Zach Enlow on the Landlord and Tenant Act Ruling on Repairs. Zach recently in a case where he represented the landlord against the tenants with a big family. A residential property normally has a big value in rentals. It started because the tenants didn't want to pay for the damages the landlord had claimed when they vacated. On the other hand the tenants argued that based on the statsheet the landlord can't go to the court based on the Landlord Tenant Act Sec. 132. Zach argued that the statsheet shout not be interpreted in short if you damage the property you need to pay for it. Darryl added an example that if you get insurance and your house was hit by a storm and had damage the insurance company will be liable for the fixing of that and not you. Same with vehicles if the car got damaged by accident the insurance company will be paying for that and many people didn't pay to fix it the company does, Zach added. So the cycle will go like this if there's damage and tenants always decline to fix the damages after they use the property the value of the home will get a lower quality. When you have a low quality home it would end up a bad property and a bad neighborhood that might cause the area to get slummy. This issue is created by the court and not by individuals. For example, a Landlord can't fix the damage to his house because he has a problem, the court won't charge the tenant since it is “stated” in the law. He argued to the court because it says that he can just ask the tenant if he already fixed it according to that law. He suggested that the landlords call legislation to revise the bill or submit a bill for the damage. There are two different species of white tailed spiders in NZ, both ex-Australian that were probably introduced with household goods a long time ago (think 1800-s!)Recent taxonomic investigations showed there are 61 species of white-tails in Australia, but just two of these have made it to New Zealand.They are nocturnal hunters that love to live on the outside of our houses. Their favourite prey is grey house spider; yep, the one that makes those messy cobwebs on weather boards and in the corner of windows – and yes, also the one that lives in your car’s side mirrors!Warm summers where people sleep with windows open make for an easy entry for the spiders.When disturbed, they tend to run quickly and hide in all sorts of nooks and crannies. They may even find their way under the sheets as wellWhite tails can and will bite when trapped or provoked, but, the media reports of serious repercussions, including necrotising fasciatus or necrotising arachnidism (where the flesh starts to die as a result of an infection in the bite) are simply unsubstantiated.So far, there is no white tail bite recorded where the biting spider was identified by an entomologist, and the patient was observed by medical experts, linking the whole cause and effect up in truly proper scientific manner.The spider bites that have been followed up resulted in nothing more than a pair of red fang marks and a wee bit of short-lived pain.Ironically, I often take a vagrant spider with me to show kids at schools, and those spiders are certainly capable of painful bites, followed by necrotising arachnidism!If you handle them correctly, though, you’ll find they are not aggressive at all and will happily walk all over you.
