This week, we're talking about an under-discussed part of federal gun law and a significant recent update to it. While most gun owners know you need to pass a background check to buy a gun from a licensed dealer. And most also know you need to pass one to get a concealed carry license. But many don't know their concealed carry license can be used to bypass the sales background check requirement--at least, in certain states. That list of states got longer this week as the result of a Gun Owners of America (GOA) lawsuit and President Donald Trump's executive review of gun policy. Now, 30 states have "Brady Permits" that allow holders to bypass the sales check. GOA's Sam Paredes joins the podcast to walk through the years-long legal fight. He lays out how GOA plans to lobby states to change their laws to qualify for the alternative status. He also said GOA plans to file follow-up suits to get ATF to recognize even more permits. Joe Biden's gun control speech in California should keep legal gun owners on notice as he wants to take away your rights.
Oregon's gun-control ballot initiative has put it at the center of the fight over guns in America. As the political battle ended with victory for Measure 114 and the deadline to implement a non-existent permit-to-purchase system closed in, a new front opened in the courts. Sam Paredes, a Gun Owners of America (GOA) board member and treasurer of the Gun Owners Foundation, was on the frontline of that legal battle. While multiple federal suits were unable to secure a Temporary Restraining Order against the law, GOA was able to convince a state judge the measure violated the Oregon Constitution's protections for the right to keep and bear arms. That decision has held thus far, despite an attempt by the state to get the Oregon Supreme Court to throw it out. Paredes joined the show this week to talk about where things stand now, and what's coming down the line. He said gun sales in Oregon will go on as usual for the time being, and the ban on magazines that hold more than ten rounds won't go into effect. But the fight isn't over as the state scrambles to create the permitting process and take the biggest practical issues with Measure 114 off the table. However, Paredes said GOA is encouraged by the Oregon Supreme Court's decision not to immediately intervene in the case. He said they may be hesitant to overturn the lower court's pro-gun ruling in the wake of the United States Supreme Court's ruling in New York State Rifle and Pistol Association v. Bruen. He argued they may not want to run afoul of Bruen and be overturned themselves. But the federal judge overseeing challenges to Measure 114 disagreed. She ruled the permit-to-purchase requirement and magazine ban likely don't violate the Second Amendment even under Bruen's text and tradition standard. Paredes said that judge did the analysis wrong. He argued the targeted magazines are in common use and protected, given SCOTUS's rulings in Heller and Caetano, and the permit-to-purchase law has no historical analogue. This week, President Biden urged the Senate to pass new gun legislation, including two House bills following mass shootings in Boulder, Colorado and Atlanta, Georgia. The first House bill looks to close loopholes on background checks and the second bill expands background checks on all firearm sales. Retired Staff Sergeant and Fox Nation host Johnny "Joey" Jones who is a pro-gun advocate joined the Fox News Rundown earlier this week to weigh in on the proposed House bills, reforming background checks and the obstacles that come with it. He also explains why he thinks mass shooting go deeper than gun legislation. Plus, host Jessica Rosenthal spoke with Sam Paredes, Executive Director of Gun Owners in California in an unaired interview about Congress passing and expanding existing gun laws in the wake of the mass shootings. Hello and welcome to this special BowlersDesk.com Political Podcast. This week Ric Epps and I tackled the tough issue of gun control. No matter what side of the gun debate you fall on everyone needs to be at the table on this. Both fervent pro gun activists and anti gun activists. We went out to a pro-second amendment rally in east San Diego County. The Lemon Grove Rod and Gun Club hosted the rally. They let anyone that wanted to come out and shoot guns, under the supervision of a club member of course. We sat down with California Stage Assemblyman Brian Jones. Brian is a Republican from the 51st assembly district, that’s east San Diego County from Santee out to the Imperial County line. One of the platforms in his campaign was gun ownership. He is a fervent supporter of it. He opposes any gun registration laws and thinks Americans should be able to buy any kind of gun they want. Sam Paredes the Executive Director of Gun Owners of California also joined us. Sam is as fervently pro-gun as the Assemblyman. Now for the sake of full disclosure you need to know I am not what could be called pro-gun. I do not believe that you should be able to buy a 50-caliber car mounted machine gun. However I think there are responsible gun owners’ out there. And like most Americans I fall in the grey space between this issue. Ric and I hope that this is the beginning of a dialog about the issue. Everyone needs to be at the table in a genuine and sincere way on this issue. We just started with the pro-gun people and hope to bring you a Political Podcast with anti-gun activists soon. This is a hot topic and I’m sure you’ll want to hop on your soapbox over it.
