But what can contract theory tell us about police violence against black people in the United States? Many theories abound with respect to the relationship between the police and Black people in the United States, and most of these theories rest upon the basic assumption—undergirded by constitutional, civil rights, and human rights law—that Black people in the United States are entitled to due process and equal protection when they are in contact with the police or other law enforcement officers. This Article uses critical contract theory and the theory of Whiteness as Contract to challenge that basic assumption and instead advance the claim that the mandate that police “protect and serve” does not apply to Black people, notwithstanding the provisions of constitutional and statutory law, because Black people are the objects of racial contracting rather than participants therein. The police are charged with protecting the racial contract and serving the contract's signatories; accordingly, they enforce the contract's terms, requiring them to specifically target Black people for surveillance, harassment, deprivation, and even death, lest the contract be subject to breach or other interference.

We met with Ryan Zuidema, Chief of Police at the City of Lynchburg Police Department at the Skyline on top of The Virginian Hotel to discuss societal issues facing our region and nation and how the department partners with our community to protect our citizens, while respecting the rights and dignity of all persons. About Chief Zuidema Prior to his current position, he served in a variety of operational and administrative roles throughout the department. Ryan received his MBA from Averett University and holds a graduate level certificate in local government management from Virginia Tech. Ryan stays actively engaged with the community through serving on several boards and participating in a variety of local initiatives. February 5th, 2018 started out like any normal Monday for Deputy Scott Stone, his fellow detective, Deputy Micah Flick, and the rest of the B.A.T.T.L.E. (Beat Auto Theft Through Law Enforcement) Task Force. What followed was a shootout that left Deputy Flick and the shooter dead, Deputy Stone in critical condition, permanently paralyzed a bystander, and injured two other officers. In this episode Deputy Stone and Micah's widow, Rachael, talk about Scott's memories from the shooting, his long recovery process and why he chose to continue his career in law enforcement. On this episode, Scott Stone joins Rachael Flick on the show. Scott, entered the challenging field of law enforcement for excitement, adventure and to make a positive impact within his community. As he grew in his career, he never imagined that it would change his life forever. On February 5th, 2018, Deputy Stone was shot in the hip arresting the car thief who killed Rachael's husband, Deputy Micah Flick. Despite weeks in the hospital, a significant, permanent loss of function in his leg and ongoing physical disability, Scott returned to law enforcement. Deputy Stone continues to serve as a police officer at the sheriff's office, while navigating his path of resilience after trauma.
