN fired Chris Licht - at dawn - in Central Park - explains what caused all the damn SMOKE here. He was fired for being a schmuck. He should've been fired for not understanding that the cable news "middle" he pursued doesn't exist, will never exist, hasn't existed for 25 years. Journalism and "advocacy" and profits can all be made. You just have to be what he wasn't: Good At It. (18:50) NOTE: The remainder of this bulletin is from Wednesday's original podcast: Mark Meadows has flipped. There's no other possible conclusion. The news has been coming for weeks. Per ABC, Meadows testified to the Jack Smith Election Grand Jury and to the Jack Smith Documents Grand Jury. And 20 members of the Trump Secret Service detail - past or present - have been subpoenaed to testify in Washington, while we begin to see what the third Smith Grand Jury in Miami is all about and how it might but Trump on trial there and not Washington. He made social media posts demanding that his thugs "fight" to prevent his indictment, just as he told the crowd on the Ellipse in Washington on January 6 to "fight" the certification. Dismiss Trump and his animal-like cunning and destructive skill at your peril and OUR peril. What you think you see in him is as bad as you think it is. Or worse. Always. Always. On January 6th. Yesterday. The Truth Social posts were made in hopes of getting somebody to attack Jack Smith or Merrick Garland or someone. The Trump thinking is not complex: "This other creature is in my way. The Federal Reserve cannot keep up with controlling the monetary side of Biden's policy because the fiscal side of his spending is so out of control and will only add to inflation. Later, those criticizing 'forever wars' citing Ukraine as 'none of our business' doesn't understand U.S interests abroad. it's one thing to disagree with the accounting of funds disbursed, but it's another to say we should surrender our position against genocidal maniacs. Afterward, US Sen. Marsha Blackburn joins the show to express her disdain for the Biden Administrations' tacit support for Iran's nuclear weapons program. This extremely contemporary controversy will be the subject of a special debate. Opponents of the independent prosecutor system charge that it violates the doctrine of separation of powers by removing a purely executive function from responsibility to the executive branch, and that it also violates traditional standards of fairness by politicizing criminal prosecution and by creating incentives to find a crime to fit the suspect rather than a suspect to fit the crime. Defenders of the statute hold that it is unrealistic to expect the executive branch to police itself and that there is both textual and historical support for Congress' constitutional authority to set up such a system.

Currently Of Counsel to The Lanier Law Firm, Ken served as president and chancellor of Baylor University and dean of the Pepperdine School of Law. He continues to teach law, write articles of interest, and serves as a commentator for Fox and various radio programs. He serves on the boards of Advocates International and the Christian Legal Society as well as the Advisory Board of Alliance Defending Freedom. Throughout his professional career, he has championed the cause of religious liberty and freedom of conscience for all persons. Ken has argued 36 cases before the U.S. Supreme Court, including during his service as U.S. Solicitor General. He served as United States Circuit Judge for the District of Columbia Circuit, as Counselor and Chief of Staff to U.S. Attorney General William French Smith, and law clerk to both Chief Justice Warren E. Burger and to Fifth Circuit Judge David W. Dyer. He was appointed to serve as Independent Counsel for five investigations, including Whitewater, from 1994 to 1999. He is author of Religious Liberty in Crisis (published April 2021); plus First Among Equals:The Supreme Court in American Life; Bear Country:The Baylor Story; and Contempt:A Memoir of the Clinton Investigation (a NY Times best seller in 2018). Ethical Lawyers Should Not Take Advantage of Right to Independent Counsel Consider Center Foundation v. Chicago Insurance Co., 227 Cal. App. 3d 547, 278 Cal. Rptr. 13 (Cal.App.Dist.2 02/05/1991) The Center for Feeling Therapy and its therapists were sued for medical malpractice and on various intentional tort theories. One of the Center's insurers, Chicago Insurance Company, following a partially directed verdict in favor of the insureds sued to avoid payment of independent counsel selected by the insured. The Center and its therapists