Alpine Securities Corp. v. Financial Industry Regulatory Authority (“Alpine’) raises a challenge to the constitutionality of the structure and regulatory authority of the Financial Industry Regulatory Authority (FINRA) before the U.S. Court of Appeals for the District of Columbia Circuit. Alpine Securities, a brokerage firm, argues that the structure of FINRA violates the U.S. Constitution, particularly the Appointments Clause (Article II, Section 2), and the separation of powers doctrine. The company contends that FINRA, which operates as a self-regulatory organization (SRO), is improperly structured because its disciplinary and regulatory authority is exercised without sufficient oversight by the federal government or the President, who would normally appoint officers exercising such powers.Alpine's central argument is that FINRA's board members are not appointed by the President, nor are they subject to Senate confirmation, as required by the Appointments Clause and the private non-delegation doctrine for officers of the United States. Alpine contends that, as a private, non-governmental entity, FINRA is composed of individuals who are not accountable to the public or elected officials in the same way that government agencies are. This, Alpine argues, makes its regulatory and enforcement powers unconstitutional. FINRA argues, however, that its regulations and enforcement decisions are under close scrutiny by the SEC, and, thus, that this delegation of federal power to it, a private regulator, is constitutionally permissible. FINRA also worries that accepting Alpine’s arguments could bring destabilizing and potentially disastrous consequences to the self-regulatory framework of the markets.The case involves questions about the balance between public regulatory authority and private self-regulation within the securities industry. The NCAA and the Power 5 conferences reached a historic proposed settlement in the House, Hubbard, and Carter cases, that will not only provide over $2.7B in back damages to eligible college athletes who don't opt out of the settlement, and will create a revenue sharing model going forward (among many other things), but will also attempt to limit the possibility of other antitrust lawsuits in the present and the future challenging restrictions on athlete compensation. One of those other lawsuits is Fontenot vs. the NCAA, an antitrust suit first brought in federal court in Colorado last year by the law firm Korein Tillery, led by Garrett Broshius. Garrett joins the pod to break down why he's bringing the case, how the House settlement impacts his case, his view on the House settlement, and why he's not ready to settle. Thank you for listening! The NCAA has reached a landmark proposed settlement in its three major antitrust cases that will require the NCAA to pay nearly $2.78 billion in back damages and permit schools to share up to 22% of their revenue with college athletes. Speakers: Angela Churie Kallhauge Executive Vice President, Impact, Environmental Defense Fund Angela Churie Kallhauge is the Executive Vice President, Impact at Environmental Defense Fund (EDF). Her work is focused on using inclusive processes and economic approaches to achieve ambitious climate solutions that deliver equitable benefits to people around the world. Angela joined EDF from the World Bank where she served as the head of the Secretariat of the Carbon Pricing Leadership Coalition (CPLC) for five years. Before that she was at the Swedish Energy Agency where she worked for 14 years on climate change, energy and development issues. During her time at the Swedish Energy Agency, she worked on carbon market development issues, including portfolio development and capacity building in developing countries. She also served as the EU lead negotiator on adaptation and resilience issues under the UNFCCC for close to a decade and represented Sweden in the Adaptation Fund Board where she led the work on accreditation for direct access. Angela also draws experience from the International Renewable Energy Agency, where she spent a couple of years leading the work to develop a climate change work program that places renewable energy action as a key part of climate change strategies. Prior to her engagement at the Swedish Agency, Angela spent close to a decade working at the Royal Institute of Technology in Sweden and in Zimbabwe and Kenya with civil society organizations on climate, energy and development policy. On this episode of Cut to the Chase: podcast, one of the lead counsel in the 3M Combat Earplug litigation cases representating the veterans, Mike Burns, discusses where things stand in the largest mass tort ever with over 230,000 veterans trying to get fair compensation from 3M after wearing defective earplugs that caused widespread hearing loss and tinnitus on our soldiers. 3M tried to get bankruptcy protection after losing against 13 of 19 veterans, but the bankruptcy court rejected that petition. Meanwhile 3M has taken an appeal on that denial and against the 13 victorious veterans. So not one soldier has been compensated. The Judge ended the year by issuing an Order establishing that 3M was the sole party responsible for any of these 230000 cases. Corey Stern is a partner at the New York based law firm of Levy Konigsberg where he works on environmental cases with a focus on children's right. Corey received a random call from a woman in a homeless shelter about dirty water so he dug in and that started him down a path that has led him to be Lead Counsel in the Flint Michigan Water Crisis case where he currently represents over 10,000 families/children who have been effected from contaminants in the city drinking water. Corey recently orchestrated a $600+ million settlement against the State of Michigan and is currently involved in additional litigation with other entities involved in the crisis. Corey just finished a 7 month bellwether trial that will help set the stage for the remainder of this ongoing litigation. I first met Corey over 20 years ago in Athens, GA. Corey is also a “Double Dawg” – graduate of UGA undergrad and UGA Law School and we talk about the connections he made at Law School and how it has shaped his legal career. Corey discusses why he took his first job out of Law School clerking for a judge and how that helped steer him on a path to representing Plaintiffs in personal injury cases to starting his own law firm to moving his family to New York for his current job. The Inquiry into Abuse in Care says abuse in state care of disabled, deaf and people who suffered mental distress was overt and systemic. The Royal Commission opens a public hearing on Monday in Auckland focusing on state institutions which provided care for these people between 1950 and 1999. The hearing will examine the use of control and restraint in disability and mental health care and impacts of long-term institutionalisation on survivors. Lead Counsel assisting the Commission, Ruth Thomas told RNZ reporter Andrew McRae the length of time some people spent in state care is a unique part of the evidence being presented.
Success Without Even Having to File a LawsuitWhen the Clapp family called Child and Parental Rights Campaign we thought we were in for a huge fight in federal court. After all, they live just outside of New York City, where gender ideology is radically supported. Their daughter was being socially transitioned to a “male” identity by her public school over her parents' objections. This, in spite of the fact that her therapist and a residential treatment center had insisted that it would be harmful to the young girl's mental health.In preparation for a federal lawsuit, we sent a letter to school officials demanding that they honor the parents' wishes and the medical opinion of the professionals who were working with the Clapps' daughter. In order to strengthen their position, we helped the parents retain a renowned psychiatrist to begin working with their daughter and she too submitted her medical opinion that it was in the child's best interest to not endorse their daughter's desire to be treated as if she were a “boy” by school officials.To the parents' great relief, the school officials caved and agreed to follow the parents' directions and the medical opinions of the medical professionals. This happened in New York State!You might wonder what fuels our resolve to fight this irrational ideology. It is emails like the one we received from Mr. and Mrs. Clapp after we helped them protect their daughter:"We can never adequately express the depth of our gratitude for your tireless work in restoring our parental rights to protect our daughter at school, nor can we ever adequately repay you for your grit, dedication, expertise, and manpower. To have a legal team of your caliber paying such scrupulous attention to our small case (and without nearly the monetary compensation you deserve) is astounding. We are still pinching ourselves that this went our way without going to court—and in New York State, no less! This is a testament your collective efforts, know-how, persistence, and passion for this cause.…we will be able to sleep at night knowing that, with your help, we've done everything in our power to safeguard [our daughter] from harmful people and practices. Again, you have our undying gratitude! Thank you for standing up for the rights of us and other parents who have been marginalized, condescended to, and disregarded by the public school system.
