What is the message of compliance inside of a corporation and how it is distributed? In a compliance program, the largest portion of your consumers/customers are your employees. Social media presents some excellent mechanisms to communicate the message of compliance going forward. Many of the applications that we use in our personal communications are free or available at very low cost. Why not take advantage of them and use those same communication tools in your internal compliance marketing efforts going forward? Louis Sapirman, Vice President and Chief Ethics & Compliance Officer for Panasonic Corporation of North America – Panasonic USA, often talks about the integration of social media into compliance. You should start with the tech-savvy nature of the today's workforce. It is not simply about having a younger workforce but a workforce whose primary tool for communication is social media. If your company is in the services business, it probably means your employee base is using technological tools to deliver business solutions. Finally, consider the data-driven nature of business today so using technological tools to deliver products and solutions is something your company most probably does now. Finally, never forget the social part of social media. Social media is a more holistic, multiple-sided communication. Not only are you setting out expectations but also these tools allow you to receive back communications from your employees. The D&B experience around the name change for its Code of Conduct is but one example. You can also see that if you have several concerns expressed it could alert you earlier to begin some detection and move towards prevention in your compliance program. Another approach is to use audio as a part of your compliance communications. Podcasts are a great way to tell a long form story about your compliance successes and challenges. Ronnie Feldman, founder of L&E Entertainment continually reminds us that the engagement of your compliance audience is through the entertainment of your compliance communications. But the key is the audio format can be a powerful tool for you and a way to reach your employee base that you are not taking advantage. They embrace the concept of “yes and”, looking to embellish what each other did and move it forward. That gives them the ability to take risks. Improv artists also practice their listening skills to make sure that they understand what each other is saying. This creates a psychologically safe environment where people can bring ideas forward without fear. Harvard Professor Amy Edmondson, argues that the best organizations do the same thing, he explains. How does an organization get to that place of psychological safety where people can feel come forward and say what's on their mind safely? Effective Compliance Program Hallmark: Training and Communication with Ronnie and Ricardo Organizations take measures to articulate their policies and guidelines realistically. Doing this ensures that they can promote their compliance and ethics programs to people with unique positions and obligations by meaningful preparation and exchanging knowledge relevant to them. However, due to their limited understanding of the hallmarks of effective compliance, specifically training and communication, plus the amount of consideration and attention they provide to it, companies sometimes fall far short of the compliance goals. While several companies and regulatory agencies assume that they treat the training and communication hallmark well, this is the area they sometimes curve out of their most vital point. The reasons why most organizations struggle to fulfill the criteria of this hallmark can be: Lack of daily scrutiny and continuing contact For the employee, not ensuring preparation and policy coordination are appropriate. Incorrect or insufficient assessment of preparation and policy efficacy Not giving regard to the risk prioritization of training. In today's Compliance Handbook chapter, we'll dive deeper into the fourth hallmark of effective compliance frameworks: training and communication. We're joined by two experts in the compliance field, Ronnie Feldman and Ricardo Pellafone. Key takeaways discussed in the chapter: While training is valuable most of the time, it's not a tool to an end in compliance. It's a tool you use to prevent misconduct, but it's not an end in itself. Find answers to questions like, "Will the compliance training benefit the regular employee, or it should be those that are in the higher ends—with the authority to either create or control risk?" Training is good, but also consider that people need reminding more than they need instruction. Simplicity and utility are the keys! Your compliance framework should not be extensive and complicated. When things are designed well and they are useful, people will use them. Have you ever been caught in a situation where you're a manager, you have to approve an invoice from a third party. What are you looking for? That is something that pretty much no one is ever trained on what to do. This is the big difference between the traditional top-down model of training versus the training model used by Ricardo Pellafone. Addressing Compliance Challenges Compliance leaders often face challenges in getting management to address compliance issues. Tom asks his guests how they would counsel a client experiencing these challenges. Nick expresses that this new age demands modern approaches: you can’t use the same approaches as 10 and 15 years ago. He suggests leading with value and reaching across departments to get the desired attention from management. The Game of Influence Gio comments that employees aren’t all reading the DOJ guidelines, nor are they all pondering how to change their organization’s compliance policies. Ronnie adds that the innovation needed to bridge this gap is influence - leaders need to understand how it impacts change within an