Hoy, en el consultorio de herencias, Itziar Pernía, de Legal por Naturalez, aborda una cuestión cada vez más frecuente: cómo convertir en rentables las herencias recibidas de padres o abuelos que, aparentemente, tienen poco valor o presentan importantes limitaciones jurídicas. El ejemplo analizado fue el de una vivienda de protección oficial (VPO o VPP) heredada y fuertemente revalorizada con el paso de los años. Una vivienda protegida no puede venderse libremente al precio de mercado mientras mantenga su régimen de protección. Pernía ha señalado algunas prácticas habituales pero ilegales, como cobrar parte del precio “en B” o entregar las llaves al comprador antes de completar los trámites administrativos. Estas actuaciones pueden derivar en sanciones, problemas fiscales e incluso en el ejercicio del derecho de tanteo por parte de la Administración. La solución que recomiendan desde Legal por Naturaleza es solicitar la descalificación voluntaria de la vivienda, un procedimiento administrativo que permite convertirla en vivienda libre. Aunque suele durar unos cinco meses, puede alargarse si no se tramita correctamente. Mientras tanto, si ya existe un comprador interesado, se pueden articular fórmulas legales como contratos de arras con condición suspensiva y contratos de arrendamiento temporal, garantizando seguridad tanto para vendedores como para compradores. También se analizó quién debe asumir los costes de la descalificación. La respuesta es clara: los herederos, aunque la Administración permite que dichos importes se paguen con bienes líquidos de la propia herencia, como saldos bancarios. Itziar destaca la importancia de planificar correctamente la valoración de los inmuebles heredados para reducir futuras ganancias patrimoniales en una eventual venta. Recordó además que toda herencia genera obligaciones tributarias, principalmente el Impuesto sobre Sucesiones, la plusvalía municipal y, cuando existe beneficio económico en la transmisión posterior, la tributación correspondiente en el IRPF.

Itziar Pernía Gómez, Socia Directora de Legal por Naturaleza, aborda la figura del legado, una herramienta testamentaria que permite al testador dejar un bien o derecho concreto a una persona determinada. A diferencia de la herencia, que supone recibir una parte del patrimonio hereditario, el legado se refiere a bienes específicos, pudiendo ser materiales o inmateriales. El legatario puede aceptar o rechazar el legado y no es necesario que sea heredero forzoso ni familiar del fallecido. Pernía explica que una misma persona puede ser simultáneamente heredero y legatario. Además, existen distintos tipos de legados, entre ellos los de cosa determinada, dinero, bienes genéricos, pensiones periódicas, usufructos o bienes gravados con cargas como hipotecas. Desde Legal por Naturaleza destacan que los legados también están sujetos al Impuesto de Sucesiones y, en caso de inmuebles, a la plusvalía municipal. Asimismo, un legado puede atribuirse a varios legatarios, aunque la falta de actuación de alguno de ellos puede dificultar la gestión posterior del bien. Entre las dudas planteadas por los oyentes se aclaró cuándo un legado queda sin efecto: por ejemplo, cuando el bien desaparece, es vendido por el testador antes de fallecer o se transforma de forma sustancial. Sin embargo, si la venta fue realizada por un representante legal del testador y no por decisión directa de este, el legatario podría reclamar el valor económico correspondiente. También se analiza la posibilidad de legar empresas, inmuebles, dinero u otros activos, así como la compatibilidad entre los legados y el respeto a las legítimas de los herederos forzosos. Si un legado perjudica la legítima, deberá reducirse para garantizar los derechos mínimos que establece la ley. Finalmente, se abordan los legados internacionales, plenamente viables siempre que se respeten las normas sucesorias y fiscales de los países implicados. La correcta planificación testamentaria resulta esencial para evitar conflictos familiares y garantizar que la voluntad del testador se cumpla de forma eficaz y duradera.