were sued by at least 50 former patients in over a dozen lawsuits alleging a variety of intentional torts and professional malpractice. The former patients claimed they had been subjected to violence and psychological coercion to compel them to donate their services and their money to the Center and they sought more than $300 million in damages for the harm done to them. Because of the conflict created by the carriers= reservation of rights, many of the defendants retained their own attorneys. Following the Cumis decision in December 1984 (San Diego Federal Credit Union v. Cumis Ins. Society, Inc., supra, 162 Cal. App. 3d 358), the Woldenberg group renewed its demand for a defense under the control of Barash & Hill. The Woldenberg group, acting through Barash & Hill, concurrently Adischarged@ Fonda & Garrard, the firm retained by Chicago, and demanded that Fonda & Garrard cease all work on the Rains cases. Barash & Hill=s fees included billings by a single attorney for more than 24 hours in a day and for 78 hours over a four‑day period. Paralegals and secretaries were sometimes billed as attorneys, at attorney rates. Time spent on noninsured cases was billed to Chicago. Several witnesses described Barash & Hill's bills as "unconscionable," "unreasonable," "utterly inconceivable," "absolutely outrageous" and "way out of bounds." In the appellate court's view, the duty of good faith imposed upon an insured includes the obligation to act reasonably in selecting as independent counsel an experienced attorney qualified to present a meaningful defense and willing to engage in ethical billing practices susceptible to review at a standard stricter than that of the marketplace. --- Support this podcast: https://anchor.fm/barry-zalma/support

Over 25 years ago, Ken Starr was appointed to investigate Bill and Hillary Clinton's role in the Whitewater scandal. The probe into the Arkansas real-estate deal would eventually expand in to other controversies involving President Clinton. Five years after it started, Starr's report would lead to impeachment hearings that divided the country. This week, the Democrats continued to ramp up their impeachment inquiry into President Donald Trump, subpoenaing more members of his administration and holding a closed-door deposition on Friday with Marie Yovanovitch, the former American ambassador to Ukraine. Earlier this week, the former Independent Counsel joined Fox News Rundown host Jessica Rosenthal to look back at his role in the Clinton impeachment and how that period in history compares to the current investigation into the President. On Tuesday's segment, Starr said he believed President trump showed “poor judgment” during his now infamous call with Ukrainian President Volodymyr Zelensky. However he does not think his behavior justifies an impeachment hearing that he feels will only divide the country and distract it from solving more pressing problems. “Impeachment is hell,” Starr said. “We should not be putting the country through this.” Starr says one lesson Democrats and all Americans should have learned from the Clinton impeachment is that American voters do not want their elections overturned. Even if the president has committed a felony.  Juanita Broaddrick is a retired registered nurse and former nursing home owner.   In 1999, she burst into the public consciousness when she accused President Bill Clinton on national television of raping her as he ran for Governor of Arkansas.  It was a TV appearance she dreaded but felt compelled to come forward after being deposed by Independent Counsel regarding the events of April 25, 1978.   The NBC Dateline interview, however, was held by NBC until after the Impeachment hearing was over and finally aired two weeks later opposite the Grammy Awards.After the trauma of relating the horrific events on national TV, Juanita wanted nothing more to do with the media and faded from the public eye until the Presidential Campaign of 2016.    It was then she heard about a tweet Hillary Clinton had made late in 2015.  Hillary tweeted, "I want to send a message to every survivor of sexual assault.  Don't let anyone silence your voice. You have the right to be heard.  You have the right to be believed….and we're with you".   Juanita could stay quiet no longer, remembering how she and the other victims of Bill Clinton had been harassed and threatened by Hillary Clinton. She asked her grandson to show her how to use Twitter.On January 6, 2016, Juanita tweeted, "I was 35 years old when Bill Clinton, Arkansas Attorney General, raped me and Hillary tried to silence me.   