By Adam Turteltaub There has been a lot of discussion over the last few years about nudges, although typically in the general business environment, rather than in the world of compliance and ethics. A notable exception has been the work of Todd Haugh, Associate Professor of Business Law and Ethics at the Kelley School of Business at Indiana University, and a Board Member and Jesse Fine Fellow for the Poynter Center for the Study of Ethics and American Institutions. He has written about nudges and offers additional resources on behavioral compliance. In this podcast, he explains that behavioral science has revealed that nudges – carefully crafted prods to make the right decision – can have a profound impact. A nudge takes advantage of choice architecture, which pushes people in a direction by structuring the environment in which choices are made. Notably, this is not about tricking people. This is a pro-social effort. So, how does it work in practice? It begins at the end. Look at the outcome desired and then examine the steps along the way. As you do, build a behavioral map that identifies when small interventions in existing processes can achieve positive compliance results. For example, one organization was receiving more anonymous reports on its help line than it desired. The organization realized that the default setting for reporters was set to anonymous. By simply shifting the default to including the person's identifying information, non-anonymous calls increased 5%. Another example comes in the area of travel. When an employee fills out a travel form for a high-risk country, it's a good time to provide information on data security and the corruption risks of meeting with government officials. Professor Haugh cautions that it is best to think of nudges as ways to have specific impacts on certain behaviors, not to do something broad like creating a positive corporate culture. Have reasonable expectations and then test out various nudges to see which ones are having an impact and which ones aren't. Listen in.  It may nudge you to think of your compliance efforts differently.

Maria Isabel Davila born in Bayamon Puerto Rico in 1977, has been through many challenges in her life. At age 11 her parents divorced and moved to the state of Connecticut. As we all know, Hispanics tend to relay all the responsibility to the oldest. Maria Isabel had 2 younger siblings and she had to raise them. She worked thru the summers as a Camp Counselor at Latino Youth Development and as years passed, she worked in many jobs to help her mother financially. In 1998 she rented her first apartment and began to work in the Physical and Chiropractic field. Maria has always been a people's person, so marketing was very easy for her. She began as a receptionist and worked herself to Management. She wrote articles for the newspaper about chiropractic and physical therapy, and assisted with therapy, translation, transportation, training, management, and billing. Later, she transitioned to a new company where she used her expertise and was able to open new chiropractic offices throughout Western Massachusetts and Connecticut. These were fun times for her. In 2002 Maria freelanced for multiple local attorneys and became a notary public. Her enthusiasm and passion for helping others lead her to start her own business while continuing to work for chiropractic offices. In 2003 She bought her first home. In 2014 She established her first business and named it Chiro Pro Billers Management. In her business, she focused on billing, marketing, and credentialing. As time passed, Maria decided to create an LLC and in 2021 Davila Pagan Enterprises, LLC was born. In 2022 She Founded Davila Partnership Group LLC and Phoenix Training Center (Non-profit).

This week on SA Voices From the Field we interviewed Courtney Bullard, Founder of Institutional Compliance Solutions about the many Title IX changes that are coming about and their impact on your own college campus.  Courtney Bullard has over ten years of experience representing institutions and organizations in matters involving sexual misconduct, including 8 years as a University system attorney. As in-house counsel, she served as a trusted advisor to the Chancellor, Vice Chancellors, Athletic Director, Director of Office and Equity and Diversity, Title IX Coordinator, Provost and other top level administrators on all legal matters affecting the institution. Her breadth of knowledge and familiarity with the unique aspects of a college campus provide a distinctive approach to partnering with institutions and school districts to assist with their legal needs. Dr. Henry Webb is the Assistant Dean for International Business Programs at Palm Beach Atlantic University. He practiced environmental law for three years in Seattle, WA before he got an MBA. After that, he moved to Ho Chi Min City to teach Business Law at an Australian university. Henry has organized study abroad programs for American students in Vietnam, as well as for Vietnamese students in America. He taught as a visiting professor for several universities in Vietnam and for one university in Hungary. This December, he's taking 22 students from my university on a two-week study abroad trip in Vietnam, and in June 2023 I am taking a group of students on another study abroad trip in Thailand, Laos, Cambodia, and Vietnam. During the Fall 2023 semester, he will be teaching on a Fulbright grant at a law school in Bhutan. We are thrilled to have Haydn on the show!   Law Industry Technology Documents flood law offices, and without an organization system intact would mean trouble. Luckily, with technology, law firms can have that extra sense of organization for litigation documents. There is a lot of documentation going back and forth between the client and the opposing counsel's attorney. All kinds of briefs and motions filed to court pile up. With the tools they have at Benchly, Haydn says they can streamline that process for everyone involved. Through that, it would be beneficial for attorneys, their secretaries, and even paralegals, and the overall bottom line is that they positively impact that. What drew Haydn to the legal industry was back in his business class days. Taking law was at the back of Haydn's mind, but he eventually chose business over it.
