(The Center Square) – Illinois' gun and magazine ban will stay in effect pending the outcome in the Seventh Circuit U.S. Court of Appeals, the appeals court ruled Thursday. Illinois banned the sale and possession of more than 170 semi-automatic firearms and magazines over certain capacities in January 2023. Lawsuits in federal court followed, challenging the ban based on the Second Amendment right to keep and bear arms and other grounds. Four cases in the Southern District of Illinois were consolidated into Barnett, et al. v. Raoul, et al. After preliminary issues went all the way to the U.S. Supreme Court, Justice Clarence Thomas said the case was not ripe because it was not on final judgement. The Southern District of Illinois consequently found the law unconstitutional. Judge Stephen McGlynn issued an injunction against the law last month but put a 30 day hold on his order. That stay would have lifted Dec. 9.

Illinois Gov. J.B. Pritzker is adamant the state must appeal a federal judge's ruling that its gun and magazine ban is unconstitutional. On the House floor Tuesday, state Rep. Dan Caulkins, R-Decatur, said the state's gun ban was deemed unconstitutional by Southern District of Illinois federal Judge Stephen McGlynn. He said the Pritzker administration needs to drop the appeal. “We're going to spend a lot of time and a lot of money fighting against a law that is blatantly unconstitutional,” Caulkins said. “We've spent millions of dollars fighting against this law that you know, we know and now a judge has said is unconstitutional.”

A ruling on whether Illinois' gun and magazine ban is unconstitutional is expected to come sometime after Monday. Illinois banned the sale and possession of more than 170 semi-automatic firearms and magazines over certain capacities during lame duck session of the Illinois General Assembly in January 2023. Federal lawsuits were then filed against the law. Southern District of Illinois federal Judge Stephen McGlynn gave litigants in the consolidated case a month to file final briefs when he wrapped up the four-day bench trial last month. He closed out the trial in East St. Louis, questioning what would have been different from the 1917 race riot in that city if the Black victims were able to protect themselves with the very firearms being debated.

An appeals court on Tuesday upheld a lower court's decision to reject Attorney General Ken Paxton's latest attempt to block the State Fair of Texas from banning most people from attending while carrying guns. The 15th District Court of Appeals ruling in Austin means the fair's new policy allowing only elected, appointed, or employed peace officers to bring firearms onto the fairgrounds is still in effect starting Friday, when the annual event begins in South Dallas' Fair Park; In other news, Dallas-based Invitation Homes has agreed to pay a proposed $48 million settlement after the company was accused of “unlawful actions against customers.” That's according to a Federal Trade Commission announcement Tuesday; many Dallas council members were concerned Monday when they learned tiny homes or sanctioned parking lots — places where people experiencing homelessness can stay temporarily— could add five months to the time providers spend rehoming people; and Dallas Trinity FC new head coach Pauline MacDonald is finally with the team after having visa issues.
