This week, we're taking a close look at the state of the NRA. The nation's largest gun-rights group is not nearly as large as it was half a decade ago. President Donald Trump just bailed on its conference. However, its civil corruption suit is now over, and its latest board election is in the books. To give us a detailed view of where the NRA is at today, we've got freelance reporter John Petrolino on the show. John often writes for Shooting News Weekly and Bearing Arms. He recently did a great breakdown of the NRA election for the latter. John said the reformers, who now go by NRA 2.0, won a sizeable victory and should have a significant majority headed into next weekend's NRA Annual Meeting. Other longtime board members and defenders of former CEO Wayne LaPierre, many of whom are now part of what's called Strong NRA, did not fare as well. But John noted those who didn't run under the banner of either group did the worst of all. He also said some prominent board members, like New York State Rifle and Pistol Association president Tom King, lost their bids. John said he was a bit surprised by some of the results, but he believes the board's partisanship may not last. He said both sides have made calls for unity, however hard that might end up being. Riding Shotgun With Charlie #225 Charlie Hiltunen III NRA BOD, NRA 2.0 Candidate   Here's another great interview with one of the NRA Board of Director members and NRA 2.0 Reform Candidate, Charlie Hiltunen III. At the Great American Outdoor Show, I got to meet several of the NRA 2.0 Candidates and set up to film some shows with a few of them. He had some commitments on the morning we filmed and asked if I could get him back so he was able to get to the airport. I told him I could do him one better and take him there. Currently, he's finishing his first term on the board.    Hiltunen was born and raised in Indiana. He grew up shooting and hunting as part of the midwest family life. He grew up in a time where high schoolers would bring a .22 rifle to school to hunt on the way home. This was a tradition with his father and he wanted to pass it along to his own children. When his kids were old enough, he was instructing and coaching them in the Scholastic Clay Target Program and Scholastic Action Program. With all the coaching and working with young people, he thinks he got more from it than they did.    His career was as an attorney working with government affairs, lobbying, and politics. When the traditions he shared as a son and father were at risk, he got more involved in activism. Part of this journey got him involved with the Indiana State Rifle and Pistol Association. The “family bond in the 2A community became even stronger.”    As an instructor and coach and president of ISRPA, he was asked if he wanted to be a candidate for the NRA BOD. While on a hiking trip in Michigan, he got the message about the offer. When he asked when they needed a bio, they said right away! With his experience as an attorney, lobbyist, and as the president of a state association, it was a great fit! One of his personal goals is to reconnect the NRA with its members, new and old.    The messaging from the BOD members I've talked to have all been the same. They want to increase members which will bring back some political clout. They want to focus on safety training, education, and competitions. The board is working more with each other to make the improvements they see fit. They all want to make sure the association stays around for another 150 years. But they do know that getting the message out is going to be a challenge.    Part of the conversation is about permitless carry and training. When Indiana went to permitless carry, there were more people who wanted to get training. Of course, it's needed for responsible gun owners. The need for those without permits is different from a regular licensing course. When the state requires training for a carry permit, that's often the only thing people take. But when they don't need a license, they have more practical needs for shooting and training.    We talk about training the women being the largest growing demographic of gun owners. He brought up fellow board member Rick Ector and the event he does in Detroit every year. It is important to get new people to try shooting so that they get that shooting is fun and training and safety are important for everyone.    It is important to vote for all 28 of the Reform Candidates. In the past, people have encouraged “bullet voting” to try and get a message to the board. That method raises only a few candidates and pushes the others down. But this slate of candidates is going to work together to make the changes they think are needed. With more of the reformers on the board, there will be less of the “old guard” who had allegiance to the former EVP. Ballots were sent out in the February issues of the NRA magazines. They're due on April 6, 2025.   It was great to get to know Charlie more during this conversation. This week, we broke a major story about Kamala Harris's record backing a total handgun ban in San Francisco. As District Attorney in 2005, Harris supported Proposition H. It banned the sale, purchase, and even possession of pistols by nearly every city resident. The measure never went into effect, but only because gun-rights activists won the court fight over it before that could happen. Chuck Michel, President of the California Rifle and Pistol Association, was the lawyer who won that case. He joined the podcast to discuss both the fight over Proposition H and the numerous other fights over gun restrictions he had with Harris during her time in California. He argued her support for several strictest-in-the-nation gun measures is more reflective of how she would govern as president than her recent remarks on owning a handgun herself. In this episode, co-host Felicia Ellsworth and Counsel Ryan Chabot discuss United States v. Rahimi, a recent decision that concerns the constitutionality of 18 U.S.C. § 922(g), a statute which prohibits individuals who are subject to domestic violence restraining orders from possessing firearms. Key foundational support for Rahimi was established in New York State Rifle & Pistol Association v. Bruen, a 2022 Supreme Court decision which enacted a test for Second Amendment challenges. The final decision in Rahimi, along with Bruen, provides the courts with a framework for determining what gun control laws are constitutional, and stands as a significant decision for ongoing Second Amendment litigation. Ellsworth and Chabot dive into the details of both Bruen and Rahimi, with Chabot explaining the historical intricacies of interpreting and litigating Second Amendment cases. He also speaks to the amicus brief he filed with Partner Alan Schoenfeld and Associate Josh Feinzig on behalf of Everytown for Gun Safety, a nonprofit that advocates for gun control and against gun violence. The organization was in support of the federal government's position that the statute at issue is constitutional and saw a sweeping victory in its favor in the Court's final ruling.This episode is the latest installment of our miniseries examining notable decisions recently issued by the US Supreme Court. Previous episodes covering this year's term looked at the decisions in cases including Cantero v. Bank of America, Alexander v. South Carolina State Conference of the NAACP, Securities and Exchange Commission v. Jarkesy, Department of State v. Muñoz and Loper Bright Enterprises v. Raimondo.

