Watch the full coverage of the live stream on @TheEmilyDBaker YouTube channel: https://youtu.be/Gi3OiGX-PBs In this Case Brief update on the Kouri Richins case, we delve into the latest motions filed by the defense, including their attempt to subpoena Kouri Richins' sister-in-law, Katie Richins-Benson, the executive of the estate. The defense is seeking financial activities of the Eric Richins' living trust from March 3rd, 2022, to the present, as well as copies of checks drawn from the sister-in-law's personal or business accounts made payable to individuals connected to the investigation. Katie's attorney responds to the subpoena, calling the requests vague, ambiguous, and an "undue burden" and "blind fishing expedition" aimed at harassment. The attorney clarifies that individuals the defense insinuated were "paid witnesses" are actually retained expert witnesses in the civil case regarding the estate. The defense claims a witness, Robert Crozier, recanted his statement about selling fentanyl, now stating he only sold Oxy or Roxy's. The prosecution argues there's no undisclosed exculpatory evidence and that Crozier's recent assertion is not credible. The defense's motion to reconsider bail and conditions of release is discussed, with the prosecution asserting that Crozier's changed statement does not amount to a material change in circumstance. Kouri Richins' attorneys request a hearing in the civil case regarding the estate to compel production of trust report information and enforce an order requiring trust accounting, believing this information will impact the criminal trial. Watch the full coverage of the live stream on @TheEmilyDBaker Emily D. Baker YouTube channel: https://youtu.be/FGOrXwYIQA4 In this case brief, we discuss the latest developments in the Brian Walshe murder trial. Originally scheduled for October 20th, the trial has been postponed due to a jail attack on Brian Walshe and a subsequent order for a mental health competency evaluation. The defense is still fighting to obtain "Proctor text messages," which are crucial for discovery. The prosecution plans to present evidence suggesting Brian Walshe knew about his wife's extramarital affair prior to her disappearance, and that a private investigator was hired to look into her infidelity. There's interest in Brian Walshe's prior federal art fraud case and its potential connection to money laundering, and whether it was a "tipping point" in the current case. While the trial is expected to be delayed for several months, it is anticipated that Brian Walshe will eventually be found competent to stand trial, as the bar for competency is "incredibly low." The episode briefly mentions the conclusion of the Donna Adelson trial on September 4th before delving into Proctor's case. Proctor, the lead investigator in the Karen Reed case, was fired after the first trial due to misconduct. His administrative hearing aims to determine if his termination was justified. The Massachusetts State Police must prove his misconduct warranted termination, after which Proctor can argue for a lesser disciplinary action. The State Police attorney used strong terms like "distasteful," "unprofessional," and "disgusting" to describe Proctor's actions. The charges include: sending derogatory texts about Karen Reed, sharing confidential investigative information with non-law enforcement individuals, engaging in unprofessional conduct that harmed the State Police's reputation, and drinking alcohol on duty while operating a department vehicle. The last charge, though unrelated to the Karen Reed case, was uncovered through his text messages. The State Police presented 36 exhibits, including Proctor's own trial testimony where he admitted to his actions.Proctor's attorney is delaying his full defense until October, citing a lack of discovery from the State Police. He argues that prior to February 2024 (when his texts were discovered), Proctor was an "exemplary" 12-year veteran with no disciplinary record. The defense intends to focus on the texts as "personal things" that shouldn't lead to job loss, despite the irony of the State Police withholding discovery. Watch the full coverage of the live stream on The Emily D Baker YouTube channel: https://youtu.be/R1zhYkOKL1U Day 8 of the Donna Adelson trial happened on September 3, 2025 and the main question was whether Donna Adelson would testify? Ultimately, she did not, after attempting to get more time from the court to make her decision. The defense rested their case, and the prosecution will not be bringing a rebuttal. Closing arguments are scheduled for tomorrow morning, September 4, 2025.A significant portion of the day was spent discussing a second violation of the witness sequestration order by the defense. The judge expressed frustration that her instructions were not being followed, as a defense expert witness was present in the courtroom during another witness's testimony. Despite the prosecution's request for exclusion, the judge reserved her ruling, noting that exclusion is an extreme remedy and