How a sinner sought and found the Savor
Send us a textIn this episode, we take a little time each on 3 major doctrines. We begin with restitution, explaining what it is and what it means, and giving some examples. Then we skim over sanctification since we have already done several episodes dealing with this powerful topic. Then we delve into the glorification of the saints to round this episode out. We will uncover some pretty amazing things today, so we feel this study has the potential to change lives. Just take the time and study God's Word with us today…
This lecture text explores contract interpretation, discussing how courts determine the meaning of agreements using the plain meaning rule and extrinsic evidence, such as course of performance, course of dealing, and usage of trade, while also considering the parol evidence rule. It then differentiates performance obligations under common law and the U.C.C., contrasting substantial performance with the perfect tender rule, and introducing the concept of conditions. The material further explains breach, including material versus minor breaches and anticipatory repudiation, before outlining the rights of third parties through assignment, delegation, and third-party beneficiary contracts, finally addressing ways performance may be excused due to impossibility, impracticability, or frustration of purpose. This conversation provides a comprehensive overview of contract law remedies, focusing on what happens when a contract is breached. It covers legal remedies, including expectation damages, incidental and consequential damages, the duty to mitigate, and equitable remedies like specific performance and rescission. The discussion also touches on restitution, quasi-contracts, liquidated damages, and the limitations that can affect the recovery of damages. The importance of understanding these concepts for law students and practitioners is emphasized throughout.TakeawaysUnderstanding remedies is crucial for contract law.Expectation damages aim to put the non-breaching party whole.Incidental damages cover reasonable costs incurred due to a breach.Consequential damages depend on foreseeability at the time of contracting. The duty to mitigate prevents unnecessary loss escalation.Equitable remedies are granted at the court's discretion.Specific performance is used when money damages are inadequate.Restitution prevents unjust enrichment, focusing on the defendant's gain.Liquidated damages must be reasonable and not punitive.Various doctrines can limit the recovery of damages.According to the plain meaning rule, courts interpret unambiguous contract language according to its ordinary meaning, without considering outside evidence. If contract language is ambiguous, courts may consider extrinsic evidence such as prior negotiations, drafts, industry standards, or other contemporaneous writings to determine the parties' intent.Course of performance refers to the parties' behavior under the current contract, while course of dealing refers to their conduct in previous contracts. Both provide insight into the parties' understanding of terms. The parol evidence rule's purpose is generally to prevent parties from using prior or contemporaneous oral or written statements to contradict or change the terms of a complete and final written contract.Common law substantial performance allows enforcement if the essential purpose is met with minor deviations, while the U.C.C.'s perfect tender rule requires goods to conform exactly to contract terms for the buyer to be obligated to accept them.Under the perfect tender rule, a seller might satisfy their obligation despite nonconforming goods by exercising their right to "cure" the defective tender within the contract performance period.A condition precedent is an event that must occur before a party is obligated to perform. An example from the source is a loan disbursement being conditioned on providing proof of income.A material breach is a serious violation going to the essence of the contract that excuses the non-breaching party's performance, while a minor breach is less significant and only entitles the injured party to damages.Upon anticipatory repudiation, the non-breaching party can treat it as a breach and sue immediately, suspend performance and wait, or urge performance and await retraction. An assignment is a transfer of rights under a contract, while a delegation is a transfer of duties. In a delegation, the original party typically remains liable unless a novation occurs.

This lecture series on contract law focuses on the remedies available when a contract is breached. It covers legal and equitable remedies, the measurement of damages, and the doctrines governing restitution and quasi-contract. The discussion emphasizes the importance of understanding these remedies for both academic analysis and practical application in resolving contractual disputes.TakeawaysUnderstanding remedies is essential for practical application.Expectation damages aim to place the non-breaching party in the position they would have occupied.Consequential damages must be foreseeable and communicated during contract formation. The injured party has a duty to mitigate damages.Specific performance is available when legal damages are inadequate.Restitution prevents unjust enrichment and measures the value of benefits conferred.Liquidated damages clauses are enforceable if they are a reasonable estimate of likely loss.Limitations on recovery can arise from contract terms and procedural doctrines. The landscape of contract remedies balances fairness and economic efficiency.Mastery of remedies informs how we enforce, draft, negotiate, and litigate contracts.contract law, remedies, damages, expectation damages, equitable relief, mitigation, restitution, quasi-contract, liquidated damages, breach of contract

The mother and father of our house, Apostle Justin and Tanya, release on Leviticus 6:1-11 (or 5:20-6:4 depending on version)! Looking at the priestly perspective on the sacrifices. Yeshua is every sacrifice, so what did He die for? Forgiveness requires confession.
