My perspective on this stuff really comes from the idea that before we are free to break the rules, we need to know what the rules are and we need to be well grounded in them." Episode Description: We begin by appreciating the evolution of some fundamental practices in psychoanalysis. We consider the meanings of 'rules' and 'guidelines'. Joyce shares with us her current thinking on answering patients' questions – for some, it's helpful, for others, not. We discuss the use of the word 'fantasy' with patients as contrasted with 'guesses' or 'imaginings'. Joyce considers the many ways that patients terminate their treatments and how frequently it does not accord with traditional models of ending. We consider reluctance to leave the treatment relationship from both sides of the couch – analysts, too, have needs satisfied in this work and can play a part in the nature of the ending. Joyce relates how some former patients remain in contact with their analysts, and that isn't necessarily problematic. For others, "being able to 'go it alone' represents an extraordinary achievement." She concludes that "termination remains an ideal worth holding onto. But loosely." “The original papers that were written about the analyst's unconscious being attuned to the patient's unconscious by Hyman and Racker, in both cases they talk about this phenomenon. But both of them utter a caution, which is that one always has to take into account one's own ‘mishegas'. Essentially, what they're saying is, the unconscious is pretty individualistic and we have our own things, and we have to consider that possibly it's our own difficulties, our own unconscious, that is playing a bigger role in our countertransference reaction to the patient's unconscious.” Episode Description: We begin by discussing the meaning of the many italics throughout the book and my sense of their being an expression of Fred's wish to be carefully understood. This is part of our conversation where we examine how internal reactions are used to comprehend another person's mind. There are a number of themes to this work, and to Fred's contributions over the years, which focus on helping individuals understand the way their mind works, as distinct from the particular contents of their mind. One of the gifts of psychoanalysis is to facilitate patient's discovery of the freedom to think which allows for a post-termination capacity for self-analysis. We discuss how self-criticism can serve as an unconscious lifeline, the importance of attending to the need for silence as distinct from what is not being said and the seductiveness of gossip, to name but a few of the topics in the book that we cover. Fred closes by describing "The wonderful thing about being a psychoanalyst is there are always things to learn and ways to grow." Welcome to Supreme Court Opinions. In this episode, you'll hear the Court's opinion in Consumer Financial Protection Bureau v Community Financial Services Assn. of America, Ltd. In this case, the court considered this issue: Does the funding scheme for the Consumer Financial Protection Bureau, which receives funding directly from the Federal Reserve, violate the Appropriations Clause of the Constitution? The case was decided on May 16, 2024. The Supreme Court held that the funding scheme for the Consumer Financial Protection Bureau satisfies the Appropriations Clause. Justice Clarence Thomas authored the 7-2 majority opinion of the Court. The Appropriations Clause provides that “no Money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law.” Article I, §9, cl. 7—in other words, government spending must be authorized by an act of Congress. Historically, the word “appropriation” requires identifying a source of public funds and authorizing the expenditure of those funds for designated purposes. The practices of the English Parliament after the Glorious Revolution, the American Colonies, early state legislatures, and the First Congress varied widely in their specificity, duration, and structure, but all met these basic requirements. The statute authorizing the CFPB's funding likewise contains the necessary elements of a valid appropriation under the Appropriations Clause. It identifies a source of funds (the combined earnings of the Federal Reserve System), sets a maximum amount that can be drawn, and specifies the purpose for which the funds can be used (to pay the CFPB's expenses in carrying out its duties). Furthermore, the CFPB's funding mechanism is analogous to some of the broad, open-ended appropriations passed by the First Congress. Therefore, the CFPB's funding statute satisfies the requirements of the Appropriations Clause. Justice Elena Kagan authored a concurring opinion, in which Justices Sonia Sotomayor, Brett Kavanaugh, and Amy Coney Barrett joined, noting that CFPB's funding scheme would have been acceptable not only in the late-18th century, but also any other time in our Nation's history. Justice Ketanji Brown Jackson authored a concurring opinion, endorsing judicial restraint. She pointed out that “when the Constitution's text does not provide a limit to a coordinate branch's power,” courts “should not lightly assume that Article III implicitly directs the Judiciary to find one.” Justice Samuel Alito authored a dissenting opinion, in which Justice Neil Gorsuch joined, arguing that the Appropriations Clause imposes more stringent obligations on Congress to monitor and control the expenditure of public funds and the projects they finance. The National Association of Realtors changed home buying rules and they've been in effect about a month. Home buyers will now have a new conversation with their realtor when they go to buy a home. The realtor will need to negotiate a fee with the buyer. Previously it was in the background as the deal went forward with a typical 6% commission split between buyer's agent and seller's agent. Now, that's all changed and is highly negotiable. Angelo DePaola has seen this coming. It's no surprise. He thinks it will make the best realtors stand out even more and the "hobbiest" realtors who sell homes as a side-hustle slowly go away.
