This week on the return of Black Law and Legal Lies, Ann and Dan talk about PPP loan forgiveness. We also talk about how a large number of people still aren't taking COVID seriously, especially with the prevalence of the Delta variant. Unfortunately, this episode was cut short due to technical difficulties. The law clinic Ann remotely recorded at had the type of WiFi you'd expect at a law clinic that Ann would remotely record at. This week Dan and Becky talk about police questioning minors. Dan has been arrested numerous times as a minor and he’s never once had a parent or an attorney in any of his interrogations. He was often propositioned with what you’d hear on typical cop TV shows, “tell us what we want and you can go home.” Voluntarily offering information to the police in order to go home always comes at a price. Dan also talks about not knowing his rights as a young teen and not fully understanding the Miranda rights. Dan highly recommends teaching children to know how to ask for an attorney and to NOT voluntarily speak to the police unless they’re victims of a crime. This is a topic we will revisit in more depth after our vacation. As of today Black Law and Legal Lies is officially on vacation! We will return in 2 weeks. This week on episode 34 of Black Law and Legal Lies we’re doing things a little different. We’re joined by author, philanthropist, community organizer, celebrity chef, motivational speaker and friend of the show, Jayda Atkinson (@JaydaEtc). Conversation with Jayda Atkison. Although we’ve known Jayda for quite some time, Dan didn’t know about Jayda. It was recently brought to his attention that Jayda was a multifaceted and accomplished creative (and kind of a big deal). Jayda has been featured on Dr. Oz, Food Network’s Chopped, Essence Magazine, and the Tom Joyner Morning Show. She is the author of ABCs: Feeding the Body and Spirit, A Guide to Fasting, and The Storm Chaser which details Jayda’s life and experiences after Hurricane Katrina. Jail, infidelity, and homelessness did not deter Jayda from finding her purpose. We learn that Jayda was offered a role on the Real Housewives of Atlanta and she details why she had to walk away from the show. She’s also been approached to participate in Wife Swap and Monster-in-Law. Her story. We sat down with Jayda to discuss her story. She takes us on a journey from her humble beginnings in New Orleans, where she learned how to hustle, to getting into the music and entertainment business, taking a cross country trip to feed the hungry, and working with some of the biggest celebrities in entertainment. Jayda landed in Atlanta where she played a pivotal role in the community because of her charitable work and service to others. An example she shares is posting public Facebook posts inviting people who didn’t have anywhere to go on Thanksgiving to her mansion to have dinner with her and her family. While continuing to service the community, she’s working on her next book and may have a podcast in the works as well. We thank Jayda for coming by to have a conversation with us, she’s truly a uniquely inspirational person. She speaks life. We talk to her about her time on the job, some of the things she witnessed in the jail, and any advice she may have for new inmates who have never been to jail before. Some of the questions we ask Michelle are: * Why did you become a CO? * What are the requirements for becoming a CO? * What was a typical shift like? * What’s one of the weirdest things you’ve seen as a CO? * What’s the most tragic thing you’ve seen in the jail? * Does rape really occur in county jail? * How and where do COs have sex with inmates? * How does most contraband get into jail? * How many inmates have you personally beaten? * Have you ever seen an inmate masturbating? * What advice would you have for new inmates who’ve never been to jail? * How do you file a complaint against a CO? Prisoner’s Rights. * Do prisons have to accommodate inmates with disabilities? * Do inmates still have their first amendment rights? * Is there any expectation of privacy in a prison/jail? * Are calls and visits with your attorney recorded and admissible in court? * Can you sue the prison for medical malpractice? * If inmates need medical attention that the infirmary can’t provide, are they afforded the right to go to a hospital or doctor of their choice? --- Support this podcast: https://anchor.fm/blacklawpodcast/support
This week on Black Law and Legal Lies, Ann, Becky and Dan break down Non-Disclosure Agreements (NDAs), celebs, and Stormy Daniels. NDAs (also known as gag orders and confidentiality agreements) are contracts that prevent one or more parties from discussing a specific subject. Celebs have long used NDAs to protect their public images and/or to prevent people from profitting off of their relationships and interactions. Some of these celebs include: Beyoncé, Justin Beiber, Drake, Chris Brown, Taylor Swift, Iggy Azalea, Charlie Sheen, and Bill Cosby. Covered this episode: 1. What are Non-disclosure agreements? 2. If so many celebs are using NDAs, why do we know about them? 3. If you sign an NDA can you discuss what the terms were? 4. If you DON’T sign an NDA can you discuss the terms presented to you? 5. What are the penalties for breaking NDA? 6. If you’re a groupie with no money or assets, what’s to stop you from breaking NDA? 7 . Is there any language that is prohibited, or that would make an NDA unenforceable? 8. What happens in the case where the person who initiated the NDA breaks it? 9. Where would every day people encounter NDAs? Stormy Daniels. Ann breaks down the details of Stormy Daniels’ NDA and how it may not be enforceable because of how sloppy (to put it nicely) it was. We also question if $130k is an acceptable amount to keep quiet about a billionaire. Revisiting Brianna Brochu. The sentence handed down to Brianna Brochu, the white student who contaminated her black college roommate’s hygiene items and belongings verifies what we’ve already known, there’s a separate judicial system for white people and people of color. Brochu avoided the hate crime designation and ended up sentenced to probation as a result of her crimes. The judge took into consideration Brochu’s age and how a criminal record would affect her future. Sadly, black and brown people are not afforded this same level of consideration. --- Support this podcast: https://anchor.fm/blacklawpodcast/support