could create appellate issues if Donna Adelson is convicted. The defense called two witnesses: Kristin Adamson, Wendi's Previous Family Law Attorney and Linda Bailey, a Family Law Attorney Expert, to discuss the Markel divorce case. Their aim seemed to be to downplay the contentious nature of the divorce, arguing it was a "normal" case and not as emotionally charged as the prosecution portrayed. However, the prosecution's cross-examination highlighted that even routine legal matters can be highly impactful and emotionally charged for the litigants involved, echoing Donna Adelson's own emails about the divorce being critical. With the defense and prosecution both resting, the court moved to the charging conference to finalize jury instructions for charges including first-degree murder, conspiracy to commit murder, and solicitation of murder. The trial saw 27 witnesses for the prosecution and 12 for the defense over eight days. The upcoming closing arguments are expected to be lengthy, and deliberations could begin tomorrow. Donna Adelson's decision not to testify was likely strategic, as her testimony could have potentially hurt her case. The argument that she needed more time to decide on testifying is dismissed as unlikely to succeed on appeal, given the extensive time and continuances already provided to the defense. Watch the full coverage of the live stream on The Emily D Baker YouTube channel: https://youtu.be/gcNGmZoS-7w Day 7 of the Donna Adelson trial happened on September 2, 2025 and began the Defense's case-in-chief. The Defense faced immediate challenges with witness scheduling, leading to an early dismissal and the judge expressing strong displeasure about the lack of preparedness and adherence to the court's timeline. The Defense introduced a tech expert, Kelsey Guay, to refute the prosecution's analysis of phone records. The expert aimed to demonstrate that the prosecution's method of counting calls between Donna and Charlie Adelson inflated the actual number of unique call events due to duplication. The Defense also argued that Donna's phone did not connect to a cell tower near Charlie's home on the day of the murder, attempting to mitigate the significance of her "I'm outside" text. Anne Cunningham & Ron Gutterson, friends of the Adelson's, took the stand to testify about Donna's distressed state after the murder. The Defense also questioned investigators, Tehronna Khan & Eddie Varnes, who interviewed jailhouse informants, particularly Patricia Byrd, to challenge any claims of Donna offering inducements for testimony. A point of contention arose regarding WhatsApp voice calls in 2014, as Anne claimed to have used it for calls with Donna, but it was noted that WhatsApp did not offer voice calls until 2015, suggesting the calls must have been via Viber. Will Donna Adelson testify? That remains the big question as the defense moves into Day 8. Watch the full coverage of the live stream on The Emily D. Baker YouTube channel: https://youtu.be/Biij9nLHQjc Day 6 of the Donna Adelson trial happened on August 29, 2025 and we heard the infamous recorded jail call where Charlie was disconnected, and Donna continued talking to people in the house with an open line. Her exchanges with Wendi about getting her affairs in order and taking a one-way flight, expressing concern about not being able to leave in time, were very revealing. This seemed to be a clarified version of the call, with a transcript provided. Following this, Donna was arrested at the airport. After Agent Sanford was excused and the jury left for lunch, the court took the unusual step of swearing in Donna Adelson. This happened after an off-the-record sidebar discussion. The court asked if she was on board with the defense's strategy for cross-examining two witnesses: the jailhouse informants. Donna, under oath, confirmed her agreement with the defense's cross-examination strategy and its impact on her rights. The court's unusual requirement for a sworn statement on defense strategy, typically seen only when a defendant testifies or not, highlights potential concern for protecting the record. Today was packed full of testimony that is potentially devastating to the defense. Following the lunch break, testimony was heard from two jailhouse informants. One of the informants, Patricia Byrd, revealed that Donna admitted to her that she committed the crime in order to “keep her grandkids, but it wasn't supposed to go that far”. Drina Bernhardt, another informant, revealed that Donna provided an alleged script that she was instructed to redo in her own handwriting. The day ended with the state resting their case, Donna's defense will present their case beginning on Tuesday, September 2, 2025. Watch the full coverage of the live stream on The Emily D. Baker YouTube channel: https://youtu.be/eCpmhdqfwDs Day 5 of the Donna Adelson trial happened on August 28, 2025 and focused heavily on the critical wiretap evidence presented by the prosecution. We explore the intricate web of phone calls between Donna, Charlie Adelson, Katie