Strength Is More Than Muscle Brett Faro is Cedarville's men's soccer coach and has led his team to more than 90 wins since 2013, three G-MAC conference titles, and two NCAA tournament bids. He's also a husband to his wife, Shelley, and dad to 2-year-old Lincoln. But to 5-year-old Fritz Krieger, Brett is an inspiration.  Fritz has Duchenne muscular dystrophy (DMD), and his parents, Bryant and Sarah Krieger, are long-time friends of the Faros. When Brett decided to compete in the Tulsa Ironman triathlon in May – a grueling 140.6 mile swim/bike/run – he chose to make it more than an athletic milestone accomplished. Brett wanted to bring attention to Fritz's disease, which typically claims the lives of those who contract it by their teens to mid-20s, although recent medical advances have increased life expectancy.  Brett wore the inspirational phrase “Strength Is More Than Muscle” on his racing outfit, which is the tagline for the Kriegers' nonprofit. He also had their website, fritzandfriendsdmd.org, emblazoned on the back. The press opportunities that followed allowed Brett to share about Fritz and how people across the country can join the fight against DMD. For Brett, this was an opportunity to transform an amazing athletic pursuit into an exercise of eternal purpose.  “There are so many who do not have the opportunity to push their bodies the way I've been able to push mine,” Brett shared during an interview prior to the Ironman. “They aren't able to run, bike, or swim. I really try to value that and share the true joy I have in Christ. God has blessed me with athletic ability, endurance, strength, and legs that work.” ………… Join the fight against Duchenne muscular dystrophy; visit fritzandfriendsdmd.org.

This week, your hosts Steve Lowry and Yvonne Godfrey interview Brett Turnbull of Turnbull Law Firm (https://turnbulllawfirm.com/) and Jerome Tapley of Cory Watson Attorneys (https://www.corywatson.com/)   Remember to rate and review GTP in iTunes: Click Here To Rate and Review   Episode Details: Trial lawyers Brett Turnbull of Turnbull Law Firm and Jerome Tapley of Cory Watson Attorneys explain how they successfully represented grieving father Hilario Cruz after his wife and two young daughters were killed in a car crash caused by a faulty brake system. In 2012, a 2004 Infiniti QX56 SUV driven by Solomon Mathenge t-boned a Dodge Caravan in Los Angeles, resulting in the death of the driver, Hilario's wife, and daughters Stephanie, 4 and Hilda, 6. Solomon insisted that his brakes were not working properly. Originally charged with three counts of vehicular manslaughter, Solomon later joined the case as an additional plaintiff, separately represented, against Nissan North America, Inc., due to the discovery of a history of braking issues in Infiniti vehicles. Nissan knew as early as 2003 that select models were equipped with a defective braking software with a "delta stroke sensor," which unnecessarily activated the car's optimized hydraulic braking. Despite this knowledge, Nissan failed to recall the vehicle or notify all vehicle owners. In 2017, a Los Angeles jury found Nissan's negligence to be 100% responsible for the three wrongful deaths and awarded plaintiffs compensatory damages totaling $24,931,109.   Click Here to Read/Download the Complete Trial Documents   Guest Bios: BRETT TURNBULL: Brett Turnbull has embraced the philosophy of keeping clients first in distinguishing himself as a leading trial lawyer, recognized for his jury verdicts and settlements on behalf of clients killed or injured by the negligent and wrongful actions of others. When Brett goes before a jury, he realizes he has one job: to get justice for his client by proving their claims and guiding the jury to award a fair and reasonable verdict. Brett has more than a decade of successful courtroom experience in complex litigation, including trucking cases, product liability, automobile defects, pediatric burns, traumatic brain injury and nursing home malpractice. Respect for individuals and for the justice system led Brett, a graduate of the University of Alabama, to pursue legal studies at The Cumberland School of Law. There, he discovered his true passion: trial law. As a class leader, Brett won national recognition for his trial advocacy skills. That leadership track continued throughout Brett's legal career. Today, he gives back to his profession by serving in leadership positions with the Alabama Association for Justice, Alabama State Bar, and Southern Trial Lawyers Association. Brett and his wife Dawn have been married for 13 years and have four children–Brett, Arden, Miller, and Bess. When he's not in the courtroom, you can find Brett and his family outside playing their favorite sports: baseball, basketball, soccer, golf, and tennis. They also enjoy taking time out of their busy schedule to relax at the lake or the beach for a weekend. The Turnbulls are active members at South Highland Presbyterian Church in Birmingham, Alabama. Read Full Bio   JEROME TAPLEY: For Jerome Tapley, the decision to become a lawyer was a deeply personal one. When he was a boy, a family member died in a workplace accident. Jerome witnessed first-hand how lawyers could make a difference in people's lives. The trial lawyers who represented his family successfully held the responsible party accountable for the tragedy, and he knew then that he wanted to be a trial lawyer. His road toward achieving that goal was not easy, but hard work has never been an obstacle for him. Jerome was born in Alexander City, Alabama - a hard-working, cotton mill town that taught him the values of persistence, keeping his word, and doing his best. The lessons