In 1988, Benjamine Spencer, a young black man in Dallas, TX, was wrongfully convicted of the murder of Jeffrey young, a young white man, the son of a prominent Ross Perot supporter, by prosecutors trained by Henry Wade, the Wade in Roe v Wade. Washington DC journalist and author Barbara Bradley Hagerty, whose 2018 reporting led to Spencer's release has now written a book, Bringing Ben Home, (https://a.co/d/6w5uHll) and talks with Sunil Dasgupta about the case and its implications. In 1969, Norma McCorvey, a Texas woman in her early 20s, sought to terminate an unwanted pregnancy. 话说在1969年, 美国德州有一位叫Norma McCorvey的二十几岁的女性, 她意外怀孕了, 然后想要堕胎.McCorvey, who had grown up in difficult, impoverished circumstances, previously had given birth twice and given up both children for adoption. 她的经济条件很差, 之前生过两个孩子都因为无力抚养, 只能把孩子送给别人领养.At the time of McCorvey's pregnancy in 1969, abortion was legal in Texas, but only for the purpose of saving a woman's life. 当时她所住的德克萨斯州对于堕胎的法律是: 除非是危及到孕妇生命的情况, 不然堕胎一律不合法. Abortion was made legal across the US after a landmark legal ruling in 1973. In 1969, a 25-year-old single woman, Norma McCorvey using the pseudonym "Jane Roe", challenged the criminal abortion laws in Texas. The state forbade abortion as unconstitutional, except in cases where the mother's life was in danger. Defending the anti-abortion law was Henry Wade - the district attorney for Dallas County - hence Roe v Wade. Ms McCorvey was pregnant with her third child when she filed the case, and claimed that she had been raped. But the case was rejected and she was forced to give birth. In 1973 her appeal made it to the US Supreme Court, where her case was heard alongside that of a 20-year-old Georgia woman, Sandra Bensing. They argued that abortion laws in Texas and Georgia went against the US Constitution because they infringed a woman's right to privacy. By a vote of seven to two, the court justices ruled that governments lacked the power to prohibit abortions. They judged that a woman's right to terminate her pregnancy was protected by the US constitution. Possibly as early as Monday June 13, 2022, a decision will be made in reference to the Roe vs. Wade case, as to whether abortion rights will be overturned or not. The purpose of abortion in underserved communities where mainly African Americns lived, was to have facilities nearby to commit "under the radar" genocide, as per Planned Parenthood founder. If this decision is overturned it will make a mark in history and in the world. Facts of the case: In 1970, Jane Roe (a fictional name used in court documents to protect the plaintiff's identity) filed a lawsuit against Henry Wade, the district attorney of Dallas County, Texas, where she resided, challenging a Texas law making abortion illegal except by a doctor's orders to save a woman's life. In her lawsuit, Roe alleged that the state laws were unconstitutionally vague and abridged her right of personal privacy, protected by the First, Fourth, Fifth, Ninth, and Fourteenth Amendments. However, this right is balanced against the government's interests in protecting women's health and protecting “the potentiality of human life.” The Texas law challenged in this case violated this right. Justice Harry Blackmun delivered the opinion for the 7-2 majority of the Court. First, the Court considered whether the case was moot, concluding that it was not. When the subject of litigation is “capable of repetition yet evading review,” a case need not be dismissed as moot. Pregnancy is a “classic justification for a conclusion of nonmootness.” The Due Process Clause of the Fourteenth Amendment protects against state action the right to privacy, and a woman's right to choose to have an abortion falls within that right to privacy. A state law that broadly prohibits abortion without respect to the stage of pregnancy or other interests violates that right. Although the state has legitimate interests in protecting the health of pregnant women and the “potentiality of human life,” the relative weight of each of these interests varies over the course of pregnancy, and the law must account for this variability. In the first trimester of pregnancy, the state may not regulate the abortion decision; only the pregnant woman and her attending physician can make that decision. In the second trimester, the state may impose regulations on abortion that are reasonably related to maternal health. In the third trimester, once the fetus reaches the point of “viability,” a state may regulate abortions or prohibit them entirely, so long as the laws contain exceptions for cases when abortion is necessary to save the life or health of the mother. This episode lays the groundwork for understanding Roe v. Wade, the famous 1973 Supreme Court decision that effectively legalized abortion nationwide for the first time.   First, we set the stage - the legal stage that is. We begin with an explanation of Jane Roe's initial lawsuit filed in the federal district court in Dallas, Texas against Henry Wade, the district attorney in Dallas County, where she argued that the 1854 Texas law criminalizing abortion, except in cases to save the life of the mother, was unconstitutional.   Jane won half the case, so she appealed to the U.S. Supreme Court.  Wade appealed to. We then move onto the appeal and explain the arguments put forth by both sides and unpack the decision of the court which didn't give either side everything they wanted, but some of what they wanted. The decision itself, and its reasoning, has been a source of much controversy in legal and political circles alike given the unique trimester framework it laid out for balancing the interests of the pregnant woman, fetus, and the state. Finally, we recap with a TL;DR and set up the next episode where we'll dissect the second most famous abortion case in America:  Planned Parenthood v. Roe v Wade was a 1971, 1973 landmark decision by the US Supreme Court. It ruled that a state law that banned abortion was unconstitutional. The 7 to 2 decision had Chief Justice Warren E Burger and six other Justices vote for "Jane Roe" and Justices William Rehnquist and Byron White vote against it. The decision divided the United States and is still controversial. People became divided into pro-life and pro-choice groups. Pro-life supporters argue that the unborn baby has the same right to life as other people, and the government should intervene to protect it. Pro-choice supporters believe that the unborn baby is not the same as a person, and