The CFPB and FTC have targeted the use of “dark patterns” on websites to influence consumer behavior. We first discuss what regulators consider to be dark patterns and why they are a focus of regulatory concern and look at examples. We then discuss the empirical issues and behavioral theories a company should expect regulators to raise if it is the target of a dark patterns investigation or enforcement action, what proactive steps a company can take to reduce the risk of a dark patterns challenge and the role of A/B testing, the practices most likely to be the focus of future dark pattern challenges by regulators, and principles to consider when designing online interactions with consumers so as to avoid potential dark patterns. Alan Kaplinsky, Senior Counsel in Ballard Spahr's Consumer Financial Services Group, leads the conversation.

An 'in conversation' event featuring Visiting Research Fellow Dr Susan Manly (University of St Andrews) in conversation with Prof Aileen Douglas (Professor of English, TCD) and organized by Trinity Long Room Hub. Susan Manly is a Reader in English at the University of St Andrews in Scotland. Her research interests are in Romantic-period Irish and English literature. She is an expert on the work of Maria Edgeworth (1768-1849), the best-selling Irish contemporary of Jane Austen, and has produced scholarly editions of a wide range of Edgeworth's writings. She is currently completing a political biography of Edgeworth. This will be the first account of Edgeworth's life to appear in the last 45 years. It will provide a new assessment of Edgeworth's intellectual and political life, looking at her milieux, correspondences, allegiances, interventions, and influence. Edgeworth's sustained engagements with debates about Ireland, about slavery and about women will form a major part of the story told in this biography. In 2019, Susan made a radio documentary about Edgeworth, ‘A Radical Life' which aired on RTÉ Lyric FM in May 2019 and re-aired in May 2020. You can hear it here. As part of Susan's research for her new political biography of Maria Edgeworth, she has been looking at Edgeworth's attitude towards West Indian and especially Jamaican slavery in the early nineteenth century. Edgeworth's fictions and plays often figured emancipated African and Creole characters: for instance, her celebrated novel, Belinda (1801) – originally entitled Abroad and At Home – features two such characters. The extent and nature of Edgeworth's personal knowledge of and implication with the West Indies, however, has never been fully established before. Educated in Ireland and America, Aileen Douglas holds a PhD from Princeton University. She began her academic career in the States, teaching at Washington University in St. Louis for five years before returning to Trinity to take up a position in the School of English. Her research interests focus on the writing of the long eighteenth century. In her monographs, 'Work in Hand: Print, Script, and Writing, 1690-1820' (OUP 2017) and 'Uneasy Sensations: Smollett and the Body' (Chicago 1996) she explores aspects of embodiment, materiality, and literary representation. She also has a particular interest in Irish writing and writing by women. Aileen Douglas is a General Editor of the IRC-supported Early Irish Fiction 1690-1820 series (Four Courts, 2011-) and has co-edited two volumes for the series. Her co-edition of Oliver Goldsmith's The Vicar of Wakefield for the Cambridge Collected Works of Goldsmith is forthcoming from Cambridge University Press in 2024.

The Absentee by Maria Edgeworth audiobook. Published in 1812, “The Absentee” by Maria Edgeworth examines social injustice in 19th-century Britain. At that time, the management of many Irish estates suffered from the absenteeism of their Anglo-Irish landlords. We meet Lord and Lady Clonbrony. Lord Clonbrony struggles with debt, while Lady Clonbrony tries to shed her Irish connections and earn status in London's high society (known as “the ton.”) Meanwhile, their son, Lord Colambre, is wary of the entanglements of that society and escapes to the family estate in Ireland, where he discovers the abuses that have arisen in the family's absence. Maria Edgeworth was a pioneer of realism in fiction, and one of the most successful and popular novelists of her time. She offered satirical portraits of society manners and sympathetic treatment of regional life. Her work won admiration from authors such as Jane Austen and Sir Walter Scott. “The Absentee” is named in the reference list “1001 Books You Must Read Before You Die.”
Ormond by Maria Edgeworth audiobook. Maria Edgeworth was one of the most popular writers of her time, a sharp and witty observer of society manners, and a favorite author for Jane Austen. “Ormond,” published in 1817, is a “coming-of-age” novel, tracing a young man's development as he approaches the age of majority. When we meet him, Harry Ormond has his “heart in the right place,” but is unsettled of character, naïve and impulsive. The central issue is: “What kind of man will he become?” In part, Harry is influenced by the books he reads: Fielding's “Tom Jones,” Richardson's “Sir Charles Grandison,” and works of the French Enlightenment. More important, however, are influences from the company he keeps, much as Prince Hal in Shakespeare's “Henry IV” takes shape as a reflection of the people around him. As an orphan, Harry had been adopted by Sir Ulick O'Shane, a man of society, full of subtlety and strategies, who exploits his public trust for private advantage (a practice known at that time as “jobbing”). Harry also spends time with Sir Ulick's cousin Cornelius, a Falstaffian figure of hearty good cheer and eccentric rural lifestyle. (He enthrones himself on a tiny island in an Irish lake, calls himself the “King of the Black Islands” and nicknames Ormond “Prince Harry.”) Later, Harry follows Cornelius's daughter to Paris, where he witnesses the glamorous dissipation of French society in the years before the Revolution. This novel explores the challenges of bringing together apparent oppositions: reconciling promised loyalty with assertion of self, Anglo-Irish landlords with their Irish tenants, Catholics with Protestants, and the impulsive heart with the rational head. “Ormond” is named in the reference list “1001 Books You Must Read Before You Die.”