It is dangerous to see that the sin of anger is hiding within the hearts of many men and women at church. Often anger is unmet expectations. When we don't get what we want, then we become angry. How can you destroy anger and turn it into love? How do I make restitution to those I have hurt?
In this Bible Study we we look at the final of the offerings in the opening chapters of Leviticus, the Guilt or Restitution offering. This offering is unique to the others in that it requires restitution be made to the offended party and an additional penalty be paid for the sin (whatever it was). Contract Law Fundamentals – Formation, Enforceability, and PerformanceThis lecture provides a comprehensive overview of contract law, a core subject in both law school and bar exam preparation. It examines how legally enforceable agreements are formed, what makes them valid or voidable, how obligations are performed or breached, and what remedies are available.FormationContract formation requires:Offer: A clear and definite promise showing willingness to enter into an agreement.Acceptance: Unequivocal assent to the terms of the offer, typically governed by the mirror image rule in common law and more flexibly under the Uniform Commercial Code.Consideration: A bargained-for exchange of value between the parties.Mutual Assent: Both parties must agree to the same terms under the objective theory of contract.Capacity and Legality: Parties must have the legal ability to contract, and the subject matter must be lawful.Defenses to FormationEven where the above elements are present, certain defenses may render a contract unenforceable:Misrepresentation (fraudulent or innocent)Duress and Undue InfluenceMistake (mutual or unilateral)UnconscionabilityLack of genuine assentThe Statute of Frauds requires certain contracts—like those involving real estate, suretyship, or long-term performance—to be in writing and signed.Performance and BreachUnder common law, parties must substantially perform their obligations unless there is a material breach.Under the UCC, the perfect tender rule applies, allowing buyers to reject goods that do not conform exactly to the contract.RemediesWhen breach occurs, the law aims to protect the expectation interest:Compensatory damages to put the non-breaching party in the position they expected.Consequential damages for foreseeable losses stemming from the breach.Liquidated damages if contractually specified and reasonable.Specific performance as an equitable remedy when monetary damages are inadequate.Restitution to prevent unjust enrichment.Third-Party RightsIntended beneficiaries may enforce contracts made for their benefit.Assignments and delegations allow parties to transfer rights and duties, with some limitations.A novation can relieve the original party of liability if the obligee agrees to substitute a new obligor.Policy ConsiderationsContract law balances freedom of contract with fairness, predictability, and market efficiency. The law adapts through judicial doctrines, statutory frameworks like the UCC, and evolving commercial practices, especially in digital transactions and standard form contracts.