Minnesotans ages 18 through 20 could soon be able to legally carry handguns, after a federal appeals court ruled Tuesday that the state's age limit on concealed carry permits is unconstitutional. Attorney General Keith Ellison's office could still appeal to the U.S. Supreme Court and a spokesperson said they are considering whether to do so. As of now, the ruling by the 8th U.S. Circuit Court of Appeals is a win for gun rights advocates and three young adults who sued against the state's age limit. The cited the 2022 U.S. Supreme Court decision in New York State Rifle & Pistol Association, Inc. v. Bruen, in which a 6-3 majority ruled people have a right to carry a handgun in public for self-defense.The Minnesota law, passed in 2003, allowed only people over 21 to apply for a permit to carry a handgun—the federal limit is 18. MPR News host Cathy Wurzer spoke about the ruling with Rob Doar, Senior Vice President of the Minnesota Gun Owners Caucus, which was a plaintiff in the lawsuit.In a statement to MPR News, Attorney General Keith Ellison said he was “extremely disappointed” by the ruling. “This epidemic of gun violence will continue unabated unless we do something about it. Unfortunately, the Supreme Court's Bruen ruling made that far more difficult by opening the floodgates to litigation from gun advocacy groups looking to undo reasonable safety legislation.“This year alone, Minnesota has experienced at least four mass shootings. Just days ago, a 20-year-old tried to take the life of the former President of the United States. It is extremely troubling that Clarence Thomas' misguided opinion in Bruen is preventing us from acting to protect the public from senseless violence like this. The people of Minnesota want and deserve solutions that reduce shootings and improve public safety, and today's ruling only makes that more difficult.”

Miller," by Brian L. Frye Bob Levy was, for 14 years, chairman of the board of directors at the Cato Institute. He is now chairman emeritus. Bob joined Cato as senior fellow in constitutional studies in 1997 after 25 years in business. The Institute's Robert A. Levy Center for Constitutional Studies is named in his honor. He has also served on boards of the Federalist Society, the Foundation for Government Accountability, and the Institute for Justice. Bob received his PhD in business from the American University in 1966, then founded CDA Investment Technologies, a major provider of investment information and software. At age 50, after leaving CDA in 1991, Bob went to George Mason law school, where he was chief articles editor of the law review and class valedictorian. He received his JD degree in 1994. The next two years he clerked for Judge Royce Lamberth on the US District Court and Judge Douglas Ginsburg on the US Court of Appeals, both in Washington, DC.

The Supreme Court handed down its first Second Amendment ruling in two years on Friday. It's also the first case where The Court applied the test it developed in New York State Rifle and Pistol Association v. Bruen. Those facts alone mean US v. Rahimi will hold a great deal of influence on gun cases across the nation. So, we've got one of the top pro-gun scholars in the country on the show to break down what The Court did and didn't hold. Independence Institute's David Kopel has been at the forefront of the Second Amendment fight for decades, with citations in federal court decisions coast to coast and at the Supreme Court itself. He also filed a brief in Rahimi that appears to have significantly influenced the majority's thinking. Kopel lays out the good, bad, and ugly of the ruling that upheld the domestic violence restraining order gun ban. He said he wasn't surprised The Court upheld Rahimi's conviction, given a lower court found him dangerous. He also agreed with some of the warnings about how the majority loosened the standard for the Bruen test that Justice Clarance Thomas included in his lengthy dissent. However, Kopel said he was overall pleased with the Rahimi decision's outcome. He argued it gave credence to future challenges to the same law by defendants who don't have the same lengthy criminal record as Rahimi did. He also predicted how the case might impact other Second Amendment cases pending in the lower courts. Special Guest: David Kopel.