The Diad and Bedroth cross the ocean to the Land of the Rising Sun with their first international film, and they're not alone! Jason Arriola of Games and Junk joins the guys to analyze Ace Attorney, a Japanese film adaptation of Gyakuten Saiban Yomigaeru Gyakuten, known in the United States as Phoenix Wright: Ace Attorney . Directed by Takashi Miike from a screenplay by Takeharu Sakurai and Sachiko Oguchi, Ace Attorney (Gyakuten Saiban in Japan) stars Hiroki Narimaya as Phoneix Wright, Mirei Kiratani as Maya Fey, and Takumi Saitoh as Miles Edgeworth, as Phoenix, an up-and-coming defense attorney, faces a series of opponents (including Edgeworth himself) while also dealing with the death of his friend and colleague, Mia Fey (played by Rei Dan). Mia's sister, Maya, who is initially charged with the Mia's murder before being acquitted thanks to Phoenix's defense, begins assisting Phoenix when he takes his next case. In a turn(about) of events, Phoenix's opponent in Maya's murder trial, the famed (and feared) prosecutor Miles Edgeworth, is also charged with murder! And this case has ramifications that go all the way back to the mysterious death of Miles's father, Gregory (Takehiro Hira) and the downfall of Maya's family name after her mother, the medium Misty Fey (Kimiko Yo) provides mystical (and mistaken) evidence for the mysterious DL-6 case. What's more, to prove Miles innocent, Phoenix must win a case against Miles's one-time mentor, Manfred von Karma (Ryo Ishibashi), who hasn't lost a single case in his 40-year career! Confused? Intrigued? So are we! Will Phoenix emerge victorious and prove that Miles is innocent? Is Miles innocent to begin with? Hello friends and welcome back to the Spiritual Misfits podcast,This episode is the second half of one extended conversation I had with Andrew Dodd and Scott Higgins. If you haven't listened to the previous episode where Scott and Andrew shared their own journeys towards inclusive theology and the story of Hamilton Baptist Church, I strongly recommend you do so. In case you don't or if you need a recap, here's an outline of the story so far: Scott Higgins wrote a paper back in the 90s giving an overview of different Christian perspectives on sexuality. In many ways this was the beginning for him of coming to see theological diversity in this area. A few years down the track and he's asked to read a statement to his church affirming that Baptists hold to a traditional view of marriage. Scott couldn't bring himself to read it, but instead asked the church who would be interested in taking a few weeks to explore some diverse understandings of sexuality, marriage and Christian ethics. Every hand went up. As the church began to have these conversations a number of queer people were drawn to come along — and ended up staying in the church. The combination of fresh theological framing alongside real and loved members of their community played a key role in what was then Edgeworth Baptist becoming LGBTQI affirming. While this was happening there was also a conversation beginning with Hamilton Baptist Church where Andrew Dodd was the pastor. This conversation was about the two churches merging. This made sense for a lot of reasons, though Edgeworth had one non-negotiable. If the churches were going to merge, LGBTQI+ people needed to be fully included and embraced in the life of the new church. So the two churches went on a process together over around 12 months, testing the waters of their relationship so to speak, before officially deciding to proceed with the merge. At this point the vast majority of people were onboard. This doesn't mean it was without cost or difficulty and some people left, though this was generally done in a gracious way. At the end of the last episode Andrew shared the story of their first service together as a new church, and the powerful moment when communion was served by a queer member of the congregation. What was powerful wasn't so much this person sharing out communion. It was the fact that it didn't matter that this person was sharing out communion. Because they were welcome as much as anyone else. So, in this next part of the conversation I talked to Andrew and Scott about what they learned from this journey that might inform other churches. There's another element of this story that's important. The change Andrew and Scott have led at Hamilton — is not one that everyone is ready for. And in Andrew's words Hamilton is now in a somewhat precarious position within the NSW Baptist denomination. So we talk a little about change, disagreement and how some of this sits within a larger system. This aspect of the conversation is not theoretical to Scott, Andrew and even myself. It is playing out in real-time. And in part, this is why I recorded this conversation. Maybe you're part of this tribe called Baptist. Or maybe you've left it behind. Maybe you're part of a different denomination, or organisation. Whatever the case, I believe listening to Scott and Andrew share there thoughts around this may be an important step in helping you to see things through a fresh lens. Here's the rest of our conversation.
