The respondents are various professionals who obtained judgments against the appellant in 2004, to which a ten-year prescriptive period applies under art. 2924 of the Civil Code of Québec. Certain actions interrupted prescription between 2005 and 2007, after which prescription started running again.A bailiff served a notice of execution on the appellant in 2016, which authorized the bailiff to seize the appellant's movable property. However, the bailiff concluded that the appellant's movable property was exempt from seizure pursuant to section 89 of the Indian Act. The bailiff later had discussions with the appellant's Grand Chief and was informed that there was no property outside of its land base. The bailiff did not prepare and file minutes of seizure. Subsequently, the appellant informed the respondents that it held a property outside of its land base but that it was exempt from seizure. The respondents registered a legal hypothec against that property.The appellant sought a declaration that the prescriptive period applicable to the judgment had expired before the respondents registered the hypothec. The trial judge concluded that prescription had been interrupted in November 2016 when the respondents served a notice of execution on the appellant. The actions of the respondents amounted to a judicial application that interrupted prescription per article 2892 C.C.Q. Although the seizure was unfruitful, it had not been dismissed or annulled by a court, in which case prescription would not have been interrupted, per article 2894 C.C.Q. The Court of Appeal dismissed the appeal and affirmed the trial judge's decision. Changing Conditions – A 12-foot tide swing means careful planning is key. Chasing False Albacore and Stripers in Cape Cod September fly fishing in Cape Cod is all about variety. Mornings start with chasing albies as they crash bait along the coast. Once the sun gets higher, it's time to head to the Monomoy rips, where strong currents create standing waves that attract striped bass, bluefish, and more albies. Fishing here is full of action—big fish, heavy flies, and rods bending deep into the backing. If you've never had an albie on a sinking line in rough water, you're missing out on one of the best fights in saltwater fly fishing. For those looking for a more classic flats experience, Monomoy's Great Flats offer prime striper action. As the tide pushes bait into shallow channels, stripers line up like cars in a traffic jam, waiting for the perfect ambush. It's sight fishing at its best—just be ready for fast-moving water and changing conditions. From Freshwater to Salt: How Cape Cod Became a Fly Fishing Obsession George's fly fishing journey started young, thanks to his grandfather's curiosity about the sport. Growing up on the Connecticut coast, he spent his days chasing bluefish and learning the rhythms of the water. His fly fishing passion really took off later, after a trip to the Catskills that changed everything. Over time, he found himself drawn back to Cape Cod, a place he visited every summer as a kid. What started as freshwater fishing in kettle ponds turned into a deep love for saltwater fly fishing. Eventually, George left his corporate career, got his captain's license, and never looked back. Now, he spends his days guiding anglers through the diverse waters of Massachusetts, from tailwater trout to stripers on the flats. Steelhead Dreams and Boat Tweaks: George Sylvestre's Off-Season Adventures When he's not guiding on the flats of Cape Cod, George is chasing steelhead on the Lake Erie tributaries. Every fall, he packs up his truck, cranks some Bob Marley, and makes the eight-to-ten-hour drive from Massachusetts for a few days of battling these powerful fish. This year, he's heading out in the spring for the first time, eager to see how the bite compares. Back at home, George can't stop tinkering with boats. Whether it's his 22-foot hydro sports skiff for saltwater or his drift boat for local rivers, he's always making small tweaks to improve the fishing experience. Cape Cod's tides and chop require a boat that can handle waves while still sneaking into quiet estuaries. It's a balance he's always fine-tuning, making sure his anglers get the best ride possible. Winter Fly Fishing in Massachusetts: Midges, Tight Lines, and Cold Water Challenges Winter fly fishing in Massachusetts means small flies, light tippet, and patient presentations. The Deerfield and Swift Rivers are prime spots this time of year, but they demand precision. With crystal-clear water, fish can see you just as well as you see them. That means size 22-26 midges and 6-7x tippet are the name of the game. George uses a mix of tight-line nymphing and indicator setups, depending on conditions. In his Avon Path Maker raft, he floats the Deerfield and Ware Rivers, sometimes stopping to let anglers wade into productive sections. In winter, trout sulk low and slow, so getting your fly right in front of them is key. It's not easy, but for those willing to bundle up and put in the