Judge Richard P. Matsch (1930-2019) served as a United States District Judge for the District of Colorado from 1974 to 2019. He is best known for his service as the trial judge in charge of the criminal trials of Timothy McVeigh and Terry Nichols, who were convicted in 1997 for their roles in the 1995 bombing of the Alfred P. Murrah Federal Building in Oklahoma City. Before Matsch's service as a federal judge, he worked as a lawyer in private practice in Denver, a federal prosecutor, and a bankruptcy referee and bankruptcy judge in Colorado. Matsch grew up in Burlington, Iowa, worked in his father's grocery store there, and attended a junior college and then the University of Michigan for college and law school. After law school, he served in the U.S. Army from 1953-55 around the end of the Korean War doing counterintelligence work in South Korea. In describing his career as a public servant, Judge Matsch quoted George Bernard Shaw:I'm of the opinion that my life belongs to the community. And as long as I live, it is my privilege to do for it whatever I can. I want to be thoroughly used up when I die. For the harder I work, the more I live. School District No. 1 case from 1973 to 1995, implementing the U.S. Supreme Court's direction in 1973 to have a federal judge oversee desegregation “root and branch” of the Denver Public Schools through busing of students. Ultimately in 1995, Judge Matsch held that the vestiges of past discrimination by the school district had been eliminated to the extent practicable, and ended the mandatory busing of students in Denver Public Schools.Matsch also discussed in this episode several other cases that involved constitutional issues including free speech and the free exercise of religion under the First Amendment, and equal protection under the Fourteenth Amendment.In Judge Matsch's 1977 ruling that called for girls to be able participate in a Colorado high school soccer program comparable to boys soccer, he noted:Any notion that young women are so inherently weak, delicate or physically inadequate that the State must protect them from the folly of participation in vigorous athletics is a cultural anachronism unrelated to reality. The Constitution does not permit the use of governmental power to control or limit cultural changes or to prescribe masculine and feminine roles.Hoover v. Meiklejohn, 430 F.Supp. 164 (D. Colo. 1977).

Murrah Federal Building in Oklahoma City.Matsch sought to hold fair trials that respected both the interest of the people in Oklahoma harmed by the bombing of the federal building and also the rights of the criminal defendants. Part of protecting the defendants' rights included providing significant financial support for the defense teams. Matsch famously told participants: “This is not theater; this is a trial.”McVeigh was convicted in 1997, sentenced to death, and executed in 2001 after an appeal of his conviction. Nichols was convicted in 1997 and sentenced to life in prison.Judge Matsch explained how he dealt with public interest in the trial:I stressed to everybody, this case is not about me. When I was first notified of this, the press got it; there was a demand that there be an opportunity to talk to me about it. So I stood out on the courthouse steps on that afternoon and answered a few questions, but that was the last time I ever met with the press. It was important to recognize, all right, this is a trial. We have a lot of trials. We're doing this as much as possible. It's just another trial. * * *When it comes to the trial itself, of course, the fundamental question is fairness and the ability to see the defendant sitting at defense table as a human being and not objectify this person as someone who has done some terrible crime.But he also explained how he dealt at trial with the emotionally powerful evidence:So in the Oklahoma City trials, I had the difficult problem of very emotional testimony from people in the building and relatives. That was heartbreaking. One of the most emotional parts of that case was that right there in the front of that building was a nursery, a daycare center, and all those children were killed, including babies. An

Three Cases Dismissed Because of Suit Against an Insurer who Did Not Insure the Plaintiff Texas Law Firm McClenny, Moseley & Associates (MMA) has had serious problems with the US District Courts in Louisiana and what appears to be an effort to profit from what some Magistrate and District judges indicate may be criminal conduct to profit from insurance claims relating to hurricane damage to the public of the state of Louisiana. In April and May several cases have been the subject of motions for Summary Judgment from insurers who were sued by MMA who was sanctioned by the District Courts and new lawyers took over the cases only to find the plaintiffs had no right to sue since they were not insured by the insurer defendants. For a representative sample note the information from the following three cases: In Ave Duruisseau v. Farmers Property & Casualty Insurance Co, No. 6:22-CV-03860, United States District Court, W.D. Louisiana, Lafayette Division (April 26, 2024) Summary Judgment was granted because there was no genuine issue of material fact for trial because Farmers did not insure Plaintiff's property. In Hester Cole v. Foremost Insurance Company Grand Rapids Michigan, No. 2:22-CV-03514 United States District Court, W.D. Louisiana, Lake Charles Division (April 26, 2024) the court granted Summary Judgment because there was no genuine issue of material fact for trial because Foremost did not insure Plaintiff's property on August 27, 2020. In Terry Ramirez v. Atlantic Casualty Insurance Co, No. 2:22-CV-04797, United States District Court, W.D. Louisiana, Lake Charles Division (May 7, 2024), James D. Cain, Jr. United States District Judge, dealt with a Motion for Summary Judgment filed by defendant Atlantic Casualty Insurance Company (“Atlantic Casualty”). The motion was unopposed. The details were a little different. The