The big opinions are starting to drop, and we're doing our best to keep pace. We first discuss Landor v. Louisiana Department of Corrections, which concerns religious liberty, the scope of Congress's power to create remedies against individuals under the Spending Clause, and whether there's any redress if government officials literally throw your rights into a trash can. We then turn to United States v. Hemani, where the Court found that a federal law barring gun possession by unlawful drug users violated the Second Amendment and revealed that some of the Justices are surprisingly open-minded about marijuana's role in American society. Key Topics[00:07:07] - Landor v. Louisiana Department of Corrections[00:08:02] - The facts of Landor's case and the prison's decision to ignore prior religious-hair protections[00:10:52] - RFRA, RLUIPA, and the path from Employment Division v. Smith to modern religious-liberty litigation[00:14:54] - The Spending Clause theory behind federal funding conditions and why the remedy question matters[00:19:54] - The majority's reasoning: why money-damages suits against officials were held unconstitutional here[00:21:33] - Sabri, the Necessary and Proper Clause, and the debate over third-party liability[00:26:04] - The parade of horribles: transgender sports, vaccines, and other funding-condition hypotheticals[00:33:03] - The constitutional background: “general welfare,” the spending clause, and the comma-versus-semicolon debate[00:38:49] - Why the Court granted the case and whether the facts pushed the legal outcome[00:42:13] - Hemani and the federal statute banning gun possession by unlawful drug users[00:44:05] - Historical analogies, habitual drunkards, and how Bruen and Rahimi are functioning together[00:47:17] - Discussion of the Court's analogical method and its practical limits in lower courts[00:54:26] - Justice Thomas's concurrence on jurisdictional hooks after Lopez[00:55:31] - Justice Jackson's concurrence on Bruen and Justice Alito's surprising marijuana comparison[00:57:51] - The real-world use of marijuana versus alcohol at the founding, and why the analogy is controversialRelevant LinksDivided Argument: https://www.dividedargument.com/Podcast merchandise: https://store.dividedargument.com/Podcast commentary and blog: https://blog.dividedargument.com/RLUIPA overview (Cornell LII): https://www.law.cornell.edu/wex/rluipaRFRA overview (Cornell LII): https://www.law.cornell.edu/wex/religious_freedom_restoration_actDistrict of Columbia v. GOING BALLISTIC DOJ Cease-and-Desist to City of Denver on AR-15 Ban The National Association for Gun Rights reports that AAG Dhillon issued a cease-and-desist letter to the City of Denver. The letter demands the removal of their AR-15 ban. Failure to comply will result in action by the DOJ. Hysteria Continues Unabated Following ATF's Announcement (Savage) The article discusses the ATF's rollback of gun regulations under the Trump administration's Justice Department, led by confirmed ATF head Robert Cekada, following an assassination attempt on President Trump. Gun control advocates like John Feinblatt of Everytown for Gun Safety criticize it as gutting ‘commonsense gun safety laws.' The author argues the hysteria is unwarranted, as the weapons used were legal nationwide and prior rules failed to prevent attacks. NAGR: Minnesota Dems Pushing Gun Ban via Omnibus Bill SF 4067 (Savage) The National Association for Gun Rights (NAGR) warns that Minnesota Democrats are advancing SF 4067, an omnibus firearms bill, through the state Senate and House. The bill proposes bans on certain semiautomatic rifles, magazines over 17 rounds, privately manufactured firearms, binary triggers, and expands red flag gun confiscation laws. NAGR urges Minnesotans to contact legislators to oppose the measure amid a tied House vote. New York State Rifle & Pistol Association v. Bruen: Impact on Baltimore, MD Homicides at 50-Year Low (Savage) Following the Supreme Court's Bruen decision, Maryland shifted from ‘may-issue' to ‘shall-issue' concealed carry permits, increasing from under 50,000 