During the hearing, Karen Read attorneys announced that she is suing Brian Albert, Nicole Albert, Matthew McCabe, Jennifer McCabe, and Brian Higgins. Her attorneys also intend to bring claims against the Massachusetts State Police, Lieutenant Brian Tully, Sergeant Yuri Bukhenik, Michael Proctor, and the town of Canton Police Department for alleged civil rights violations, conspiracy, and negligent training/supervision. The court anticipates discovery closing in December 2026, with a trial realistically expected in 2027, possibly 2028, especially if additional parties are added. The court strongly urged parties to explore resolutions outside of trial, emphasizing the arduous and expensive nature of civil litigation. The episode briefly mentions the conclusion of the Donna Adelson trial on September 4th before delving into Proctor's case. Proctor, the lead investigator in the Karen Reed case, was fired after the first trial due to misconduct. His administrative hearing aims to determine if his termination was justified. The Massachusetts State Police must prove his misconduct warranted termination, after which Proctor can argue for a lesser disciplinary action. The State Police attorney used strong terms like "distasteful," "unprofessional," and "disgusting" to describe Proctor's actions. The charges include: sending derogatory texts about Karen Reed, sharing confidential investigative information with non-law enforcement individuals, engaging in unprofessional conduct that harmed the State Police's reputation, and drinking alcohol on duty while operating a department vehicle. The defense intends to focus on the texts as "personal things" that shouldn't lead to job loss, despite the irony of the State Police withholding discovery. Closing arguments are scheduled for tomorrow morning, September 4, 2025.A significant portion of the day was spent discussing a second violation of the witness sequestration order by the defense. The judge expressed frustration that her instructions were not being followed, as a defense expert witness was present in the courtroom during another witness's testimony. Despite the prosecution's request for exclusion, the judge reserved her ruling, noting that exclusion is an extreme remedy and could create appellate issues if Donna Adelson is convicted. The defense called two witnesses: Kristin Adamson, Wendi's Previous Family Law Attorney and Linda Bailey, a Family Law Attorney Expert, to discuss the Markel divorce case. Though it was blurred it still leaves room for the imagination and recommended that it be blacked out redactions. This widespread release occurred because the case did not go to trial, meaning the photos didn't undergo the official sealing process typically seen in court proceedings like the Alex Murdaugh case. The lack of judicial oversight in the release process of the Bryan Kohberger Case led to a lawsuit against the city of Moscow. Madison Mogen's mother, Karen Laramie, requested a temporary restraining order (TRO) after redacted crime scene photos were released. On August 15th, Idaho Second District Judge Marshall issued a TRO, blocking the city from releasing any further images, audio, or video depicting the inside of Madison Mogen's bedroom until a preliminary injunction hearing on August 21st. While the TRO specifically applies to Mogen's bedroom, the city has stated it will not release photos or videos from any victim's bedroom until the court fully reviews the matter. The attorney representing the families, Leander James, emphasized that the families want peace and not conflict, and urged the public to avoid viewing the photos. Wendi Adelson is still subpoenaed by the prosecution, which grants her derivative and use immunity for her testimony. Jury selection began on August 19th, 2025. The process involves individual voir dire, where potential jurors are questioned one-by-one to prevent information about the high-profile case from influencing other jurors. The goal is to find jurors who have not formed an opinion about the case, even if they have heard about it. The judge read a statement of the case and the material part of the indictment to the potential jurors. In this episode of The Emily Show Podcast, I am covering the recent court date in the Denise Richards, Aaron Phypers, Divorce case. They were in court on August 8, 2025; however, ahead of that court date, Aaron Phypers brought on counsel for the limited purpose of representing him during the Temporary Restraining Order proceedings. Additionally, it was reported by People and other outlets that police were called to Calabasis when Denise Richards showed up at the home where Phypers and his family are still living. Denise, through her attorney, stated that she was allowed at the house and was retrieving her dogs.  A video purportedly showing Bryan Kohberger in his prison cell has been circulating online, prompting a response from the Idaho Department of Prisons. Is the footage real, and who within the prison leaked it? Additionally, Bryan Kohberger is complaining of ‘harassment' by other prisoners within the supermax facility. The prison also responded to media requests, stating that prisoners frequently communicate and that the ‘perceived harassment' has been reported to him.  Finally, Roblox has lost substantial value amid a wave of lawsuits and conversations around whether or not children are being protected on the platform. Roblox says safety is at the forefront of their platform, but the Roblox community disagrees. Once Roblox banned known Roblox creator Schlep, the creators rallied to call out Roblox for failing to protect children and respond to complaints and reports adequately. While federal discovery was provided in the Karen Read case, a protective order limits its use. Defense attorneys in other cases argue for access to this information, as Trooper Proctor was a lead investigator. The Commonwealth has been negotiating with the US Attorney's Office to modify the protective order. The motion for modification also seeks permission for the Norfolk District Attorney's Office to review remaining confidential materials provided to the prosecution and defense teams in the Karen Read case. The Commonwealth has made headway with the feds to review additional discovery materials, including grand jury and non-grand jury materials, which they have not yet seen. These materials were not part of the discovery turned over in the Karen Read case, suggesting they might be separate investigations. For the new grand jury and non-grand jury materials, the Commonwealth will first review them to determine if they need to be disclosed. Then, the federal court will decide if these materials can be turned over, potentially with an additional protective order. A future hearing on discovery process is scheduled for August 28th, 2025, at 2 p.m. ET. The Brian Walshe case is moving forward to trial in October 2025; highlighting the urgency of receiving discovery and rulings on motions to dismiss to prepare for trial. Once a jury is seated, opening statements will follow quickly. Most motions were addressed, with the court ruling that evidence would be admitted if relevant. Dan Markel, a legal professor, was murdered in 2014 amidst a child custody battle with his ex-wife, Wendi