learned from his community propelled Jerome to become the first college graduate in his family. He graduated from Auburn University Montgomery, where he was Student Government President, and earned his law degree through Cumberland School of Law at Samford University. He is now a principal at Cory Watson Attorneys, focusing 100 percent on courtroom litigation and trial, including Class Action, Mass Tort, and Products Liability Litigation. He is admitted to all state and federal courts in Alabama and Florida. Jerome's peers rightly view him as an accomplished trial lawyer, having tried cases in multiple venues across the country including a $25 million verdict for plaintiffs in an automotive defect case against Nissan in California, a $10 million wrongful death verdict in Alabama, and a $50 verdict against DuPont for pollution caused cancer in Ohio. Notwithstanding his courtroom accomplishments, Jerome is more than a trial lawyer. Since joining Cory Watson in 2003, Jerome has become a shareholder, Co-Chair of the Class Action & Consumer Fraud litigation group, and a member of the firm's management committee. He has also served as Lead Counsel in a multitude of certified nationwide consumer fraud class actions against large corporations in jurisdictions across the country; has years of experience as Lead Counsel in multiple cases representing state Attorneys General, represented nearly every city and county in the State of Arkansas against every major Opioid manufacturer and distributor; and served leading roles for the firm in Multi-District Litigation, including appointment as Co-Lead Counsel in In re Google Inc. Gmail Litigation, MDL 2430. Jerome's cases often involve recalls or product redesigns resulting not only in financial recovery for the class, but also increased safety for the public. One such litigation involved two certified nationwide consumer fraud class actions against fireplace manufacturers who made dangerous glass-front fireplaces, successfully changing industry design standards to prevent severe third-degree burns to infants and toddlers. Jerome has been married to his high school sweetheart, Kelli, for 20 years. Kelli is a pediatrician and loving mom to their two daughters, Madeline and Harper. In his free time, you can find Jerome with his family or quail hunting with his bird dog Duke. The Tapley family is active at Haven Field Community Church, where Jerome serves as Chairman of the Elders. Though Jerome has a variety of hobbies and interests, one of his favorite quotes speaks to his hard-working background: “No one has ever drowned in sweat.” - Lou Holtz. Brett Iwanowicz was skeptical about joining a high-level mastermind at first because he was in a one-sided business partnership for seven years and that relationship really burned him when it was over. However, after being part of ASCEND, Brett finally feels like he's home. Learn more about Brett and his story on this week's episode!   Key Takeaways: Brett always wanted to be on Alex's show and doesn't understand why he just didn't ask him. When Brett first started his entrepreneurial journey, he had to shift his mindset. When it comes to working with someone, you want to serve them, not yourself. Alex never had a sales process until he went through John Martinez's Real Estate Investors Sales Academy. What was Brett doing before real estate? Brett's first real estate partnership was very one-sided. It lasted for seven years and it made Brett feel very defeated once it was over. Brett grew up without a father and he put a lot of energy into that partnership as he was hoping he could fill that gap. It made Brett distrust partnerships after that. Even after joining Lifeonaire, it still took Brett a long time to realize the people in the community were for real. Brett had to work hard to find his tribe. You really have to work hard to find your people. When Brett became committed to his personal development, he was committed and nothing was going to stop him. He was more committed to his success than the fear of failure. There is always purpose in pain. If you have personal issues, they're affecting your life, your happiness, and your business! Why does Brett love ASCEND? By Brett being vulnerable, people would come up to him and tell him how they needed to hear his message. No matter how difficult something is, you can still have fun. Life's a journey! Most people miss the opportunity to enjoy what they're doing right now. When you have the strong desire to succeed, it's incredible what happens next. Want to find your strengths? Ask people around you what they think they are. It's insightful and you might not like what you hear! Tiffany from Renton has asked Fitz for help because she’s pretty fed up with her boyfriend Brett. She cosigned on a loan for fully loaded $70,000 pickup truck he said would be ideal to use for renovating their home as well as for work projects. But after a couple of weeks she just found out he’s been renting trucks for all that work because he doesn’t want to scratch and devalue the truck. She is upset not just about the money but also because he has been hiding that from her. When Brett comes on, he says the truck is an investment in their future and he needs to keep it in good shape to keep its value. He says he is thinking long-term about it being the safest vehicle to carry their future children, as well as it’s usefulness for camping trips and such. When we question him about the lying, he is a bit evasive, but he does make a compelling argument about the truck’s long-term value versus the cost or rentals. But when the talk turns to the cost and value of an engagement ring, the wheels come off.