suit dealt with alleged damage to a residence located at 2026 7th Avenue, Lake Charles, Louisiana, in Hurricane Laura, which made landfall in Southwest Louisiana on August 27, 2020, and Hurricane Delta, which impacted the same area on October 9, 2020. Plaintiff, who was then represented by counsel from the law firm of McClenny Moseley & Associates, filed suit in this court against Atlantic Casualty on August 25, 2022, raising claims of breach of insurance contract and bad faith. Therein he represented that he was the owner of the property represented at 2026 7th Avenue and that the property was insured under a policy issued by Atlantic Casualty. All cases filed by plaintiff's counsel were suspended due to concerns about misconduct committed by that firm. New counsel enrolled for plaintiff on July 11, 2023, and the stay was lifted. Atlantic Casualty moved for summary judgment, showing that plaintiff is not the owner of the insured property and is not listed as a named insured under the policy and requested that the court dismiss plaintiff's claims with prejudice. Louisiana law provides that an insurance policy is a contract and that its provisions are construed using the general rules of contract interpretation in the Louisiana Civil Code. The policy at issue is a commercial lines policy that provides lessor's risk coverage to several dwellings, including the one at 2026 7th Avenue. Doc. 20, att. 3, pp. 5-6. Darrell and Shirley Crochet are listed as the named insureds. According to Atlantic Casualty's records, they are also the owners of 2026 7th Avenue and plaintiff was a tenant at that address. The policy provides that certain individuals, such as employees, may be considered insureds in connection with the business run from that property. However, there is no basis under the policy to consider that the tenant has an insurable interest in the immovable property. Accordingly, plaintiff cannot maintain a claim for breach of contract against Atlantic Casualty. In the absence of a valid contractual claim, plaintiff's bad faith claims must also fail. The Motion for Summary Judgment was granted and all claims in this matter were dismissed with prejudice. The result of these three cases indicates that the MMA firm had a problem with the truth and filed suits on behalf of people who were not insured by the insurer defendant and was, as a result, a suit based on fraudulent allegations. Washington is a veteran of our armed services for which he deserves our gratitude. Phillip A. Washington has a background in bus and train travel. Phillip A. Washington has no background whatsoever in flight. Phillip A. Washington has been nominated to run the Federal Aviation Administration. Phillip A. Washington went 0-7 on a brief aviation policy quiz Senator Ted Budd offered him. Phillip A. Washington couldn't answer even one of those questions correctly. Phillip A. Washington isn't prepared to run the FAA. Phillip A. Washington is black and, to the racial-equity-theorists that is all that matters. Phillip A. Washington is not the only case where we see the Soft Bigotry of not caring. Charnelle Bjelkengren is a nominee of the Biden regime to be United States District Judge for the Eastern District Of Washington. Charnelle Bjelkengren doesn't know what Article 5 of the Constitution is about. Charnelle Bjelkengren doesn't know what Article 2 of the Constitution is about. Charnelle Bjelkengren being unaware of even the basic contours of the Constitution is like an NFL player being unaware of the length of the field and the number of downs a team is allotted to travel 10 yards toward the end zone of their opponent. Charnelle Bjelkengren is black and that is all that matters to the racial-equity-theorists. Merrick Garland is white. Merrick Garland is wealthy. Merrick Garland is mentally slow under questioning. Merrick Garland is ineffective in communication. Merrick Garland is easily bullied into bullying others. Merrick Garland is stymied by simple concepts like equal treatment under the law. Merrick Garland is afraid to enforce any laws that might anger The Party. Merrick Garland is a supposed victim of Trump willing to do anything to maintain his Peter Principle Perch and that is all that matters to the the people who run Joe Biden. What does God say? Solomon Oliver is a United States District Judge based in Cleveland, Ohio. Born and raised in the segregated South, he moved north to attend college and, after years of working as an Assistant U.S. Attorney and teaching at both the college and law school levels, was appointed by President Bill Clinton to the federal bench in 1994. In this episode of Higher Callings, I talk with Judge Oliver about his childhood in Alabama during the early years of the civil rights era, his experience in the late 1960s as a minority student at the College of Wooster in Wooster, Ohio, his decision while there to become a lawyer and later to become a judge, the values he looks for and hopes to instill in the law clerks who work for him, and his lifelong commitment to the principle of equal rights and opportunity for all enshrined in America's founding documents. In this episode of Law, disrupted, John joins the Honorable Alan D. Albright, United States District Judge for Western District of Texas, Waco Division. After less than four years as a federal judge, Judge Albright now hears more patent cases than any other judge in the United States, with a docket that includes 25% of all patent cases in the country.Judge Albright predicts what the next big technology battleground in patent cases will be, shares advice for lawyers who are interested in practicing patent law and offers tips for attorneys who practice before him.To start the discussion, Judge Albright describes his years of experience as a patent litigator and how that experience shaped his approach to management of his patent docket. Judge Albright explains how speed in moving patent cases to trial has led his courtroom to become a preferred venue for patent plaintiffs. He