The holidays are coming QUICKLY!If you're anything like me, you're staring at your calendar like “how did we get here, and how is all of this happening in the next 6 weeks?!” It's the time for Thanksgiving prep, Christmas planning, kids' activities, basketball season, and alllll the food-focused events. It's a LOT, and it can totally knock you off your fitness routine if you're not prepared (yep, that used to be me).Honestly, your approach this holiday season depends on your actual life and GOALS. Maybe you're in a season where you need rest, or maybe you're in a solid maintenance groove. Maybe you feel good enough to push a little harder, and really kick ass! Die aktuellen Wirtschaftsnachrichten mit Michael Weyland Thema heute: Winterliche Gefahren: Wer räumen muss und welche Versicherungen schützen Noch ist der Winter nicht vorbei und mit jedem Schneefall und bei Eisglätte nehmen die Risiken für Unfälle auf Gehwegen, Hauseingängen und Zufahrten deutlich zu. Haus- und Grundstückseigentümer sowie in manchen Fällen auch Mieter sind gesetzlich verpflichtet, diese Flächen sicher für Passanten zu halten. Wer diese Verkehrssicherungspflicht vernachlässigt, haftet für Schäden, die durch Unfälle auf nicht geräumten oder gestreuten Wegen entstehen. Eine Privathaftpflichtversicherung bietet in solchen Fällen finanziellen Schutz und wehrt unberechtigte Forderungen ab“, sagt der Bund der Versicherten e. V. (BdV). Primär sind Hauseigentümer für den Winterdienst verantwortlich. Diese Pflicht kann jedoch durch eine klare Vereinbarung im Mietvertrag auf Mieter übertragen werden. Kommt eine Person auf glatten Wegen zu Schaden, müssen Eigentümer und Mieter unter Umständen haften, wenn sie den Winterdienst vernachlässigt haben. „Das kann beispielsweise der Fall sein, wenn es geschneit hat, während ein Eigentümer im Büro war und in dieser Zeit ein Passant auf einem nicht geräumten Gehweg vor dem Grundstück ausgerutscht ist“, sagt man. Sind Eigentümer beziehungsweise Mieter schadensersatzpflichtig, kann das teuer werden, denn sie haften mit Vermögen und Einkünften bis hin zur Pfändungsgrenze. Zur Absicherung der finanziellen Folgen dient in einem solchen Fall die Privathaftpflichtversicherung. Sie begleicht berechtigte Ansprüche und wehrt zu Unrecht erhobene Schadensersatzforderungen ab – sogar vor Gericht. Hauseigentümer, die ihre Immobilie nicht selbst bewohnen, sollten zudem prüfen, ob sie eine Haus- und Grundbesitzerhaftpflichtversicherung benötigen. Diese deckt die Haftung ab, wenn Dritte beispielsweise auf einem nicht ordnungsgemäß geräumten Gehweg ausrutschen und sich verletzen. Zusätzlich empfiehlt der BdV, sich gegen Schäden abzusichern, die durch Schnee am Gebäude entstehen können. „Eine Wohngebäudeversicherung sollte idealerweise um eine Elementarschadenversicherung erweitert werden, um Schäden durch Schneedruck oder andere Naturereignisse abzudecken“. Die Räum- und Streupflichten können regional unterschiedlich geregelt sein. In welchen Zeitfenstern und wie oft geräumt und gestreut werden muss, legen Städte und Gemeinden in ihren Ortssatzungen fest – und das kann ganz unterschiedlich ausfallen. Dort steht unter anderem auch, in welcher Breite die Wege zu räumen sind. In vielen Gemeinden gelten feste Zeiten, etwa von 7 bis 20 Uhr, in denen Gehwege begehbar sein müssen. Auf Schweizer Strassen sterben wieder mehr Menschen: In fünf Jahren stieg die Zahl der Verkehrstoten um 34 Prozent – der stärkste Anstieg Europas. BFU-Direktor Stefan Siegrist fordert deshalb risikoabhängige, individuell berechnete Versicherungsprämien für Autofahrer und andere Verkehrsteilnehmende. Bisher sei es nicht gelungen, diesen Negativtrend in der Schweiz umzukehren und den Anstieg der tödlichen Unfälle zu stoppen. Gefordert seien deshalb eine konsequente Politik zugunsten der Verkehrssicherheit und ein gemeinsames Engagement aller Akteure im Strassenverkehr. Adrian M. (30) hat ein ungewöhnliches Handicap: Er erkennt Menschen nicht an ihren Gesichtern. Schlimmer noch – er vergisst sie immer wieder. Selbst vertraute Gesichter aus seinem engsten Umfeld entgleiten ihm regelmäßig. Kein Wunder also, dass der Beginn seiner Beziehung zu seiner zauberhaften Freundin Gina etwas holprig verläuft. Für Adrian sehen alle Gesichter irgendwie gleich aus. Das war schon immer so. Es ist angeboren. “Prosopagnosie”, auch Gesichtsblindheit genannt, beschreibt die Unfähigkeit, Menschen anhand ihrer Gesichtszüge zu erkennen oder voneinander zu unterscheiden. Betroffene sind nicht blind, sie sehen Gesichter durchaus, können die visuellen Informationen jedoch nicht mit einer Identität verknüpfen. Diese seltene Wahrnehmungsstörung kann, wie in Adrians Fall, angeboren sein. Dass er dabei regelmäßig in Fettnäpfchen tritt, lässt sich leicht vorstellen. On today's episode of the podcast I'm Download the Contractor Onboarding Toolkit at notavglaw.com/toolkit. Inside you'll find the State by State Contractor Classification Cheat Sheet, the California Contractor Compliance Framework. and the Essential Contract Considerations for Your Contractor Agreement. When going through contractor onboarding, we need to go through