This Day in Legal History: Ratification of the Bill of Rights by New JerseyOn November 20, 1789, New Jersey became the first state to ratify the Bill of Rights, a landmark moment in American constitutional history. Just months after the U.S. Constitution went into effect, debate over its lack of explicit protections for individual liberties sparked calls for amendments. Responding to this concern, James Madison introduced a series of proposed amendments in the First Congress in June 1789, aiming to ease Anti-Federalist fears and solidify support for the new federal government. Congress approved twelve amendments on September 25, 1789, and sent them to the states for ratification.New Jersey acted swiftly, ratifying eleven of the twelve proposed amendments less than two months later. The state rejected the first proposed amendment, which concerned congressional representation, and accepted the rest, including protections for freedom of speech, religion, the press, the right to bear arms, and safeguards against unreasonable searches and seizures. New Jersey's early endorsement gave momentum to the broader ratification effort, which required approval by three-fourths of the states.By December 15, 1791, ten of the amendments had been ratified by the necessary eleven states and became known as the Bill of Rights. These provisions would become foundational to American legal doctrine, judicial interpretation, and civil liberties jurisprudence. New Jersey's rapid ratification also signaled the willingness of smaller states to embrace a constitutional framework that better balanced federal power with individual protections. The ratification process itself reflected the structural legal mechanism required to alter the Constitution—Article V mandates both congressional proposal and state approval. This episode demonstrates how early American legal institutions navigated public pressure and political compromise to create durable legal norms. The Bill of Rights remains central to constitutional interpretation today, frequently invoked in court cases involving speech, privacy, and due process.A group of senior judges on the U.S. Court of Appeals for the Fifth Circuit has recently influenced several rulings on politically sensitive cases, softening the conservative tone of one of the nation's most right-leaning appellate courts. These judges, many appointed decades ago by presidents like Jimmy Carter and Ronald Reagan, were part of three-judge panels that struck down or allowed challenges to laws involving religion in schools, drag shows on campus, and firearm signage. However, these decisions are now set for reconsideration by the court's full active bench in January, as part of a growing trend of en banc rehearings. The Fifth Circuit includes 17 active judges and seven senior judges. While senior judges can still hear cases and author opinions, their influence is ultimately limited because active judges control en banc reviews, which can overturn panel rulings. Most of these upcoming en banc cases saw dissents from Trump-appointed judges at the panel level. Some senior judges, like Edith Brown Clement, are conservative and remain highly active, while others like James Dennis and Patrick Higginbotham are known for their moderate or liberal views and are key voices in current and upcoming decisions.Legal experts say senior judges' experience and moderation often make them more willing to adhere to precedent rather than pursue ideological shifts. Their dissents and opinions can also help signal to the U.S. Supreme Court that a case warrants review. With an increase in ideologically charged cases on topics like immigration and free speech, the Fifth Circuit's internal dynamics reflect a broader national tension between judicial restraint and a more activist, conservative legal agenda.Full Fifth Circuit Overrides Moderate Senior Judges' RulingsThe Equal Employment Opportunity Commission (EEOC) has asked a federal court to enforce a subpoena against the University of Pennsylvania as part of an ongoing investigation into alleged antisemitic harassment. The EEOC's request was filed in the U.S. District Court for the Eastern District of Pennsylvania and stems from a charge initiated in December 2023 by Republican-appointed Chair Andrea Lucas. The agency is seeking documents and information identifying victims and witnesses to reported religious-based harassment affecting faculty and staff. The investigation centers on claims that the university failed to adequately respond to internal complaints of antisemitism. The EEOC under Lucas—particularly during and after the first Trump administration—has prioritized enforcement actions related to religious discrimination, with higher education institutions facing increased scrutiny. Penn has not yet issued a public response regarding the subpoena or the broader investigation.EEOC Seeks UPenn Information Disclosure in Antisemitism ProbeCryptocurrency exchange Kraken announced that it has confidentially filed for an initial public offering (IPO) in the United States. The project, now called the Crane Clean Energy Center, involves reviving an 835-megawatt reactor that was shut down in 2019. Constellation entered a partnership with Microsoft in 2024 to help offset the tech company's energy use, especially for power-intensive data centers. The reactor's restart reflects rising energy demand tied to emerging technologies like artificial intelligence. The Department of Energy's Loan Programs Office (LPO) issued the loan to help lower financing costs and encourage private investment. Officials emphasized that nuclear energy offers stable, carbon-free baseload power critical for both grid reliability and climate goals. While Constellation is financially strong enough to obtain private funding, the administration said public support signals a national commitment to clean and dependable energy infrastructure. The plant still needs regulatory approvals, including from the Nuclear Regulatory Commission. Constellation has already begun hiring workers, inspecting systems, and ordering essential equipment. The company now expects the reactor to come online by 2027, a year ahead of the original timeline due to an accelerated grid connection review.US loans Constellation $1 billion for Three Mile Island reactor reboot | Reuters This is a public episode. Charles Daniels and James Dennis discuss the current political climate today
Today on the Rarified Heir Podcast, we are talking to Brad James, son of game show host and television icon, Dennis James. We loved talking to Brad because of all the many connections his dad had to early – and we mean early – television that connected with host Josh Mills own family in early television. Fans of classic television should appreciate this episode as we talk about televisions earliest beginning when there were literally just a few hundred sets in the New York metropolitan area. From there we discuss all the many game shows Dennis James was a part of including landmark shows like: The New Price is Right, Let's Make a Deal and Name That Tune as well as obscure shows like Haggis Baggis, Cash and Carry and Name's The Same. It's why he was known as the “Dean of Game Shows.” We are just scratching the surface here as James worked on commercials, radio, movies and became a philanthropic juggernaut when he hosted the first-ever telethon for united Cerebral Palsy Associations as emcee that continued well into the 1990s. In fact, after his father passed away in 1997, Brad took over that role as host to help keep his father's life work alive. Along the way, we talk golf & Kevin Costner, a skinny kid from New Jersey like James named Sinatra who came up through the ranks together and how his father raised – get this $750 million dollars in his five decades of work for United Cerebral Palsy. There is also a story about Foster Brooks and a gun that entertained us to no end. So please, take a listen to the Rarified Heir Podcast with guest Brad James. Everyone has a story.

