This is the Trump on Trial podcast and this is your update for 10-16-2023.Good morning, listeners. Here's the latest on the legal proceedings surrounding former and disgraced President Donald Trump from across the country:In Georgia, on October 12th, a Fulton County judge has ruled against Trump's bid to move his election interference case to a federal jurisdiction. The trial has been marked for March 6, 2024. The following day, Trump's legal team introduced a motion to dismiss, asserting that the grand jury was improperly formed. The court has yet to issue a decision on this motion. Meanwhile, the state's special prosecutor, Fani Willis, disclosed on October 14th her intentions to probe Trump on potential racketeering charges.Switching to New York, a judge, on the 12th, declared that Trump is required to give testimony in a civil lawsuit initiated by Summer Zervos, a past participant of 'The Apprentice'. Zervos alleges that Trump acted inappropriately towards her. Trump's counsel, on October 13th, moved to delay the Zervos case until the conclusion of his ongoing criminal trials. The decision on this request remains pending. In another update, on October 14th, Attorney General Letitia James unveiled a $250 million civil lawsuit against both Trump and the Trump Organization, accusing them of business misconduct. Finally, in Washington, D.C., the special counsel delving into the January 6th Capitol incident, Jack Smith, on October 12th, served Trump with a grand jury subpoena. Trump's lawyers quickly reacted the next day, suggesting that Trump, as a former president, should be exempt from such legal proceedings. The court's decision on this matter is still in the offing. Smith, on October 14th, declared an expansion in the breadth of his inquiry, now covering Trump's activities leading up to and during the January 6th event.Stay tuned for more updates as these stories develop.

Trump Legal Troubles Update: Top Stories and Major Headlines from the Past 7 DaysOctober 5, 2023Trump's Mar-a-Lago Classified Documents CaseTrump is facing criminal charges for allegedly mishandling classified documents after leaving office. He is accused of taking thousands of sensitive papers with him to his Mar-a-Lago estate in Florida, where they were stored in a haphazard manner. Trump has pleaded not guilty to the charges, and his trial is scheduled to begin in May 2024.In the past 7 days, there have been several notable developments in the case. On October 3, the Justice Department released a batch of documents related to its investigation, including a memo from Trump's former chief of staff, Mark Meadows, in which Meadows warned Trump that he could be charged with a crime if he did not return the classified documents. The documents also showed that Trump resisted efforts by his own aides to retrieve the documents, and that he continued to claim that he had declassified them, even though there is no evidence to support this claim. On October 4, Trump's lawyers filed a motion to dismiss the charges, arguing that the Justice Department is targeting Trump for political reasons. The motion is unlikely to succeed, but it could delay the trial.Trump's New York Civil Fraud TrialTrump is also facing a civil fraud lawsuit brought by the New York Attorney General's Office. The lawsuit alleges that Trump and his company inflated the value of their assets in order to obtain loans and insurance policies on favorable terms. Trump has denied the allegations, and the trial is scheduled to begin in January 2024.In the past 7 days, there have been no major developments in the civil fraud case. However, it is worth noting that the case is being presided over by Judge Arthur Engoron, who has already issued several rulings against Trump. This suggests that the case could pose a serious threat to Trump and his business empire.Trump's Other Legal TroublesIn addition to the Mar-a-Lago classified documents case and the New York civil fraud trial, Trump is facing a number of other legal challenges. These include:A criminal investigation in Georgia into Trump's efforts to overturn the results of the 2020 election. A civil defamation lawsuit filed by Summer Zervos, who alleges that Trump sexually assaulted her. A civil defamation lawsuit filed by E. Jean Carroll, who alleges that Trump raped her in the 1990s.It is important to note that Trump has denied all of these allegations. However, the fact that he is facing so many legal challenges on multiple fronts is a sign that he is in serious legal trouble and will likely be found guilty of many serious crimes.Trump's legal troubles are mounting, and he is facing the possibility of serious consequences, both criminal and civil. they pose a significant threat to Trump's personal and political future.Thank you listenand please be sure to subscribe to never miss an update.

