This encore presentation is of particular importance as we, again in the United States, face those who denigrate powerful women whether it be a female journalist, the first BIPOC woman running for President of the United States, or every person who speaks truth to power. Elaine Miller-Karas, the host of Resiliency Within, is interviewed by her colleague and friend, Dr. Michael Sapp. She will discuss a concept that she calls the “Rebecca Effect” with Dr. Sapp. The “Rebecca Effect is the empowerment and transformation possible for all of us who have been oppressed, marginalized, or shamed. Her ideas were sparked by the fictional character Rebecca Welton, the owner of the fictional Richmond football team in the Ted Lasso television show. Initially, Rebecca is consumed by a desire for revenge against her ex-husband, Rupert, who betrayed their marriage. She aims to destroy his beloved football team, which she received in their divorce, by hiring the soccer-illiterate American football coach Ted Lasso. Her eventual journey is littered with reminders of her ex-husband's public attempts to marginalize and shame her. Through her self-reflections, the support of friends, and her relationships with Lasso and her best friend, Keeley, she reclaims herself. Like Rebecca, many women and non-binary persons endure betrayal, marginalization, and oppression. Despite possessing great strength, they may experience doubt and question their value. Many of us encounter individuals who espouse misogynistic views and attempt to diminish our worth. The Rebecca Effect describes the process through which women can embrace themselves in totality—their gifts and their imperfections. They gain the courage to confront injustice. This transformation includes embracing vulnerability, acknowledging their inner child, and realizing their inherent power and worth. Compassion, strength, and courage co-exist. Strict Scrutiny Applied to laws that affect fundamental rights or target suspect classifications (such as race or national origin), strict scrutiny is the most stringent standard. Under this review, a law is constitutional only if it serves a compelling state interest and is narrowly tailored to achieve that interest with the least restrictive means. Cases like Brown v. Board of Education (1954), which ended racial segregation in public schools, exemplify the application of strict scrutiny. Intermediate Scrutiny Used mainly for laws that classify based on gender or legitimacy, intermediate scrutiny requires the law to further an important government interest in a way that is substantially related to that interest. This standard, less rigorous than strict scrutiny, was developed in cases like Craig v. Boren (1976), which dealt with gender discrimination in alcohol laws. Rational Basis Review The most lenient standard, rational basis review, is applied to all other classifications. A law will pass this review if it is rationally related to a legitimate government interest. This standard gives a great deal of deference to legislative choices. A notable case is Railway Express Agency v. New York (1949), where the court upheld a city regulation under rational basis review. Racial Discrimination and Affirmative Action The fight against racial discrimination has been at the forefront of constitutional law, reflecting America's ongoing struggle with its racial history. Historical Context Initially, the Supreme Court upheld racial segregation (Plessy v. Ferguson, 1896), endorsing the "separate but equal" doctrine. However, this began to change with cases like Brown v. Board of Education, which declared state laws establishing separate public schools for black and white students unconstitutional. Affirmative Action In recent decades, affirmative action policies aimed at rectifying historical racial injustices have been a focal point. Key cases include Regents of the University of California v. Bakke (1978), where the Court held that race could be one of several factors in Gender Discrimination and Gender Equality Gender discrimination and the fight for gender equality have evolved significantly in constitutional law. Evolution of Gender Equality Cases like United States v. Virginia (1996), which opened the Virginia Military Institute to women, reflect the increasing recognition of gender equality. The Court has expanded the understanding of discrimination to include not just overtly discriminatory laws but also those that have a disparate impact on a particular gender. Age Discrimination Age discrimination in employment is a significant issue. While the Equal Protection Clause itself does not explicitly protect against age discrimination, statutes like the Age Discrimination in Employment Act (ADEA) have been enacted to protect older workers. Constitutional challenges in this area typically receive rational basis review. Disability Discrimination The Americans with Disabilities Act (ADA) of 1990 represents a landmark in fighting discrimination against individuals with disabilities. While the ADA is a statutory protection, the Supreme Court has addressed disability rights under the Constitution, especially in contexts like access to public services and accommodations. Sexual Orientation and Gender Identity One of the most significant developments in recent years has been the recognition of rights based on sexual orientation and gender identity. In cases like Obergefell v. Hodges (2015), the Supreme Court recognized same-sex marriage as a fundamental right under the Constitution. This decision and others, like Bostock v. Women have long faced discrimination in the workplace, and this is still true today. From being told that they should stay in the kitchen, to being denied job opportunities, to facing sexual harassment and assault, women have had to fight hard for their rights in the workplace.One example of this discrimination is the story of Linda Strader, the first woman to be hired as a US Forest Service Fire Crew. Linda was 20 when she applied for the job, and was met with resistance from her male coworkers. She was told that women belonged in the kitchen, and was told to quit and find something else to do with her life. Despite this, Linda persisted and worked for the Forest Service for seven years. During that time, she had to prove herself to her male coworkers, often working harder than them to show that she was just as capable.Unfortunately, Linda also faced discrimination from her supervisors. She was told that she would not be hired because she was a woman. This is illegal, of course, but Linda was unable to prove it since it was just her and her supervisor in the room. Unfortunately, Linda's experience is not unique. Many women still face discrimination in the workplace today, from being passed over for promotions to facing sexual harassment.The good news is that there are laws in place to protect women from discrimination in the workplace. The Equal Employment Opportunity Act, for example, ensures that employers cannot discriminate against women in hiring, firing, or promotion decisions. Additionally, there are laws in place to protect women from sexual harassment in the workplace.Despite these laws, however, women still face discrimination in the workplace. This is why we must continue to fight for women's rights in the workplace and ensure that they are treated with the respect they deserve. We must also continue to raise awareness of the discrimination that women face in the workplace and take steps to eliminate it. This is a 3-part series of Channel's story. We're back for a wrap-up of Channel's story. Starting from where Part 2 left off, Channel, Margi and John discuss racism in general in the United States, and racism experienced in Utah by Channel and her children in Utah based on their skin color, with even her lighter-skinned children getting treated better than those with darker skin. This will be a 3-part series of Channel's story. Channel is continuing her story from her marriage, an embarrassing disciplinary council where she is judged for her “sins” by a group entirely of white men, and dealing with the fall-out of a marriage that was ill-suited from the beginning and facing the stigma of divorce within the LDS church as a woman of color. Channel marries again, this time to a non-member of the church and has two children. Despite her husband's encouragement to leave, Channel continues to seek acceptance and approval from her religion despite her skin color. As she becomes disillusioned over time, Channel manages to stay in because of the influence of a few good friends, especially when her second marriage dissolves, and she finds herself needing more help. We learn more about issues around race issues in general such as the difference between racism and white supremacy and how both show up in the Church's doctrines, practices, and members, including being constantly talked down to and told what to do with her life and what to think even by friends over a decade younger than she. This will be a 3-part series of Channel's story. In Part 1 We get some background on Channel's family growing up, how black families and black culture differ substantially from Mormon white culture, what led Channel to seek God and how that led to her joining the Church of Jesus Christ of Latter-day Saints. Channel tells us the good, bad & ugly of how she was treated as a black teenage convert, when she learned of the Church's racism, and ways that she accepted, excused, and eventually internalized it to see herself as “less” than her white counterparts. This became most apparent in dating and marriage. While white men in the church may find her exotic and are willing to date her, Channel finds that they are unwilling to marry her as “mixing seed” would pass her “curse” [black skin] to children that could otherwise have two white parents. As Channel loses herself and what makes her unique to the cultural expectations of the Church she marries another black member of the church at the counsel of her Bishop against her better judgment.