Brett Swarts is the Founder of Capital Gains Tax Solutions. Each year, he equips hundreds of business professionals with the Deferred Sales Trust tool to help their high net worth clients solve capital gains tax deferral limitations. His experience includes numerous Deferred Sales Trusts, Delaware Statutory Trusts, 1031 exchanges and $85,000,000 in closed commercial real estate brokerage transactions.  He’s an active commercial real estate broker and investor with brokerage experience and ownership in multifamily, senior housing, retail, medical offices, and mixed-use properties. He is a licensed California Real Estate Broker who holds series 22 and 63 licenses.   Podcast Highlights     Who is Brett Swarts?    Brett is a Christian so he believes that each of us were given unique gifts to help others, and that shaped his world view when he was young. At the age of 12 he encountered several different mentors that helped him develop and realize that challenges are an opportunity to grow. In terms of superhero powers, Brett is a careful observer that can learn from the mistakes of others and see better ways to get things done. In college, Brett was guided by one of his older cousins towards investing in commercial real estate which lead to him getting an interview with Marcus and Millichap. It was there that Brett learned that he loved the business and competition, and that the moment you learn more about someone’s business or piece of real estate than they know themselves is the moment you start adding value. Brett’s career started off rough but he kept persisting until he found the results he wanted.    We are forged in the fire, all the difficulties and challenges that Brett worked through are how he developed the tools and skills he needed to succeed.     The Power of Persistence   When Brett was working on his business he didn’t take the negative opinions he often heard seriously. He had his wife supporting his vision and felt like he was on the right path. Persistence has always been part of Brett’s personality so without a challenge to keep him engaged he tends to get bored. The strategy of the deferred sales trust is something that caught Brett’s eye that he saw as something that could serve people’s needs, so he invested a lot of time into understanding it. This turned into Brett becoming a trustee and educator who teaches financial advisors, brokers, and high end realtors on the strategy.    Deferred Sales Trusts   You can defer your taxable gains on real estate by using the 1031 exchange as long as it’s done within a certain time period. The challenge is that if that’s the only tool in your toolbelt you may be put into a situation where you can’t make the best decision because of the 46 day window. It’s a seller’s market today, so if you sell today and buy 180 days later you are likely paying more with a higher interest rate for example. Debt is not your friend in a highly appreciated, overpriced marketplace. The 1031 exchange requires you to buy something of equal or greater value, which means that you will have to take on that debt or more on the next deal. The intent is to take on smart debt when it makes sense, usually during a buyer’s market. A deferred sales trust gives you multiple options for what you can do with your money. According to the American Banking Association

Brett Bastian shares how Warriors Never Give Up began by utilizing our passion for the outdoors to serve our nation’s heroes, but God called us to step out of our comfort zone to do so much more. Our intention of this organization and its outdoor adventures is and always has been to provide a place of relaxation, hope, family, and a break from life’s daily struggles. However, along the journey, we soon realized that a bigger piece of God’s intention was missing. Throughout the transformation of this awesome and amazing journey, it became obvious that God’s calling was not only providing a place of mental and physical healing, but also a place of spiritual healing. We take pride in our mission of touching the lives of each volunteer or participant knowing that our chief sponsor, God, is in control. The hunt brings us together, but the Spirit changes the lives of our participants when we least expect it. We are dedicated to changing the lives of our nations heroes one outdoor adventure at a time. https://www.facebook.com/warriorsNGU WarriorsNeverGiveUp.org Warriors Never Give Up’s (WNGU) mission is the inspiration behind the creation of the Warriors Arrow. The creation took place in the basement of Hunts End Outdoors Archery shop this winter following a conversation between Dustin Sperlich and Brett Bastian. Dustin is a combat veteran, Pastor, avid outdoorsman, and the owner of Hunts End Outdoors and Brett is a veteran, avid outdoorsman, and a co-founder of WNGU. The two share a common bond for the outdoors, bow hunting, and both feel that the outdoors holds a natural affinity for healing. “When Brett told me about Warriors Never Give Up, I immediately thought, ‘How can I get involved?’ which stirred the idea of the Warriors Arrow”.

A memory that Brett and I recalled was the time that I injured and dislocated my shoulder during a Duxbury High School football game. To recall this information from our memory storage (retrieval), Brett and I walked to the Duxbury High School turf field and positioned ourselves right in the spot where the injury occurred. What we were doing was a context-dependent memory. With context-dependent memories information is more easily retrieved in the context in which it was encoded and stored. When Brett and I positioned ourselves exactly in the spot and environment of where our memory took place at the turf field, this made it easier to recall information and certain details that happened during that specific memory. Additionally, the shoulder dislocation injury is an example of an episodic memory. An episodic memory is a memory of a specific event that you experienced yourself. I experienced the shoulder dislocation injury myself, but Brett was still right there on the sideline to witness the injury and drama firsthand as well. Overall, when someone is brought back to a specific spot, area, or environment of where a specific event took place, it is easier to recall and retrieve memories and specific details from that occurrence.