a few steps: 1. Determine if someone is a contractor or employee This is the first layer of protection on my Legal Layers of Protection. Layer 1 is protection, and it's basically just "don't break the law." This is why you need to make sure your new hires are classified correctly, because misclassification is illegal and there are interests and penalties when you get audited. These laws are dictated by state. This is where the State by State Contractor Classification Guide in our Toolkit comes in handy. Each state has different classification laws, with about 30 states using the ABC test. California is known for enforcing it the most after they passed the AB5 Law. You can implement this test with our , and you can learn more about that in the California Contractor Compliance Framework Part A - Control - You can't have too much control over your contractors and their work. Part B - A business owner may not provide services that are within the usual course of the hiring entity's business. For example, a lawyer hiring a lawyer to provide legal services, a photographer hiring a second photographer, these would need to be employees. It's not just this simple, it's anything that's integral to your business that you're doing all the time. This is the part of the test that a lot of people fail. Part C - Someone can only be a contractor if you're hiring them to provide a service that they already have a business doing. For example, if you're hiring a photographer who has a photography business to come do your brand photos. 2. What type of contractor are they? If you've determined them to legally be a contractor, ask yourself if they are working in your business or are they a project-based contractor? If you are a project-based contractor, you may consider yourself a service provider offering B2B services. If you are the service provider, you are likely the one to provide the contract versus the person hiring you giving you a contractor agreement. Also consider who's leading the conversation? Be careful to avoid the use of the term "controlling" the situation, as that brings you back to test A on control. 3. Contractor onboarding If the contractor is the one leading the conversation/process to provide you the service, they should be providing you the contact, sending you the invoices, etc. When hiring a contractor, make sure you get a contractor agreement, ideally a copy of their business license (in some states they need to have their own business in order to be a contractor), and have them provide you a W9 (get this up front so you don't have to chase them down for a 1099 later on). What should go in the contract? You want their address, you want to specify the exact services they'll be providing, you want to outline the payment terms and you want provisions in there that this is a work-for-hire agreement. You can find all of these in the Contractor Agreement in the Contract Club (notavglaw.com/club). I also recommend a sophisticated onboarding tool (I use Gusto) to connect the W9, their ID and all the necessary tax information and then Gusto will automate the 1099 come tax time. It's important to note that before hiring a contractor or employee, you want to have an LLC and just generally have your shit together. Marlen Reussers Karriere ist in vielerlei Hinsicht aussergewöhnlich: Trotz Kindheit auf dem Bauernhof zieht es sie zur Geige und bereits mit 14 Jahren wird sie Jungstudentin an der Hochschule der Künste in Bern. Später studiert sie Medizin, und als sie sich mit Mitte Zwanzig aufs Rad setzt, fährt sie kurz darauf allen davon. Erst als 27-Jährige wird sie Profisportlerin und holt im Zeitfahren praktisch alles, was es zu gewinnen gibt: nebst dem Weltmeistertitel auch viermal den Europameistertitel, die Olympia-Silbermedaille und zwei Tour de Suisse-Titel. Doch neben den grossen Triumphen kennt sie auch krachende Niederlagen, beispielsweise als sie ein WM-Rennen aufgibt, weil sie merkt, dass ihr an diesem Tag die Motivation fehlt. Ebenso werfen sie Unfälle und Krankheiten immer wieder zurück, besonders eine Long Covid-Erkrankung zwingt sie zu einer längeren Pause ohne zu wissen, ob sie je wieder gesunden wird. Mithilfe von Hypnose, wie sie sagt, kann sie die Krankheit schliesslich überwinden und gewinnt dadurch auch einen neuen Blick auf die Medizin und den Körper. Später studiert sie Medizin, und als sie sich mit Mitte Zwanzig aufs Rad setzt, fährt sie kurz darauf allen davon. Erst als 27-Jährige wird sie Profisportlerin und holt im Zeitfahren praktisch alles, was es zu gewinnen gibt: nebst dem Weltmeistertitel auch viermal den Europameistertitel, die Olympia-Silbermedaille und zwei Tour de Suisse-Titel. Doch neben den grossen Triumphen kennt sie auch krachende Niederlagen, beispielsweise als sie ein WM-Rennen aufgibt. Ebenso werfen sie Unfälle und Krankheiten immer wieder zurück, besonders eine Long Covid-Erkrankung zwingt sie zu einer längeren Pause ohne zu wissen, ob sie je wieder gesunden wird. Mithilfe von Hypnose, wie sie sagt, kann sie die Krankheit schliesslich überwinden und gewinnt dadurch auch einen neuen Blick auf die Medizin und den Körper.
