This episode is about a woman who is largely incapacitated due to congenital health issues as well as a near drowning accident in early childhood. At 29 she was sexually assaulted by a caregiver. This encounter resulted in a pregnancy that was not diagnosed until the baby was being born due to incompetence on the part of the medical staff at the facility where she was being cared for. Although tragic her circumstances were able to bring about changes that will hopefully prevent another patient from being harmed in the future.

Arizona adults unable to protect themselves from abuse or exploitation because of a physical or mental impairment are falling through the cracks of the state system designed to protect them. This week on The Gaggle, an Arizona politics podcast, Yvonne Wingett Sanchez and Ronald J. Hansen get an advance interview with healthcare reporter Stephanie Innes about her reporting on the flawed system serving vulnerable adults. This includes myriad agencies, such as Arizona's Adult Protective Services, Arizona Department of Health Services and more. The episode takes you behind the scenes into a state task force meeting to hear heartbreaking testimony from victims and their families, and how local leaders are hoping to improve conditions. The state task force convened after a woman with severe disabilities was raped and gave birth at Hacienda HealthCare in December 2018. Hacienda HealthCare has been under international scrutiny since the January after an incapacitated patient was raped and gave birth. Another patient was found with maggots near a surgical wound. It sparked outrage over conditions at Hacienda, as well as fear over what might be happening at other care facilities across Arizona. Many of us are still wondering about the fallout. Arizona officials and Hacienda claim they have taken appropriate action and things are better. Parents of patients at Hacienda say it's a nice facility that they like. But a new investigation by The Arizona Republic reveals information about its condition and what it may mean for patients and the public more broadly. The Gaggle's hosts Yvonne Wingett-Sanchez and Ronald Hansen talk with Republic's reporters Robert Anglen and Stephanie Innes to break down part of their subscriber exclusive investigation and what it tells us about Arizona care facilities. Hello and welcome to Day in Washington, your disability policy podcast. I’m your host Day Al-Mohamed working to make sure you stay informed. I know everyone was watching the news about the Hacienda HealthCare facility in Phoenix, Arizona, where a 29-year-old patient had been raped several times, and the staff had no idea she was pregnant until she went into labor and gave birth to a healthy baby boy on December 29th. Originally the story posted that she was in a coma. That has been corrected by her parents who described her as intellectually disabled because of seizures in early childhood. While she doesn't speak, she has some mobility in her limbs, head and neck. She also responds to sound and can make facial gestures. What bothers me is that this isn’t some piece of meat on a table but that this was a vulnerable woman who was well aware of what was being done to her. Nathan Sutherland was the nurse who was supposed to be looking after her; and instead raped her. He was arrested in January after Phoenix police said his DNA was tied to the baby. Last month, his attorney said there was "minimum evidence" his client committed the crime. Really? The first of what will probably be many hearings, was yesterday. But let’s get real here. People with disabilities are sexually assaulted at nearly three times the rate of people without disabilities. A 2005 survey of people with disabilities indicated that 60 percent of respondents had been subjected to some form of unwanted sexual activity. Unfortunately, almost half never reported the assault. Approximately 80% of women and 30% of men with developmental disabilities have been sexually assaulted. The part that is really awful? Just 3% of them are ever reported. The vast majority of sexual assaults, 80 to 90%, are committed by someone the victim knows. And for many people with disabilities, comes from caregivers. The only reason Nathan Sutherland was caught, was because the woman gave birth. Notice, I didn’t say “got pregnant” because a very small, very jaded part of me wonders if some facilities don’t just “get such things taken care of” out of the light of day. The #MeToo movement has drawn much attention to sexual harassment and sexual abuse, I can only hope that as it garners more attention and visibility it continues to include disability. As of right now, even with the persistence and support of parents, family members and friends, victims with disabilities are not receiving justice. What is also disturbing, and is particularly important as related to disability, is that in many instances, the person who has a disability may rely on the perpetrator for care or support, making it even more difficult to come forward. Today, more and more women, including women with disabilities are coming forward to share their stories. We are not looking at just “ways to protect” but examining perpetrators and the structures and institutions that protect them and allow them to continue their behaviors. If the person being abused is considered a vulnerable adult under your state laws, you may also be able to contact the local Department of Human Services or Department of Social Services. She has seizure disorder and quadriplegia and had no way of defending herself against the sexual assault. 1. First Monday of F*&kery. We slide into 2019 with mixed weather and some fuckery left over from 2018. I discuss a news story about a woman who gave birth while in a vegetative state at the Hacienda Healthcare facility in Phoenix Arizona. Although they claim they have a great reputation of quality healthcare I feel their boasting should be on the back burner given the details of this story. I will be following this story for any further developments. For now I hope for better changes for 2019.