The Supreme Court last month heard oral arguments in United States v. Rahimi, in which the Court will decide the constitutionality of a federal law that criminalizes the possession of firearms by individuals on whom state courts have imposed domestic violence protective orders. This case came to the Court following its June 2022 ruling in New York State Rifle & Pistol Association v. Bruen. In that case, the Court determined that whether a law violates the Second Amendment depends on whether there is a “representative historical analogue” for the contemporary law. Amanda Tyler, the Shannon Cecil Turner Professor of Law at the University of California, Berkeley School of Law, argued in a recent article in Lawfare that the many laws disarming loyalists that existed at the time of the Founding serve as a set of “historical analogues” required by Bruen to demonstrate the constitutionality of the statute at issue in Rahimi—a claim which has been disputed by Rahimi's lawyers. Lawfare Research Fellow Matt Gluck sat down with Tyler to discuss the Rahimi case, the nature of the Founding-era laws that stripped loyalists of their firearms, whether loyalists were members of the American political community, why that question matters for the Court's ruling in Rahimi, and more.Support this show http://supporter.acast.com/lawfare. The Rich Zeoli Show- Full Episode (09/25/2023): 3:05pm- A new Washington Post/ABC News survey indicates that presumptive Republican nominee for president Donald Trump has a 9-point lead over President Joe Biden—51% to 42%. Interestingly, Trump holds a 20-point lead over Biden with voters under the age of 35 in the hypothetical rematch. 3:25pm- Chairman of the Senate Foreign Relations Committee Robert Menendez (D-NJ) has been charged with accepting hundreds of thousands of dollars in bribes in exchange for providing Egypt with “sensitive U.S. government information.” During a Friday press conference announcing a three-count indictment, U.S. Attorney for the Southern District of New York Damian Williams explained that federal prosecutors found $500,000 in cash, as well as gold bars, in Sen. Menendez' home—some of which contained fingerprints or DNA of Fred Daibes, a real estate developer also accused of bribing Menendez and his wife Nadine. According to The New York Times, Daibes pled guilty to financial crimes in 2022. Senator Menendez and his wife have both denied the criminal conduct alleged by prosecutors. Menendez insisted he was innocent and explained that he held nearly half-a-million in cash at his home for “emergencies.” 3:35pm- In an article for NJ.com, Tom Moran writes: “Look past the bars of gold, the envelopes stuffed with cash, and the shiny new Mercedes parked in the garage of Sen. Robert Menendez. Bad as that stench is, it's far from the worst of it. For that, you need to cast an eye to the torture chambers run by Egypt's military dictatorship, where security goons rape women to pressure their husbands in the next cell, where they clamp metal grips to men's genitals and shock them into submission, where they hang teens by their arms, tied behind their back, and leave them until their shoulders dislocate. That is why I am calling on Democratic and Republican leaders to unify on this issue. I'm asking Democrats in particular to reexamine their assumption that a loose border is somehow more compassionate. It is not. Alexandria Ocasio Cortez why she bought an electric vehicle that was not “union-made”? Ocasio Cortez nonsensically explained that she bought her vehicle before the COVID-19 pandemic. 4:40pm- Reporter Jon Levine attempted to dine at some of New York's finest restaurant's while wearing shorts and a sweatshirt—dressed similarly to Senator John Fetterman (D-PA). Unsurprisingly, the restaurants did not allow Levine into the dining room, explaining that he was in violation of the dress code. Coons explained, “right now the polls head-to-head are more concerning than I would expect.” 6:25pm- While appearing on Face the Nation with Margaret Brennan, Rep. Alexandria Ocasio Cortez (D-NY) bizarrely blamed Sen. Marco Rubio (R-FL) for the immigration crisis at the U.S. Southern border. She seemingly concluded that the U.S. should remove sanctions from Venezuela and the authoritarian Nicolas Maduro regime. 6:30pm- On Sunday, 60 Minutes documented that the United States is financing more than just defense weapons in Ukraine—an enormous amount of tax-payer money is also being used for farming, 57,000 first responder salaries, and the subsidization of Ukrainian small businesses. 6:40pm- Last week, a missing Lockheed Martin F-35 Lightning II valued at $90 million was located. The stealth jet went missing after a pilot was forced to eject over North Carolina—a debris field has been spotted in Williamsburg County.