Magbanua, and Sigfredo Garcia, highlighting how these conversations reveal attempts to cover up information and Charlie's escalating panic. These recordings are presented as critical evidence by the prosecution to establish conspiracy and cover-up attempts. The analysis highlights the "game of telephone" played by the co-conspirators as they relay information and react to developments. Charlie's increased panicked state as the investigation progresses. He is heard trying to control the situation, denying knowledge of a "family problem" to an undercover agent, and attempting to convince others not to talk to authorities. His calls reveal his belief that law enforcement wouldn't have sufficient evidence, despite being on a wiretapped line.Donna claimed to the under cover agent, that her grandchildren using her phone and her openly discussing the situation with friends, are presented as attempts to deflect responsibility. The prosecution views her actions, including her repeated urging for Charlie to "handle it," as evidence of her involvement in the conspiracy. The prosecution's approach of likening the case to "train cars that didn't move" and emphasizing the rapid, back-and-forth communication among the conspirators is noted. The trial is nearing the end of the prosecution's case, with a highly anticipated "clarified audio of the jail call" (where Donna discusses a one-way flight to a non-extradition country) still to be presented. Baker YouTube channel: https://youtube.com/live/Q2sgVWyygnQ Join us for a comprehensive recap of Day 1 of the Donna Adelson murder trial, which kicked off Friday, August 22nd, 2025, in Florida. Judge Everett is pushing for a swift trial, aiming to have the case to the jury by September 5th! Discover the state's powerful argument outlining Donna Adelson as the "relentless driving force" behind the murder of Dan Markel. We delve into their claims of motive (hatred for Dan Markel, desire for relocation of her grand children), alleged bribes (including a $1 million offer), and threats. We analyze the defense's strategy, which surprisingly focused heavily on praising Dan Markel as a loving father and professor, while arguing that there is "not a single piece of evidence" directly linking Donna Adelson to planning, hiring, or intending the murder. Their core theme: "It wasn't me." Luis Rivera took the stand and confirmed that he was hired to participate in the murder of Dan Markel. He testified that he had no direct contact with "the dentist" (Charlie Adelson) or any other member of the Adelson family. He confirmed that "everything went through Katie." He also stated he knew nothing about "the lady in Tallahassee whose kids who needed her kids" (presumably referring to Wendi Adelson). Watch the full coverage of the live stream on The Emily D. Baker YouTube channel: https://youtube.com/live/X7H24DzEPnI Due to numerous public records requests in the Bryan Kohberger Case, law enforcement agencies in Idaho released over 200 crime scene photos online, some of which depict the victims, albeit blurred. Though it was blurred it still leaves room for the imagination and recommended that it be blacked out redactions. This widespread release occurred because the case did not go to trial, meaning the photos didn't undergo the official sealing process typically seen in court proceedings like the Alex Murdaugh case. The lack of judicial oversight in the release process of the Bryan Kohberger Case led to a lawsuit against the city of Moscow. Madison Mogen's mother, Karen Laramie, requested a temporary restraining order (TRO) after redacted crime scene photos were released. On August 15th, Idaho Second District Judge Marshall issued a TRO, blocking the city from releasing any further images, audio, or video depicting the inside of Madison Mogen's bedroom until a preliminary injunction hearing on August 21st. While the TRO specifically applies to Mogen's bedroom, the city has stated it will not release photos or videos from any victim's bedroom until the court fully reviews the matter. The attorney representing the families, Leander James, emphasized that the families want peace and not conflict, and urged the public to avoid viewing the photos. Watch the full coverage of the live stream on The Emily D. Baker YouTube channel: https://youtube.com/live/ArCNozStXbQ Donna Adelson's defense attempted to subpoena Wendi Adelson to testify, but her attorneys successfully moved to quash (squash/get rid of) the subpoena. The judge ruled that Wendi Adelson would assert her Fifth Amendment rights if called by the defense, and calling a witness solely to invoke the Fifth Amendment in front of the jury is inappropriate. Wendi Adelson is still subpoenaed by the prosecution, which grants her derivative and use immunity for her testimony. Jury selection began on August 19th, 2025. The process involves individual voir dire, where potential jurors are questioned one-by-one to prevent information about the high-profile case from influencing other jurors. The goal is to find jurors who have not formed an opinion about the case, even if they have heard about it. The judge read a statement of the case and the material part of the indictment to the potential jurors. Donna Adelson is charged with first-degree murder, conspiracy to commit first-degree murder, and solicitation of first-degree murder in the death of Dan Markel on July 18, 2014. These statements are not considered evidence of guilt. Learn more about your ad choices. Visit podcastchoices.com/adchoices

