In this episode we meet Rhanee Rego, the young Novocastrian who became interested in the case of Australia's "worst serial child killer", Kathleen Folbigg, when studying law. Six years later, Rego was instrumental in securing the release of Folbigg, who'd been jailed in 2003 for killing her four infant children. With Folbigg's convictions now quashed, Rego is working to secure what's expected to be one of the biggest compensation payouts in Australian legal history. Got a question for the trio? https://forms.zohopublic.com/propertyplanningaustralia/form/GotaquestionforthePropertyTrio/formperma/zYCQAxzE_24CVlDafP1ozyzwtmB-8m1iCNtCTgDvHXMThe February 2024 data is out, and the Trio circle the headline; the ridiculously tight vacancy rates nationally. Mike compares houses and unit performance and ponders the drivers for unit purchasers. Dave delves into Perth's outperformance and notes the predictions he and Pete made eighteen months' prior. Is buyer confidence up? Cate sheds light on her own experience at the coalface. But how does data lag impact the figures, and will Cate's prediction match the March data? Only time will tell... What is happening with the regions? For the quarter, combined regions have outperformed the combined cities, but why? The Trio unpack this.Mike dares to broach the question... "Where is Melbourne at?" The Novocastrian dares to challenge the proud Melburnians with this question, but they rise to the challenge and shed light on what is going on in their home city with investors. And have the regions suffered to the detriment of Melbourne's recovery? Not at all, but Cate explains the dynamics post-COVID. Cate also shares the value-proposition of houses in nearby regions versus apartments in Melbourne's inner-east. Vacancy rates are so tough on tenants right now and the Trio note that vacancies have tightened even further. From changed planning laws to talk of investor incentives, the jungle drums are beating. But sadly the Trio concur that conditions will continue to deteriorate until governments make a different kind of change. Listing activity is higher, yet sales volumes reflect that buyer demand is meeting supply and this coming weekend is set to be a stand-out weekend for auction numbers. But what will post Easter, and early winter look like?"We only need to talk about rate decreases and people go crazy" Rental values have re-accelerated in 2024. Feb recorded the highest rental reading for the last eleven months. Will rent growth outpace capital growth? The Trio weigh in... and they don't all agree. The three year bonds curve shows that the money markets are predicting three rate reductions as an average cash rate. And... time for our gold nuggets... Cate Bakos's gold nugget: For any prospective tenants out there, you have to be prepared to differentiate yourself in this tight vacancy rate environment.Dave Johnston's gold nugget: This month suggests that so many data points are pointing towards a property price rebound this year, so if you are considering buying property, it's time to get your ducks in a row. Narrow in on your strategy, arrange your pre-approval and be clear on the plan. Shownotes: https://www.propertytrio.com.au/2024/03/18/ep-249-february-market-update/

They chat all things quantity surveying, but drill into the Novocastrian man behind the microphone... from his dangerous hobbies, to what it was that led him to his career as a 'construction economist'. Mike's candid demeanour brings something special to the trio, and this particular recording sheds light on Mike's zest for trends, data and the identification of property market drivers. Cate delves into the various facets of quantity surveying that requires Mike's skillsets. This ranges from depreciation schedules, replacement cost estimates for insurance purposes, strata management schedules, among other activity. We are thrilled to welcome Mike to the show and we look forward to scheduling some great episodes derived from his MCG Quantity Surveying 1,000 Assets Reports. Mike shares some intriguing snippets of data about lost depreciation benefits and the figure is staggering... .tune in to hear the details!Gold Nuggets: The Quantity Surveyor, Mike Mortlock: Journalistic bias is something that buyers should keep in perspective. Cognitive bias creeps into our thinking often, and it's important we recognise this when making property decisions. The Property Planner, David Johnston: Dave suggests that investors who haven't actioned their depreciation schedules need to get in touch with a good Quantity Surveyor to claim their deductions. With the Landing Pad space for entrepeneurs here in Newcastle it's something very practical we can do to try and help de risk, by having a partnership like the landing pad with the University of Newcastle and the amazing facilities that it brings just to make it that little bit easier for somebody thinking of relocating to a regional city to take advantage of the better quality of life that a city like Newcastle is able to bring. I can speak from personal experience as someone who has moved from Sydney to Newcastle 12 years ago that, you know, one of the reasons why we wanted to relocate was housing affordability, we love the beach, and we wanted to be close to the beach. But if we wanted to stay in Sydney, we just seem to get further and further away from it. And the commute time. So I would take public transport, and it would be one hour each way from where I lived in suburban Sydney to Alexandria. And I was like is this what my life is going to be like, especially with young children but i had luckily married a Novocastrian. And it was a somewhat easier transition to a leap of faith to move to Newcastle because I was sort of familiar with the layout, when you Newcastle initiative was up and running at that point, which supported creative entrepreneurs to access space for them to be able to operate from and that really interested me, but otherwise, I had no networks up here. And my background was marketing. And, you know, while the COVID and hybrid work opportunities or being able to work 100% remotely, has really opened up the doors, I think, to people to consider moving to regional locations like Newcastle. And that's been demonstrated by those figures that Declan just outlined, yes, working from home is fantastic. We all like being able to be in our pajamas while we take zoom calls or put a load of washing on during during lunch break. But ultimately, at the end of the day, were connected humans that need to be able to be in person with each other. And that's what the landing pad ultimately ultimately is able to provide is that face to face interactive connection into humans and people that are going through the same journey you are, particularly if you're starting a new business.

