In 2008, Allan Schoenborn killed his three children, a crime for which he was judged to be NCR or Not Criminally Responsible because of mental health issues. Since then Schoenborn has been held at the Forensic Psychiatric Hospital in Coquitlam, B.C. The hearing was attempted in April of this year but proceedings devolved into chaos. The hearing will resume this coming week and what should we expect? AND: Not Criminally Responsible. Courts in dissaray in Ontario at this time because of staffing issues and health concerns within courtrooms (mold). Hundreds of criminal cases (and maybe more) may be thrown out because of not meeting required timelines from charges being laid to a trial concluded, per the Supreme Court Jordan decision of 2016. Might killers walk?Not the first time. In 2017 a report by the Senate standing committee on legal and constitutional affairs, revealed tens of thousands of criminal cases may have to be thrown out for the same reason. And then there's the issue of NCR. Not Criminally Responsible. NCR has been a national headlines creating reality and is again in British Columbia with premier David Eby "whitel hot" angry over the release of an NCR psychiatric patient, Blair Evan Donnelly, who stabbed his teenage daughter to death and last weekend stabbed three people at the Light Up Chinatown festival in Vancouver. Also making news this week, Matthew de Grood of Calgary who stabbed 5 university students to death at a Calgary house party in 2014. de Grood was found to be NCR 2 years later because of undiagnosed schizophrenia and was sent to the Alberta Hospital in Edmonton where he receives ongoing psychiatric treatment. Last year the Alberta Review Board assessed de Grood as a continuing significant threat to the public and not entitiled to an absolute discharge. Now de Grood is appealing to the Supreme Court of Canada in order to gain a conditional discharge with additional freedoms. Confessed mass murderer Jarrod Ramos had a long-running feud with The Capital Gazette. Ramos thought an article about him made him look “crazy” so he demanded a retraction and apology. When he didn't get either, he sued the newspaper and the reporter for defamation. A judge dismissed his case and when Ramos exhausted his appeals, he withdrew from the world — living like a hermit. He stayed at home with his dying cat as his only companion, planning his revenge against The Capital Gazette for two years. When he finally took her to be euthanized, he was ready to launch his plan to kill as many people as he could at the newspaper. In this episode, you'll hear about Ramos from his younger sister, who has testified in the trial. Police witnesses talk about his reaction when he was apprehended and questioned. Ramos pleaded guilty to murder in the shooting deaths of 5 people on June 28, 2018, but his lawyers are asking the jury in this trial to find him “Not Criminally Responsible.” You'll find out what the law requires for this insanity defense to succeed. Episode 095 - On a summer evening in 1995 sportscaster and former NHL hockey player Brian Smith, 54, was shot by a stranger as he exited the CJOH studios in Ottawa, Ontario after a day's work. The two me had never met, but the gunman, a man named Jeffrey Arenburg from Bridgewater, Nova Scotia was convinced that the murder of the beloved sportscaster would bring attention to his plight, and perhaps, put a stop to his thoughts being stolen and broadcast by Smith's TV station. Arenburg, who'd suffered from paranoid delusions for years, and had been in and out of court and hospitals, was found NCR, not criminally responsible, for the murder. This week ON THE LEDGE welcomes Melissa Lantsman as a guest contributor. Melissa’s a VP at Hill and Knowlton and was also a war room strategist for the Ontario PC party during the 2018 provincial campaign. All the talk in Toronto was about the spike in gun violence this week. The region averaged more than 2 shootings a day in a 7 day stretch. That has prompted Ontario Premier Doug Ford to reiterate his law and order commitment to the Toronto Police Service in the form of $25 million. Ford and Toronto Mayor John Tory are expected to make a joint announcement in the coming week on their plans to curb the rash of shootings.  That is likely to score the premier some positive marks in the 416 but Doug Ford caught a good deal of criticism after he unleashed on the Not Criminally Responsible patients - calling them “animals” who need to be jailed rather than treated at CAMH. His willingness to be baited by the media and his political opponents suggest it’s going to be hard for Doug Ford to sit quietly on his hands AND on the sidelines during the pending federal election campaign.

Tim McLean left Edmonton at 12 a.m. on July 30, 2008, on board a Greyhound Bus, destined for Winnipeg. At 7 p.m. the bus left one of the scheduled stops with a new passenger, Vincent Weiguang Li. Li, a tall man, with shaved head and sunglasses, sat near the front of the bus but moved next to McLean following a scheduled rest stop. McLean proceeded to fall asleep with his headphones on. Suddenly there was a blood-curdling scream and Li was standing over McLean stabbing him repeatedly in the neck with a huge knife. McLean struggled and tried to escape but couldn't as Li was blocking the aisle. The bus driver pulled to the side of the road as screaming, panicked passengers fled the bus. The driver and two other men tried to rescue McLean but were chased away by Li, who slashed wildly at them from behind the locked bus doors. Li then decapitated McLean and displayed his severed head to passengers outside. Li began severing body parts and eating McLean's flesh. By 9 p.m. Police were in a stand-off with Li, who taunted police, continuing cannibalizing and defiling the corpse. At 1:30 a.m. Li tried to escape out a window and was tasered and arrested. Body parts of the victim were found in plastic bags on the bus while one ear, the nose and the tongue were found in Li's pockets. McLean's eyes and part of his heart were missing.  Li, his face bloody, pleaded with officers, "I'm sorry. I'm guilty. Please kill me!"In March 2009 Vincent Li was found Not Criminally Responsible for the gruesome murder of Tim McLean in 2008. In May 2015 Vincent Li was released from custody from the Selkirk Mental Health Centre and is now a free man living in a group home.   In February, 2009, Guy Turcotte a cardiologist stabbed his two young children, Anne-Sophie, 3, and Olivier, 5, 46 times while they were lying in their beds. Turcotte admitted to the killings, but in the subsequent murder trial he claimed he could not recall carrying them out. The Guy Turcotte murder trial was one of the most closely followed in recent history in Canada — both horrifying and captivating the public. The jury deliberated for 5 days, deciding on the fate of the cardiologist charged with first-degree murder in the deaths of his children Olivier and Anne-Sophie. The trial hinged on Turcotte’s state of mind at the time of the February 2009 slayings. Was he trying to get revenge on his estranged wife, a fellow doctor, for cheating on him with a mutual friend? Or was he a sick man who had lost all reason? Turcotte’s lawyers argued he had been rendered temporarily insane over the recent breakup of his marriage with Ms. Gaston. In the July verdict, a jury found he was “not criminally responsible” for his actions. In September, Turcotte faced a five-person mental health tribunal to determine whether he should be released, or whether he should be detained for another year. As the mental health tribunal decided whether to set Guy Turcotte free, hundreds of protesters gathered in 14 Quebec cities calling for an overhaul of the justice system.