Se trata de un profesional neutral, nombrado normalmente por notario, cuya función es inventariar, valorar y repartir los bienes hereditarios conforme a la ley, evitando en muchos casos la costosa y lenta división judicial de la herencia. Esta figura puede solicitarse cuando exista falta de acuerdo entre los herederos y quienes lo promuevan representen al menos el 50 % del haber hereditario. Entre sus facultades destacan la elaboración del inventario, la valoración de bienes, la formación de lotes, la liquidación de la sociedad de gananciales, la incorporación de donaciones colacionables y la obtención de información bancaria o registral necesaria para la partición. Itziar Pernía, diferencia este concepto del contador-partidor testamentario en que este último ha sido designado directamente por el testador en su testamento, mientras que el dativo se nombra tras el fallecimiento cuando surgen conflictos entre los herederos. Ambos generan honorarios que constituyen un gasto de la partición y deben ser asumidos proporcionalmente por los herederos. En el ámbito internacional, la figura resulta especialmente útil para coordinar herencias con bienes en varios países, teniendo en cuenta la normativa sucesoria aplicable, los convenios para evitar la doble imposición y las obligaciones fiscales tanto en España como en el extranjero. Su objetivo principal es aportar seguridad jurídica, reducir conflictos familiares y facilitar una partición ordenada y eficaz de la herencia. Como cada lunes, Pernía resuelve consultas de los oyentes, destacando que un heredero que se desentiende del proceso no puede bloquear indefinidamente una herencia, ya que los demás pueden solicitar el nombramiento del contador-partidor dativo.

Dr. Sebastian Bojemski Graduated from the Institute of History of Warsaw University and gained his doctoral degree at The Cardinal Wyszyński University in Warsaw. At the Institute of World Politics (Washington, DC) he attended individual courses in geography and strategy, geoeconomy, strategic influence and propaganda. He was awarded scholarships by the Kosciuszko Foundation (USA) and the M. Grabowski Fund (UK). Mr Bojemski also has extensive experience in strategic communication, marketing, sales and management. For over 15 years (2003-2018) he had owned a Warsaw-based consulting firm. Between 2018-2024 he was an executive director for marketing at PKN Orlen – the largest oil company in Central Europe, a vice chairman at Lotos Fuels, the second largest oil company in Poland and a vice chairman at PERN, the largest fuel and logistics company in the region and critical infrastructure operator. He is currently affiliated with the University College of Professional Education as a member of the Center for Research on Disinformation and Cybersecurity and a senior fellow at the Eastern Flank Institute, a Brussels-based think tank. En el consultorio de herencias, Itziar Pernía, de Legal por Naturaleza, aborda una cuestión que muchas familias desconocen tras un fallecimiento: las obligaciones fiscales del causante y de sus herederos en la campaña de la renta de 2025. La idea principal es que una persona fallecida también debe presentar declaración de la renta del año de fallecimiento. Esta obligación recae sobre los herederos, que deberán presentar una declaración individual del causante, salvo casos excepcionales como un fallecimiento el 31 de diciembre. Si la declaración sale a devolver, el importe corresponde a los herederos, aunque la devolución no es automática. Para reclamarla es necesario aportar documentación sucesoria como el testamento, la declaración de herederos, el impuesto de sucesiones o la escritura de adjudicación de herencia. Si, por el contrario, la renta sale a pagar, la deuda tributaria también se transmite a los herederos, aunque las sanciones previas que pudiera tener el fallecido no pasan a ellos. Otro de los puntos destacados fue qué ocurre cuando se olvida presentar la renta del causante. En estos casos, Hacienda puede reclamar la deuda e intereses, aunque normalmente no impone sanción si los herederos regularizan voluntariamente la situación. Pernía ha explicado cómo tributa el usufructo heredado de una vivienda habitual. Cuando fallece el usufructuario y los nudos propietarios consolidan el pleno dominio, estos deberán empezar a imputar la correspondiente renta inmobiliaria en su IRPF desde la fecha del fallecimiento, salvo que pase a ser su vivienda habitual. Y como todas las semanas, Itziar Pernía respondie a dudas de los oyentes sobre casos de herencias.

JODY LYNN NYE Author & Writers of the Future Judge – Biography Jody Lynn Nye lists her main career activity as ‘spoiling cats.' When not engaged upon this worthy occupation, she writes fantasy and science fiction books and short stories. Since 1987 she has published over 50 books and more than 200 short stories. Among her novels are her epic fantasy series The Dreamland, Mythology 101 contemporary humorous fantasy series, three medical science fiction novels in the Taylor's Ark series, and Strong Arm Tactics, humorous military science fiction. Jody also wrote The Dragonlover's Guide to Pern. She also collaborated with Anne McCaffrey on four SF novels, including Crisis On Doona (a New York Times and USA Today bestseller. Jody co-authored the Visual Guide to Xanth with author Piers Anthony. She has edited two anthologies, Don't Forget Your Spacesuit, Dear!, and Launch Pad, and written two short story collections, A Circle of Celebrations, holiday SF/fantasy stories, and Cats Triumphant!, SF and fantasy feline tales. Nye wrote eight books with the late Robert Lynn Asprin, License Invoked, and seven set in Myth Adventures universe.