in 2020 to over 200,000 by April 2025. Baltimore City has seen homicides drop to a 50-year low, with only 33 homicides and 89 non-fatal shootings as of May 1, 2025, down 10.8% and 11.9% from the prior year. April 2025 recorded just four homicides, the fewest monthly since at least 1970. ATF Reforms on Pistol Braces (NPRM 1140-AA98) (Savage) The article discusses ATF reforms under the Trump administration that remove regulatory language from the vacated Biden-era pistol brace rule (NPRM 1140-AA98), affecting enforcement of the National Firearms Act (NFA) and Gun Control Act (GCA) on braced pistols classified as short-barreled rifles. While presented as a positive step, the changes do not limit ATF's statutory interpretation authority, allowing continued enforcement risks for gun owners. The author views it as meaningful progress but potentially ‘smoke and mirrors' without further congressional action.0 Navy v. Patrick Tate Adamiak: NRA Files Amicus Brief Urging U.S. Supreme Court Review (Savage) The NRA, along with other gun rights organizations, filed an amicus brief urging the U.S. Supreme Court to hear Navy v. Patrick Tate Adamiak, involving a Navy veteran's 20-year sentence for National Firearms Act violations over nonfunctional firearm relics. The case challenges the treatment of inert, destroyed items as regulated ‘firearms' under an expansive NFA interpretation, bypassing Second Amendment protections. The brief argues lower courts distorted precedent by avoiding Bruen's historical analysis test. DOJ/ATF 34 Final and Proposed Firearms Rules (April 29, 2026) (Savage) On April 29, 2026, the Department of Justice and ATF announced 34 notices of final and proposed rulemaking, the largest overhaul of federal firearms regulations in agency history, following Executive Order 14206 Protecting Second Amendment Rights. The package includes 8 finalized rules (e.g., rescinding bump stock machine gun definitions per Garland v. Cargill) and 26 proposed rules aimed at reducing burdens on FFLs and gun owners, modernizing forms like 4473, streamlining NFA processes, and aligning with court precedents. Rules cover repeals of Biden-era pistol brace and ‘engaged in the business' expansions, electronic recordkeeping, and interstate transport protections. Trump Pardon Call for Patrick ‘Tate' Adamiak (Fourth Circuit Federal Case) Patrick ‘Tate' Adamiak, a U.S. Navy sailor, was convicted on federal machinegun and unregistered destructive-device charges and sentenced to 20 years in prison despite no prior record or victims; the Fourth Circuit remanded on double-jeopardy grounds. The article urges gun owners to petition President Trump for a full pardon, framing it as a stand against ATF overreach and federal weaponization against Second Amendment activities. Items involved remain legally sold online, highlighting perceived injustice. REVIEWS Review: Anonymous Coward from Iowa Five Review: Anonymous Coward from Nebraska Review form coward. 5 something. On March 2, 2026, the Supreme Court will hear oral argument in United States v. Hemani. This case explores whether a federal law that criminalizes possession of firearms by an individual who is an "unlawful user of or addicted to any controlled substance" violates the Second Amendment. The U.S. Court of Appeals for the Fifth Circuit held this law unconstitutional as applied to most drug users, determining it could only be applied consistent with the Second Amendment to "those presently impaired." Hemani is the latest in a series of challenges the courts have confronted since the Supreme Court announced in New York State Rifle & Pistol Association v. Bruen that laws burdening firearms possession must comport with our nation's historical tradition of firearm regulation. Join us for a Courthouse Steps program where we will recap and analyze the oral argument at the Supreme Court. Featuring:Prof. F. Lee Francis, Associate Professor, Widener Law CommonwealthMarc Levin, Chief Policy Counsel, Council on Criminal Justice and Senior Advisor, Right on Crime(Moderator) John Ohlendorf, Partner, Cooper & Kirk, PLLC