the woman has the right to choose what she wants to do with her body and that the government should not intervene. Roe was limited by a later decision, Webster v Reproductive Health Services (1989), which allowed the regulation of abortion in some cases. Several states have considered laws banning abortions altogether. In May 2022, a leaked draft of the Supreme Court's decision to overrule Roe v Wade was published. Background. The case began in 1970 in Texas as a challenge against a law banning any kind of abortion unless the mother's life was in danger. A pregnant Texas woman, Norma McCorvey (alias Jane Roe), brought a lawsuit against Henry Wade, Dallas County District Attorney, in a Texas federal court. Claiming to be a single woman and pregnant, McCorvey wanted to terminate her pregnancy. She wanted it to be done safely by a doctor but said that she could not afford to travel outside Texas. She could not get a legal abortion in Texas because her life was not in danger. Her lawsuit claimed that the Texas law violated her right to privacy, protected by the First, Fourth, Fifth, Ninth, and Fourteenth Amendments. Roe added she sued "on behalf of herself and all other women" in the same situation. The case slowly made its way to the US Supreme Court. Meanwhile, McCorvey had her baby and placed it for adoption. Majority opinion. In a 7 to 2 decision, the court held that a woman's right to an abortion was protected by her right to privacy under the Fourteenth Amendment. The decision allowed a woman to decide whether or not to have an abortion during the first trimester. That affected the laws of 46 states. Justice Harry Blackmun wrote the majority opinion. "We... acknowledge our awareness of the sensitive and emotional nature of the abortion controversy, of the vigorous opposing views, even among physicians, and of the deep and seemingly absolute convictions that the subject inspires." — Justice Blackmun (1973).

Tonight's episode Roe VS Wade, the onion cast give you their perspective of what is going on with women losing their rights to their own body! Roe v. Wade was a landmark decision of the U.S. Supreme Court in which the Court ruled that the Constitution of the United States protects a pregnant woman's liberty to choose to have an abortion without excessive government restriction (meaning the government couldn't get involved) . The decision struck down many U.S. federal and state abortion laws. Roe fueled an ongoing abortion debate in the United States about whether or to what extent abortion should be legal, who should decide the legality of abortion, and what the role of moral and religious views in the political sphere should be. It also shaped debate concerning which methods the Supreme Court should use in constitutional adjudication (or formal judgement) . The decision involved the case of Norma McCorvey—known by the legal pseudonym "Jane Roe"—who in 1969 became pregnant with her third child. McCorvey wanted an abortion but lived in Texas, where abortion was illegal except when necessary to save the mother's life. Her attorneys, Sarah Weddington and Linda Coffee, filed a lawsuit on her behalf in U.S. federal court against her local district attorney, Henry Wade, alleging that Texas's abortion laws were unconstitutional. A three-judge panel of the U.S. District Court for the Northern District of Texas heard the case and ruled in her favor. Texas then appealed directly to the U.S. Supreme Court. In January 1973, the Supreme Court issued a 7–2 decision in McCorvey's favor ruling that the Due Process Clause of the Fourteenth Amendment to the United States Constitution provides a "right to privacy" that protects a pregnant woman's right to choose whether to have an abortion. It also ruled that this right is not absolute and must be balanced against governments' interests in protecting women's health and prenatal life. The Court resolved this balancing test by tying state regulation of abortion to the three trimesters of pregnancy: during the first trimester, governments could not prohibit abortions at all; during the second trimester, governments could require reasonable health regulations; during the third trimester, abortions could be prohibited entirely so long as the laws contained exceptions for cases when they were necessary to save the life or health of the mother.[5 The Court classified the right to choose to have an abortion as "fundamental", which required courts to evaluate challenged abortion laws under the "strict scrutiny" standard, the highest level of judicial review in the United States. The killing of Lee Harvey Oswald and the subsequent trial were the genesis of the Kennedy conspiracy theory complex and, despite no good evidence, polls show that the majority of people still believe there was a conspiracy at play here. There's something uniquely American about conspiracies, and in our current moment, they're more prevalent than ever. KENNEDY'S AVENGER focuses on the trial for what is still today the most witnessed crime in the history of the world. It called into question how a fair trial could be granted when the jury were witnesses. The trial itself was a veritable circus - book deals were in place for the major players before it began (including for the judge); media hounded the subpoenaed witness, which were a colorful cast of strippers, boxers, police officers and a never-ending line of doctors and psychiatrists; the city of Dallas itself was on trial. This was the trial that set the standard for every media-heavy trial to follow. Abrams uses the actual trial transcript to show how the proceedings ignited the conspiracy theories, details Ruby's desperate testimony to the Warren Commission, and outlines why Jack Ruby died an innocent man. Despite having more eyewitnesses than any other crime in history - to this day - few would remember the bizarre trial that followed three months later in Dallas, Texas. In 1969, a young Texas woman sought a legal abortion. But when she was unable to obtain one, she turned to two young lawyers for help. Those lawyers took Norma NcCorve's case to court, and eventually to the United States Supreme Court. Along the way, Norma NcCorvey became known in the court papers as "Jane Roe." Henry Wade was the local prosecutor she was suing, so the case became known as Roe v Wade. And on January 22, 1973, the Supreme Court ruled in her favor, effectively legalizing abortion across the U.S. I met Norma McCorvey in 1994, when she wrote a book clled "I Am Roe."