organization. He recommends learning activities that are short, fun, and interesting. Nick says, “This is 100% a game of influence. We’re either trying to influence our peers, we’re trying to influence leadership to get more budget, and really our mandate is trying to influence the behavior within our organization.” He adds that there are two sides to influence: the objective and the human side. We need both to transform our teams and organizations. Building a Speak Up Culture Tom asks how an organization can build a ‘trust and speak up’ culture. Gio advises having a collaborative relationship with third-party vendors to be able to access information that may help to resolve employee issues. Ronnie comments that before creating any training program to tackle this or any issue, leaders should start with their objectives in mind. Think about the communication channels available and obstacles you may face, he remarks. “The goal is to influence the social environment,” he says, “and the best way to do that is to be interesting and short, and I think entertaining, because then you can put that in more places, and they're gonna like you.” Gio adds, “We as compliance leaders and ethics experts need to be the ones who lead beyond those strict requirements and say, ‘Well, this is what quality means. This is what is going to get us to engagement. This is the type of partner that's gonna help us figure out the thing that we don't know yet.’” The Importance of Active Listening Tom asks, “What skills does a compliance officer need beyond being able to read the law or to read a spreadsheet?” Ronnie stresses the importance of being an active listener. He uses an example from his time doing improv to illustrate his point. “The compliance department as a profession needs to be better at integrating and melding with other departments and also bringing those views into their organization,” Gio says. There needs to be more diversity within the organization in order for compliance to function more strategically. They’re both trying to impact the workplace in the same way, Ronnie adds. How does Speak Up compliance training fit into this new mandate? Some of the highlights include: Why is this change both significant and importantly was is the Government’s expectation? What is the difference between “shorter” and “targeted” training? The DOJ has acknowledged what most successful programs have known for a while. That shorter, more frequent training and communications are more effective. Most adult learning principles support this. Training is important, but it should be shorter, relevant and interesting. Comms is separate. It services a different purpose. To advertise where resources are. To drive traffic to those resources – teach people where to go. To remind people and reinforce resources and themes. “Enable employees to timely identify and raise issues” That is making resources accessible and easy to use Show up in more places – Apps, Newsletters, Intranet Posts, email signature, in the mouths of leadership It’s also about making people know that they are safe Targeted is focused on making training relevant. Corporate comms can go to everyone, everywhere, all the time. Training should be tactically relevant to job function. Learnings and Entertainments creates short stories about specific issues so that companies can deploy those to those specific audiences. Broadcat makes job aids which are helpful in this regard. Offerings are aligned with what the DOJ is recommending in their 2020 update. “Hey maybe a group of comedians and improvisers have something to offer.” L&E's whole business is structured around two things. In a prior podcast, we established that a Speak Up Culture requires trust and that requires changing the social environment. Some of the highlights include: How do you change your organization’s social environment to create trust? It is more than simply training. You must continually reinforce the right kind of behaviors and attitudes - over and over and over and over again. Overcoming message fatigue. If you don't want message fatigue and you don't want people to tune you out, you need to be creative and interesting and you need to change up the delivery mechanism to keep it fresh. You actually want your message to be jarring in a way. It's important to be interesting and entertaining, so you can put it in more places. Show up where people are. Integrate into other department trainings, newsletters, meetings. Use social collaboration sites. Get on the video message boards. Play commercials. This only happens if your programming is interesting. It should be Positive not Preachy. Scare tactics drive bad behavior underground. Have the message come from employees. Person-on-the-street campaigns have been successful because it comes from the people saying, this is how we feel about it. We are the kind of company that speaks up. Why is transparency so important? To build trust, you need to shed light on the process. Transparency is the key. Share what happens after people speak up and highlight confidentiality in the process. Highlight that all reports are followed up on. Tell stories about things that happened - masked to protect the innocent/guilty. This will help you build trust over time. And what about training? Training, but training for management. Create a Listen Up Culture for Management. Campaigns targeted at leadership. Give them a simple process for them to get help on what to do. Make it simple. Give them training - teach and then use improv skills to help them be more welcoming and approachable. Don't be a snitch Nothing will happen anyway Someone else will probably take care of it I don't want to get anyone in trouble I'm a no drama llama THEREFORE - you have to actually reverse this kind of thinking, which takes time. How can you establish trust? Comms are more important than training – continually promote and do so creatively so people pay attention