The Supreme Court: Oral Arguments

Wolford v. Lopez | 01/20/26 | Docket #: 24-1046 24-1046 WOLFORD V. LOPEZ DECISION BELOW: 116 F.4th 959 LIMITED TO QUESTION 1 PRESENTED BY THE PETITION. CERT. GRANTED 10/3/2025 QUESTION PRESENTED: New York State Rifle & Pistol Association, Inc. v. Bruen , 597 U.S. 1, 33 (2022), holds that "the Second Amendment guarantees a general right to public carry" of arms, meaning ordinary, law-abiding citizens may "'bear' arms in public for self-defense." In this case, the Ninth Circuit sustained a Hawaii law that makes it a crime for a concealed carry permit holder to carry a handgun on private property unless he has been "given express authorization to carry a firearm on the property by the owner, lessee, operator, or manager of the property." H.R.S. § 134-9.5. That holding is in acknowledged direct conflict with the Second Circuit's holding in Antonyuk v. James , 120 F.4th 941 (2d Cir. 2024), a decision that struck down an identical State law in the same procedural posture as this case. The Ninth Circuit also sustained a multitude of other location bans on carry by permit holders, relying solely on post-Reconstruction Era and later laws. That doctrinal approach is in direct conflict with the Third Circuit's decision in Lara v. Commissioner Pennsylvania State Police , 125 F.4th 428 (3d Cir. 2025), the Fifth Circuit's decision in United States v. Connelly , 117 F.4th 269 (5th Cir. 2024), the Eighth Circuit's decision in Worth v. Jacobson , 108 F.4th 677 (8th Cir. 2024), and, most recently, the Eleventh Circuit's en banc decision in NRA v. Bondi , No. 21- 12314, 2025 WL 815734 at *5 (11th Cir. March 14,2025) (en banc), all of which hold that primary focus must be on Founding generation laws and tradition in applying the text, history and tradition test Bruen mandates. The questions presented are: 1. Whether the Ninth Circuit erred in holding, in direct conflict with the Second Circuit, that Hawaii may presumptively prohibit the carry of handguns by licensed concealed carry permit holders on private property open to the public unless the property owner affirmatively gives express permission to the handgun carrier? 2. Whether the Ninth Circuit erred in solely relying on post-Reconstruction Era and later laws in applying Bruen 's text, history and tradition test in direct conflict with the holdings of the Third, Fifth, Eighth and Eleventh Circuits? LOWER COURT CASE NUMBER: 23-16164

Examining the Fight Over 2A Rights for Illegal Immigrants

This week, we saw two federal appellate courts weigh in on the Second Amendment rights of people in the country unlawfully. The opinions covered a variety of positions on the question. Of course, they aren't the first courts to address the issue, and it's only become a more common challenge in the wake of 2022's New York State Rifle and Pistol Association v. Bruen. So, to dissect the state of the legal debate, we have Seattle University of Law professor Alan Mygatt-Tauber on the show. He has a law review article set to publish early next year that examines the state of the fight over undocumented immigrants and guns, as well as weighing in on the different arguments. Mygatt-Tauber said he's read every Second Amendment challenge to the illegal immigrant gun ban since Bruen was handed down. He said the most common outcome was a court holding that undocumented immigrants are part of "the people" protected by the Second Amendment, but upholding the gun ban as consistent with America's tradition of gun regulation. Then there were courts that determined they aren't protected by the Second Amendment at all. Finally, the least common holding was that they are protected, and the law is unconstitutional. He noted that the Sixth and Tenth Circuit holdings were both in the first category, but one included a notable, lengthy dissent explaining why all non-citizens don't enjoy Second, First, or Fourth Amendment rights. He noted that, even though he belives its the most accurate position, no court has yet held illegal immigrants are entitled to Second Amendment rights and the law barring them from possessing guns is unconstitutional. Special Guest: Alan Mygatt-Tauber.

The Supreme Court's interpretation of the Second Amendment has changed significantly over the last 20 years. Rulings in cases like DC v. Heller in 2008 and New York State Rifle & Pistol Association, Inc. v. Bruen in 2022 recast the "right to bear arms" in a new legal framework that makes it more challenging to create effective firearm regulations. On this episode of Policy Outsider, we speak with a New York State legislator and a political science scholar about constitutional originalism—the theory underlying aspects of these rulings—and the practical considerations of legislating in the complex legal environment created by the Court's decisions. Litigation Update: Attorney's Fees as Deterrence in Civil Rights Litigation