On this week’s podcast, celebrity trainer of NBC's The Biggest Loser season 11, Brett Hoebel, discusses how we all can discover our unique healthy life, why our struggle can be our greatest gift, and how we can get clear on the choices that will truly make a difference. On this show, Brett shares his own story about when he experienced his own “Fitting Point” moment as a teenager. This would be a key moment in his life that led him to find his new, inner strength to overcome his struggles with poor nutrition. Without knowing it then, this new lifestyle change and a passion for fitness would lead him to have a career that he loves as one of best known trainers in the health and fitness community. In a world where we follow busy schedules that can include a family, a career, and other commitments, it can be difficult to find the time and motivation to fit in a good workout. Living a healthy lifestyle can be even more difficult if we’re battling inner demons that keep us from being the best that we can be both inside and outside the gym. How To Find Fitness From Within The reality is that if you force yourself to exercise or eat healthy foods without the right passion for it, you will always see changing your lifestyle as something negative. With this attitude, you will view these changes as something that you have to have happen and not what you truly get to let happen. At some point, you will see a lifestyle change as something positive when you finally find a personal connection to fitness. This connection gets to be be something that moves you forward on an emotional level. It can become very tiresome and boring to do the same exercises week after week. To change it up, Brett recommends finding something that truly energizes you and makes you excited to live a fitter life- in or outside the gym walls. Brett, for example, really enjoys taking the time to do Salsa dancing classes before getting into his workout. Takeaway: Do whatever works for you to make you happy and feel motivated! Discovering Your Fitting Point As easy as it may sound, finding your passion to live a healthy lifestyle is not always so simple. Life comes with so many different obstacles and curve balls that can stop us or put us off track from exercising, eating nutritious foods, and enjoying living healthy. Even Brett went through many struggles as an overweight teenager. He was involved in many sports growing up, but would overeat unhealthy foods with gluten and sugar that were against the diet he was supposed to be following. In denial of his emotional eating disorder and at rock-bottom, he had a sudden revelation and found his “Fitting Point.” The Fitting Point is when a person has found a moment in their life when they find inner strength and realize a change needs to be made for them to become healthy. This change may be trying to schedule a time to workout out more or, like Brett, stop eating unhealthy, processed foods and eat more natural foods. Identifying Your Life Passion It can be a long journey to discover what drives you to be excited about living healthy. Similarly, you may also face different paths and interests by attending different classes and switching careers before you truly find a major or job that you can be passionate about each day. When Brett began college, he was not doing as well as he had hoped to do and just wasn’t excited about what he was studying. With some advice from his father, Brett decided to change his major to Pre-Med because he really loved studying science. By changing his major, Brett was finally excited about his classes and had the motivation to do better in school. This switch greatly helped Brett, but he soon found out that a Pre-Med major was not his true calling because it lacked the human interaction that he really enjoys. With another revelation, Brett discovered that fitness was his true passion. This would eventually lead him down a new path to his successful career as a fitness trainer. We will all go through some difficult moments in life when we don’t feel passionate about what we’re doing. But if we dig down deep and think about what truly makes us happy, it will lead us to something that we truly love. It can take time, sometimes lots of time, but when you find your calling, you will realize that everything that led up to that moment helped you along the way and the journey was worth it. It was great to speak to Jay and Mark Duplass. They are two gents from Louisiana who have been pumping out quality entertainment for years. First time we saw them was late night on cable years ago with the short film called "This is John." In this conversation, we talk about their latest endeavor "Togetherness" an eight-episode series on HBO. It was created by the two brothers and their high school friend, Steve Zissis (who has an amazing story, FYI). This is also the debut of the Duplass bros as a writing team. The show stars Mark Duplass, Melanie Lynskey, Steve Zissis, Amanda Peet, Peter Gallagher and John Ortiz. Here's the synopsis: Brett and Michelle are struggling to rekindle the spark in their relationship, which has puttered out from the stresses of marriage and children. When Brett's friend Alex and Michelle's sister, Tina, move in with them, the foursome engage in a tragically comedic struggle to follow their personal dreams, while still remaining good friends, siblings and spouses to each other. Just having wrapped up its season finale last Sunday, you can still view episodes on HBO Go. In this interview we touch on their life motto, what it means to be creatively relevant, what kind of smoothie Jay and Mark like, and a bit about Stevie Nicks. Just listen to the damn episode. Stop reading this.