and remember. Transparency – share what happens - in aggregate. Tell stories. Share the mechanics of the process Make personal connections – you and your team need face time Listen Up Culture – provide skills and resources for management – we do improv training to support that Can you do this in the new WFH environment? In today’s episode A Video Isn't a Video – we discuss some of the creative approaches to Ethics & Compliance training and communication videos. We break down some of the different types of videos and the benefits of each creative technique. Scenario-Based Videos, Narrative (Live Action) These are the most common and are great for showing real life situations. They can show a slice of life. However, it may be hard to represent your whole company, i.e. hard to show diversity of different environments, different people. Also, they can require context - you may well need to add the lesson. They are the most expensive and the hardest to pull off well and the hardest to successfully enact. Animation - Scenario-based The tend to be less real and unfortunately can be cheesy. However, they can be better for diversity and environment. They are usually the same per video, but you can do them one at a time. Character Monologues (falls in the "real" category They are a great way to show real people. They are also great for showing different types of personalities or different job functions. There is more telling than showing. Finally, they are less expensive and easier to produce. Talking Head Videos These are great for making a personal connection and for highlighting real people. They are best if you add some creativity usually by having an engaging host/personality. Make it a dialogue such as an interview or talk show. You have to work as this format can be boring. Involve Your Employee Videos This format is the best for going viral and for showing "who we are". At times scenes can be hard to do well and there is the risk of employee embarrassment. The best results tend to be seen when you give employees something simple to do and let them be themselves. Once again it is best if you add some an engaging host/personality to lead interviews. Finally, this format can be an efficient way to generate a lot of content. Storytelling Videos This can be a great way to share interesting, real stories. It tends to be more telling than showing. It can easily involve real people or actors and can cover more nuance to share lots of context. The bottom line is that a video isn't a video. There are different creative devices that are better for different things. Typical Ethics & Compliance training doesn't work, because it's preachy and boring. Education = training and communication and serve two different purposes. Why are we talking about this? Scare tactics drive bad behavior underground. John Cleese - humor is the easiest way to get people from the closed to the open mode. Need to get people to talk about these important issues - create a social environment where people are more likely to speak up.

Some of the highlights include: Stretching you compliance messaging by using tactics for reaching more employees. -Using internal social media sites like Chatter, Yammer, Jive, Workplace to reach employees in new ways. These are used by other departments to connect groups. Why doesn’t the compliance function use them as well? This is another channel outside of an LMS push to reach more people These channels work like social media. The key is that you need to present something interesting for people to choose to access. This week’s guest on Innovation In Compliance is Garin Bergman, founder of the Palmtree compliance app. He chats with Tom Fox and Ronnie Feldman about the app, and how it puts compliance into the hands of employees. Making Compliance Simpler and Timely Ronnie believes that the next boundary in compliance is simplicity, not complexity. Garin’s innovative solution is a simple way to get compliance to people through technology, he says. Garin explains that Palmtree is a mobile application for smartphones and tablets that allows compliance departments to put their materials into their employees’ hands wherever they are. The app can recognize employees’ location and send them communications that might be relevant to their project or that might minimize compliance risk. In addition, having the app available on their devices - an environment they’re already used to and like to use - in an engaging and easy to read format, further supports the compliance program. Key Features Palmtree has the ability to track and analyze metrics that are important to the company. Another innovative feature is the gift registry module. Garin explains that this allows individuals to submit gifts to be reviewed and approved by their supervisor. The supervisor is notified of the request and, using the information available in the app, makes an informed decision whether to allow the gift. The request is approved or declined right within the app, and the employee is notified. Additionally, robust back end analytics can provide reports on the types of gifts that have been given over the past two years. Solving A Compliance Problem Tom comments that an often overlooked reason why adoption of new technology is slow in the compliance industry is that it requires lawyers, who comprise the majority of the industry, to deviate from the static policies, procedures and delivery of training they’re accustomed to using. People also assume that having a solution like Palmtree will be very expensive, Garin says. However, the cost is quite reasonable and it can be deployed in as few as 45 to 60 days. Welcome to the Creativity in Compliance Podcast - a new offering from the Compliance Podcast Network. In this show, hosted by Ronnie Feldman and Tom Fox, we’ll explore how creativity affects the world of compliance - the ways we use it, and the surprising impacts it can have on the work we do every