The world is unfair — but how much of that unfairness is inevitable, and how much is just contingency? After centuries of efforts to arrive at formal theories of history, society, and economics, most of us still believe and act on what amounts to myth. Our predecessors can't be faulted for their lack of data, but in 2022 we have superior resources we're only starting to appreciate and use. In honor of the Santa Fe Institute's new role as the hub of an international research network exploring Emergent Political Economies, we dedicate this new sub-series of Complexity Podcast to conversations on money, power, governance, and justice. Subscribe for a new stream of dialogues and trialogues between SFI's own diverse scholastic community and other acclaimed political economists, historians, and authors of speculative fiction.Welcome to COMPLEXITY, the official podcast of the Santa Fe Institute. I'm your host, Michael Garfield, and every other week we'll bring you with us for far-ranging conversations with our worldwide network of rigorous researchers developing new frameworks to explain the deepest mysteries of the universe. In this episode, we talk with SFI President David Krakauer about the goals of this research theme and what SFI brings to the table. We discuss the legacy of long-standing challenges to quantitative history and mathematical economics, how SFI thinks differently about these topics, and a brief outline of the major angles we'll explore in this sub-series over the next year-plus — including the roles of dimension, causality, algorithms, scaling, innovation, emergence, and more.Subscribe to Complexity Podcast for upcoming episodes with an acclaimed line-up of scholars including Diane Coyle, Eric Beinhocker, Ricardo Hausmann, Doyne Farmer, Steven Teles, Rajiv Sethi, Jenna Bednar, Tom Ginsburg, Niall Ferguson, Neal Stephenson, Paul Smaldino, C. In 1784, British men went to the polls. It was a pivotal contest in the aftermath of the American Revolution, following a slew of prime ministers who had tried and failed to form governments that satisfied the British electorate, and King George III. British women played a critical role in this election, even though they could not vote. They canvased for votes according to very specific social customs, and accessorized their clothing and bodies to signal support for their respective candidates. They wore muffs, passed out cockades and ribbons, and plied the electorate with beer. And when women slipped outside the bounds of those gendered customs, as the Duchess of Devonshire was alleged to have done, women were accused of electioneering rage. On today's episode, Dr. Kelly Fleming joins Jim Ambuske to discuss how electioneering rage shaped eighteenth-century British literature. Fleming is a literary scholar and historian who is the Monticello College Foundation and Andrew W. Mellon Foundation Fellow at the Newberry Library in Chicago. She is currently completing a book entitled, Ornaments of Influence: Fashion Accessories and the Work of Politics in Eighteenth-Century British Literature. It's a study that explores the tension and anxiety in British literature about women's participation in British politics during the long eighteenth century. Fleming looks at a wide array of fashion accessories like muffs, cockades, and even ostrich feathers, which were procured through the trans-Saharan slave trade and served as a symbol of royal authority. Ambuske and Fleming begin their conversation by learning how literary scholars unpack novels and read them for evidence. They also look at what it means to do a close reading of a novel like Henry Fielding's 1749 book, Tom Jones, before diving into Anglo-Irish author Maria Edgeworth's 1801 novel, Belinda, a work inspired in part by Edgeworth's disdain for women who failed to follow social norms. About Our Guest: Kelly Fleming is a scholar of eighteenth-century British literature and culture. She recently earned her Ph.D. in English from the University of Virginia. Her research explores relationships between gender, material culture, politics, law, and empire in British literature from the long eighteenth century. Her work has appeared in Eighteenth-Century Fiction and The Burney Journal. She is working on her book project tentatively titled, Ornaments of Influence: Fashion Accessories and the Work of Politics in Eighteenth-Century British Literature. About our Host: Jim Ambuske, Ph.D. leads the Center for Digital History at the Washington Library. A historian of the American Revolution, Scotland, and the British Atlantic World, Ambuske graduated from the University of Virginia in 2016. He is a former Farmer Postdoctoral Fellow in Digital Humanities at the University of Virginia Law Library. At UVA Law, Ambuske co-directed the 1828 Catalogue Project and the Scottish Court of Session Project. He is currently at work on a book about emigration from Scotland in the era of the American Revolution as well as a chapter on Scottish loyalism during the American Revolution for a volume to be published by the University of Edinburgh Press.
The issue of slavery is a constant in Maria Edgeworth's thinking about questions of government, from the beginning of her writing career until the 1820s and 30s. In this paper, Susan Manly discusses the multiple elements to this seam of thinking, and in particular examines the importance of the reformist thinker Jeremy Bentham and his French interlocutor Étienne Dumont.