I am now 73….it never goes away."   The tweet went viral, instantly, and she has been tweeting in support of Donald Trump ever since.   Juanita, along with other victims of Bill Clinton, appeared with Mr. Trump at the 2nd presidential debate October 9, 2016, in St. Louis.  She has been interviewed numerous times on Fox News by Sean Hannity, Laura Ingraham, Martha MacCullam, Judge Jeanine and Jesse Watters,  on CNN by Jake Tapper and SE Cupp, on OAN TV by Graham Ledger and on CRTV by Eric Bolling.  She continues to do  interviews on national radio shows, including the Sean Hannity radio show.  Juanita has written a book about her life and the years of trauma and emotions of being raped by a powerful man.   Now as we see the women coming forward telling their stories of sexual assault by another powerful Attorney General from New York, she remembers what it was like so many years ago.   Their comments in the New Yorker are a haunting reminder of what she went through.  One said, "What do you do if your abuser is the top law-enforcement official in the state?"   Exactly, …….her thoughts four decades ago.  And now we see the double standard by the Democrats by elevating the uncorroborated allegations of Dr. Christine Ford while turning their backs on Broaddrick during the impeachment of Bill Clinton 1999.  p.p1 {margin: 0.0px 0.0px 0.0px 0.0px; font: 14.0px Helvetica; min-height: 17.0px} p.p2 {margin: 0.0px 0.0px 0.0px 0.0px; font: 18.0px Helvetica} p.p3 {margin: 0.0px 0.0px 0.0px 0.0px; font: 18.0px Helvetica; min-height: 22.0px} span.s1 {font-kerning: none} Juanita's book is titled, "You'd Better Put Some Ice on That".  Those are the words Bill Clinton said to her after he raped her, referring to her swollen, bleeding lip.  Those words will forever be a reminder of that day in 1978.

Robert Mueller was unethical for not coming out with this announcement before the midterm election. But this all started with surveillance by members of the Obama Administration. By leaking information to the media the FBI and Obama Administration intelligence officials perpetuated the biggest scandal in American history and the media was complicit in all of it. Mueller failed us over and over again; from dragging out a bogus investigation to pursuing the narrative of obstruction in an effort to impeach the president. Mueller used vague verbiage to allude to a potential crime in his report despite saying that he would not pursue additional indictments. Different from Watergate and Ken Starr's Independent Counsel reports regulated by the Independent Counsel statute—Mueller however, was not regulated under that statute and must comply with the regulations under 6e of the federal code. Then, the media continues their distortion of the facts making it appear as if President is still suspected of a crime by Mueller - which he is not . Afterwards, Michael Avenatti was arrested for extortion for shaking down Nike and he's also charged with falsifying client billing statements. It’s also believed that Attorney Mark Geragos of the Clintons' Whitewater fame is suspected of being an unnamed co-conspirator of Avenatti's and has subsequently been let go from CNN. The Whitewater controversy, Whitewater scandal, or simply Whitewater, was an American political episode of the 1990s that began with an investigation into the real estate investments of Bill and Hillary Clinton and their associates, Jim McDougal and Susan McDougal, in the Whitewater Development Corporation, a failed business venture in the 1970s and 1980s. Neither Bill Clinton nor Hillary were ever prosecuted, after three separate inquiries found insufficient evidence linking them with the criminal conduct of others related to the land deal. The matter was handled by the Whitewater Independent Counsel, Kenneth Starr. Look, believe this stuff or don't. my thought is that if we see conspiracy everywhere we are bound to be right once. I think that's why people invest in them. like cheering for the underdog, we hope we bet on the long shot horse. it's cool, i mean i have hobbies too. Just understand that while you believe, normal people think that yes maybe, but who's place is it to actually investigate? Where is your evidence from, and If you don't believe the man, We deserve the same rights to not believe you. Go and document and investigate, That's the awesome American way. Best of luck. Anybody can exclame conspiracy, most have sources that can corroborate. most don't shout conspiracy until they have that irrefutable evidence. Donald had none of that. he googled his opponent, Read the search