Adelson, Donna's daughter. The prosecution alleges that Donna Adelson and her son, Charlie Adelson, conspired to murder Dan Markel to resolve the custody issue, believing that without a father, the court couldn't force shared custody in Tallahassee. Two gunmen and a "middle person" (who worked at Charlie's dental office and is expected to testify) have already been prosecuted in connection with the murder. Charlie Adelson was also convicted. However, Proctor's lawyer claims nothing exculpatory exists outside the federal materials, partly because Proctor got a new phone in February 2024, potentially wiping earlier data. The problem is that the state police and Norfolk DA cannot directly extract this data; they must get it from the feds, who rejected requests for discovery from other prosecutions but turned it over in the Karen Read case. In the Karen Read case, the federal discovery was turned over, but it came with a federal protective order prohibiting its use in other cases. This creates a "boot loop" or "procedural quagmire" because Assistant District Attorney McLaughlin, who worked on the Read case, is aware of potentially exculpatory and impeachment information regarding lead investigator Former Trooper Proctor contained within these federal materials. Under Rule 14, McLaughlin is obligated to disclose the existence of such information to the defense in other cases (like the Walshe case), but the federal protective order prevents the office from physically turning over or even reviewing this material for exculpatory content. This is complicated by the fact that the prosecution did not consistently bate stamp documents. Another significant issue is the ongoing delay in receiving discovery related to Former Trooper Michael Proctor's text messages, which are relevant to five cases, including the Myles King case. The court is waiting for federal authorities to release this discovery. The defense is frustrated by the continuous "dripping faucet" of new discovery, making it difficult to prepare their case. The bar for dismissing a case due to discovery failures in Massachusetts is high, and typically, the remedy is to grant more time for trial. The Karen Read case has brought attention to this widespread issue of lingering discovery in Massachusetts cases. The next hearing for the Myles King case is scheduled for August 12th at 2pmET, where the judge will continue to try and clarify the specific evidence at issue for the motion to dismiss. He is representing himself and is seeking spousal support. Denise Richards filed for an ex parte temporary restraining order from Aaron Phypers. Photographs of a black eye were submitted as evidence and she explained that her laptop and phone were stolen. Denise accuses Aaron of disseminating private nude photographs and text messages from her stolen laptop to various news organizations, including the Daily Mail, even after the TTRO was issued. Denise moved out of their shared Calabasas home in 2023 due to marital issues and has since been renting three separate townhouses. Aaron, along with his parents, is still living in the Calabasas rental. On August 8th, a court hearing is scheduled to address the temporary restraining order. The purpose of this hearing is to determine if a more permanent restraining order needs to be issued, or if the existing temporary order should be extended. Alec Baldwin's malicious prosecution lawsuit against the prosecutor and Kari Morrissey, related to the "Rust" prosecution, was dismissed by the judge on July 29, 2025, because no significant action had been taken in 180 or more days. He was also given various fines and civil penalties. The Judge Hippler stated that Kohberger would be imprisoned until he dies and would likely be moved out of Idaho for his own safety. The judge delivered a powerful statement, acknowledging the courage and strength of the victims' families and survivors, and emphasizing that focusing on "why" gives Kohberger undue power. The judge also clarified that while Kohberger waived his right to appeal, he still has the right to file a notice of appeal, though doing so might violate his plea agreement and potentially lead to the state seeking the death penalty. However, he clarified that the court's prior preservation order remains in place, and sealed documents are still sealed. The media's petition to unseal all documents was denied as premature. The judge stated that after sentencing, scheduled for July 23rd, the court will begin reviewing sealed materials to determine what can be unsealed, starting with the newest documents first. This process will allow counsel to object to unsealing specific documents or request redactions. He warned that this unsealing process will take a considerable amount of time, and public records requests for sealed documents will be denied until they are officially unsealed. The judge also addressed the right to appeal, noting that while Kohberger's plea agreement includes a waiver of appeal rights, the US Supreme Court's ruling in Garza v. They are text messages between Murdaugh and Eddie Smith. This is in addition to the ongoing appeal of the murder conviction based on allegations that the clerk of court, Becky Hill, influenced the jury. This could mean that a new murder trial can occur. However, Murdaugh will remain in prison for decades due to his multiple financial crime convictions. The gag order has been lifted in the Bryan Kohberger case and his sentencing is scheduled for Wednesday, July 23rd. While he waived his right to appeal, he can still file one, though it is unlikely to change his predetermined four consecutive life sentences. Tom Girardi has reported to prison as of July 17th, 2025, despite his attempts to delay. She claimed she didn't recall the Commissioner telling her to "do the right thing," despite previously telling the defense he said that to her. Commissioner Cox denied knowing Officer Dever was associated with the Karen Read case and that he influenced her testimony, despite her acknowledging a meeting with him where he offered support. He stated he "encourages" many officers. Karen's Defense Attorney, Alan Jackson, sent a formal letter to Commissioner Cox, requesting that Officer Kelly Dever be included in the Brady database. This is due to her changed testimony and "false memory" claim, which he argues irreparably compromises her credibility and reliability as a law enforcement officer. She states that her attorney sent one introductory message in February 2025 and has not responded to her five inmate messages, two handwritten letters, or attempts by nine third-party representatives. Boone says her appeal is in jeopardy because an order was issued on June 13, 2025, requiring an initial brief within 20 days, or her appeal may be dismissed due to lack of communication from her attorney.  However, there was a third extension granted on the appeal. She argues that her attorney's failure to perform duties or communicate cannot be held against her and that dismissal would deny her due process and effective assistance of counsel. The trial court judge cannot force the appellate attorney to communicate and that appeals typically take a long time, with minimal client input needed since the brief is based on the record.