day. To get started, Ronnie Feldman will be sharing how he was introduced to the world of ethics and compliance. From Comedy to Compliance Ronnie started out with an MBA business background in the healthcare field in his 20's, and came across the improvisational comedy community, which he fell in love with immediately. He quit his job to pursue it as a career, and while it didn't eventually lead him to fame, fortune and Saturday Night Live, he did get a job as a producer where he learned video marketing. Video marketing turned to training videos and that was his path into the ethics and compliance community. His production experience gave him the necessary tools and confidence to launch his own company, Learnings and Entertainments, a creative services and content provider. How Creativity Enhances a Compliance Program Ronnie talks about how in his opinion, all humans are creative in their everyday non-work lives, but within a corporate environment, they all fall into the trap of constriction: following static cultures of communication, which stifles the ability to connect with other human beings. In turn, this stifles their ability to learn from us. Bringing creativity into the workplace makes it a better place, and over the course of this podcast, he and Tom Fox, who you already know as the Compliance Evangelist are going to explore the whats, whys and hows of it all. One of the hosts of this show, Ronnie Feldman is the author of an article entitled ‘Ethics and Compliance Practitioners’ Greatest Challenge: Role VS Reputation – The Great Irony.’ Tom says there are two types of reputations: personal and corporate, and he wants to know – what is Ronnie’s thought process on the topic of Creativity and Compliance? That’s what you’ll find on this episode of the Creativity and Compliance Podcast. Painting the Right ImageRonnie explains how the first time he attended an Ethics and Compliance event 10 years ago, he wasn’t sure what to expect from the professionals there. It turns out that the rather negative image he had formed about Compliance People in his mind was, delightfully, totally different than what he discovered: dedicated people that help their companies navigate through the rules. He does add that one thing that Ethics and Compliance professionals need to learn is how to change this reputation that society attributes to them! Speak-Up CultureTom brings up the KPMG cheating scandal and all the polemics around it – but what baffles him the most about this whole ordeal is that no one within the organization bothered to call the ‘hotline’ – no one reported anything. When there is a reputation failure, Ronnie says the first reaction people have is to stay away: employees know it’s wrong, but they don’t want to ‘tattletale’ or get involved in drama and so, they don’t speak up. He explains how organizations need to start acknowledging the speak-up culture, letting their employees know that it is okay to report internal problems. One way to do that is to make it known and make it clear that they value and have integrity, and that it is okay to speak up when something is wrong, that it is part of their responsibility to make the workplace a good place. What About Policies?Ronnie states policies are often written from a legal perspective – what needs to be done, rather than constructed from a user’s perspective. But what an employee really wants to know is how do these policies affect them? Thinking like a human and not a lawyer, in this situation, is a good way to better policies and include creativity. Communicating with ColleaguesRonnie talks about techniques similar to improvisational acting that professionals can use to be better communicators. If a colleague is viewed as the person who always says no, then other colleagues will not feel comfortable coming to them with their problems. Instead, they will go around them with their problems. Today on the show, we have a guest who isn’t your typical compliance professional. Ronnie Feldman is the President and Creative Director at Learnings and Entertainments… and a comedian! Ronnie and his team help clients communicate more effectively through humor and entertainment, and when it comes to a subject as serious as compliance, Ronnie shares that laughter may be the best teacher. Engaging employees with comedy Treating a serious subject seriously is a surefire way to make it boring, pedantic, and to lose your employees’ attention. You have to separate the message from the delivery mechanism. As compliance professionals, employees might dislike or be afraid of you, so there needs to be a friendly and positive way to approach these subjects. Also, a majority of employees don’t think about these issues regularly, if at all, and this is mostly because we aren't communicating effectively. A better approach is to treat the subject matter like advertisers: things like helpline jingles might be weird, but it sticks out, it’s catchy, and it helps people remember them. Compliance needs a makeover There is a need to rebrand Compliance and Ethics from the perception of it as a scary, finger-wagging police force. Even if your e-learning needs to be more serious, you can still play around with campaigns: these could be videos, posters, GIFs, memes, or any other communication channels that say: the compliance team is available for advice and support, and we are here to help. These messages should be continually reinforced all the time because you’re undoing the preconceived notion that you’re all scary people. Why it’s a good idea Ronnie makes a few arguments for the efficacy of this unorthodox approach: People are forgetful. A lot of corporate learning is lost after initial training, and people need regular reminders and reinforcement. It helps create a social environment where people police themselves because that’s the kind of company you are. It combats messaging fatigue and keeps people interested instead of tuning out.
