The respondents are various professionals who obtained judgments against the appellant in 2004, to which a ten-year prescriptive period applies under art. 2924 of the Civil Code of Québec. Certain actions interrupted prescription between 2005 and 2007, after which prescription started running again.A bailiff served a notice of execution on the appellant in 2016, which authorized the bailiff to seize the appellant's movable property. However, the bailiff concluded that the appellant's movable property was exempt from seizure pursuant to section 89 of the Indian Act. The bailiff later had discussions with the appellant's Grand Chief and was informed that there was no property outside of its land base. The bailiff did not prepare and file minutes of seizure. Subsequently, the appellant informed the respondents that it held a property outside of its land base but that it was exempt from seizure. The respondents registered a legal hypothec against that property.The appellant sought a declaration that the prescriptive period applicable to the judgment had expired before the respondents registered the hypothec. The trial judge concluded that prescription had been interrupted in November 2016 when the respondents served a notice of execution on the appellant. The actions of the respondents amounted to a judicial application that interrupted prescription per article 2892 C.C.Q. Although the seizure was unfruitful, it had not been dismissed or annulled by a court, in which case prescription would not have been interrupted, per article 2894 C.C.Q. The Court of Appeal dismissed the appeal and affirmed the trial judge's decision. Stephen Silverbear McComber is a seedkeeper and a recently elected chief on the Mohawk Council of Kahnawà:ke whose portfolio is sustainable development. Silverbear tells us about the seeds that different people shared with him while visiting different First Nations communities within the Confederacy. He tells us how he has taken care of these seeds and a generation later, he has been able to return some of these seeds to the families of the folks who shared them with him, and the joy and connection that this brings. Silverbear explains how he plants by the phases of the moon, and what crops he plants during different periods, how the spring has been starting later than it used to and the autumn is also ending later and the challenges that creates for growing food. Silverbear explains how it is important to select corn and other crops to adapt to this changing environment and to your bioregion. Three days of arguments around the expanding of daily fantasy sports and online poker in Ontario's regulated gambling industry were heard in the province's court of appeal last week with a decision by the five-judge panel not expected until the new year. The legal beagles piled up the billable hours on behalf of their clients, including the Douglas Ford government, sports betting and gaming businesses, the Mohawk Council of Kahnawake, and the four provincial lottery and gaming entities that make up the Canadian Lottery Coalition. Among the interested observers in the courthouse proceedings was Canadian Gaming Association senior advisor Amanda Brewer, who made her return to the latest episode of the Gaming News Canada Show presented by GBG Plc (welcome back to our presenting sponsor). Brewer provided her take on what she saw and heard last week and the scenarios that could play out once the panel reaches a decision. We also asked Brewer for her thoughts on the continued debate around sports betting advertising in our home and native land, what's news in Alberta (the province's Minister of Red Tape Reduction last week took aim at Bodog), and iGaming Ontario's search for a president and chief executive officer, who's expected to move into Martha Otton's chair some time in the first quarter of 2025. Court is in session this summer, at least the Court of Appeal for Ontario, which is being asked by the provincial government “to answer whether the Ontario's igaming regime would remain lawful under the Criminal Code (of Canada) if the overall size of the potential gaming audience of the scheme, otherwise known as its liquidity, is expanded to include players outside of Canada”. The latest session, which took place July 6, included legal representation for the Attorney General of Ontario, the Attorney General of British Columbia, members of the Canadian Lottery Coalition, the Canadian Gaming Association, Flutter Entertainment (owners of PokerStars and FanDuel), NSUS Group Inc. and NSUS Limited (proprietors of GGPoker), and the Mohawk Council of Kahnawà:ke. For their respective perspectives on the court proceedings, the Gaming News Canada Show welcomed back CGA president/CEO Paul Burns and Jack Tadman, the managing partner of GME Law. Burns walked us through the CGA's role in supporting the province's request and provided some history around cross/jurisdiction/border online