result, and shouted headline until other filled in blanks for him. Donald Trump didn't win because he was better. Donald won because his opponents refused to be worse. In my opinion Park Police discovered Foster, dead from an apparently self-inflicted gun shot wound to the head, in Fort Marcy Park off the George Washington Parkway in Virginia, on July 20, 1993. Foster was holding a gun in his hand. An autopsy and subsequent investigation later confirmed that Foster had committed suicide by shooting himself once in the mouth with the .38 caliber revolver found at the scene. Subsequent investigations found that Foster was distraught over accusations and criticisms related to the White House Travel Office controversy. Foster had confided to friends and colleagues that he was considering resignation, but feared that he could not handle the "personal humiliation" of returning to Arkansas in defeat. Foster admitted to his sister that he was depressed shortly before his death, and he sought treatment for depression one day before committing suicide. Although police found no evidence of foul play, several tabloids and right-leaning newsletters speculated that Foster's death may have been a homicide, possibly involving the Clintons themselves. Subsequent investigations by White House special counsel Robert Fiske, and the Senate Banking Committee concluded that there was no evidence of a homicide. A final investigation, led by White House independent Counsel Kenneth Starr also concluded that there was no evidence to support the claim that Foster was murdered. Starr's report addressed several additional questions about physical and forensic evidence that had previously fueled speculation about the case. The report established that Foster owned the handgun used in the suicide, and confirmed that the body had not been moved from its position prior to its discovery by police. The report concluded “In sum, based on all of the available evidence, which is considerable, the OIC-Office of Independent Counsel, agrees with the conclusion reached by every official entity that has examined the issue: Mr. Foster committed suicide by gunshot in Fort Marcy Park on July 20, 1993.” The suicide has nevertheless continued to fuel speculation: then-presidential candidate Donald Trump made news in 2016 when he remarked in an interview with the Washington Post that Foster's death was "very fishy", and added "I will say there are people who continue to bring it up because they think it was absolutely a murder. The book focuses on the April 3rd, 1996 plane crash that killed sitting Secretary of Commerce Brown and 34 others on a mysterious trade mission in Croatia. Mr. Wilson's central role in a political and legal drama that lasted well into the 1990's makes him uniquely well placed to discuss the investigation. About the Speaker: Mr. Thomas Wilson has led a varied and high profile career. After graduating with a BA in history from Georgetown University, he went on to pursue a law degree from Georgetown Law School. Upon graduation, rather than going into legal practice, he decided to join the US Army, serving in the 6th Special Forces Group (Airborne), in the United States from 1967 to 1968, and in the 5th Special Forces Group (Airborne) in the Republic of Vietnam from 1968 to 1969. He was awarded the Bronze Star Medal, Combat Infantryman's Badge, and Parachute Wings (from the United States, Israel, and the Republic of Vietnam). After military service, he pursued an MBA from Columbia University before going into legal practice. His legal career spanned more than 40 years and included representing clients such as CIA Costa Rica Station Chief Jose Fernandez in the Iran-Contra affair; the Assistant to President George H. W. Bush in an Independent Counsel investigation into the 1992 search of then Presidential candidate Bill Clinton's passport file; a client investigated for making allegedly illegal campaign contributions to the 1996 Clinton/Gore re-election campaign; the former Director of MKULTRA, the CIA's Cold War drug testing program; as well as a major private security firm in a very sensitive, high-profile investigation sited in Baghdad, Iraq. Mr. Wilson has been lead counsel on a host of matters before numerous appellate tribunals, including most United States Courts of Appeals and the United States Supreme Court. Until his retirement in 2013, he served as of counsel in the Washington, D.C. office of Berliner, Corcoran & Rowe, L.L.P., where he practiced general litigation with specialties in complex civil, administrative and white-collar criminal litigation.