Former President Trump has sued the National Archives and the chairman of the January 6 investigating committee, Congressman Bennie Thompson, to try to prevent the disclosure of White House papers, records and communications up to and during the riot. He's asserting executive privilege. What does that mean again? Where does the idea of executive privilege come from, and how are the interests weighed in a situation like this? And then...does a former president have a strong executive privilege claim? That's a not-very-well-explored question. Trump is also instructing former advisers, including Steve Bannon, not to comply with subpoenas from the committee. Bannon hasn't been complying and so the committee voted to make a criminal referral to the Justice Department for contempt of Congress. Does that mean the Sergeant at Arms has a job to do? (Not just yet.) Plus: President Trump is deposed for more than four hours, New York's new anti-SLAPP law and the Summer Zervos lawsuit, Lev Parnas's ongoing trial, and Congressman Fortenberry is indicted.

According to a Wednesday report from Consortium News, "defense witness Prof. Paul Rogers, political scientist at Bradford University, established that Assange is motivated by a political viewpoint that places him as a political opponent of his accusers. On cross examination, the prosecutor, James Lewis QC, hammered Rogers to try to get him to admit he has no basis to testify that the prosecution of Julian Assange is politically motivated. Lewis tried to destroy the witness' credibility as an expert by saying he did not include a statement by the US prosecutor saying that the charges against Assange are motivated by criminal justice, and not politics." What is going on here?"Coronavirus deaths in the United States topped 190,000 Wednesday along with a spike in new cases in the US Midwest with states like Iowa and South Dakota emerging as the new hotspots in the past few weeks," Reuters reported Wednesday. What are the ramifications?"The writer E. Jean Carroll, who has accused Donald J. Trump of raping her in the 1990s and is suing him for defamation, asked on Thursday that he provide a DNA sample to determine whether his genetic material is on a dress she says she had on at the time of the incident," the New York Times reported in January. In August, the Washington Post reported, "Verna L. Saunders, a New York Supreme Court Justice, wrote that the lawsuit filed by journalist E. Jean Carroll could move forward and need not wait for an appeals court decision in a similar suit brought by former 'Apprentice' contestant Summer Zervos, who also alleges Trump sexually assaulted her." Finally, the Post reported on Tuesday, "The Justice Department on Tuesday intervened in the defamation lawsuit" brought by Carroll, "moving the matter to federal court and signaling it wants to make the US government — rather than Trump himself — the defendant in the case." How does this happen? "Upon returning from summer recess on Tuesday, Senate Republicans introduced a 78-page piece of legislation that party leaders have called a 'skinny' coronavirus relief plan," Common Dreams reported Tuesday. Is it skinny or emaciated? "German Chancellor Angela Merkel and her economy minister on Tuesday played down the possibility of halting the Nord Stream 2 gas pipeline from Russia to Germany as part of any sanctions imposed on Moscow due to the poisoning of Kremlin critic Alexei Navalny," Reuters reported Tuesday. Are there some very fine lines being walked here? "Analysts with TankerTrackers.com have tentatively identified a new round of Iranian gasoline shipments to Venezuela," the Maritime Executive reported Monday. "According to the firm, the product tankers Forest, Faxon and Fortune appear to have taken on about 825,000 barrels of gasoline at Port Shahid Rajaee, then turned off their AIS transponders. None have broadcast an AIS position since the end of August, according to consultancy Dryad Global." Are Iran and Venezuela thumbing their noses at US sanctions?"Shares of Semiconductor Manufacturing International Corp (SMIC), China's biggest contract chipmaker, plunged over 23% on Monday, after the US government said it was considering putting export restrictions on the company," CNBC reported Monday."Over 100 organizations that work on issues related to Latin America and the Caribbean sent a letter calling for the next administration to adopt a new Good Neighbor Policy toward the region based on non-intervention, cooperation and mutual respect," MintPress News reported Tuesday. Today's episode is inspired by the 56th anniversary of Gideon v. Wainwright, one of the most famous and celebrated landmark Supreme Court cases that guarantees indigent defendants the right to a court-appointed lawyer.  