Justice issues in Canada: The Supreme Court of Canada has refused to hear the appeal from Calgary mass killer Matthew de Grood who killed five fellow U of Calgary students at a 2014 house party. De Grood declared NCR (not criminally responsible) because of mental health issues. - As well the scheduled for this Tuesday hearing for another NCR killer, Allan Schoeborn, found delusional after having stabbed and smothered his 10 year old daughter and 8 and 5 year old sons to death has been postponed to possibly April or May. Schoenborn was already in 2022 granted 28 day unescorted leave from the Forensic Psychiatric Hospital in Coquitlam, B.C. even though he was assessed as continuing "to constitute a significant threat to the safety of he public." In 2016 de Grood was found NCR (Not Criminally Responsible) and found to be living with undiagnosed schizophrenia. He has since been living at the Edmonton Alberta Hospital and receiving psychiatric treatment, while appearing annually before the Alberta review board to have his case and detention assessed. In September of last year the board determined de Grood posed a "significant risk" to the public and would not be granted an absolute discharge. de Grood is now seeking to have the Supreme Court of Canada hear and consider his case and grant more freedoms. Courts in dissaray in Ontario at this time because of staffing issues and health concerns within courtrooms (mold). Hundreds of criminal cases (and maybe more) may be thrown out because of not meeting required timelines from charges being laid to a trial concluded, per the Supreme Court Jordan decision of 2016. Might killers walk?Not the first time. In 2017 a report by the Senate standing committee on legal and constitutional affairs, revealed tens of thousands of criminal cases may have to be thrown out for the same reason. And then there's the issue of NCR. Not Criminally Responsible. NCR has been a national headlines creating reality and is again in British Columbia with premier David Eby "whitel hot" angry over the release of an NCR psychiatric patient, Blair Evan Donnelly, who stabbed his teenage daughter to death and last weekend stabbed three people at the Light Up Chinatown festival in Vancouver. Also making news this week, Matthew de Grood of Calgary who stabbed 5 university students to death at a Calgary house party in 2014. de Grood was found to be NCR 2 years later because of undiagnosed schizophrenia and was sent to the Alberta Hospital in Edmonton where he receives ongoing psychiatric treatment. Last year the Alberta Review Board assessed de Grood as a continuing significant threat to the public and not entitiled to an absolute discharge. Now de Grood is appealing to the Supreme Court of Canada in order to gain a conditional discharge with additional freedoms. Guest: Scott Newark. On this episode of the Global News podcastCrime Beat, crime reporter Nancy Hixt brings us to Part 3 of her special series, the Brentwood five massacre. This episode takes an in-depth look at what it means to be found not criminally responsible (NCR) in Canada. Carol de Delley understands the anguish of what NCR can mean for the family of a victim, as few others can. She lost her son, Timothy McLean, in one of the most high profile cases in Canadian history where the killer was found NCR. In 2008, McLean was brutally attacked by a stranger—a man who sat next to him as they rode a Greyhound bus. McLean was stabbed more than 100 times. He was mutilated and cannibalized. Vince Li was charged with second-degree murder Less than a year later, he was found not criminally responsible for his actions. Just eight years after that, Vince Li (who changed his name to Will Baker) was granted an absolute discharge. That ruling gave him complete freedom. He never has to receive treatment or take medication again—if he chooses not to. The families of the Brentwood five are concerned the same thing that happened to McLean’s killer will happen to the man who killed their five children in the Spring of 2014. Matthew de Grood was originally charged with five counts of first-degree murder but was later deemed to be NCR for the stabbing deaths of Lawrence Hong, Kaiti Perras, Jordan Segura, Josh Hunter and Zackariah Rathwell. The judge ruled de Grood was suffering from a mental disorder that rendered him incapable of knowing that his actions were wrong when committed the worst mass killing in Calgary’s history. The finding meant de Grood would not go to prison and he would not have a criminal record. He was no longer a part of the Canadian criminal justice system. Instead, he was moved to the healthcare system. De Grood’s case is assessed on a yearly basis by the Alberta Review Board (ARB) and each year the board has three options: to continue his treatment in a secure facility, to grant him a conditional discharge or to grant him an absolute discharge. In the conclusion of “the Brentwood five massacre” you’ll hear from the families of these five victims, and from Timothy McLean’s mother. They are working together to lobby for a change in Canadian legislation so killers deemed to be NCR would be mandated to continue their treatment and monitoring indefinitely.
