Legal principle that one is presumed innocent until proven guilty

What happens when leaders stay silent about abuse? In this episode, the Remnant Radio hosts—Joshua Lewis, Michael Rowntree, and Michael Miller—break down Mike Winger's explosive six-hour investigation into Shawn Bolz and the devastating coverup culture plaguing charismatic Christianity. The hosts dive deep into the evidence Mike Winger presented showing how Shawn Bolz faked prophetic words through data mining, committed sexual misconduct, and how Bethel Church leadership knew about it for years but failed to warn their own congregation. This isn't just disappointing—it's dangerous. When victims suffered devastating consequences from fraudulent prophecies, where was the public accountability? Joshua, Michael, and Michael also respond to Kris Vallotton's recent sermon that many see as damage control rather than genuine accountability. They examine his claims about social media fake news, family confidentiality, and shepherding complexity—but find these arguments fall short of biblical standards for church discipline. This episode tackles critical questions every Christian needs to wrestle with: -What does biblical prophecy actually look like versus manipulation and fraud? -When should church leaders publicly expose false prophets and abusers? -How do we balance mercy with justice against deception? -What does 1 Timothy 5:19-20 require when multiple witnesses come forward? Whether you're navigating charismatic theology, concerned about spiritual abuse, or simply want to understand what biblical accountability looks like in the modern church, this episode provides crucial insights.EXTRA LINKS:Mike Winger episode: https://www.youtube.com/watch?v=GH05S53QlY0&t=14543sBethel Sermon: Starts at 1:41:36 https://www.youtube.com/watch?v=s25IuN0oDrs0:00 – Introduction0:51 – Overview of Mike Winger's Investigation & Kris Vallotton's Response3:48 – Background on Victims5:38 – Timeline of Bethel's Knowledge 9:50 – Analysis of Kris Vallotton's Speech: Complexities of Shepherding Claim22:04 – Critique of "Everyone Has a Platform" and Fake News Narrative27:03 – Evaluating the "No Family Talks Anymore" Defense34:26 – The Problem of Breaking Confidentiality vs. Protecting Victims43:58 – "Innocent Until Proven Guilty" and the Investigation Excuse55:17 – Using Judas and Broken People as Justification1:10:04 – Were the Prophetic Words Valid? Key Themes and Important Ideas:1. Foundational Importance:The presumption of innocence is presented as a "vital safeguard that underpins the entire criminal justice system" and "serves as the bedrock of our legal protections."It ensures that "the burden remains on the state to prove its case and that no person is punished without a clear, evidentiary demonstration of guilt."2. Historical Roots:The concept has origins in ancient legal traditions, including Roman law, where the state's responsibility to prove guilt began to take shape. The common law tradition in medieval Europe further refined the notion, with English jurists articulating that the accused did not bear the burden of proving innocence. The maxim “Ei incumbit probatio qui dicit, non qui negat” – "the burden of proof is on the one who declares, not on one who denies" – encapsulates the core of the presumption of innocence.3. Constitutional and International Enshrinement:While not explicitly stated in the U.S. Constitution, the principle is "inferred from the due process clauses of both the Fifth and Fourteenth Amendments."Internationally, Article 11 of the Universal Declaration of Human Rights explicitly states: "Everyone charged with a penal offence has the right to be presumed innocent until proved guilty according to law in a public trial at which he has had all the guarantees necessary for his defence."These codifications affirm it as both a legal principle and a fundamental human right.4. Operation within the Criminal Justice System:It places the "burden of proof squarely on the prosecution" throughout a criminal trial. The state must present evidence that meets the high standard of "beyond a reasonable doubt."This standard is intentionally rigorous due to the high stakes involved (freedom, reputation, life).Ambiguity in evidence must be viewed "in favor of the accused," acting as a "shield against wrongful conviction."5. The Meaning of "Beyond a Reasonable Doubt":It does not imply absolute certainty or mathematical precision. It means the evidence must be "so convincing that a reasonable person would have no logical reason to doubt the defendant's guilt."Any "reasonable uncertainty about the accused's guilt" after considering all evidence compels a verdict of not guilty.6. Practical Implications for Legal Actors:Prosecutors: Bear a "heavy responsibility" to gather robust, reliable evidence and present a case leaving little room for doubt. They cannot rely on "conjecture, bias, or even circumstantial evidence that fails to meet the stringent threshold of certainty." Effective practice demands "ethical principles and rigorous standards of proof."Defense Attorneys: Have a "powerful tool" to argue for their clients' rights by emphasizing the prosecution's burden. They can highlight gaps or inconsistencies to "sow reasonable doubt." Their role is often to ensure the state fails to meet its burden, not necessarily to prove absolute innocence.7. Seminal Case Law:Courts have "repeatedly reaffirmed that the presumption of innocence is a cornerstone of fair trials."Landmark decisions have explicitly stated that "the burden of proof rests with the prosecution and that any ambiguity in the evidence must benefit the defendant."Appellate courts have underscored that "beyond a reasonable doubt" is a "firm requirement" for conviction.8. Impact on the Jury's Role:Jurors are instructed to approach the case with the understanding that the defendant is presumed innocent. These instructions are "vital to ensuring that jurors do not allow their personal biases or preconceived notions to influence their judgment."It acts as a "check against potential miscarriages of justice" by ensuring rigorous and impartial scrutiny of the prosecution's case.
In this in-depth lecture, we journey through the evolution of the presumption of innocence—a cornerstone of criminal law that insists an accused is innocent until proven guilty beyond a reasonable doubt. We explore its historical origins, its enshrinement in constitutional and international human rights frameworks, and its practical application in the courtroom. Discover how this fundamental principle shapes the roles of prosecutors, defense attorneys, and judges, and learn about the challenges posed by modern media and evolving legal practices. Ideal for law students, legal professionals, and anyone interested in safeguarding justice, this lecture provides a comprehensive look at the doctrine that continues to protect individual rights and maintain the integrity of our criminal justice system.