On 23rd August 1944, following the collapse of the pro-Nazi dictatorship of Ion Antonescu, Romania changed sides and abandoned the Axis to join the Allies. Justice and Restitution in Post-Nazi Romania explores the hopes, struggles and disappointments of Jewish communities in Romania seeking to rebuild their lives after the Holocaust. Focusing on the efforts of survivors to recuperate rights and property, Stefan Cristian Ionescu demonstrates how the early transitional government enabled short term restitution. However, from 1948, the consolidated communist regime implemented nationalizations which dispossessed many citizens. Jewish communities were disproportionality affected, and real estate and many businesses were lost once again. Drawing on archival sources from government documentation to diaries and newspaper reports, Justice and Restitution in Post-Nazi Romania: Rebuilding Jewish Lives and Communities, 1944-1950 (Cambridge UP, 2024) explores both the early success and later reversal of restitution policies. In doing so, it sheds light on the postwar treatment of Romanian Jewish survivors, and the reasons so many survivors emigrated from Romania. Learn more about your ad choices. Numbers 5 – Historical and Cultural Context, Laws on Purity, Restitution, and Marital Faithfulness Numbers 5 provides laws that govern purity, restitution, and marital faithfulness among the Israelites. These laws were deeply rooted in the historical and cultural context of ancient Israel and were essential for maintaining social order and religious holiness. 1. Purity Laws and Removal of the Unclean (Numbers 5:1-4) Historical Context In the ancient Near East, many societies, including Egypt and Mesopotamia, had rules regarding ritual purity, often linked to religious practice. The Israelites, however, had a unique system where impurity was directly tied to God's presence in their camp. •The Israelites had just received the Law at Mount Sinai, where God established that He would dwell among them (Exodus 25:8). •The need to remove those with skin diseases (e.g., leprosy), bodily discharges, or contact with dead bodies was not only for hygiene but to maintain the camp's ritual purity. •Unlike other ancient societies that viewed disease as fate or punishment from capricious gods, the Israelites saw impurity as something that could be addressed through prescribed rituals (Leviticus 13-15). Significance •These laws reinforced that holiness was essential for God's presence to remain among the people. •They protected the community from potential disease outbreaks, aligning with what we now recognize as public health measures. •The Israelites understood purity not only as a physical condition but as a spiritual state necessary to be in fellowship with God. 2. Restitution for Wrongdoing (Numbers 5:5-10) Historical Context Restitution laws were common in the ancient world, but Israel's laws placed special emphasis on confession and compensation. •In other Near Eastern legal codes, such as the Code of Hammurabi (c. 1754 BCE), penalties were often severe and did not necessarily involve restitution to the victim. •The Israelite law required a guilty person to confess their sin, compensate the victim with the original amount plus an additional 20%, and offer a sacrifice to atone before God. •If the victim had no relatives to receive the repayment, it was given to the priest, reinforcing the communal aspect of justice. Significance •This law highlights that sin is not only against an individual but also against God and the community. •It shows that biblical justice emphasized restoration, not just punishment. •The concept of confession before restitution foreshadows later Jewish and Christian teachings on repentance. 3. The Test for an Unfaithful Wife (Numbers 5:11-31) – The Sotah Ritual Historical Context This passage describes a trial by ordeal, a common judicial practice in the ancient Near East where divine intervention was sought to determine guilt or innocence. •Similar rituals existed in Mesopotamia and Babylon, where accused individuals had to submit to tests like being thrown into a river—if they survived, they were innocent. •The Sotah ritual (trial of the suspected adulteress) in Israel differed significantly. It involved a priestly ceremony where the accused woman drank water mixed with dust from the Tabernacle floor. •If guilty, she would suffer illness and infertility; if innocent, she remained unharmed and could bear children. Significance •This law protected women from arbitrary punishment by requiring a formal religious process rather than allowing husbands to act out of jealousy. •Unlike other ancient laws where women were immediately executed if accused of adultery (as in Hammurabi's Code), Israel's law required divine judgment, ensuring fairness. •The ritual emphasized that God was the ultimate judge in cases where human evidence was lacking. •The ceremony was symbolic, demonstrating that marital faithfulness was not just a social matter but a covenant before God. Key Lessons from Numbers 5 in Historical Context 1.Holiness and Community Order – The purity laws emphasized the sacredness of God's dwelling among the people and reflected an advanced understanding of hygiene and social order. 2.Justice and Restitution – Unlike many ancient laws that prioritized harsh punishment, biblical justice focused on confession, repentance, and making amends. 3.Divine Judgment in Relationships – The Sotah ritual ensured that accusations of adultery were handled fairly, rather than allowing human bias to dictate justice. Numbers 5 shows that ancient Israel's laws were deeply tied to their understanding of God's presence and moral order. Unlike other ancient societies where rulers and priests controlled legal matters for personal gain, Israel's system ensured fairness, justice, and divine guidance in both personal and communal matters.Become a supporter of this podcast: https://www.spreaker.com/podcast/sendme-radio--732966/support.

