This is not just any court. It's the United States Court of International Trade. Trump already appealed. Stephen Miller already called it a "judicial coup." The fact that America's corporations simply went along with Trump's crap when it knew - as the court knew - this was executive overreach - is its own problem. The halt on the tariffs will itself probably be halted by the appeals. So the re-shaping of the market will be re-re-shaped by the judges, and re-re-re-shaped by the further litigation. That, of course, is not Trump's problem. His only job is to break stuff. SPECIAL COMMENT: Now it's Governor Gretchen Whitmer has learned the lesson - twice. Never appease Trump, never negotiate with Trump, never cooperate with Trump, never support anything Trump wants, never do anything Trump wants. All that registers with him is: you are easier for him to destroy. She sucked up to him. She worked with him. He tricked her into appearing at his photo-op. She hid her face behind a folder like it was a perp walk. Now, he says he's looking into PARDONING THE TERRORISTS CONVICTED OF TRYING TO KIDNAP HER. There is only one way Gretchen Whitmer is going to SURVIVE Trump, Governor. Apple is going to SURVIVE Trump, Tim Cook. There is only one way Columbia is going to SURVIVE Trump, Claire Shipman. There is only one way the White House Correspondents are going to SURVIVE Trump, Eugene Daniels. If you haven’t figured it out yet, I’ll spell it out. Doing what he wants only tells him you will DO WHAT HE WANTS. So he comes back and gives you ANOTHER list of what he wants. He’s a blackmailer. He’s a crooked businessman. He’s a bully. Anybody remember Rudy Giuliani's alleged boast he could sell you a pardon for two million, to be split between him and Trump. And a past president's grandson has died. The president he was the grandson of, left office in... 1845. B-Block (33:00) THE WORST PERSONS IN THE WORLD: Kristi Noem and the camel she rode in on. Jesse Watters and Rep. Tim Burchett try to make fun of men using straws not remembering there's a photo of Trump at Yankee Stadium using a straw. And boy did THIS sound familiar: Rupert Murdoch just buried a New York Post reporter who followed all the rules and instructions Murdoch's minions had laid out for him, because somebody didn't like the story... Just like in 2001 Rupert personally fired ME for doing exactly the same thing (C-Block 43:00 THINGS I PROMISED NOT TO TELL). The punchline is the reporter's name is Josh Kosman and last September he was the guy at The Post who called and told me they were about to update the RFK Jr/Olivia Nuzzi sexting story by claiming I had lived with Olivia. Josh Kosman has been covering the financial industry for twenty-five years. The letter is a kind of Rosetta Stone that starkly lays out the peculiarities of the billionaire mindset. We didn’t want to get bogged down in a close reading here, but we’re planning a much more developed analysis of it in the near future. Coulter runs TPG Capital, which is one of the largest private equity firms. He loves to say stuff like "Data is the new oil." We spend a lot of time talking about what private equity is and how it works. The cool thing about private equity is that it has about $2 trillion in assets under management, making it one of the largest sectors of the economy and no one except the super rich are allowed to participate in it. If corporations are people, then PE firms are vampires. Leslie Alexander is the former owner of the Houston Rockets who is mixed up in “securitizing” private student loan debt taken out by students to pay for-profit colleges. Securitizing means “bundling,” which means packaging and reselling debt to investors, which, as far as I know, has caused no problems whatsoever in the past. His student loan company, First Marblehead went bankrupt because of too many people defaulting on loans. The company rebranded as Cognition Financial and the website says they do “private student loan solutions you can trust,” so presumably they’ve fixed all the problems and everything is good now. Josh Kosman returns to once again talk about the Private Equity industry, an industry many of us have little knowledge of and an industry that greatly impacts all of us. The facts are that the number two private employer in this country is a Private Equity firm, KKR, and among the top ten private employers in this country five of those companies are PE companies. There is no question that PE firms have a direct impact on our economy and thus should be on the radar screens for anyone following the economy. I asked Josh Kosman to come back on the show to give us an update on PE since we last spoke and to my surprise they are making a dramatic comeback. The reason is simple, with the Federal Reserve keeping interest rates far below the natural rate of interest the investment managers at pensions and mutual funds are looking for some yield to meet the hurdle rate (minimum acceptable rate of return) that is mandated by the fund. In effect, the Fed is pushing money right into the hands of the very PE firms that saddle good American companies with debt while gutting the infrastructure at the same time. It is a deal that leaves the companies unable to compete internationally and makes the US less competitive as a result. Hopefully Josh can give us some good news that things are changing...
