This Day in Legal History: Articles of Confederation AdoptedOn November 15, 1777, the Continental Congress formally adopted the Articles of Confederation, establishing the first constitutional framework for the United States. Crafted during the Revolutionary War, the Articles aimed to unify the thirteen colonies under a single government while preserving their independence and sovereignty. This early governing document reflected deep fears of centralized authority, granting Congress limited powers such as conducting foreign diplomacy, declaring war, and managing relations with Native American tribes. However, it lacked crucial mechanisms for enforcement, taxation, and regulating interstate commerce. Under the Articles, each state retained significant autonomy, with Congress functioning as a weak central body unable to compel states to contribute financially or militarily. Unanimous consent from all states was required to amend the Articles, which proved a significant obstacle to addressing its shortcomings. These limitations became increasingly evident in the post-war period, as the fledgling nation struggled with economic disarray, unpaid war debts, and internal unrest such as Shays' Rebellion.The Articles served as a critical stepping stone in American constitutional development, highlighting the need for a more robust federal system. In 1787, the Constitutional Convention convened to replace the Articles, ultimately resulting in the U.S. Constitution, which created a stronger, more balanced federal government. Despite its shortcomings, the Articles of Confederation represented a bold experiment in democratic governance and the principle of federalism that continues to shape the nation's identity.Continuing the procession of unqualified and ill-equipped appointees, President-elect Donald Trump has nominated members of his criminal defense team for key positions in the Justice Department, including Todd Blanche as deputy attorney general. Blanche, a former Cadwalader attorney, is currently defending Trump in federal cases related to attempts to overturn the 2020 election and the mishandling of classified documents. Prior to representing Trump, Blanche was best known for defending Paul Manafort, Trump's former campaign chairman, who was convicted of tax and bank fraud in connection with consulting work for pro-Russian Ukrainian politicians. In addition to this settlement, the city plans to allocate $21 million toward housing and small business initiatives aimed at supporting the affected residents and their descendants. The Section 14 neighborhood also housed Latino families and other immigrants, many of whom have long sought recognition and compensation for their forced displacement. The settlement will provide payments to over 1,200 former residents and descendants, amounting to approximately $4,000 per person after legal fees. As part of the agreement, recipients must sign waivers releasing further claims against the city.Palm Springs Mayor Jeffrey Bernstein acknowledged the limits of financial restitution, describing the reparations as a symbolic step toward addressing past injustices. B.W. argued that from grades 8 through 10, he faced harassment, including being called "Whitey" by a teacher, having a meme made of him as a Ku Klux Klansman, and being ostracized for his political and religious beliefs. He claimed the school district violated Title VI of the Civil Rights Act of 1964, which prohibits racial discrimination in federally funded education programs.A prior panel had ruled that B.W.'s allegations were primarily tied to his ideological beliefs, which Title VI does not cover, and the evenly split rehearing reaffirmed this. President-elect Donald Trump's plan to eliminate the $7,500 EV tax credit threatens significant setbacks for the U.S. automotive industry, innovation, and environmental goals. The credit has played a vital role in making EVs affordable and driving their adoption, helping U.S. automakers remain competitive in a global market heavily supported by subsidies in countries like China and the EU. Without it, American automakers could struggle to compete against lower-cost foreign EVs while managing the high expenses of research and development.The policy could exacerbate issues already created by recent changes to R&D tax rules, which have limited immediate expensing for innovation costs. Combined, these moves could raise EV prices, reduce demand, and stifle the momentum of U.S. automakers like Ford and GM as they work to electrify their fleets. Most people think of Bill Barr's interference in the Mueller Report in a very limited sense – a letter to Congress and a press conference. But it was far deeper and more deliberate than that. Bill Barr turned out to be the ideal consumer for the spin Paul Manafort, Devin Nunes, and Fox News spewed to cloak Donald Trump's vast connections to Russia. Armed with a passion for covering up Republican high crimes, an authoritarian worldview, and a view of executive power that resembles monarchy, Barr “reluctantly” returned to government with two goals. He wanted to kill the Mueller investigation. He then launched a counter-investigation that he hoped would reverse the special counsel's extensive record of convictions. Those plans, which he withheld from Congress during his confirmation hearings, were exacerbated by Rudy Guliani. The president's lawyer led the effort to transform the backlash to the Russia investigation into a “harebrained” counter-scandal of his own, based on Russian disinformation and Donald Trump's opportunistic persecution fantasies. Gaslit Nation is vindicated yet again. Today, The New York Times reports on Bob Woodward's latest book War, which confirms what we've been warning about since day one: Russia is infiltrating the U.S. through Trump's MAGA fascist cult. The same tactics of weaponized corruption that Paul Manafort, Trump's longtime friend and neighbor in Trump Tower, used to bring “Ukraine's Trump” Viktor Yanukovych to power are being deployed here. Ukraine has long been a testing ground for Russian aggression, and what happens there is a precursor for what Russia will try in other nations, including the U.S. This is why Ukraine's success is our own. Days before the 2016 election, Rudy Giuliani went on Fox News promising a "big surprise," emphasizing