What financial lessons can we learn from a tax collector who climbed a tree? Stay tuned and find out.Of course, you know I'm talking about Zacchaeus in Luke 19. That story is filled with important teachings about money, stewardship, and generosity. Dr. Kelly Rush joins us today with some interesting observations about the life of Zacchaeus.Dr. Kelly Rush is a Professor of Finance, Department Chair, and Financial Planning Program Coordinator at Mount Vernon Nazarene University in Ohio. The Cultural and Financial Context of ZacchaeusIn first-century Israel, political, social, and religious divides were as prevalent as they are today. Labels like Pharisee, Sadducee, and zealot carried heavy connotations, just as terms like Democrat or Republican do in our culture. Among the most despised figures in Jewish society were the tax collectors, or publicans, who collected tribute for the oppressive Roman Empire.A publican acted as a financial middleman, collecting various taxes such as road tolls, harbor dues, and purchase levies. Chief publicans, like Zacchaeus, oversaw entire regions and often amassed great wealth by overcharging and exploiting their fellow Jews. Essentially, publicans were seen as greedy traitors who profited from an unjust economic system—what we would call white-collar criminals today.Zacchaeus' position as chief publican meant he was not just a participant but a leader in this corrupt system. However, his story took a radical turn when he encountered Jesus.A Life-Changing Encounter with JesusIn Luke 19, Jesus is passing through Jericho, heading to Jerusalem for Passover. Despite being days away from His crucifixion, Jesus takes the time to walk through the town, looking for Zacchaeus.Zacchaeus, unable to see over the crowd because of his short stature, humbles himself by climbing a sycamore tree to catch a glimpse of Jesus. In a moment of divine grace, Jesus stops, looks up, and calls Zacchaeus by name, inviting Himself to his house. This moment showcases a beautiful truth: while Zacchaeus was seeking Jesus, Jesus was already seeking him.The turning point in Zacchaeus' story comes when he joyfully receives Jesus and declares his willingness to make restitution:He pledges to give half of his possessions to the poor. He commits to repaying anyone he has cheated four times the amount—going far beyond the Old Testament requirement of returning stolen goods plus 20% (Leviticus 6).This response highlights a powerful principle: true financial transformation begins with a changed heart. Zacchaeus' generosity wasn't an attempt to earn salvation, but a response to the salvation he had already received.Lessons from Zacchaeus' Financial TestimonyJesus Seeks the Lost, No Matter Their Financial PastZacchaeus' reputation was well known, yet Jesus didn't shy away from him. Instead of condemnation, Jesus offered restoration. No financial mistake is too great for God to redeem. Repentance Leads to ActionZacchaeus' turnaround was immediate and public. He didn't just feel remorse; he acted decisively to make things right. This challenges us to evaluate our own finances and take bold steps toward integrity and generosity. Money Reflects the HeartHow we handle our finances reflects what's happening inside of us. Zacchaeus' newfound generosity was evidence of his transformed heart. Salvation Precedes StewardshipJesus declared, "Today salvation has come to this house" (Luke 19:9), showing that salvation is a free gift, not a reward for financial generosity. Stewardship is simply our response to God's grace. Many people struggle with shame over their financial decisions, preferring to keep them hidden from God and others. Zacchaeus, however, openly acknowledged his financial failures and took steps to correct them. His story reminds us that God's grace covers our past, and He calls us into a new future of faithful stewardship.Zacchaeus' story ends with a bold proclamation: "Look, Lord, here and now I give!" His financial testimony stands as a powerful example of what happens when we allow Jesus to transform not just our hearts, but our wallets as well.Let Zacchaeus' example inspire you to take an honest look at your finances, surrender them to God, and trust Him to guide you in stewardship that honors Him.Faithful Steward: FaithFi's New Quarterly PublicationYou can read Dr. Kelly Rush's full article on Zacchaeus in our new quarterly publication, Faithful Steward. Over thirty years ago an AA archivist gave me a book that changed my life. It's one of the best descriptions of the Oxford Group program out of which AA would later blossom and grow. Published in 1933 and titled WHAT IS THE OXFORD GROUP? the anonymous author lays out many of the principles and practices that Bill Wilson drew from in writing the Big Book. If you're ready for a life-changing shift to your program, this series may be for you. The book is available free through a link in the show notes. This episode explores RESTITUTION as it was understood and practiced by the AA pioneers. Making amends for our past wrongs affects others as much as ourselves and requires guidance and courage in knowing how best to proceed.
