In episode 5 of Critical Theory: Bernard E. Harcourt explores the utility of genealogical critique for revolutionary praxis. This presentation serves as a conclusion to this year's 13/13 seminar that has interrogated the relationship between critical theory and revolutionary practice by examining the written works of worldly, revolutionary philosophers. This episode focuses precisely on the place where critique can nourish worldly activity—and vice versa. It explores the activist writings of Nietzsche and Foucault in relation to praxis. It locates specifically when, how, and where critical philosophy and worldly activism can work together productively. “In any case, I hate everything that merely instructs me without augmenting or directly invigorating my activity.” It is with those words of Goethe, you will recall, that Nietzsche opened his untimely meditations on the value of history. Today, history has been eclipsed by the genealogical method, within critical circles. Foucault's genealogical approach now dominates historically inflected critique. But not all genealogical work today encourages praxis. Not all genealogies, nor all philosophical debates over genealogy, directly invigorate our activity. In part because of its proliferation and now ubiquity, the genealogical method has essentially become what history was in the nineteenth century. It is crucial now that we assess the value of genealogical critique for praxis. The proper metric against which to evaluate genealogical writings is whether they contribute to transforming ourselves, others, and society. Here, Bernard E. Harcourt proposes that we use the term “critical genealogy” to identify those genealogical practices that nourish our activity and thereby advance the ambition of critical philosophy, namely to change the world. It is time, once again, Harcourt argues, that we test whether our historical critiques are productive or demobilizing. It is imperative that we knock on them to determine which are hollow and which are robust—which discourage and which nourish action. It is time, once again, that we do philosophy with a hammer. Episode 4: George Jackson and Revolutionary Prison Writings with Paul Redd former member of the Short Corridor Collective, Pelican Bay State Prison, California. In episode 4 of Critical Theory: The Podcast, Bernard E. Harcourt sits down with Paul Redd, who was incarcerated for 46 years in California, 35 of them in solitary confinement, and was released on May 21, 2020, to discuss the influence of prison writings and the experience of the Short Corridor Collective at Pelican Bay State Prison. The members of the Short Corridor read and exchanged the critical works of George Jackson, Assata Shakur, Eldridge Cleaver, Michel Foucault, Bobby Sands, and others, leading to the country's largest ever prison hunger strike, in 2013, involving more than thirty thousand women and men throughout California prisons who refused to eat, as part of a series of prison hunger strikes that began in July 2011. The hunger strikes and aggressive litigation ultimately led to California's agreement to end indeterminate solitary confinement based on gang affiliation. Paul Redd participated in organizing the hunger strikes on the Short Corridor, was part of the efforts to end hostilities, and was a signatory to the agreement. He discusses the role of reading Bobby Sands, George Jackson and others with us in preparation for the public seminar, Revolution 7/13, at the Columbia Center for Contemporary Critical Thought. On 19 July, the U.S. Department of Defense announced that Abdul Latif Nasir had been released from Guantanamo Bay back to his family in Morocco. Mr. Nasir was a detainee at Guantanamo for 19 years, during which time he was known as prisoner 244. He was never charged. In 2016, during Barack Obama's push to close Guantanamo, Abdul Latif Nasir was cleared for release by the Periodic Review Board (PRB). Six U.S. agencies assured that he was no longer a risk to U.S. security. However, his release was delayed and when Donald Trump was inaugurated into office in January 2017 it was too late. Trump's campaign promise that no more detainees would be released from Guantanamo Bay was fulfilled. But on 19 July he was released, making him the first Guantanamo detainee to be sent home in more than three years. In this episode, Al Bawaba's Nicholas Prichard speaks to two lawyers who helped to free Abdul Latif Nasir. Thomas Anthony Durkin is a defense attorney at the law firm Durkin and Roberts and teaches law at the Loyola University Chicago School of Law. He's worked to defend many notable cases to do with terrorism and Guantanamo detainees. His other guest, Bernard E. Harcourt is Professor of Law and Professor of Political Science at Columbia University in the City of New York. He is also a distinguished theorist, legal advocate, writer, and editor. His most recent book is Critique and Praxis. Nicholas began by asking Tom Durkin how he found out about Abdul Latif Nasir's release. The conversation then moves to the legal specifics of Abdul Latif Nasir and the other detainees in Guantanamo Bay. The conversation ends with a discussion on what this means for justice in the U.S. and the relationship between the courts and politicians.

Counterrevolution Since 9/11 and the wars in Iraq and Afghanistan, US warfare has focused on counterinsurgency. America now uses this counterrevolutionary playbook to govern domestically. Counterrevolutionary theory identifies a passive majority in all populations and a small insurgency. The first step is to brutally eliminate the rebellion, and then win over the passive majority. Using counterrevolutionary measures necessitates creating an internal enemy—for instance, Muslims, immigrants, minorities, or ANTIFA. Counterinsurgency establishes brutal violence as a policy, which quickly becomes the norm, as we’ve seen with the current level of government violence directed at US citizens. Legalizing Brutality America is a profoundly legalistic country, which looks to the law for the protection of rights. At the same time, it also has a long history of rendering questionable actions legal. The CIA redefined torture under the Bush Administration to require organ failure, which legalized many torture techniques that fell short of this standard. The summary drone strike execution of US citizen Anwar al-Awlaki required a 41-page legal memo to frame it as legal under due process. Prisoners are legally held indefinitely in Guantanamo Bay through convoluted legal justification. Counterinsurgency requires state-sponsored violence, and America is adept at legalizing actions that are normally viewed as illegal to achieve this. Once these actions are legalized, they then become normalized. Abolition Democracy To move past counterrevolution as a governing theory, we should look to WEB Dubois’s idea of Abolition Democracy. Abolition Democracy stated that no action was taken after slavery’s end to support former slaves with education, employment, and other necessities. Because of this failure, we are still combatting the legacy of slavery in the US. Abolition theory can be applied to the counterrevolution as well. In The Counterrevolution: How Our Government Went to War Against Its Own Citizens (2018), Harcourt examines how techniques of counterinsurgency warfare spread to U.S. domestic policy. Harcourt served as a law clerk for Judge Charles S. Haight Jr. of the U.S. District Court for the Southern District of New York. He began his legal career representing death row inmates, working with Bryan Stevenson at what is now the Equal Justice Initiative, in Montgomery, Alabama. He continues to represent pro bono inmates sentenced to death and life imprisonment without parole. In 2019, Harcourt was awarded the New York City Bar Association Norman J. Take a step back and remember your truth Once a day, try to center yourself and go through your comments and thoughts of the day. "Did I say the things that i believe in?" Take a step back and determine what is important, what your values and ethical beliefs are. Then recalibrate life, work, and personal communications in order to reflect your values.