When Congress amended the Civil Rights Act in 1976, it directed federal courts to use judicial discretion to award “reasonable attorney’s fees” to a prevailing party. Yet when state actors are found in violation of the nation’s civil rights laws, what is “reasonable” often means that civil rights attorneys take a reduced fee award. Because of this, states are emboldened to enact and enforce more unconstitutional laws and the pattern repeats.Mere days following the U.S. Supreme Court’s decision in New York State Rifle & Pistol Association v. Bruen, the New York Assembly enacted new legislation allowing secular businesses to permit customers to carry concealed weapons on their property, but refusing to afford sensitive locations, like churches, the same choice. His Tabernacle Church in Elmira, New York filed suit under the Civil Rights Act claiming the new law violated its First and Second Amendment rights. It prevailed both in district court and at the U.S. Court of Appeals for the Second Circuit. When the matter returned to the district court, the State of New York claimed the church’s attorneys were entitled to just 16% of the fees requested in their application. Judge John R. Sinatra, Jr. of the Western District of New York rejected New York’s arguments, awarding 100% of the requested fees, concluding that the Civil Rights Act “encourages lawyers taking meritorious cases like this one” but to engage in “[p]erennial ‘haircuts’” in fee awards would “discourage well qualified counsel.”Join the Federalist Society for a discussion on the importance of courts awarding appropriate attorney’s fees in civil rights litigation.Featuring:Erin E. From December 27, 2023: The Supreme Court last month heard oral arguments in United States v. Rahimi, in which the Court will decide the constitutionality of a federal law that criminalizes the possession of firearms by individuals on whom state courts have imposed domestic violence protective orders. This case came to the Court following its June 2022 ruling in New York State Rifle & Pistol Association v. Bruen. In that case, the Court determined that whether a law violates the Second Amendment depends on whether there is a “representative historical analogue” for the contemporary law. Amanda Tyler, the Shannon Cecil Turner Professor of Law at the University of California, Berkeley School of Law, argued in a recent article in Lawfare that the many laws disarming loyalists that existed at the time of the Founding serve as a set of “historical analogues” required by Bruen to demonstrate the constitutionality of the statute at issue in Rahimi—a claim which has been disputed by Rahimi's lawyers. Lawfare Research Fellow Matt Gluck sat down with Tyler to discuss the Rahimi case, the nature of the Founding-era laws that stripped loyalists of their firearms, whether loyalists were members of the American political community, why that question matters for the Court's ruling in Rahimi, and more. The Weekly Reload Podcast
The NRA After Its Latest Board Election and Trump's Snub (ft. John Petrolino)

The Weekly Reload Podcast

This week, we're taking a close look at the state of the NRA. The nation's largest gun-rights group is not nearly as large as it was half a decade ago. President Donald Trump just bailed on its conference. However, its civil corruption suit is now over, and its latest board election is in the books. To give us a detailed view of where the NRA is at today, we've got freelance reporter John Petrolino on the show. John often writes for Shooting News Weekly and Bearing Arms. He recently did a great breakdown of the NRA election for the latter. John said the reformers, who now go by NRA 2.0, won a sizeable victory and should have a significant majority headed into next weekend's NRA Annual Meeting. Other longtime board members and defenders of former CEO Wayne LaPierre, many of whom are now part of what's called Strong NRA, did not fare as well. But John noted those who didn't run under the banner of either group did the worst of all. He also said some prominent board members, like New York State Rifle and Pistol Association president Tom King, lost their bids. John said he was a bit surprised by some of the results, but he believes the board's partisanship may not last. He said both sides have made calls for unity, however hard that might end up being. Special Guest: John Petrolino.

