This Day in Legal History: Pennsylvania Coal Co. v. MahonOn this day in legal history, November 14, 1922, the Supreme Court heard arguments in Pennsylvania Coal Co. v. Mahon, a foundational case in American property law. At issue was a Pennsylvania statute—the Kohler Act—that prohibited coal mining beneath certain structures to prevent surface subsidence. The Pennsylvania Coal Company had previously sold the surface rights to a parcel of land but retained the right to mine the coal beneath. When the state blocked their ability to do so, the company sued, arguing that the law had effectively stripped them of valuable property rights without compensation. The case reached the Supreme Court, where Justice Oliver Wendell Holmes Jr. delivered the majority opinion.In his decision, Holmes introduced the now-famous principle that “while property may be regulated to a certain extent, if regulation goes too far it will be recognized as a taking.” This line marked the birth of the regulatory takings doctrine, which holds that government actions short of full appropriation can still require just compensation under the Fifth Amendment. Holmes emphasized that the economic impact of a regulation on the property owner must be weighed, not just the public interest it serves. In this case, the regulation was deemed too burdensome to be considered a mere exercise of police power.The Court sided with the coal company, holding that the Kohler Act, as applied, amounted to an unconstitutional taking. The dissent, penned by Justice Brandeis, warned against undermining states' ability to protect public welfare. Despite being a 5–4 decision, Mahon has had lasting influence on land use, zoning, and environmental regulation. It reframed the boundaries between public regulation and private rights, signaling that not all public-interest laws are immune from constitutional scrutiny. Today, Mahon remains a cornerstone case for litigants challenging regulations that significantly diminish property value.A Texas judge is set to hear arguments on Attorney General Ken Paxton's request to block Kenvue from issuing a $398 million dividend and from marketing Tylenol as safe during pregnancy. Paxton sued Kenvue in October, accusing the company of hiding risks linked to prenatal Tylenol use, including autism and ADHD—a claim not supported by the broader medical community. The lawsuit follows public comments by Donald Trump and Robert F. Kennedy Jr. promoting the same unproven theory. Kenvue and Johnson & Johnson, which previously owned Tylenol, maintain the drug's safety and argue the state has no authority to interfere in federal drug regulation or corporate dividends.The companies also say the dividend will not impair Kenvue's solvency and warn that Paxton's effort could undermine both the First Amendment and the credibility of Texas courts. Paxton, however, argues that the public interest justifies intervention, citing potential future liabilities from Tylenol and talc-related lawsuits. He contends that misleading commercial speech can be regulated, and that the dividend should be halted to preserve cash in the face of those risks. The law firm sued the West African nation in 2022, claiming it was still owed money for representing Sierra Leone in a high-stakes case against Gerald International Ltd., which had sought $1.8 billion in damages over an iron ore export ban. Jenner argued the legal work was more extensive than initially expected and said it had only been paid $3.6 million by the end of 2021.Sierra Leone pushed back, disputing the existence of a valid contract and asserting that no further payments were owed. The country also tried to claim sovereign immunity, but a federal judge rejected those arguments in January, allowing the lawsuit to proceed. U.S. Magistrate Judge G. Michael Harvey announced the settlement in principle last week, although specific terms were not disclosed. Back in 2021, Margaret Atwood came on the show to give her dark take on the American future. Four years later, Atwood's prescience, particularly in her 1985 classic The Handmaid's Tale, is increasingly self-evident. As the journalist Irin Carmon notes, MAGA America has become an Atwoodian dystopia of trad wives and state fecundity. But it is also, Carmon warns in her new book Unbearable, a place that actively discriminates against pregnant women, especially those of color. American women are dying in childbirth at three times the rate of their peers in other wealthy nations. Even in liberal New York City, Black women are nine to twelve times likelier to die than white women. So MAGA America is simultaneously fetishizing and punishing fecundity—celebrating “Trump babies” while jailing pregnant women who test positive for drugs. Forget the trad wives. The problem lies with the trad men making pregnancy so unbearable in America today.1. America's Maternal Mortality Crisis Is a National Disgrace American women die in childbirth at three times the rate of their peers in other wealthy nations. In New York City—one of the world's wealthiest cities—Black women are nine to twelve times likelier to die from pregnancy-related causes than white women. For every death, there are 60-70 cases of severe maternal morbidity, including hemorrhage, sepsis, and hysterectomy.2. MAGA's Pronatalism Is Rooted in White Supremacy The natalist ideology espoused by RFK Jr., JD Vance, Elon Musk, and Trump himself is explicitly linked to eugenics and deportation. As Carmon notes, “We want our people to have babies” is something you hear openly from MAGA leaders. They celebrate “Trump babies” while considering children born to immigrants as not truly American—making fertility central to their white supremacist project.3. Pregnancy Has Been Criminalized in America Since Dobbs, there have been 412 pregnancy-related arrests in the United States, about half of them in Alabama alone. Women are being jailed for testing positive for drugs while pregnant—not offered addiction treatment, but arrested and held on impossible $10,000 cash bail. Some women don't even know they're pregnant until they're tested upon admission to jail. Their pregnancies become evidence against them.4. The Handmaid's Tale Was Always About American Slavery As Carmon points out, the dystopia Atwood portrayed was already the reality for enslaved Black women in America. The “father of obstetrics and gynecology,” J. Marion Sims, experimented on enslaved women—Anarcha, Betsy, and Lucy—for years without anesthesia or consent. American pregnancy care was founded on the torture of Black women's bodies, and that legacy continues today.5. The Trump Administration Is Erasing the Evidence Trump has effectively canceled PRMS (the pregnancy research monitoring service) that tracks maternal morbidity and mortality nationally. Research grants studying how to improve maternal health are being cut as “DEI violations.” CDC pregnancy data is being deleted from websites. RFK Jr. says that new dietary guidelines will be released in December and he claims they will change food culture in the U.S. We can hope this change is positive, but considering how RFK Jr has backed mRNA, rubber stamped a MAHA report with AI writing and errors, and push processed prepared meals, the change might be negative. Already the USDA recommends vegetables and fruits, but RFK Jr. has hinted how the new guidelines will include more promotion of meat and dairy products, though he say “Whole Foods” will be a big part of the new guidance. Is it possible the guidelines get worse? Does it matter when few consult them to begin with? What does it matter when some States try to independently start initiatives that lack funding and respect anyway? Even if the entire government of every state moved in a positive direction is it possible the public would rebel? (2:00) Being policy-focused rather than party-focused in governmental policy should be the focus. (8:30) Dr. Hampton describes his career focus on improving metabolic health, including how to incentivize doctors to help people discontinue medications and reduce the cost of care. (12:00) RFK Jr. may not always speak clearly to the mainstream public in a way that resonates. Dr. Hampton still faces challenges in the mainstream medical space, where other doctors struggle to embrace certain concepts; for example, many of his peers continue to have trouble accepting the idea that saturated fat is not harmful. (14:00) Despite the benefits of a low-carb or ketogenic diet and its positive effects on things like diabetes and other metabolic diseases, it is still not accepted by many doctors. (21:00) Advocating and Taking Action Dr. Hampton describes a current concept in healthcare being initiated by Advocate Trinity. (31:00) They discuss the negative aspects of GLP-1s. The muscle loss associated with GLP-1 is more pronounced than that observed with natural weight loss.