Watch the full coverage of the live stream on The Emily D. Baker YouTube channel: https://youtube.com/live/NZXF2GjEDGA The Commonwealth of Massachusetts is in a difficult position regarding Former Trooper Proctor's federal discovery. While federal discovery was provided in the Karen Read case, a protective order limits its use. Defense attorneys in other cases argue for access to this information, as Trooper Proctor was a lead investigator. The Commonwealth has been negotiating with the US Attorney's Office to modify the protective order. The motion for modification also seeks permission for the Norfolk District Attorney's Office to review remaining confidential materials provided to the prosecution and defense teams in the Karen Read case. The Commonwealth has made headway with the feds to review additional discovery materials, including grand jury and non-grand jury materials, which they have not yet seen. These materials were not part of the discovery turned over in the Karen Read case, suggesting they might be separate investigations. For the new grand jury and non-grand jury materials, the Commonwealth will first review them to determine if they need to be disclosed. Then, the federal court will decide if these materials can be turned over, potentially with an additional protective order. A future hearing on discovery process is scheduled for August 28th, 2025, at 2 p.m. ET. The Brian Walshe case is moving forward to trial in October 2025; highlighting the urgency of receiving discovery and rulings on motions to dismiss to prepare for trial. Watch the full coverage of the live stream on The Emily D. Baker YouTube channel: https://youtube.com/live/FRAkjqjIHUI Jury selection for Donna Adelson's trial is set for August 19th, with the state's case beginning around August 25th. Once a jury is seated, opening statements will follow quickly. Most motions were addressed, with the court ruling that evidence would be admitted if relevant. Dan Markel, a legal professor, was murdered in 2014 amidst a child custody battle with his ex-wife, Wendi Adelson, Donna's daughter. The prosecution alleges that Donna Adelson and her son, Charlie Adelson, conspired to murder Dan Markel to resolve the custody issue, believing that without a father, the court couldn't force shared custody in Tallahassee. Two gunmen and a "middle person" (who worked at Charlie's dental office and is expected to testify) have already been prosecuted in connection with the murder. Charlie Adelson was also convicted. This will be the fourth time the government has prosecuted a part of this case, with Donna being the last to be charged. Will Charlie Adelson will testify? How will Wendi Adelson will testify. Watch the full coverage of the live stream on The Emily D. Baker YouTube channel: https://youtube.com/live/dpvMV9XQhOs Obtaining a federal download of Former Trooper Michael Proctor's phone data is sought by attorneys for multiple defendants in Norfolk County murder cases because it may contain exculpatory evidence. However, Proctor's lawyer claims nothing exculpatory exists outside the federal materials, partly because Proctor got a new phone in February 2024, potentially wiping earlier data. The problem is that the state police and Norfolk DA cannot directly extract this data; they must get it from the feds, who rejected requests for discovery from other prosecutions but turned it over in the Karen Read case. In the Karen Read case, the federal discovery was turned over, but it came with a federal protective order prohibiting its use in other cases. This creates a "boot loop" or "procedural quagmire" because Assistant District Attorney McLaughlin, who worked on the Read case, is aware of potentially exculpatory and impeachment information regarding lead investigator Former Trooper Proctor contained within these federal materials. Under Rule 14, McLaughlin is obligated to disclose the existence of such information to the defense in other cases (like the Walshe case), but the federal protective order prevents the office from physically turning over or even reviewing this material for exculpatory content. This forces the defense to argue for potentially exculpatory evidence they cannot see or definitively prove. The judge, however, noted that the defense has had the same discovery as the prosecution and that the prosecution has an obligation for full disclosure. A contentious motion to quash a subpoena issued by the defense. Baker YouTube channel: https://youtube.com/live/V_gRWoUtPKY A hearing was held on August 5th, which was intended to continue the evidentiary