Master Marc Zirogiannis interviews Legislative Director of the California Rifle And Pistol Association, Rick Travis, on the impact and status of AB 1333. AB 1333 was the subject of last week's very popular show with this description, "Last week, Assemblymember Rick Chavez Zbur introduced AB 1333 to update the state's self-defense laws. The legislation explicitly clarifies that Californians must avoid resorting to fatal actions when they have the opportunity to de-escalate or disengage from a conflict outside their homes, with the aim of preventing violent confrontations. Master Marc Zirogiannis takes a Quick Look at both side of the issue. Is this a sensible piece of Self Defense Legislation, or an anti-victims' rights bill." Riding Shotgun With Charlie #225 Charlie Hiltunen III NRA BOD, NRA 2.0 Candidate   Here's another great interview with one of the NRA Board of Director members and NRA 2.0 Reform Candidate, Charlie Hiltunen III. At the Great American Outdoor Show, I got to meet several of the NRA 2.0 Candidates and set up to film some shows with a few of them. He had some commitments on the morning we filmed and asked if I could get him back so he was able to get to the airport. I told him I could do him one better and take him there. Currently, he's finishing his first term on the board.    Hiltunen was born and raised in Indiana. He grew up shooting and hunting as part of the midwest family life. He grew up in a time where high schoolers would bring a .22 rifle to school to hunt on the way home. This was a tradition with his father and he wanted to pass it along to his own children. When his kids were old enough, he was instructing and coaching them in the Scholastic Clay Target Program and Scholastic Action Program. With all the coaching and working with young people, he thinks he got more from it than they did.    His career was as an attorney working with government affairs, lobbying, and politics. When the traditions he shared as a son and father were at risk, he got more involved in activism. Part of this journey got him involved with the Indiana State Rifle and Pistol Association. The “family bond in the 2A community became even stronger.”    As an instructor and coach and president of ISRPA, he was asked if he wanted to be a candidate for the NRA BOD. While on a hiking trip in Michigan, he got the message about the offer. When he asked when they needed a bio, they said right away! With his experience as an attorney, lobbyist, and as the president of a state association, it was a great fit! One of his personal goals is to reconnect the NRA with its members, new and old.    The messaging from the BOD members I've talked to have all been the same. They want to increase members which will bring back some political clout. They want to focus on safety training, education, and competitions. The board is working more with each other to make the improvements they see fit. They all want to make sure the association stays around for another 150 years. But they do know that getting the message out is going to be a challenge.    Part of the conversation is about permitless carry and training. When Indiana went to permitless carry, there were more people who wanted to get training. Of course, it's needed for responsible gun owners. The need for those without permits is different from a regular licensing course. When the state requires training for a carry permit, that's often the only thing people take. But when they don't need a license, they have more practical needs for shooting and training.    We talk about training the women being the largest growing demographic of gun owners. He brought up fellow board member Rick Ector and the event he does in Detroit every year. It is important to get new people to try shooting so that they get that shooting is fun and training and safety are important for everyone.    It is important to vote for all 28 of the Reform Candidates. In the past, people have encouraged “bullet voting” to try and get a message to the board. That method raises only a few candidates and pushes the others down. But this slate of candidates is going to work together to make the changes they think are needed. With more of the reformers on the board, there will be less of the “old guard” who had allegiance to the former EVP. Ballots were sent out in the February issues of the NRA magazines. They're due on April 6, 2025.   It was great to get to know Charlie more during this conversation. I'm looking forward to seeing what the reformers will do and hoping the changes they make will be positive changes for the association.    Favorite quotes: “There's so many great people on the board of directors.” “Change is difficult for any organization.” “The NRA is not an organization, it's an organism.” “If you forget your history, you're going to lose your future.” Elect A New NRA Website https://electanewnra.com/   Second Amendment Foundation https://secure.anedot.com/saf/donate?sc=RidingShotgun    Citizens Committee for the Right to Keep and Bear Arms https://www.ccrkba.org/     Please support the Riding Shotgun With Charlie sponsors and supporters.    Self Defense Radio Network http://sdrn.us/   Buy a Powertac Flashlight, use RSWC as the discount code and save 15% www.powertac.com/RSWC   SABRE Red Pepper Spray  https://lddy.no/1iq1n   Or listen on: iTunes/Apple podcasts https://podcasts.apple.com/us/podcast/riding-shotgun-with-charlie/id1275691565

The Supreme Court last month heard oral arguments in United States v. Lawfare Research Fellow Matt Gluck sat down with Tyler to discuss the Rahimi case, the nature of the Founding-era laws that stripped loyalists of their firearms, whether loyalists were members of the American political community, why that question matters for the Court's ruling in Rahimi, and more.Support this show http://supporter.acast.com/lawfare.