I take you through a thought-provoking discussion on the principles of innocent until proven guilty, especially in light of the Luigi murder case. Whether you're in the legal profession or simply interested in the justice system, there are key takeaways from this episode worth reflecting on.Here are three pivotal insights:Balancing Reality with Legal Principles: I emphasize the necessity of upholding the presumption of innocence in legal practice while acknowledging the real-world instincts about a case. This dual mindset ensures that justice is not only served but perceived with fairness. The Role of Criminal Defense Lawyers: Representing seemingly guilty clients is not about agreeing with their actions but ensuring that the law is applied impartially and justly. As I note, this responsibility is crucial for maintaining a just society for all individuals.Historical and Cultural Context of Justice: I refer to historical precedents like the dialogue from A Man for All Seasons, illustrating the timeless importance of preserving legal rights, even for those we might naturally oppose.Got a question you want answered on the podcast? Thank you for joining me in the studio again for another weekend rant session. I give my thoughts on a few of the random news stories such as Microsoft announcing the development of their newest quantum processor, Diddy's lawyer bowing out of his case, and with the Luigi doc dropping, how can he expect an uncompromised trial? Let's jump right into another fun and winding monologue about everything going on in the world!
Part 2 of this series brings you to the trial preparation of an attempted murder case, with the defendant facing a potential life sentence. We'll hear the emotional perspective of the attorneys throughout the life of the case and explore the psychology of false confessions. This episode also highlights the work of a false confession expert as we discussed how lying about evidence and contamination during an interrogation can lead to unreliable results. Ever wonder what it's like behind the scenes of trial preparation for attempted murder? In this two-part Special Edition of the Truth Be Told podcast, we explore a case from 2014 out of Brooklyn, NY where heroes from FDNY rescued two young children who were trapped inside a burning apartment. As the flames subsided, the investigation ensued, and police were pointed at a primary suspect for the alleged arson. Once in custody, the police conducted an interrogation which produced a controversial confession to the incident. This resulted in the defendant facing multiple charges of attempted murder, assault and arson with the potential of spending life in prison. However, as the legal team of Adam Heyman, Anna Carlsen and Sarah Siegel learned more about their assigned case – it was not as open and shut as it seemed. This team of attorneys joined the Truth Be Told podcast to give their perspective on how they reviewed the case, prepared for trial and ultimately represented their client. The team also brought in Maria Hartwig, PhD, an expert in false confessions and police interrogation techniques to provide her opinion to the court on the reliability of the confession that loomed over their case. Professor Hartwig also joins the panel to share the research behind false confessions and the common contributors, such as misclassification, coercion and contamination. This two-part episode is intended to provide you the insight and perspective from the legal team of the defendant, and understanding how an expert witness is effectively used at trial. For investigators, this series also provides several takeaways on how to ensure evidence is collected appropriately and can be relied on for further investigation or prosecution. Our hope is to provide future jurors, investigators, attorneys and anyone involved in the courtroom working group with a new perspective on how our system is built on the foundational premise of “innocent until proven guilty." *Disclaimer: This podcast series does not represent a comprehensive review of the investigation into this case, but rather highlights the perspective of the defense team. There are no assertions made by the Truth Be Told podcast as to the integrity of the investigation itself or the reliability of the statements provided by involved parties. We encourage listeners to review all the information and formulate their own opinion relative to the case but with a more enlightened perspective provided by our panel of guests.

Content warning: This episode discusses rape, sexual assault, and gender-based violence. If you need support, you can call Rape Crisis for free on 0808 500 2222This week - though an 'open secret' in the media industry - it was revealed by the Times, the Sunday Times, and Channel 4 Dispatches that Russell Brand has been accused of rape, sexual assault, and emotional abuse. Four women have alleged sexual assaults between 2006 and 2013, others have made a range of accusations about Brand's controlling, abusive and predatory behaviour. More women have come forward since the article and documentary aired. Brand denied the allegations and said his relationships have all been consensual, and said there is a mainstream media conspiracy theory to take him down.In this episode, we address Brand's announcement of a 'mainstream media conspiracy', plus other reactionary statements including 'Why didn't she say anything before?', 'What about false accusations?', and - often the biggest statement when rich and famous men are accused of sexual assault - 'Innocent until proven guilty!'. To address the crucial context of systemic failures that's often missing from the conversation on rape convictions, we then revisit our Series 1 investigation: "Rape Justice: What happens to the 98%?" The charge rate of rape is less than 2%. The investigation features rape survivors not just from the UK, but from the US and Europe too: however varied their experiences or assault, silence and injustice are themes that shape them all. They attest to the multitude of reasons why victims may not go to the police; and why even when they DO go to the police, they may come to regret it. We will also debunk the dark doctrine of original sin and replace it with the truth about our condition at birth and the incredible hope this gives us for the eternal existence of the infants we have lost before or in the early days/years just after their birth.

Once upon a time there were rules in a courtroom and an overarching idea of innocence until proven guilty.