and John then discuss how he has been able to attract clerks with technical backgrounds and experience with patent law and how he consulted with patent lawyers from a wide range of firms to come up with rules for litigating patent cases that he hopes are objectively fair to all sides. Judge Albright explains why he believes that it is essential to stay all discovery until after the Markman hearing.Together, Judge Albright and John dissect the factors that make Texas a fertile venue (both Eastern District and Western District) for patent litigation. Discussing the Alice test and section 101 patent eligibility issues, Judge Albright shares his thoughts on where there is adequate certainty from the federal circuit on such issues, and where further guidance and clarity is needed. He and John then discuss the circumstances when it is beneficial to appoint a technical advisor on a case and when it is less beneficial. Judge Albright also discusses his utilization of magistrate judges. The conversation turns to Judge Albright's goals for adjudicating cases expeditiously and the changes that he has introduced to his Standard Order Governing proceedings in his Court. Judge Albright also describes the short-term and permanent changes to the litigation process resulting from the Covid-19 pandemic, including his shift to using Zoom for virtually all pretrial hearings and, in some instances, for trial witnesses. John and the judge then explore Judge Albright's “dialog” with the Federal Circuit on venue issues, including how one writ of mandamus quickly grew to eight or more. They cover Judge Albright's approach to deciding when a case should be heard in Austin, as opposed to Waco and how Judge Albright handles cases that are transferred from Waco to Austin. They then discuss Judge Albright's views on when a case should or should not be stayed in favor of IPR proceedings.The conversation then shifts to what Judge Albright believes will be the next big technology battleground for patent cases: electric cars and the aspects of that technology that make it ripe for patent litigation.Finally, Judge Albright gives advice to young lawyers interested in going into the patent field, including what qualities patent lawyers should have if they do not have a technical background. Sykes is a citizen of the Navajo Nation. She appeared before the committee for her confirmation hearing on February 1, 2022. The COVID-19 pandemic resulted in over a year of virtual public schooling in some parts of the country, which caused a surge of interest in school choice options as parents sought in-person instruction for their children. About 500,000 students nationally left traditional public schools during the pandemic to move into private schools, charters, and full-time home-schooling. State legislatures across the country thus responded by considering legislation to increase the number of charter schools, offer additional scholarship and tax credit programs, and create education savings account options to increase choice in education.This panel surveyed proposed education reforms to expand school choice and discussed the responses of unions, school boards, and parents to these proposals. Salling pleaded guilty in December 2017 and agreed to serve the jail time followed by 20 years of supervised release. Additionally, he agreed to pay $50,000 in restitution fees to each victim and register as a sex offender.

Recorded in May 2017 - Hon. Lorna G. Schofield ’81 is a United States District Judge for the Southern District of New York. She was nominated in 2012 by President Obama and confirmed by a unanimous vote of the US Senate. For 20 years previously, Judge Schofield was a litigation partner at Debevoise & Plimpton LLP in its New York office. Her practice focused on litigation in complex commercial matters, including regulatory and white collar criminal investigations, class actions, corporate bankruptcies, and other business disputes. Her trials included the successful defense of Rosie O’Donnell in her contract claim against the publisher of Rosie magazine, and of a big four accounting firm in a class action in which the jury returned a defense verdict after only 30 minutes. Judge Schofield previously served as a federal prosecutor and worked on cases involving arms dealing, domestic terrorism and white collar crime. She began her legal career as an associate at Cleary Gottlieb Steen & Hamilton. She is a former Chair of the Section of Litigation of the American Bar Association. Judge Schofield has written and spoken frequently about trial tactics and women in the legal profession. Judge Schofield is the first Filipino-American federal judge to be appointed under Article III of the US Constitution.

Afterward, he joined the University of Illinois from Loyola Law School Los Angeles, where he served as the James P. Bradley Chair of Constitutional Law. His recent book, The Lost History of the Ninth Amendment, was published in 2009 by Oxford University Press. Cambridge University Press will publish his second book, American Privileges and Immunities: Federalism, The Fourteenth Amendment and the Rights of American Citizenship. According to court documents obtained by E! News, a United States District Judge granted the dismissal request from the U.S. Attorney's office. However, the case was dismissed “without prejudice” per the prosecutor's request, meaning that it can be refiled in the future. Details Emerge About 'Glee' Star Mark Salling's Death; Cause of Death Revealed The Glee star was found dead in a park near his San Fernando Valley home on January 30. Officials confirmed his cause of death was asphyxia as a result of hanging. His death comes just a few weeks prior to his four to seven year prison sentence for possession of child pornography. Salling pleaded guilty in December 2017 and agreed to serve the jail time followed by 20 years of supervised release. Additionally, he agreed to pay $50,000 in restitution fees to each victim and register as a sex offender.