Jessica Eckford-Aguilera has always had a special connection to Newcastle. A born and raised Novocastrian, Jess is shaking things up by using her decades of passion and experience to give the Hunter a market like no other. Jess jump started her career in Events Management at the age of 18 and opened her first company in 2003 in Sydney. She made a huge splash, curating celebrated events such as Australian Bridal Fashion Week and Newcastle Fashion Weekend and working alongside brands such as McDonalds and Pfizer. After completing the third ABFW in 2016, Jess found her passions pulling her back to Newcastle to create her biggest project yet: The Newcastle Food & Flower Markets. From the beginning, Jess's passion was to support as many Australian Flower Growers as possible and to give Newcastle a must-see destination for floral designers, locals and tourists to appreciate the best our city has to offer. The response has been overwhelming, with many delighting in the added convenience of having our first- class products on offer. But going forward, Jess has her sights set on even bigger goals for the Australian Flower Industry. With COVID she saw a real gap in the market to create an online platform that connects Australian Flower Growers to the right buyers. The Flower Farm Collective was born late 2020 with the official launch hitting 2021. The Collective is about reconnecting our industry and supporting an exciting new generation of passionate flower growers. It's a platform that showcases our incredible Floral Designers as they deserve. The industry was hit hard over COVID. We aim to bring it back bigger and better! The collective aims to be the voice for the Australian Flower Industry. There is an exciting movement of young up and coming growers who share a passion for growing Jess says, they are more tech savvy and welcome new initiatives that will enhance their businesses and brand. There is so much planned for The Flower Farm Collective and we couldn't be happier supporting the Australian Flower Industry.

During winter in Newcastle you would be hard pressed to walk down the street without seeing a Mark Hughes Foundation beanie on a Novocastrian head. The unofficial uniform is a product of the foundation and its founder who played rugby league for Newcastle, NSW and in the English Super League. In 2013 Mark Hughes had an operation to remove an avocado sized tumour from his brain and went through rounds of treatment to try and beat a condition which arrived with few warning signs. It was great to have a yarn with Mark, who is striving to make sure those hit with brain cancer have an increasingly good chance of beating this terrible disease.

As you know, we three are Novocastrian optometrists. We operated a business through a unit trust. We were the directors of the trustee. Entities associated with, or controlled by, us were the unit holders. One of us became worried about the behaviour of the other two. The concerned one appointed a new trustee, a Co controlled by him and his wife. Eventually, over resistance from the other two (and the trust’s accountant whose conduct was “egregious”: [58]), the new trustee took control. Litigation followed. The Court considered (i) whether the appointment was valid and (ii) whether a receiver should be appointed to the trust: [17]. The appointment was in writing ([41]) and in good faith: [61]. There is no rule preventing our appointor appointing a company he controlled: [65]. The appointment was valid: [68]. The Court refused to appoint a receiver noting it has no power to “wind up” of a trust on the basis proposed: [75]. Though there are powers to order the existing trustee to do certain things: [77]. The wisdom of 20/20 hindsight!

We've spoken a lot on this podcast about the importance of our First Peoples in our national identity but this the first time I've managed to line up a yarn with an Indigenous Australian! From the Cambridge Hotel to the Corner Hotel, Leroy Macqueen and Kat Friend - better known as The Gooch Palms - have laid waste to stage after stage with their stupidly-simple and seriously sensational take on garage rock.