work, the rewards are well worth it. Mastering the Wind: Saltwater Fly Casting Tips from George Sylvestre Saltwater fly fishing demands adjustments in casting technique, especially when dealing with constant wind. George shares three key casting strategies to help anglers adapt and make accurate presentations even in tough conditions: Sidearm Casting – Tilting the rod horizontally moves the fly away from your body, keeping it out of the wind. Casting Across Your Body – Shifting the rod to your non-dominant shoulder helps when the wind is coming from your casting side. Dans le contexte du texte biblique, il s'agit ici d'un Juif hellénisé. Le terme, avec le temps, évolue. L'époque contemporaine lui donne ainsi un autre sens, à la fois volontariste et même extensif. Il qualifie alors le génie, mêlant à la fois la civilisation, la langue et l'esprit des Hellènes par opposition aux mondes barbares. Pourtant, les royautés hellénistiques se sont imposées sur l'ensemble du pourtour oriental de la Méditerranée. Alexandre le Grand fut l'archétype de ce nouvel exercice du pouvoir. Cependant, la recherche historique nous révèle que la polis grecque ne disparaît pas pour autant, ni ne décline. Les enfants de la mission Andendé.Prix Nobel de la paix 1952 pour son altruisme, son respect de la vie et son appel à la fraternité entre les hommes et les nations, Albert Schweitzer arrive pour la première fois au Gabon en 1913, à la mission protestante Andendé. C'est là que le Pasteur accueille ses premiers malades en tant que médecin. Mais la mission Andendé, c'est aussi l'école primaire où Moïse, Michel, Ernest, Sylvestre et Jeanine ont été scolarisés dans les années 50 et 60… À moins d'un km de l'hôpital créé par Schweitzer après la Première Guerre mondiale. La proximité entre la mission Andendé et l'hôpital Schweitzer a été déterminante pour les familles du Moyen Ogooué dont le sacrifice a été récompensé par la réussite sociale de leurs enfants. Mais à quel prix les enfants ont-ils intégré l'école des Blancs ? Augustin, mais aussi Tonton Sylvestre et sa sœur maman Jeanine, ainsi que les trois frères Tonton Moïse, Tonton Michel et Tonton Ernest. Tous sont nés à l'Hôpital Schweitzer et ont connu le « Grand » Docteur. Des femmes et des hommes dont les récits d'enfance évoquent toute une épopée coloniale au bord du fleuve Ogooué ainsi que les talents d'un médecin blanc envoyé par Dieu en Afrique pour pratiquer sa religion de l'amour. Au fil de leurs récits, nous découvrons les dimensions multiples de la fascination exercée par un homme dont la spiritualité, l'esprit bâtisseur, les talents médicaux mais surtout le don de soi les a marqués à jamais.  En pirogue sur l'Ogooué, en découvrant les ruines de la mission d'Andende et son école, en déambulant dans la zone historique de l'Hôpital, en rencontrant Arnaud Flamen, le dernier médecin blanc qui l'a dirigé, nous nous interrogeons sur l'œuvre d'Albert Schweitzer, précurseur de la médecine humanitaire, initiateur en chef d'une communauté hospitalière autonome au bord du fleuve. Especially since the pandemic, a lot of us have connected deeply with the need to build food resilience by cultivating our own gardens, and quite a few have even gone further and started to grow at a market scale.  It's a beautiful thing to be able to eat fresh healthy produce from your own land, but I've often wondered as well, how we can cross the long dark and cold period of winter, when fresh local veggies are tough to come by. Though there are quite a few volumes about season extension in the garden, I had never really come across anyone who was actively planting for deep months of winter, and so I was thrilled when I found that New Society publishers were putting out a whole book on exactly this subject. Building on years of research, experimentation, and collaboration, and co authored by Catherine Sylvestre and Jean Martin Fortier “The Winter Market Gardener” is a beautifully illustrated practical guide to winter vegetable production for small farmers growing in northern climates.  I got to speak with Catherine Sylvestre who is a professional agronomist and director of vegetable production and leader of the market garden team at la Ferme des Quatre-Temps (The Fours Seasons Farm) in Quebec, Canada. She develops, implements, and teaches best practices for cold-season growing, specializing in crop protection and greenhouse production for northern climates. In this episode we cover just about every focus in this very complete book, from where the interest and research into winter growing started, sources of knowledge and inspiration for their ongoing experiments into winter growing, strategies and season planning, and even sales and marketing advice for the off-season produce. Catherine also gives crucial advice on the very practical side for things like structures and season extension tools, greenhouse heating devices, disease and pest protection, harvesting and cold storage, and even lists of plants that have grown well for them as well as those which have struggled.