The journey of 1,000 miles, otherwise known as "Operation Get Back to .500" begins with one step. That's tonight, as the Lakers play a promising-but-not-yet-good Detroit Pistons team at the Crypt. They'll have reinforcements, with Dennis Schroder and Thomas Bryant likely joining the lineup, and more importantly, with LeBron James a real possibility to suit up. He was a full participant in Thursday's practice for the Lakers - albeit a non-contact practice for all involved - and Darvin Ham said James was running and jumping, looking "great."So if LeBron can play, the Lakers really have no excuse to drop a game to the lowly Pistons, right? And they really should beat a San Antonio squad rapidly coming back to earth after a quick start, right? They can't get back to .500 in a day or a week or even a month, likely. This is a project. And while technically, it doesn't matter which teams they beat en route to a return to contention, it sure is easier if you beat the bad teams.Plus, vibes. They are very bad after losing to Detroit.Meanwhile, he's not winning the race right now, but where does Russell Westbrook rank in the Sixth Man of the Year competition? What would it take for him to have a real shot at taking home the hardware? Certainly the storyline is compelling, but what else has to happen? Finally, our friend Darius Soriano wrote a great story for SilverScreenandRoll about the Lakers draft capital, how people tend to describe it inaccurately, and why that matters. It led to a fun Twitter conversation, which leads to a fun podcast conversation.HOSTS: Andy and Brian KamenetzkySEGMENT 1: LeBron is back, maybe! Today on the Rarified Heir Podcast we are talking to Brad James, son of legendary television personality Dennis James. We talk to Brad about his dad's career that began in New Jersey radio in the 1940s (where he became friends with a young Frank Sinatra) and moved to television in New York shortly after. A man of firsts, Dennis James (aka The Dean of Game Show Hosts) was the first person to: appear in a television commercial, host a wrestling event on television, emcee a variety show, appear on video tape, appear in an infomercial and on and on and on. The man started in television when there were likely only 300 in the entire New York area. He went on to have a 6 decade career as a host of the United Cerebral Palsy telethon which raised a billion dollars over the years, hosted a variety of game shows like Name That Tune and The New Price Is Right as well as play himself in films like Rocky IIIand The One and Only. Somehow we get through all of this and find time to discuss meeting Elvis Presley, believing comedian Foster Brooks was Santa Claus, parking cars at The Playboy Mansion, befriending local LA legend Mad Man Muntz over a thoroughly inappropriate videotape and much more. If you love game shows, stories about the birth of television, watching Jeopardy with Bob Hope and golfing with Kevin Costner, take a listen to this episode of the Rarified Heir Podcast.

James Dennis is a senior lecturer in political communication and journalism at the University of Portsmouth ~ I have to admit - I’ve never really liked those Facebook profile picture overlays. You know the ones that have catchy slogans and campaign hashtags that are designed to raise awareness for certain issues like mental health - but have massive bank brands behind them? Yeah, you know. As well as wondering about the motivations of the brands behind these campaigns, I’ve often queried the individual motivations behind the people who add these overlays to their profile pictures. Are they really engaged - or do they just want to appear to be? Are they better citizens than me for using their platform to signal and proudly align themselves with a cause - while I just keep my regular profile picture? As with most things in our social media realm and our human behaviour, the answer is more complex than what’s on the surface. This practice of supporting a political or social cause by means such as social media or online petitions is sometimes referred to as 'Slacktivism' - which, by definition, is characterised as involving very little effort or commitment. Updating an overlay on your profile picture is pretty simple, after all - but is this popular definition - and my past scepticism - a fair assessment? In this episode, we’re speaking with James Dennis, Senior Lecturer in Political Communication and Journalism at the University of Portsmouth. James’s research focuses on digital politics and in particular, political engagement on social media. James has written a book called Beyond Slacktivism: Political Participation on Social Media. By reflecting on his research, James argues that the definition of slacktivism is too narrow and that the use of social media in regards to political issues can actually be more beneficial and progressive than we think. In this episode, we chat to James about his research, popular definitions of slacktivism and his reasons as to why should think more broadly about this idea as it exists on the spectrum of being aware, informed and active. For me, this conversation was really refreshing and hope-inspiring, and reflected the power that our social platforms have to spread awareness, educate and amplify resources and materials that are informative, useful and, ultimately, progressive. Sheffield Hallam is gearing itself up to using digiatl audio. I sense that following two years of background work there are indications here that digital audio is a media that people are ready to use. There is a lot of interest in the Closer! podcasting pilot, for example. Part of the effort made by me has been in making sure that everything's in place for staff and students to use it whenever they were ready. In this episode I speak with James Dennis about what he and the AV unit have been doing in preparing the Edit Suites on both our City and Collegiate campuses. This recording is an extract of a longer recording I made as James and I talked through various learning scenarios and approaches to making good quality recordings. These recordings are available for staff on the Closer! pilot project website site. Check the Show Notes at http://ltapodcast.blogspot.com
