It's the case that has shocked France and led to protests outside of an Avignon court house. For 50 years, Dominique and Gisèle Pélicot were married, but for a decade of their marriage, Gisèle was being raped without her knowledge — drugged and sexually assaulted by dozens and dozens of men. Victim advocates are questioning the process that allowed a convicted sex offender to gain a position on the High Court. In 2018, Adrian Dermer was jailed after he admitted to a sexual connection and violent charges with a 14-year-old when he was two months shy of 17. Dermer has now been admitted as a barrister and solicitor of the High Court. Criminal lawyer Steve Cullen says the Law Society has a comprehensive process when it comes to issuing the necessary certificate of character to practise law. "That committee would call for a variety of reports, the onus would be on the applicant to satisfy the committee that the were fit and proper - I would think any committee member would have to have regards to the totality of the circumstances." A long-running case that's ended with a Christchurch man convicted of murdering his childhood friend is being described as unique by a criminal lawyer. It was the second trial faced by former prison guard David Benbow over the disappearance of Michael McGrath in 2017. It followed an eight-week trial in the High Court in Christchurch. The verdict follows six years of investigation and two trials, one ending in a hung jury. Criminal lawyer Steve Cullen told Mike Hosking that this case has been on solely circumstantial evidence. But he says this can happen, and with such a small population in New Zealand, it can be easier to whittle suspects down. LISTEN ABOVE See omnystudio.com/listener for privacy information.

There's pushback on a suggestion that MPs should be able to criticise judges. In his valedictory speech yesterday, sacked Labour MP Stuart Nash claimed judges need to be held accountable and should face criticism from MPs if their decisions are far from public expectations. Criminal lawyer Steve Cullen is calling that gutless dribble. He told Heather du Plessis-Allan that it's laughable to claim judges aren't held accountable, and that's what appeals are for. Three people, including a 16 and 12-year-old have been charged in a series of robberies of sports trading cards in the GTA, with a gun involved. When police arrested two of the suspects, they found a loaded firearm. Charges have been laid against the youths and the adult who was in violation of bail conditions. The question we're asking though is one we first posed approx. 30 years ago to massive response. A 12-year-old at the time was involved in convenience store robberies and flashed a handgun in the process. The question was and is again: should a police officer encounter a 12-year-old child brandishing a very real, or real-looking handgun and that child points the real or real-looking gun at the police officer, what must the police officer do in order to protect anyone in the immediate vicinity and the officer's own life? Last week, Toronto Police seized a large amount of guns, most of them traced back to America, and destined for Toronto's streets. Toronto Police Chief, Jon Ramer, said that this is disturbing and that these guns are killing our kids. One man was arrested during this gun bust and has been charged with gun smuggling, but coincidentally, the same man shot and killed one of his friends. But he only received a seven and a half year sentence for murdering someone. So why are some of our hardened criminals just allowed to walk after committing such a heinous act? Let's ask Ari Goldkind, a Criminal Lawyer, who can answer to this and whether or not our criminals are getting off too easily. Learn more about your ad choices. Visit megaphone.fm/adchoices