portion of the motion to dismiss for the Myles King Murder Case, but this did not happen. Instead, the court requested the defense and prosecution to collaboratively create a comprehensive list of all evidence, when it was turned over, and which items are considered prejudicial by the defense. This is complicated by the fact that the prosecution did not consistently bate stamp documents. Another significant issue is the ongoing delay in receiving discovery related to Former Trooper Michael Proctor's text messages, which are relevant to five cases, including the Myles King case. The court is waiting for federal authorities to release this discovery. The defense is frustrated by the continuous "dripping faucet" of new discovery, making it difficult to prepare their case. The bar for dismissing a case due to discovery failures in Massachusetts is high, and typically, the remedy is to grant more time for trial. The Karen Read case has brought attention to this widespread issue of lingering discovery in Massachusetts cases. The next hearing for the Myles King case is scheduled for August 12th at 2pmET, where the judge will continue to try and clarify the specific evidence at issue for the motion to dismiss. Her legal team has filed two significant motions: a motion for the return of her seized property and a motion to release impounded sidebar transcripts. First, we delve into the motion to return property. Karen Read's attorneys are pushing for the return of her 2021 Lexus LX 570 and personal cell phone, which were taken by the Massachusetts State Police. We explore the complexities surrounding the damaged Lexus, which was disassembled as part of the investigation, and how this might impact her car insurance claims. Next, we examine the motion for relief from sidebar impoundment. Karen Read's legal team is seeking the release of transcripts from sidebar conferences held during both pretrial proceedings and the trials. The argument is that "good cause" for keeping these discussions sealed no longer exists now that a verdict has been reached. We highlight the video's commentary on the unnecessary impoundment of pretrial sidebar discussions, especially when no jury was present, distinguishing these from the justified sealing of discussions related to the federal investigation. He was also given various fines and civil penalties. The Judge Hippler stated that Kohberger would be imprisoned until he dies and would likely be moved out of Idaho for his own safety. The judge delivered a powerful statement, acknowledging the courage and strength of the victims' families and survivors, and emphasizing that focusing on "why" gives Kohberger undue power. The judge also clarified that while Kohberger waived his right to appeal, he still has the right to file a notice of appeal, though doing so might violate his plea agreement and potentially lead to the state seeking the death penalty. The judge imposed the maximum possible fines and penalties, speculating that this was partly to ensure that any future profits Kohberger might attempt to make from his crimes would go to restitution and fines. However, he clarified that the court's prior preservation order remains in place, and sealed documents are still sealed. The media's petition to unseal all documents was denied as premature. The judge stated that after sentencing, scheduled for July 23rd, the court will begin reviewing sealed materials to determine what can be unsealed, starting with the newest documents first. This process will allow counsel to object to unsealing specific documents or request redactions. He warned that this unsealing process will take a considerable amount of time, and public records requests for sealed documents will be denied until they are officially unsealed. The judge also addressed the right to appeal, noting that while Kohberger's plea agreement includes a waiver of appeal rights, the US Supreme Court's ruling in Garza v. Idaho indicates that a defendant's right to file the appeal. Therefore, the appellate process is expected to play out. The investigation into document leaks is ongoing. They are text messages between Murdaugh and Eddie Smith. This is in addition to the ongoing appeal of the murder conviction based on allegations that the clerk of court, Becky Hill, influenced the jury. This could mean that a new murder trial can occur. However, Murdaugh will remain in prison for decades due to his multiple financial crime convictions. The gag order has been lifted in the Bryan Kohberger case and his sentencing is scheduled for Wednesday, July 23rd. While he waived his right to appeal, he can still file one, though it is unlikely to change his predetermined four consecutive life sentences. Tom Girardi has reported to prison as of July 17th, 2025, despite his attempts to delay. Court documents indicate that his motion for bond pending appeal will be heard in September, but the attorneys agreed he would go into custody in the interim. Denise Richards and Aaron Phypers are divorcing. Denise has filed for and received a