Is it under attack from our right-wing Supreme Court?  (You bet it is.) We begin with a quick update on the recent district court opinion in California v. Ross and what that means for the 2020 Census. Then, it's time for an Andrew Was Right segment a update on the New York appellate court's ruling in the Summer Zervos lawsuit.  As it turns out, Donald Trump does have to respond to Summer Zervos's lawsuit -- just like Bill Clinton had to respond to Paula Jones's. Then it's time for a terrifying deep dive into Clarence Thomas's dissent in the Supreme Court's recent decision in Garza v. Idaho.  What's the case about, and why is Thomas using it as a vehicle to try and overturn one of the most basic and fundamental rights criminal defendants enjoy today?  Listen and (sadly) find out. After all that, it's time for a fun listener question about footballer Wayne Rooney and public obscenity laws. Then, it's time for the answer to Thomas Takes The Bar Exam #118.  Did Thomas get a dreaded real property question correct??  Listen and find out!  And, as always, remember to follow our Twitter feed (@Openargs) and like our Facebook Page so that you too can play along with #TTTBE! After that, we revisit our discussion from Episodes 146 and 148 regarding the Pennsylvania Supreme Court's opinion redrawing congressional maps in that state.  The U.S. Supreme Court -- and yes, that's the Brett Kavanaugh-and-Neil-Gorsuch-laden Supreme Court! -- just declined to intervene to protect the Republicans.  Why is that, and how is that a map forward?  We tell all! Of course he was told in big bold letters “DO NOT CONGRATULATE” as otherwise Donald might have a hard time reading such big words. Needless to say, Donald ignored this advice, which let’s not forget leaked out immediately from Donald Trump’s own White House. Max starts off by giving his take on the recent Austin bombings and the effect on the city of Austin where he lives. Next Max gets into Donald's recent telephone call with Russia's Putin to congratulate him on his recent electoral win as after all, it was a free and fair election. Of course he was told in big bold letters “DO NOT CONGRATULATE” as otherwise Donald might have a hard time reading such big words. Needless to say, Donald ignored this advice, which let's not forget leaked out immediately from Donald Trump's own White House. Then Max gets into Trump's choice of lawyers, they may not be lawyerly but they play one on TV. Sure seems to Max that Trump has found a class A legal team and is bound to have Mueller quaking in his boots. Plus now it seems like two more women are suing the Donster, one for defamation, which is the case that could really cause Donald a lot a problems. Attorney Gloria Allred was fighting for women long before anyone ever hashtagged Me Too or Time's Up, and she's the subject of a new Netflix documentary Seeing Allred.  She reveals how her own personal experience inspired to fight for victims assault, harassment, and discrimination.  She addresses critics who say she just does it all for the publicity, and explains that for many of her clients such as the Cosby accusers, a "trial" in the court of public opinion may be the only justice they can get.  She talks about how that's changing with a new California law that extends the statute of limitations for sexual assault, she discusses why she decided to represent the family of Nicole Brown Simpson during the O.J. trial, and she gives an update on her client Summer Zervos’s pending defamation suit against President Donald Trump.  Plus she talks about her surprisingly cordial relationship with defense attorney Alan Dershowitz, the battle of the Friar’s Club steam room, and why so many people call her "Senator." On this week’s episode of Versus Trump, Charlie, Jason, and Easha talk about a defamation lawsuit brought by Summer Zervos, a woman who alleges that she was sexually assaulted by President Trump in a hotel room in 2007. Charlie, Easha, and Jason begin by discussing the facts in the lawsuit and then [at 5:00] quickly move to the first reason that President Trump has asked the court in New York to dismiss the case: the sitting President cannot be sued in state court. That leads to some deep cuts about the relationship between federal and state power [at 13:00] and then a wonky discussion [at 26:30] of how California's so-called Anti-SLAPP statute works and why Zervos may have been trying to avoid it. They then turn [at 32:30] to the President's second argument, which is that the statements calling Zervos a liar were protected by the First Amendment because they were made in the context of a political campaign. No Trump Nuggets this week, but stay tuned for the big end-of-year recap, coming soon! Please share or provide feedback, and rate us in iTunes.
