Over the weekend, the news broke that President Donald Trump is accepting a luxury jet from the country of Qatar for presidential travel. This extraordinarily brazen act may well violate the Emoluments Clause, which bars foreign gifts to officials unless expressly authorized by Congress. It comes even as Trump is embarking on a Mideast trip to countries that are the sites of Trump-branded projects, and Trump-aligned businesses are scooping in huge sums from foreign governments via crypto. We talked about all this with Representative Jamie Raskin, the ranking Democrat on the House Judiciary Committee. He explains why Trump's latest move outrageously abuses the Constitution, how his corruption has grown to “epic” and unprecedented proportions, and what Democrats will do now in response. From February 11, 2017: Donald Trump's election as president brought a surge of interest in the previously obscure Emoluments Clause, which prohibits any “Person holding any Office of Profit or Trust under [the United States]” from accepting “any present, Emolument, Office, or Title, of any kind whatever, from any King, Prince, or foreign State.” Norm Eisen and Richard Painter, ethics experts for Presidents Barack Obama and George W. Bush, have been leading the charge to hold Trump accountable under the Emoluments Clause for his failure to divest of his businesses. Recently, they filed suit against him in their capacity as chair and vice-chair of the good government group Citizens for Responsibility and Ethics in Washington. Benjamin Wittes chats with Norm about the Emoluments Clause, the lawsuit, and what all this has to do with national security. To receive ad-free podcasts, become a Lawfare Material Supporter at www.patreon.com/lawfare. A sort of list of Trump Atrocities. With wine. And anger.
38 Trademarks applied for by Donald Trump were approved by China, after he was elected President. Spring Chang was Trump's Beijing-based lawyer for the transactions. Emoluments Clause in the Constitution, just in case you can't quite recall it word for word: From Article I, Section 9: No Title of Nobility shall be granted by the United States: And no Person holding any Office of Profit or Trust under them, shall, without the Consent of the Congress, accept of any present, Emolument, Office, or Title, of any kind whatever, from any KIng, Prince, or foreign state. I don't know where a Queen or Princess would fit in. Don't worry: they'd be representative(s) of a foreign state.
In the section of Deuteronomy customarily called "Shoftim" (which means both "Judges" and "Leaders"), we find the famous command that "Justice, Justice You Shall Pursue" but strangely without reference to the pursuit of social justice, community organizing, or even the personal awareness of victims. Instead it might mean that people in that position begin the process by focusing on the emoluments clause and their oath of office. What if our personal Torah, our personal scroll we carry around with us and occupy our minds with every day, was not the entire Torah but just our oath of office? What would this tell us about the Torah's message to healing ourselves and our society?

In a time of an international health and economic crises, it’s good to have a POTUS who can be trusted by the world community. Instead, we have a grifter with an entire family of money-grubbing, lying grifters.
Just this week, a unanimous D.C. Circuit Court of Appeals threw out a lawsuit filed by over 200 members of Congress alleging Donald Trump is in violation of the Emoluments Clause of the Constitution. The court held the members of Congress did not have standing to bring the lawsuit. So this week, we discuss the Emoluments Clause itself and the concept of judicial “standing.” What does they mean? Check out this week’s edition of The Law for the answer. The post The Law episode 69: Blumenthal v. Trump appeared first on Speakeasy Ideas.
July 25th our president extorted the new President of the Ukraine using our US assets as a bargaining chip for his own personal gain. And here we are.

This world is absent of common sense in 2019. Gary Weed and Travis Corley of Agitate the Airwaves join Mark to discuss these moments of lapse in common sense across our great nation. First up, Mark talks to Travis about being a promoter and how good he is at what he does on a weekly basis. This quickly switches to Marks new section of the show called "What dumb thing has Trump done this week!" Donald Trump decided to take the Emoluments Clause of the US Constitution and explain that it is PHONY and FAKE. Which is weird since the clause was put into the document by Republican President James Madison. So even Trump doesn't like republican rules in the constitution. Trump also made a comment about Colorado getting a "Big Beautiful New Wall" to protect it's borders. Trump is so out of it that he doesn't realize that Colorado is not a border state. Mark explains that this is just gonna get worse...and Mark's pre-election claim of early onset Dementia is becoming a little more accurate as we get deeper into this presidency. Finally the guys discuss a little Halloween stuff and talk about their favorite horror movies from the past 5 years. Find out who they recommend you watch to scare yourself!

This week on The Breach, we take a closer look at those 49 words that mean so much: the Foreign Emoluments Clause of the United States Constitution. Law professor Zephyr Teachout joins host Lindsay Beyerstein for an in-depth discussion of one of our founding document's most critical anti-corruption clauses. Teachout and her legal colleagues at Citizens for Responsibility and Ethics in Washington (CREW) have launched a groundbreaking lawsuit against Trump to stop him from taking cash from foreign governments through his empire of hotels and rental properties. The Emoluments Clause has never been tested in court. A loss for Trump will make legal history and could set the stage for divestment, resignation, or even impeachment.
Matt Taibbi says “Trump made idiots of us all.” He covered the campaign for Rolling Stone—and his new book is "Insane Clown President." Also: suing the president: it's not easy. But Erwin Chemerinsky has found a way to do it--under the Emoluments Clause of the Constitution. Erwin is Dean of the law school at UC Irvine.