temporary restraining order, alleging physical violence. Media reports suggest this grand juror was involved in the Karen Read case and leaked information related to it, though I caution that grand juries handle numerous cases, and this specific connection is not yet definitively confirmed from official documents. The individual was charged on July 11th and has already signed a plea agreement to plead guilty. Her initial appearance in federal court is scheduled for July 22nd. The plea agreement, dated July 11th, indicates prior conversations between her attorney and the U.S. Attorney's Office. Fallout from the Karen Read Retrial continues, focusing on Boston Police Commissioner Cox's statements regarding Officer Kelly Dever and a strongly worded letter from Attorney Alan Jackson asking she be added to the Brady List. Officer Dever testified in the Karen Read Retrial, stating that her initial observations to the FBI about Burkowitz and Higgins in the Canton PD sallyport garage were a "false memory." She claimed she didn't recall the Commissioner telling her to "do the right thing," despite previously telling the defense he said that to her. Commissioner Cox denied knowing Officer Dever was associated with the Karen Read case and that he influenced her testimony, despite her acknowledging a meeting with him where he offered support. He stated he "encourages" many officers. Karen's Defense Attorney, Alan Jackson, sent a formal letter to Commissioner Cox, requesting that Officer Kelly Dever be included in the Brady database. This is due to her changed testimony and "false memory" claim, which he argues irreparably compromises her credibility and reliability as a law enforcement officer. Jackson asserts that if she lied, it's perjury, and if she truly suffers from false memories, she's unfit to serve. Jackson's letter warns that failure to disclose this information would be a constitutional violation, potentially leading to severe sanctions, including the dismissal of any cases Officer Dever is involved in, even post-prosecution, if this information is not disclosed to the defense. Baker YouTube channel: https://youtube.com/live/C8Ou77B6Eow In Sarah Boone's latest letter to the court, she is inquiring about the status of her appeal and her court-appointed appellate attorney. She states that her attorney sent one introductory message in February 2025 and has not responded to her five inmate messages, two handwritten letters, or attempts by nine third-party representatives. Boone says her appeal is in jeopardy because an order was issued on June 13, 2025, requiring an initial brief within 20 days, or her appeal may be dismissed due to lack of communication from her attorney. However, there was a third extension granted on the appeal. She argues that her attorney's failure to perform duties or communicate cannot be held against her and that dismissal would deny her due process and effective assistance of counsel. The trial court judge cannot force the appellate attorney to communicate and that appeals typically take a long time, with minimal client input needed since the brief is based on the record. There might be a desire for Boone to control her lawyer, which is often not how the attorney-client relationship works in appellate cases. Watch the full coverage of the live stream on The Emily D. Baker YouTube channel: https://youtube.com/live/Yy9rHg9m4xkBryan Kohberger has signed a factual basis admitting to the burglary and four murders, and a plea agreement for a fixed life sentence without parole or opportunity for reconsideration. This means a life sentence with no possibility of release. He has also waived his right to a fair trial, including the right to confront and cross-examine witnesses. Consequently, the media argues that the non-dissemination order should be lifted, as there is no longer a jury pool to taint or concerns about his right to a fair trial. The prosecution, however, objected to lifting the order. The court initially made a preliminary decision, stating it could be revisited if a reason emerged. The court also noted that no bond was set for the defendant. Bill Thompson emphasized the need for time to provide a full statement, which he claimed was difficult while preparing for sentencing. However, this was deemed not a legal justification, and the media has highlighted that "more time" is insufficient legal grounds to maintain a restrictive non-dissemination or gag order. As of July 10th, more docket entries haven't appeared since the order was filed on July 2nd. There's a possibility the court is backlogged and won't address it until July 23rd, at which point it would become moot and withdrawn.RESOURCESBryan Kohberger Playlist - https://www.youtube.com/playlist?list=PLsbUyvZas7gKASBczV3CsUx-t5oRAK0caBryan Kohberger Change of Plea Hearing - https://www.youtube.com/watch?v=TdOt4zAWjp8This podcast uses the following third-party services for analysis: Spotify Ad Analytics - https://www.spotify.com/us/legal/ad-analytics-privacy-policy/Podscribe - https://podscribe.com/privacy