his point with a Crypt Keeper cackle. "We've got a couple of things up our sleeves that should turn this around." The vast majority of the polls had Hillary Clinton comfortably winning. Paul Manafort, the Kremlin's longtime operative in Ukraine and Trump's longtime friend and neighbor, had laid low in recent weeks following a bombshell report out of Ukraine that he took millions of dollars in off-the-books payments from Ukrainian kleptocrat and wannabe strongman Viktor Yanukovych. However, Manafort broke his silence days before the election and wrote on Twitter: "Battleground states moving to Trump en masse. Media not liking the pattern. By Sunday, Trump will be over 270 in polls." But the polls said no such thing. Why were Giuliani and Manafort suddenly so confident Trump would pull off an upset? Convicted felon Trump must go to prison for the safety of every American, the world, and our future. Sending Trump to prison would send a strong message to Putin: no one is above the law. And it will remind Putin that The Hague is waiting for him. Several recent polls show a majority of Americans, including Independents, want convicted felon Trump to drop out of the race. Yet here we are, with Trump still running and Biden's approval ratings scraping the bottom of the historical barrel. Why? Merrick Garland, Biden's Attorney General, is the worst possible choice for this critical moment in American history. We all saw Trump and his family try to overthrow our democracy, tailgating before their violent attempted coup and setting up a war room just steps from the White House at the Willard Hotel. Yet, they're still free, enriching themselves, and gearing up to finish the coup they started with Kremlin support back in 2016. None of this is normal. The cynicism is palpable. Americans expect Trump to walk free, maybe get probation, and continue his campaign for president. This absurdity erodes our faith in already crumbling institutions. The bottom line? A Russian asset should never have come near the White House in 2016. Trump's presidency is a catastrophic failure of the FBI, CIA, Obama's foreign policy team, and Republican leaders who shielded him during two impeachment trials. The establishment wants us to forget this because many now profit from book deals and TV appearances, even though they're part of the problem. And now, to some good news! Congratulations to Mexico for electing your first female and Jewish president, Claudia Sheinbaum. This gives hope that another world is possible, one built on accountability and justice. House Speaker Mike Johnson, self-proclaimed champion for human rights and freedom, and enemy of dictators everywhere, inched closer to getting Ukraine aid after eight months of successfully delaying it, empowering Russia's genocide. Kremlin state TV repeatedly praised Johnson for assisting their brutal invasion, which, as discussed in this week's bonus show, emboldened Iran to unleash a shocking swarm of drones and missiles against Israel. The Ukraine aid package still faces delays, thanks to MAGA, and will have to go back to the Senate before it reaches President Biden's desk. The Trump-proposed changes, of structuring some of the aid as a loan, can be forgiven by the President, including partial loan forgiveness by Biden on his way out, should he lose the election. If Trump wins, he could force Ukraine to repay what's left of the loan and refuse to send ATACMS, the long-range missiles that have made Ukraine effective at blowing up Russian planes and other military targets that slaugher civilians. The compromise in this aid package, far less than what Ukraine actually needs to win the war, adds to the urgency to ensure Trump loses the electoral college. Today history repeats, with Tucker Carlson releasing a two-hour rant by Putin, presenting what Kellyanne Conway once lovingly referred to as “alternative facts.” Gaslit Nation has the fact-check for you here, and explains why Tucker Carlson, in his traitors paradise in Moscow, visiting Tara Reade, should be investigated for being an unregistered foreign agent. The Dominion lawsuit against Fox News essentially established that Tucker Carlson is not a journalist, and therefore must be investigated for furthering the Kremlin's agenda. Like longtime Kremlin operative Paul Manafort who he tried to rehabilitate on his Fox News show, Tucker Carlson reeks of FARA (Foreign Agents Registration Act). According to Anton Gerashchenko, a former member of Ukraine's parliament who has served in various government roles, Russian telegram channels expressed frustration in the Kremlin over Putin and Tucker's love-in. (Putin sounded like one of those rambling email forwards about Barack HUSSEIN Obama, but the anti-Ukrainian version.) Those reports mention that Tucker was paid a fee. If that's the case, then he needs to report that and any other perks he received from a foreign adversary. If he doesn't disclose if and what he was paid for his Kremlin interview, he should face a FARA investigation by the DOJ (Wake up, Merrick Garland!), and an investigation by Democrats in the Senate. On Wednesday's Mark Levin Show, Chris Christie finally suspended his Presidential campaign. Christie is an angry, ruling-class establishment Republican from the Bush administration, and is doing what establishment Republicans always do – sabotage their opponents. The same was done in 1980 with Ronald Reagan, who won a landslide victory even with a third-party candidate. We cannot let people like Christie and John Sununu destroy real conservatives like Donald Trump or Ron DeSantis while pushing the establishment candidate, Nikki Haley. Also, Congress voted to hold Hunter Biden in contempt of court, but unlike Trump allies like Paul Manafort and Peter Navarro, Hunter has not been charged with anything yet. If the DOJ does not charge Hunter Biden, then there will need to be an equal protection case, because he is getting special treatment as Joe Biden's son and knows that if anything happens, Joe will pardon Hunter. Joe Biden is the John Gotti president and has been corrupt his entire life, but AG Merrick Garland will never investigate the Biden Crime Family. The Democrat party is the insurrectionist party and has destroyed our sovereignty and our Constitution, and we are the ones trying to fix it.
