Somewhere in a South Carolina evidence locker sits unidentified male DNA pulled from underneath Maggie Murdaugh's fingernails, and the same prosecutors who want to convict Alex Murdaugh of killing her are fighting to keep it away from independent testing. SLED already ran one test, ruled the DNA didn't belong to a Murdaugh, and stopped there. No further work. No attempt to identify whose it was. The defense wants an outside forensic genealogy lab, the one that helped identify Bryan Kohberger in Idaho, to test what remains before it's gone. Prosecutors want SLED to test it again first, with the same method that already came up empty, in a process that could consume the sample before anyone else gets a look.  If the state is right that this DNA doesn't matter, letting someone else confirm it costs them nothing. Blocking the test only makes sense if there's a chance it matters quite a bit.  The defense says this fits a pattern they've documented throughout the case, including a T-shirt that tested negative for blood it was supposed to have on it, and a blood spatter expert who allegedly changed his conclusions after a visit from the lead investigator.  On top of that, a federal judge dismissed Alex Murdaugh's lawsuit against former clerk of court Becky Hill on August 5th, killing the subpoenas and depositions that could have forced her records and sworn testimony into the open before the retrial begins.  Two fights, two setbacks for the defense, and a retrial now five months out, with the death penalty on the table and no plea in sight. There's DNA sitting in a South Carolina evidence locker that could identify whose skin was under Maggie Murdaugh's fingernails the night she and her son Paul were shot to death, and prosecutors trying to convict Alex Murdaugh a second time don't want an independent lab anywhere near it. SLED tested the sample once, said it didn't match the family, and stopped. The defense wants a second opinion from the genealogy lab that helped crack the Bryan Kohberger case in Idaho. The state wants first crack at it themselves, using the same process that already failed, in a procedure the defense argues could use up what's left before anyone independent ever sees it. Ask yourself why. If that DNA is really meaningless, a confirmed result helps the prosecution as much as anyone else. The only reason to block a test is if you're not sure what it says.  The defense has also laid out a pattern they say runs through this whole case: a white T-shirt that tested negative for blood, a blood spatter expert who allegedly reversed his findings after a visit from the lead investigator, and a SLED captain accused of directing subordinates to bury exculpatory results.  Meanwhile, a federal judge threw out Murdaugh's lawsuit against former clerk of court Becky Hill on August 5th, the case his own attorney admitted was built for one purpose: putting her under oath and pulling her records before the retrial. Gone with it is any chance of tracing the anonymous email that got a juror removed from deliberations.  Two doors just closed, five months before Alex Murdaugh goes back to trial for murder. A five-page ruling on August 5, 2026, changed the shape of the Alex Murdaugh retrial. Judge Richard Gergel dismissed Murdaugh's federal lawsuit against Becky Hill, the former clerk whose contact with his jury got the murder conviction thrown out. The money claim was $600,000. What actually ended that day was the defense's only route to Hill's emails, her texts, her phone records, and her sworn testimony.The unanswered questions are specific. State investigators told the sentencing judge they lacked the evidence to charge Hill with jury tampering. Five justices then reviewed the same conduct and erased a double murder conviction over it. Becky Hill's text messages and emails from the weeks she managed Alex Murdaugh's jury have never been examined by anyone outside the state's closed investigation. Murdaugh's lawyers wanted them, and the federal lawsuit they filed in May 2026 was the only legal instrument that could get them. A civil defendant can be subpoenaed and deposed. A private citizen who took a plea deal cannot be touched by a criminal defendant's discovery at all.Judge Gergel's dismissal on August 5 cut off the records, the deposition, the trace on the anonymous email that removed a juror mid-deliberations, and the chance to put the tampering investigators under oath about why their conclusion and the Supreme Court's landed in different places. South Carolina prosecutors are now backing the unsealing of major records tied to the Becky Hill jury-tampering fallout in the Alex Murdaugh case, including materials related to the removal of former juror Myra Crosby — the so-called “egg juror” — and investigative files from SLED's probe into Hill.