gaming and daily fantasy sports. Tadman added a layer or two, too, to that topic and spoke about what intrigues him about the case and the participants. Burns had some thoughts last month's Canadian Gaming Summit and welcomed Kiron Interactive as the association's newest member. Both Burns and Tadman addressed the ever-evolving nature of regulated sports betting and gaming, and we also asked Tadman for his reaction to the ongoing push by Senator Marty Deacon to pass Bill S-269, National Framework on Advertising for Sports Betting Act. Given the recent cornucopia of happenings around the business of sports betting and igaming, we brought back the Gaming News Canada Show panel with Amanda Brewer and Phill Gray.The rapid-fire roundtable featuring the two gambling industry veterans opened with a discussion on the recent ruling by the Ontario Superior Court against the Mohawk Council of Kahnawà:ke that the gaming model operated by iGaming Ontario is of the valid variety, and its potential impact on the future on other regulated provinces across Canada. Brewer, who will participate in a couple of panels at next month's Canadian Gaming Summit in Toronto, and Gray also weighed in on the agenda that's been created by SBC in collaboration with the Canadian Gaming Association for the three-day conference inside the Metro Toronto Convention Centre.The conversation turned to south of the border where U.S. states such as Illinois are proposing tax hikes to regulated sports betting operators, and the recent snub by operators toward the Massachusetts Gaming Commission to discuss placing betting limitations. On the latest edition of the Gaming News Canada Show, regular guests Amanda Brewer, Kris Abbott and Phill Gray were joined by Covers gambling industry beat writer Geoff Zochodne for a rather robust roundtable.Zochodne provided his thoughts and layers on spending two days inside an Ontario Superior Court of Justice courtroom last week to listen to lawyers for iGaming Ontario and the Mohawk Council of Kahnawà:ke lay out facts and arguments in the council's civil proceedings against Ontario's regulated sports betting and igaming industry. Gray, Abbott and Brewer added their perspective on the case, in which Judge Lisa Brownstone is expected to submit a ruling before summer. With the changes to the AGCO's standards around advertising and marketing taking effect tomorrow, the panel discussed the transition by Ontario's licensed operators to the new regulations around the use of athletes and celebrities, and the continuing presence of .net operations pitching their products on television networks. The announcement by Unibet last week that it will officially leave the Ontario market on March 26 sparked a conversation on the likelihood of other licensed operators vacating the province before Year 3 of regulated sports betting and igaming begins in early April. That conversation prompted Brewer to point out that smaller operators are leaning into the Canadian grey market to support their Ontario businesses.Finally, there was reaction from Abbott, Brewer, Gray and Zochodne to the American Gaming Association releasing a third straight year of record numbers for regulated gambling across the U.S. of A. Craig and Doc Project host Acey Rowe trace the claim to the land his condo is on back through history, through property booms and busts, from a group of monks who gambled it all away to some dubious cross-planting by one Jacques Cartier -- all the way back to the original inhabitants, for a conversation with Mohawk Council of Kanesatake Grand Chief Serge Simon to hear what he thinks, and what he hopes for the future. n 2017 Blue Fish Canada organized a half-day focus on fish health and fish consumption as part of the St. Lawrence River Institute for Environmental Studies Annual research and policy symposium. In attendance was Dr. Laurie Chan, Canadian co-chair of the IJC Health Professionals Advisory Board, and a University of Ottawa Professor and Canada Research Chair in Toxicology and Environmental Health. Good news, the International Joint Commission just announced the formation of a Fish Consumption Advisory Project with the Mohawk Council of Akwesasne, and Dr. Chan is Co-Chairing the initiative! The initiative represents a first step to better understand the role of fish consumption advisories and what catching and consuming fish in the Great Lakes Basin and St. Lawrence River means to the socio-economic sustainability of shoreline communities. With leaders preaching across the country for Indigenous people to take the COVID-19 pandemic serious, one nation in Quebec has five confirmed cases but can’t pinpoint the source. That means Kahnawake’s numbers could go up said Lloyd Phillips, commissioner of public safety for the Mohawk Council of Kahnawake. Perry Bellegarde, national chief of the Assembly of First Nations, said people can’t take any risks and need to treat this virus seriously.
